Comparison of artificial intelligence and health data usage in healthcare public services between France and Sweden

With the meteoric rise of artificial intelligence over the last decade, it is playing an increasingly important role in our societies. This technology can play a decisive role in the development of many sectors. However, it is also necessary to have a large volume of quality data available in order to obtain high-performance models. In the healthcare sector, useful, high-quality data is often subject to fairly high security and confidentiality standards, as it is personal data that is subject to legislation (such as the GDPR at European level). At national level, each country has its own strategy, approach and objectives for integrating artificial intelligence into public services. Here, we will be looking at two European Union countries, Sweden and France. Sweden is characterised by openness and transparency. In France, on the other hand, privacy is a very important concept. Comparing their approach to the subject can therefore yield some interesting results. To carry out this comparison, a state of the art was carried out. This state of the art was based on the reading of various documents, and was accompanied by conducting five interviews with players active within this system. The analysis showed that despite different healthcare organisational structures and approaches, Sweden and France are at similar stages and have similar safety standards. However, the major difference lies in the structure of the healthcare system, which results in different advances for the two countries, with, for example, the Swedish regions working independently and interpreting the legal grey areas individually. In reality, the legal framework remains a limiting factor for the development of this sector for both nations, despite the desire of all parties to maintain an ethical approach. Finally, the future political choices concerning artificial intelligence and its legal environment will be societal choices that correspond to the cultural values of each country. However, the AI Act (a draft European law) should harmonise the legal aspects, based on an approach to technology based on the risks it could pose to individuals. / Den artificiella intelligensen har under det senaste decenniet fått ett enormt uppsving och spelar en allt viktigare roll i våra samhällen. Denna teknik kan spela en avgörande roll för utvecklingen av många sektorer. Men för att få fram högpresterande modeller krävs det också att man har tillgång till en stor mängd kvalitetsdata. Inom hälso- och sjukvårdssektorn är användbara, högkvalitativa data ofta föremål för ganska höga säkerhets- och sekretessstandarder, eftersom det är personuppgifter som omfattas av lagstiftning (till exempel GDPR på europeisk nivå). På nationell nivå har varje land sin egen strategi, sitt eget tillvägagångssätt och sina egna mål för att integrera artificiell intelligens i offentliga tjänster. Här kommer vi att titta på två EU-länder, Sverige och Frankrike. Sverige kännetecknas av öppenhet och transparens. I Frankrike, å andra sidan, är integritet ett mycket viktigt begrepp. Att jämföra deras förhållningssätt till ämnet kan därför ge intressanta resultat. För att kunna göra denna jämförelse har en state of the art genomförts. Denna state of the art baserades på läsning av olika dokument och kompletterades med fem intervjuer med aktörer som är aktiva inom detta system. Analysen visade att Sverige och Frankrike, trots olika organisationsstrukturer och tillvägagångssätt inom sjukvården, befinner sig i liknande skeden och har liknande säkerhetsstandarder. Den stora skillnaden ligger dock i hälso- och sjukvårdssystemets struktur, vilket resulterar i olika framsteg för de två länderna, där till exempel de svenska regionerna arbetar självständigt och tolkar de juridiska gråzonerna individuellt. I själva verket är den rättsliga ramen fortfarande en begränsande faktor för utvecklingen av denna sektor i båda länderna, trots alla parters önskan att upprätthålla ett etiskt förhållningssätt. Slutligen kommer de framtida politiska valen om artificiell intelligens och dess rättsliga miljö att vara samhälleliga val som motsvarar de kulturella värderingarna i varje land. AI-lagen (ett förslag till europeisk lag) bör dock harmonisera de rättsliga aspekterna, baserat på en inställning till teknik som bygger på de risker den kan innebära för individer.

Daar word na die funksies van die Departement van Binnelandse Sake verwys ten einde bepaalde werksaamhede van daardie Departement as voorbeeld te laat dien in die beantwoording van bogestelde vraag. Ter aanvang word voor-unie regeringinstellings en -openbare dienste, die ontstaan van Suid-Afrikaanse staatsdepartemente en die doelgerigtheid van open bare dienste beskryf. Daarna word die wyses waarop beheer oor die werksaamhede van 'n staatsdepartement asook hoe beheer in 'n departement uitgeoefen word, uiteengesit. Nadat die doeltreffendheid en effektiwiteit van bestaande beheer ontleed, en die beheer wat die Hooggeregshof uitoefen van die van ander beheerinstellings onderskei word, word geregtelike beheer en statutere beperkings daarop beskryf. Die studie strek oor 'n tydperk wat eindig op 27 April 1994. Daar is bevind dat geregtelike beheer afsonderlik of tesame met ander wyses van beheer, en sander statutere beperkings daarop, uitgeoefen behoort te word. / The study was undertaken to determine the desirability of judicial control which the Supreme Court of South Africa exercises over the activities of state departments. The functions of the Department of Home Affairs are referred to in order that particular activities of that Department may serve as an example when answering the above-stated question. Initially, government institutions and public services prior to union, the origin of South African state departments and the purpose of public services are described. Thereafter the modes by which control is exercised over the activities of a state department and how control is exercised in a department, are set out. After an analysis of the efficiency and effectiveness of existing control, and the control exercised by the Supreme Court is distinguished from that of other controlling institutions, judicial control and statutory limitations thereon are described. The study covers a period ending on 27 April 1994. "I thought libraries were about books" : Mål och funktioner inom kreativa rum på australiska bibliotek

Creative spaces, or makerspaces, is an emerging and global phenomenon in libraries. The aim of this study is to examine the objectives that underlie the creative spaces in Australia, expressed by library professionals, as well as the purposes they fulfil in the library context. The material is derived from seven in-depth interviews with staff working with creative spaces at three public and one state library. Additionally, one observation was conducted in the creative space at each of these libraries. “The four spaces model”, created by Danish researchers Henrik Jochumsen, Casper Hvenegaard Rasmussen and Dorte Skot-Hansen, comprises the study's theoretical framework. According to the model, the library's objective is to support the goals: experience, involvement, empowerment and innovation. The library spaces, in which the goals should be supported, are the inspiration space, the learning space, the meeting space and the performative space. The study shows that the most distinct objectives of the creative spaces are experience and empowerment. Involvement and innovation are also present, but not as prominent. Further, the study shows that the purposes fulfilled by the creative spaces places them within the learning space and the meeting space, and to some degree in the inspiration space and the performative space. Findings reveal that creative spaces support STEM-based (science, technology, engineering and maths) learning and digital literacy through both collaborative and individual learning. The learning takes place in informal settings where play is a significant factor. The creative spaces function as “high-intensive” meeting places for the local community, and the library professionals highlight the importance of the social aspects of the creative spaces. The aim of this master’s thesis is to examine how Swedish public libraries approach and regard lesbian pulp fiction as a genre, from both a historical and modern perspective, and also to visualize and critique the surrounding discourses that influence the perception and reception of the genre. The method is twofold and consists of qualitative interviews as well as discourse analysis inspired by Foucault. The data consists of interviews with three librarians responsible for library collections, selection and purchase of new library materials which is combined with a survey reading of Biblioteksbladet, the periodical of Svensk Biblioteksförening, from 1945–1990. Michel Foucaults theories on discourses and the principles and mechanisms of exclusion, and Pierre Bourdieus theories on taste and distinction, guide the analysis. The analysis focuses to a great extent on discursive patterns, especially concerning the relationship between popular and quality fiction, and components of Bourdieus field theory and how this contributes to the creation of taste through distinction. Throughout the analysis possible explanations regarding the position of lesbian pulp fiction are given which covers areas from classification and interpretation of literary genres to quality assessment, selection and purchase of literature. The results of the study shows that lesbian pulp fiction is quite invisible in Swedish public libraries which is mainly seen as an effect of discursive practices that surround and influence the genre such as the societal and historical view of homosexuality but also the view on popular literature. Conclusions are that librarians are not making conscious exclusions of lesbian pulp fiction per se, they are if anything quite unaware of the genre’s existence, but that the practices that shape the field of public libraries has contributed to the genre’s position. Pop-up-bibliotek : På gränsen mellan uppsökande verksamhet och PR / Pop up library : On the border between outreach and PR

This master’s thesis in Library and Information Science examines the phenomenon ”pop up library” and how public libraries are working with projects within this area. The method to collecting data is qualitative interviews with represents from five libraries in Sweden. The theoretical framework mainly consists of theories from mar- keting management especially adapted for non-profit organizations and libraries. The main results of the study shows that the purpose of why the libraries are using this method is to attract new users, make the library more available, marketing the library, work with reading promotion, start up and/or develop cooperation’s with other organizations or units within the municipality. One desire with the pop up libraries is to attract people to also visit the physical main library but there is also a fear among the informants that some people will think that the pop up library is the only library in the community. Common factors seen in my informants view of pop-up library are: temporary, unexpected and adapted for the target audience and the environment. Pop up libraries is much about relationships, to build and develop relationships with both partners and prospective users. Pop up libraries can be seen as buzz marketing, an effective way to advertise with small means. By making them into "a hot topic" it generates a buzz and publicity in local media. The pop up libraries in this study are primarily implemented as projects, funded by external project funding. They do not require as much resources to implement but is more difficult to engage in regular activities. The opportunities that libraries see with the pop up library concept is to continue to reach out to new audiences by using new creative ways. Le vieillissement au travail chez les infirmières et le personnel soignant d’expérience auprès de personnes en perte d’autonomie : activités professionnelles et cadres bureaucratiques en transformation

Cette thèse cherche à comprendre comment les transformations bureaucratiques influencent l’activité professionnelle des infirmières et du personnel soignant d’expérience dans le domaine des soins aux personnes âgées en perte d’autonomie depuis les années 90 au Québec. Elle s’inscrit dans une profonde remise en question de l’État-providence, de sa régulation hiérarchique, de son rapport avec le marché privé, et particulièrement des agences privées de placement du personnel. Prenant en compte le déploiement inégal des changements imposés de façon top down et promus par des considérations économiques visant une plus grande « performance » des services publics, plus près du milieu de vie de la personne, notre démarche tient aussi compte de la dimension relationnelle propre au travail infirmier, qui s’illustre par des formes différenciées tenant compte des modèles de pratique préconisés. Notre démarche s’attarde finalement aux rapports entre l’activité professionnelle et la prise de la retraite. À travers l’exploration du nouveau rôle attendu de l’infirmière, dont les habiletés de « chef » ou de « gestion d’équipe de travail » sont sollicitées à titre d’« intervenante pivot » ou de « gestionnaire de cas », et de la place importante qu’occupe la notion de compétences relationnelles dans la prescription de nouvelles modalités des services, plus près des besoins spécifiques de la personne, les données empiriques se présentent sous la forme d’un tableau hétérogène qui montre que ce ne sont pas toutes les infirmières qui souscrivent à ce type de pratique professionnelle. Leur âge, expérience et trajectoire professionnelle, le poste occupé ou encore le milieu de pratique influenceront le rapport entre leurs activités professionnelles et le cadre bureaucratique en transformation. La base empirique de la recherche est constituée d’une collecte de données réalisée entre janvier 2003 et juillet 2006 et qui comprend 9 entrevues exploratoires, 7 entrevues semi-dirigées auprès de retraité-e-s, infirmières, infirmières auxiliaires, 17 réunions incluant majoritairement des membres de la direction d’établissements, ainsi que des syndicats, 21 observations directes avec des infirmières, infirmières auxiliaires, préposées aux bénéficiaires et auxiliaires familiales et sociales, la passation de 112 questionnaires auprès de ces différentes catégories professionnelles, et 7 entrevues semi-dirigées complémentaires, réparties dans 4 établissements différents, sur deux territoires. Quatre grands constats ressortent de notre matériel empirique. Premièrement, la dimension relationnelle au sein des activités professionnelles du personnel soignant d’expérience ainsi que sa perception en ce qui concerne les compétences et l’âge présentent des formes contrastées, voire opposées. Si certains membres du personnel soignant estiment que les interactions professionnelles se sont considérablement réduites à la suite des transformations des dernières années et que la compétence n’est pas reliée à l’âge des professionnelles, les observations directes indiquent, au contraire, un rapport étroit entre ces deux derniers éléments qui s’illustre à travers de riches relations interpersonnelles. Les données quantitatives montrent, quant à elles, qu’une écrasante majorité de répondantes estiment que les compétences associées à leurs fonctions sont reconnues par l’organisation (89,3%), probablement sous l’angle de la conformité aux descriptions de travail, et qu’elles bénéficient d’une marge d’autonomie dans leur travail (83%). Deuxièmement, des résultats s’opposent également en ce qui concerne l’influence du cadre bureaucratique sur les « capacités » ou l’« intérêt » des infirmières d’expérience à maintenir un lien à l’emploi à la date d’éligibilité à la retraite. La majorité des répondantes s’estiment « incapables » de conserver un tel lien alors qu’une minorité d’entre elles exprime un intérêt face au nouveau rôle souhaité chez l’infirmière. Quantitativement, la prise de la retraite à bas âge est toutefois marquante, surtout pour celles qui occupent une fonction et possèdent une rémunération élevée (ex. cadres). Troisièmement, des contrastes apparaissent aussi en ce qui concerne les formes que prennent les rivalités entre les infirmières d’expérience et d’autres catégories professionnelles ainsi que dans les rapports intergénérationnels. Même si les trois quarts (76,2%) des répondantes d’expérience estiment que la répartition du travail devrait être le fruit d’une discussion entre elles et les plus jeunes, et non une imposition de la direction, près de la totalité (92,6%) veulent garder leurs acquis sociaux même si elles savent que la prochaine génération de travailleuses n’aura pas les mêmes avantages. Leur rapport face aux professionnelles d’agences privées de placement est également paradoxal. Huit répondantes sur dix (78,6%) perçoivent le fait que l’établissement recourt aux agences de placement contribue à alourdir leur travail, alors qu’une partie envisage de poursuivre leur activité professionnelle après leur date d’éligibilité à la retraite, par l’intermédiaire de ces mêmes agences. Finalement, il ressort de ce portrait hétérogène que la confrontation des changements du cadre bureaucratique sur l’activité professionnelle se manifestera différemment selon la vision paradigmatique qu’aura le personnel soignant de sa pratique. Les résultats quantitatifs et qualitatifs soulignent que ce paradigme sera influencé par trois dimensions : le territoire de pratique, le type d’établissement de services et l’unité spécifique de travail. Le style de gestion (traditionnel ou intégrateur) influencera également l’impact de ces changements. L’analyse et l’interprétation de l’influence différenciée des transformations bureaucratiques sur l’activité professionnelle s’illustrent par la manifestation de rapports plus conflictuels avec les autorités administrative et professionnelle, ainsi que dans les relations interprofessionnelles. Ces conflits ont émergé lors du passage d’un cadre bureaucratique historiquement construit sur un modèle médical (cure) qui considère la personne comme un « malade chronique » et associé à un style de gestion traditionnel, voire autoritaire, surtout dans certains CHSLD, à une approche « milieu de vie » privilégiant un modèle d’accompagnement (care) favorisant des services associés aux besoins spécifiques de la personne en perte d’autonomie, à titre de « partenaire actif ». Le style de gestion intégrateur de ce dernier modèle rapproche les domaines administratif et de soins de santé, approche que nous retrouvons davantage, mais non exclusivement, dans le cadre de soins à domicile. Une des conclusions majeures de cette thèse est la possibilité d’« enrichir les qualifications de base » (Le Boterf, 2005) des professionnelles lorsque le cadre bureaucratique et le style de gestion institués tendent vers un modèle care/intégrateur, ce qui constitue une forme de « compromis social » (Oiry, 2004). La « surutilisation » des effectifs (O’Brian-Pallas et al., 2005) qui en résulte peut expliquer, en partie, l’incontournable force d’attraction vers la retraite, dès la date d’admissibilité, du personnel soignant, quitte à ce qu’il poursuive ensuite ses activités professionnelles, selon des exigences personnelles, par le biais d’agences privées de placement. Les « fissures » (Laville, 2005) de la frontière entre les services publics et ceux du marché privé ne peuvent alors que s’accentuer, surtout lorsqu’on constate que le cinquième des effectifs, soit 14, 000 infirmières de 55 ans et plus, est potentiellement admissible à la retraite dès maintenant (OIIQ, 2008a). / This thesis aims to understand how bureaucratic transformations influence professional activity of experienced nurses since the 90s in Quebec in the field of elderly care who dealing with the lost of autonomy. It falls into a deep questioning of the Welfare state, its hierarchic regulation, and its relationship with the private market, particularly the private nursing agencies. Taking into account the unequal deployment of changes implemented in a top down manner, and promoted by economic considerations for a greater “performance” of public services, closer to the living environment of the individual, our approach takes also into account the specific relational dimension of nursing work, which is illustrated by differentiated forms that reflect practice models. Our research finally focuses on the relationship between professional activity and time of retirement. While taking into account the new nursing role expectations, in which “leadership” and “management team work” abilities are in demand as a “pivot professional” or “case management”, and of the important place of the concept of relational skills in the prescription of new modalities of service, closer to the specific needs of the individual, empirical data is presented in the form of a heterogeneous picture which shows that not all nurses subscribe to this type of professional practice. Age, experience and professional career, position or the practice environment will influence the relationship between their professional activities and bureaucratic framework in transformation. The empirical basis of this research consists of a data collection conducted between January 2003 and July 2006 and includes: 9 exploratory interviews; 7 semi-structured interviews with retirees, nurses, and nursing assistants; 17 meetings attended by management and unions; 21 direct observations with nurses, nursing assistants, orderlies, and home and social aids; 112 questionnaires distributed to the aforementioned professional groups; and 7 semi-structured interviews, in 4 different organizations from two territories. Four major findings emerged from the empirical findings. First, the relational dimension in the professional activities of experienced nursing staff and their perceptions regarding skills and ages have contrasting and even opposite forms: while some believe that professional interactions have greatly reduced following the transformations of recent years and that skills are not related to the age of the professional, direct observations rather indicate a close relationship between these two elements, and which is illustrated through rich interpersonal relationship. The quantitative data shows, in turn, that an overwhelming majority of respondents believe that the skills associated with their functions are recognized by the organization (89.3%), probably in terms of compliance with the job description, and that they enjoy a degree of autonomy in their work (83%). Second, results are also opposed in regards to the influence of the bureaucratic framework under the "capacities" or "interest" of experienced nurses to maintain a link to the employment at the date of eligibility retirement: the majority of respondents consider themselves "unable" to maintain such a link while a minority express an interest in facing the new expectation. Quantitatively, taking retirement at an early age is oustanding, especially for those who hold high position and pay (ex. managers). Third, contrasts also appear regarding the forms taken by the rivalries between experienced nurses, other professional groups and in intergenerational relationships. Even if three quarters (76.2%) of respondents believe that the division of labor should be the result of a discussion between themselves and younger staff, and not an imposition of the direction, almost all (92.6%) want to keep their social benefits even if they know that the next generation of workers will not have the same benefits. Their relationship with professionals working for private nursing agencies is also paradoxical: eight in ten respondents (78.6%) perceive that using their services contributes to increase their work, while continuing professional activities at the date of eligibility for retirement is planned through these same agencies. Finally, this heterogeneous picture underlines confrontational changes in the bureaucratic framework concerning professional activity that will manifest itself differently depending on the paradigmatic vision of the nursing staff of their practice. The quantitative and qualitative results emphasize that this paradigm is influenced by three dimensions: the territory of practice, the type of service establishments and the specific unit of work. Management style (traditional or integrator) will also influence the impact of these changes. The analysis and interpretation of the differentiated influence of bureaucratic changes on professional activity are illustrated by more conflicting reports with administrative and professional authorities, as well as with inter-professional’s relationships. These conflicts have emerged during the transition from a historically bureaucratic framework built on a medical model (cure), which considers the individual as a "chronically ill", and associated with a traditional management style, even authoritarian, especially in some nursing homes, to an approach that emphasizes living environment, a model of support (care) that favors related services to the specific needs of the individual in loss of autonomy, as an "active partner". The integrator’s management style of this latter model will bring the administrative and health care closer, that we find more, but not exclusively, through home care. A major conclusion of this thesis is the ability to "enrich the basic skills" (Le Boterf, 2005) of professionals when the bureaucratic framework and management style tend to set up a care/integrator’s model, which is a form of "social compromise" (Oiry, 2004). However, the "overuse" of the workforce (O'Brien-Pallas et al., 2005) that may result can explain, partially, the inescapable pull of retirement, from the date of eligibility of nursing staff, even if they then continues then their professional activities, according to their personal requirements, through private agencies. The "cracks" (Laville, 2005) in the border between public services and private market can then only increase, especially as the fifth of the workforce, 14 000 nurses aged 55 and over, are potentially eligible to retired now (OIIQ, 2008a).

A travers l'observation des services publics de base, cette thèse s'intéresse à la réorganisation des pouvoirs politiques et techniques consécutive à la mise en place de la réforme de décentralisation. En Inde, cette question a déjà fait l'objet de plusieurs études de cas en zone rurales et dans les villes métropolitaines. L'objet de ce travail est de compléter ce corpus en le replaçant dans le contexte différencié des petites villes indiennes. Celles-ci ont jusqu'ici peu interpellé l'attention des chercheurs et des planificateurs. Ce désintérêt traduit un biais dans la manière de penser l'urbanisation indienne où la « ville » désigne avant tout des agglomérations métropolitaines, considérées comme les moteurs de la croissance économique, aux dépens du reste de l'Inde urbaine. Pourtant, une part importante de la population urbaine vit aujourd'hui dans ce type de villes et est donc tout autant concernée par les changements introduits par les nouvelles politiques urbaines issues de la décentralisation. Dans le cadre de ce travail doctoral, une enquête a été menée à travers quatre petites villes de 20000 habitants sélectionnées à l'est de l'Uttar Pradesh en interrogeant les hommes politiques, les ingénieurs et les habitants. La recherche empirique s'est appliquée à analyser la formation des gouvernements locaux avec une perspective multi-niveaux pour comprendre les transformations institutionnelles depuis la réforme. Les résultats de l'étude permettent d'obtenir une image du processus d'émergence des municipalités dans les petites villes / This Ph.D research aims to analyse the new political and technical arrangements in small towns governance, especially regarding the management of publics basic services, since decentralisation reforms in India. Various research projects have dealt with these subjects in rural areas and large metropolises but little attention has been paid to the same issues in smaller urban settlements. Yet more than half of the urban population in India lives in these towns. There has been a bias within Indian urban studies against small towns, because the idea of “urban” has always designated large urban settlements. This scientific disinterest translates into a more characteristic way of thinking about the urbanization process and resource allocation in India where big cities have been glorified as part of “Shining India”, while at the same time forgetting the rest of urban India. For this thesis, a sample survey has been conducted in a few selected towns comprising around 20,000 inhabitants in eastern Uttar Pradesh. The fieldwork has focused on urban local bodies and interviews has been conducted conducted with political leaders, government officials appointed at different levels (local, regional and state) and other actors such as engineers. Other interviews have been conducted with citizens as users to verify the information collected on effective service delivery and to understand what their relationships are with elected public servants and service providers. The results of the study gives a good view of the institutional building process consequent to decentralisation reform and the municipality emergence in small towns

Busca-se à luz de teorias sobre "relações raciais" no Brasil e no Paraná, de "políticas públicas", "ações afirmativas", analisar as experiências e estratégias formais e informais vigentes neste processo e o significado da presença de negros (pretos e pardos) nos serviços públicos do Paraná. As questões norteadoras foram: as características das relações raciais no Paraná; conjuntura social e política que possibilitou a aprovação da Lei; papel do Movimento Social Negro local na construção e aplicação da referida Lei; forma de gerir este programa nos diversos órgãos onde aconteceram concursos de 2004 a 2009; e apreensão dos beneficiados (cotistas). Consideram-se, ainda, indicadores sobre a presença de negros em diversos órgãos públicos do Paraná, assim como em empresas de economia mista do Estado. A partir de uma análise "qualitativa", os resultados revelam a possibilidade que - dada a complexidade das relações raciais no Brasil -, ações potencialmente inovadoras, como é o caso da Lei 14.274 de 2003, tenham sido orientadas por percepções e valores tradicionais, isto é, gestadas a partir da ideia, por exemplo, de "democracia racial" e da invisibilidade da população negra no Estado e pouco tenham alterado a sub-representação de negros nos diversos espaços / Abstract: The study emphasizes the Law No. 14274 - 24/12/2003 establishing a reserve of 10% quota for Afro-descendants in all procurement of Paraná State. Search in light of theories about "race relations" in Brazil and Parana, "public policy", "affirmative action" to analyze the experiences and strategies in formal and informal existing process and significance of the presence of (black and mulatto), public services do Paraná. The questions were: the characteristics of race relations in the Paraná, social and political situation that led to the approval of the law, the role of Black Social Movement in the local construction and application of this Act; way of managing this program in various organs where they occurred contests 2004 to 2009, and seizure of beneficiaries (unitholders). Os Juizados Especiais Cíveis são atualmente no Brasil a principal experiência para a efetivação do acesso à justiça, constituindo-se em uma via judiciária estatal de baixo custo e fácil acesso aos cidadãos para a solução de seus conflitos e garantia de seus direitos. Pesquisas e levantamentos sobre o desempenho desse modelo indicam que, ao invés de conflitos cotidianos, é cada vez maior a presença de demandas de consumidores contra prestadores de serviço público. A presente dissertação analisa os tipos de autores, reclamados e ações interpostas em três Juizados Especiais Cíveis localizados em regiões de diferentes perfis sócio-econômicos do Município de São Paulo com o objetivo de verificar a presença deste tipo de litígio e a hipótese se esses Juizados tornaram-se de fato um \"balcão de reclamações\" contra a prestação de serviços públicos. / Currently, in Brazil, the Small Claims Courts are the main experience of effectiveness in access to justice. They are state judiciary institutions that offer low costs and easy access to the citizens for the solution of their conflicts and guarantee of their rights. Researches and surveys on this model\'s performance indicate that there is an increasing presence of demands from consumers against private agents that render public services, instead of other daily conflicts. The present study analyzes the types of plaintiffs, defendants and judicial actions in three Small Claims Courts located in regions of different social-economic profiles in São Paulo City. The aim is to verify the presence of this type of litigation and the hypothesis whether these Courts had become in fact a \" claims counter\" against private agents that render public services.

O fornecimento de energia elétrica é uma função social do Estado outorgada às concessionárias. Preocupadas em manter padrões de qualidade e reduzir custos para atingir seu objetivo maior que é o lucro, as empresas de energia não se interessam pela extensão de seu serviço para atender populações rurais pobres. O governo do estado de São Paulo planejou uma política de eletrificação rural com o objetivo de promover a valorização social da vida no campo. Baseado em um modelo desenvolvido pelo Banco Nacional de Desenvolvimento Econômico e Social em parceria com a Universidade de São Paulo, foi proposto o programa \"Luz da Terra\", envolvendo vários novos atores e deixando para as concessionárias o papel de executar serviços de engenharia somente. Este trabalho analisa o processo de planejamento, o arranjo institucional e a prática de implantação desse programa em sua primeira fase. Os fracos resultados são atribuídos à falhas no arranjo institucional e nas ações de campo. O eixo do programa deslocou-se das comunidades e do poder local para as concessionárias. Em sua prática, o programa negou o modelo. Nesse contexto, são sugeridas medidas corretivas. / The electric energy supply is a State social matter granted to the utilities. Worried in to maintain quality patterns and to reduce costs to reach its larger objective that it is the profit, the utilities are not interested in the extension of its service to assist poor rural populations. The state of São Paulo government has planned a rural electrification politics aimed to promoving the social valuation of the life in rural areas. Based on a model developed by the Banco Nacional de Desenvolvimento Econômico e Social in partnership with the Universidade de São Paulo, the program \"Luz da Terra\" was proposed it, involving several new actors and passing to the utilities the task of executing engineering services only. This work analyses the planning process, the institutional arrangement and the practice of that program in its first phase. The weak results are attributed to mistakes in the institutional arrangement and in the country actions. The program axis moved from the communities and the local power to the utilities. In its practice, the program denied the model. In that context, this work suggests actions to correct it.
