by a theoretical-empirical approach, further revision of literature about the question problem, was verified the coherence with the reality, to conceive relevance information that reference the development of practical contributions for the intended situation. oriundas do avanço da economia digital, promovendo o desenvolvimento de novas aplicações tecnológicas e técnicas de gestão alinhadas às demandas da sociedade brasileira para a área de registros públicos. Para tanto foi focalizado o estudo dos processos do serviço de averbação de penhora de imóveis, com o objetivo de estruturá-lo para sua integração com as aplicações da Central Registral de Serviços Eletrônicos Compartilhados CRSEC. A CRSEC é uma iniciativa das entidades representativas dos registradores do Brasil que tem o objetivo de fornecer serviços com alto grau de eficiência para seus usuários, mediante a utilização de tecnologias digitais e de documento eletrônico com segurança e validade jurídica. A pesquisa foi pautada por uma abordagem teórico-empírica, na qual além da revisão de literatura sobre o assunto, procurou-se verificar a coerência com a realidade, para conceber um conjunto de informações que servissem de referência para o desenvolvimento de contribuições práticas
para o problema em questão. Com a finalidade de coletar fontes de evidência que auxiliassem na compreensão do processo focalizado, foram feitas visitas a diversas organizações e profissionais ligados a temática, o que permitiu a evidenciação da situação atual do processo de averbação de penhora de imóveis e possibilitou o desenvolvimento da proposta de uma nova sistemática, com o desenvolvimento da averbação eletrônica de penhora de imóveis. Os resultados de pesquisa mostraram que a nova sistemática é passível de implantação, entretanto são necessários novos estudos que aprofundem o tema, e forneçam a base técnica adequada para sua implantação

Les relations des collectivités territoriales avec leurs organismes satellites / The relationships between regional authorities and their satellite organizationsVignes, Alexandre 27 November 2017 (has links)
Dans la perspective de mettre en œuvre les services qui relèvent de leurs compétences, les collectivités territoriales sont, en principe, libres d’emprunter le mode de gestion de leur choix et, en conséquence, d’opter soit pour une gestion directe soit pour une gestion déléguée. Cependant, désireuses de confier la réalisation de certaines missions à un tiers tout en conservant la maîtrise de leur exercice, les collectivités territoriales envisagent, parfois, de recourir à une entité personnalisée dont elles constituent les membres et que nous proposons d’identifier sous les termes d’« organismes satellites ». Dans ce cas de figure, les collectivités territoriales sont inévitablement amenées à nouer des relations avec ces structures satellites afin que ces dernières disposent des moyens de fonctionner et aient des tâches à accomplir. Ces relations, à la fois organiques, matérielles et fonctionnelles traduisent, d’une part, la participation des collectivités territoriales aux organismes satellites et, d’autre part, l’attribution de missions des premières aux seconds. Or, le cadre juridique dans lequel évoluent les collectivités territoriales tend à s’opposer à l’établissement de ces relations et à compromettre l’apparente faculté pour les collectivités territoriales de recourir à un mode de gestion mixte de leurs services. / In order to apply the services that come under their competences, regional authorities are, in principle, free to take the method of administration of their choice and, consequently, to opt either for a direct administration or a delegated one. However, having the desire to entrust the realization of some projects to a third party while keeping the control, regional authorities sometimes plan to use a legal entity in which they are members and that we suggest to be identified under the words “satellite organization”. In this case, regional authorities have to build relationships with the satellite organizations so as they have tools to work and to get projects. These organic, material and functional relationships show, on the one hand, the participation of regional authorities in the satellite organization and, on the other hand, the awarding of projects to the satellite organization. But the legal framework around regional authorities seems to be opposed to the setting up of these relationships and compromising the apparent faculty for the regional authorities to use a method of mixed administration of their services.

Analýza zabezpečování veřejných služeb na municipální úrovni / The Analysis of Public Services Provision on Municipal LevelFATRDLOVÁ, Marie January 2008 (has links)
This master thesis deals with analysis of providing of public services at the municipal level. Thesis is evaluated on the basis of information gathered in 10 municipalities from which 7 are situated in the Jihočeský kraj region and 3 are situated in the Vysočina region. Since the law not specifies strict variant of providing the services, municipalities may choose the most suitable alternative. Data were gathered in the period from the year 2001 to 2006. Five chosen services were the object of the analysis. The services were: Municipal solid waste disposal, public green foliage maintenance, local communications maintenance, streetlight maintenance and funeral services. The results of thesis are the ways of providing examined services by municipalities and whether there are possibilities to raise the effectiveness of providing these services.

Previous issue date: 2005 / Resumo: Este trabalho de tese introduz, no estudo do processo de eletrificação, o conceito de politização dos serviços de energia elétrica. O texto inicialmente discute a noção de indústria de energia elétrica e ao mesmo tempo coloca em relevância alguns temas centrais do recente processo de privatização e desregulamentação dessa indústria no Brasil. Além do mais, informa os métodos que são utilizados para pesquisar os problemas políticos e sociais na era da reestruturação da indústria de eletricidade.
Em seguida, são feitas duas retrospectivas: a primeira recai sobre a singular história de Goiás, ressaltando a construção das modernas cidades, Goiânia, a nova capital do Estado (nos anos 1930), e Brasília, a da República (nos anos 1950). Cabe também destaque à criação do Estado do Tocantins em 1988 e a recomposição do quadro político regional pós-regime militar até os dias atuais. A segunda reconstitui o processo de implantação de usinas, das linhas de transmissão e de distribuição de eletricidade em Goiás e no Distrito Federal ao longo do século XX. Neste processo, destaca-se a criação das empresas pioneiras de eletricidade, a ação dos grupos estrangeiros LIGHT e AMFORP, a intervenção dos governos estadual e federal através da criação da CELG e da CEB, além de FURNAS, da CEMIG, da ELETROBRÁS e da ELETRONORTE. Esta retrospectiva alcança o recente processo de desregulamentação dos negócios da indústria de energia, procurando introduzir a discussão sobre as licitações do patrimônio elétrico e dos novos projetos hidrelétricos a serem instalados. Os resultados das pesquisas de campo, das consultas realizadas no Ministério Público Estadual e Federal, das visitas periódicas às bibliotecas e das participações em congressos e seminários são apresentados nos três últimos capítulos. No conjunto, esta investigação enfoca a composição e o conflito de interesses capitalistas pelos novos projetos hidrelétricos recentemente licitados pela ANEEL. São analisados os projetos hidrelétricos localizados nos rios Araguaia, Claro, Verde, São Marcos e o processo de instalação do empreendimento de Corumbá IV. Por último, o foco analítico recai sobre poderosos grupos econômicos nacionais e estrangeiros que disputam atualmente o mercado e o patrimônio de energia elétrica em Goiás. Nesta análise, relevam-se os problemas do passivo social e ambiental das obras já instaladas das usinas de Cachoeira Dourada, de Serra da Mesa e de Cana Brava. Conclui-se este trabalho afirmando-se que o processo de mercantilização dos serviços públicos de eletricidade fez da vasta maioria da população a sua vítima e não a sua beneficiária. A continuidade desta lógica provoca rapidamente o esgotamento dos recursos naturais, além da expropriação das terras dos pequenos proprietários ribeirinhos / Abstract: The present thesis incorporates the concept that the electrification process, while a technical and economic process, has also an important social and politic aspecto The text begins with an overview of the electric power industry and with the mechanisms of its recent transformation in the Brazil through the privatization period, and informs the methods adopted in the research on the political and social problems associated with this process. Subsequently, two retrospectives are made: the first one relapses on the State of Goiás singular history, jutting out the construction of the modem cities of Goiânia, the new capital of the state (in the 1930's), and Brasília, the capital of the Republic (in the 1950's). In detach, also the creation of the new state of Tocantins in 1988 and the recomposing of the regional politic scene after military regime unti1 the present days. The second retrospect reconstitutes the process of implantation of the power plants, the transmission lines and the electricity distribution in Goiás and in the Federal District throughout the 20th century. In this process, detaches the pioneer e1ectricity enterprises creation, the action of the foreign groups LIGHT and AMFORP and the intervention of state and federal govems through CELG an CEB creation, as well as FURNAS, CEMIG, ELETROBRÁS and ELETRONORTE. The retrospect attains the recent deregulation process of the energy industry business, looking over to introduce the discussions about the outbidding of the settled electric patrimony and the new hydroelectric projects to be settled.
The results from the field research, the consultation realized in the State and Federal Public Ministry, the periodic visits to libraries and the participation in congresses and seminaries are presented in three chapters. In conjoint, the investigation focuses the composition and the capitalist's interests' conflicts for the new hydroelectric projects recently outbid by ANEEL. In a first moment, hydroelectric projects in the Araguaia, Claro, Verde and São Marcos rivers are analysed. Subsequently, it's studied the installation process of the Corumbá IV hydroelectric project in the Corumbá River. At last, an analytical focus relapses over national and intemational powerful economic groups, which presently dispute the energy market and patrimony in Goiás. In this analysis, it's revealed problems in the ambient and social passives in the settled works of Cachoeira Dourada, Serra da Mesa and Cana Brava works. This work is conc1uded affirming that the mercantilization process of the electric public services didn't benefit most of the population, but made them a victim. Molti studi hanno evidenziato come le riforme legate al NPM abbiano favorito l’adozione di logiche di mercato nelle amministrazioni pubbliche, basate sul rafforzamento dell’efficienza e dell’efficacia, e l’introduzione di innovazioni manageriali nell’erogazione dei servizi pubblici. In ciò, i meccanismi contabili pubblici hanno giocato un ruolo importante. Alcuni hanno enfatizzato che sono poche le evidenze sulla relazione tra logiche di NPM e maggiore performance, sottolineando che l’efficienza e l’orientamento ai risultati non sono sufficienti a evitare le conseguenze di shock. Altri affermano che le recenti misure di austerity hanno portato ad un rinnovato interesse sia in approcci di tipo privatistico, che a logiche neo-weberiane, ma sono anche emersi nuovi paradigmi.
Date queste considerazioni, la mia ricerca mira a contribuire (i) alla letteratura di pubblica amministrazione e a quella di financial management investigando come le risposte organizzative a eventi negativi sono legate alle precedenti strategie finanziarie e condizioni e capacità organizzative, e come la resilienza organizzativa sia influenzata da condizioni interne ed esterne; (ii) alla letteratura di public sector accounting, esplorando come l’accounting inficia sulle relazioni tra stato ed enti locali nell’ambito delle politiche di austerity, e le relative conseguenze su come i servizi pubblici sono organizzati, erogati e a chi. / Many studies have emphasized how NPM reforms have led to the adoption of market logics within public sector organizations, based on enhancing efficiency and effectiveness, and to the introduction of managerial innovations to public service delivery. In this, public accounting mechanisms have played a relevant role. Some have emphasized that there are scant evidences of the relation between NPM logics and increased performance, with “efficiency” and “result-orientation” being not sufficient to avoid the consequences of shocks. Others claim that the recent austerity measures has led to a renewed interest on both private-like approaches and neo-weberian logics, but also to the emergence of post-NPM paradigms.
Based on these considerations, my research aims (i) to contribute to public administration and public sector financial management literature by investigating how organizational responses to negative events are rooted in past financial strategies and organizational conditions and capacities, and how organizational resilience is affected both by internal and external conditions; (ii) to contribute to public sector accounting literature by exploring how accounting is implicated in the (re)shaping of the relationship between central and local governments under the emergence of austerity policies, and how this affects how public services are organized, provided, and to whom.

En quoi le traitement journalistique contribue-t-il à une construction de l’Histoire, quand il se confronte à la barbarie du genre humain ou aux pires déchaînements de Mère Nature ? De quels éléments de compréhension dispose-t-on dans la mémoire de ces événements ? La place occupée par le journaliste sur ces terrains en crise est intenable. Il est comme coincé dans une crise perpétuelle qu’il ne vit qu’au présent. Avec des archives conservées ou non, les traces disponibles sont très aléatoires. Je souhaite décortiquer ce que l’on appelle parfois la machine médiatique. Par une recherche approfondie mais non moins sélective des médias et des publics qui les consomment, il s’agit de trouver les clés pour comprendre comment ces crises majeures se transforment en une nouvelle Histoire focalisée sur l’instantané du journaliste qui traite de ces crises. Guerres, crimes génocidaires, tremblements de terre, tsunami : cette toile de fond ne reçoit pas le même traitement journalistique selon que l’on se situe en avril 1994 ou en janvier 2010.Interroger l’approche de ces crises qui se ressemblent mais déchirent les mémoires diversement selon que le traitement journalistique porte sur la République démocratique du Congo ou le Rwanda ; éclairer ce qui fait le terreau du misérabilisme ou suscite l’admiration dans la manière de rapporter les événements qui touchent Haïti ou le Japon ; savoir pourquoi telle ou telle direction est privilégiée dans la couverture de ces crises dans la presse imprimée francophone à travers des titres belge et français ; comprendre comment le Web bouscule les choix et la vitesse de la couverture du chaos : voici la base de cette recherche. / How does media coverage contribute to build History, when it faces Human atrocities and huge natural disasters? What keys to understanding can be found in the recollection of such events? The journalist’s position on these unstable fields is untenable. He is stuck in a permanent crisis that he can only watch as a contemporary witness. And, because records are not always held, traces are randomly available. My objective is to dissect what we may call the media spiral. Through an in-depth but nonetheless selective study of the Medias and their publics, the aim is to find keys to understanding how these major crises are turned into a new History focused on the reporter’s snapshot. Wars, genocides, earthquakes, and tsunami: this backdrop is not subject to the same media coverage depending whether we are in April 1994 or in January 2010. Questioning the approach to crises which are alike, but tear memories variously as the journalistic treatment concerns the Democratic Republic of Congo or Rwanda; decoding what is a breeding ground for ‘miserabilism’ on the one hand, and what arouses the admiration on the other hand, in the way of reporting the events which affect Haiti or Japan; trying to find out why such or such direction is favoured in the coverage of these crises in French-speaking printed press, through the study of Belgian and French titles; comprehending why the Internet rushes the choices and the race for the chaos coverage: here is the basis of this research.

L'expansion de l'intervention des personnes publiques dans le domaine économique et du nombre d'activités de service public confiées à des entités privées a profondément modifié le droit administratif général. La question du traitement fiscal de ces activités s'est alors posée. Or, le législateur fiscal ne tient pas compte du fait que l'activité est de service public pour y répondre; d'ailleurs, lorsque la notion de service public est employée dans les textes fiscaux, elle renvoie à une définition différente de celle retenue en droit administratif général. Le législateur fiscal ne se réfère pas non plus à la distinction entre services publics administratifs et services publics industriels et commerciaux. Cependant, cela ne signifie pas qu'il ne prend pas la mesure de la multiplication des activités de service public : en effet, le régime légal d'imposition, pour appréhender le traitement fiscal d'une activité, la compare avec ce qui existe sur le marché concurrentiel, comme le fait également le droit administratif général lorsqu'il s'agit de déterminer le visage d'un service public. Ainsi, si la nature de service public d'une activité -au sens du droit administratif général -n'influence pas son traitement fiscal, son visage -administratif ou industriel et commercial -pourrait, au contraire, permettre son identification. En cela, le droit fiscal rejoint la logique du droit administratif général : accordant peu d'importance à la nature de service public d'une activité, il pourrait être amené à se servir du visage pour obtenir la solution fiscale. / The growing intervention of public figures in the economic field as well as the increasing number of public service activities entrusted to private entities has deeply changed the public law. The question thus arose as to which tax treatment should be applied to these activities. The tax legislator has not yet taken into account the nature of the activity, a public service, to respond to the question. In addition, when the concept of public service is used in tax regulations, it refers to a different definition to the one used in public law. The tax legislator does not refer to the distinction between pure public services and industrial and commercial public services. However, this does not mean that the tax legislator does not take into consideration the increase of public service activities. Indeed, in order to apprehend the tax treatment of an activity, the legal tax regime, just like public law, compares it with the activities existing in the competitive market. Thus, if the nature of the public service in the view of public law does not have any influence on its tax treatment, its administrative or industrial and commercial tainting may, on the contrary, allow its identification. As such, tax law joins the logic of public law: by granting little importance to the public service nature of an activity, it might be required to use the tainting to reach the tax solution.

The topic of public services is a complex societal issue, which touches upon such questions which are on the border of legal and economic research and comprises various ideas of societal arrangements. The provision of public services in European societies is seen as a constitutive element of the European social model(s). This issue is experiencing a remarkable revival in academic work as well as in political discourse. The aim of this Master's Thesis is to provide an insight into the process of the Europeanization of public services. The Thesis is embarking on questions comprising the national variations of public services, the transformation of the welfare state and the European social model (or models). The common theme which is connecting the different strands of the Thesis is the idea of the crucial influence of European integration on all of these aspects, the process of which has a far-reaching influence on the role and shape of public services and thus on the future societal development in the individual Member states as well as European society as a whole.
