Právní předpoklady rodičovství / Legal pre-conditions for parenthood

The work follows the current legislation dealing with matters of parenthood. It is designed in accordance with the breakdown of motherhood and fatherhood. After an introduction, defining the purpose and need for legal regulation of family issues, follow the main chapters dealing with different issues. First, attention is paid to the determination of motherhood. This section is divided into three chapters, the first of which is further divided for clarity even in the following sections. The first chapter is devoted to the issue of child identity undetected. This chapter is further divided into parts and special sections devoted to the identity of unidentified child, called the found child, another sub-chapter describes the legislation and the possibility of using the birth mother's identity and privacy of anonymous births, and the last sub-sections deal with the problem of their baby boxes, and legal issues. In other chapters of the work deals with the erroneous entry in the matrix and the state where the child is born outside the medical facility. Then follow chapters on the determination and denial of paternity. The work follows a system of three statutory presumptions of paternity and the subsequent denial of the possibility of paternity. Matter of Life and Death

This thesis is a critical analysis of the processes, concepts and imagery of my artwork. In my art, I intended to explore death anxieties, individuality and the uncanny. I am interested in what we leave behind after we are gone as proof of existing post mortem. My themes include procreation, forensic science, and religion among others. My imagery includes fragmented bodies, reliquaries, and forensic evidence. I use traditional and non-traditional sculpture materials and processes that are intended to conceptually inform the viewer further.

An Energy-Efficient Medium Access Control Protocol for Wireless Sensor Networks "V-MAC"

Wireless sensor networks (WSNs) are composed of hundreds of wireless sensors which collaborate to perform a common task. Because of the small size of wireless sensors, they have some serious limitations including very low computation capability and battery reserve. Such resource limitations require that WSN protocols to be extremely efficient. In this thesis, we focus on the Medium Access Control (MAC) layer in WSNs. We propose a MAC scheme, V-MAC, for WSNs that extends that lifetime of the network. We compare V-MAC with other MAC schemes. V-MAC uses a special mechanism to divide sensors in different groups and then all the members of a group go to sleep at the same time. V-MAC protects WSNs against denial of sleep and broadcast attacks. We present the V-MAC scheme in details and evaluate it with simulations. Our simulations show that V-MAC enjoys significantly higher throughput and network lifetime compared to other schemes.

Understanding the Holocaust: Ernest Becker and the "Heroic Nazi"

This paper examines the power and limitations of historical analysis in regards to explaining the Holocaust and in particular the widespread consent to the Nazi program. One of the primary limitations that emerges is an inability of historians to fully engage other social sciences to offer a more comprehensive explanation as to why so many Germans engaged in what we would consider an “evil” enterprise. In that regard, I offer the work of Ernest Becker, a social anthropologist, whose work provides a framework for understanding history as a succession of attempts by man to create societies that generate meaning through various heroic quests that defy man's finite existence, yet often result in carnage. Combining Becker's theoretical framework with the rich historical evidence specific to the Holocaust provides a much richer understanding of both Becker's work and why the Holocaust happened.

A dissertação elabora a análise de alguns contos de João Antônio com a intenção de traçar o percurso narrativo de sua obra. A seleção de contos se organiza sob o arco histórico da ditadura militar, e as análises buscam se associar a temas da identidade nacional. Partindo de Malagueta, Perus e Bacanaço, trata de seus assuntos mais imanentes, como a anonímia e o negacear do malandro, relacionando-os à sua época e ao empenho inicial do autor. Segue com a análise de Paulinho Perna Torta, em que se discute os desdobramentos de um tipo de progresso que a experiência nacional tornou particular. Neles se inserem tanto a violência urbana quanto a nova formação do sujeito. E elabora em seguida as leituras de Dedo-Duro e Toni Roy Show, contos que servem para a retomada do gênero conto e passam a delinear uma abertura formal e temática que se resolve no conto Abraçado ao meu rancor. Em perspectiva, esta dissertação busca depreender da obra do autor uma constante que atravessa o seu fazer literário e seu tempo histórico, nomeada aqui como uma \"literatura de negação\". / The dissertation elaborates some analysis of short stories of João Antonio with the intention of tracing the narrative course of his work. A presente dissertação aborda a problemática questão da responsabilidade do Estado por omissões judiciais em seus diversos aspectos. Apresenta um panorama geral do papel e da função do instituto da responsabilidade extracontratual do Estado concebido dentro de um sistema amplo de controle e responsabilidade em sentido amplo do Poder Judiciário e da magistratura, sobretudo no sistema brasileiro. Examina a tipologia dos atos oriundos do Poder Judiciário para fins da incidência da responsabilidade estatal. Analisa a responsabilidade do Estado em face dos atos jurisdicionais e não jurisdicionais do Poder Judiciário. Estuda separadamente cada requisito da responsabilidade do Estado por omissão. Traça as peculiaridades de cada um desses requisitos considerando as peculiaridades da atividade judiciária. Propõe e delimita, com enfoque (mas não exclusivamente) no processo cível, oito espécies de omissões judiciais passíveis de gerar a responsabilidade do Estado. Enfrenta, dentre essas espécies, a questão da denegação de justiça e morosidade judicial. Trata da responsabilidade pessoal do magistrado e demais servidores. Discorre sobre a relação dessa responsabilidade com a do Estado. E, por fim, expõe algumas questões processuais relacionadas a tais ações. / This dissertation addresses the highly problematic issue regarding liability of the State on court omissions in its various aspects. It provides an overview of the role and function of the liability of the State in torts considering the Brazilian broad control system of judicial acts. This work deals with specific types of acts related to liability of the State in the Judiciary, by analyzing the liability on judicial and non-judicial acts. It also studies each aspect of the liability of the State on court omissions considering the peculiarities of the judicial activity. Another point is the effort to clearly define eight species of court omissions focusing (but not exclusively) in Civil Procedure Law and the attempt to deal with issues related to justice denial and judicial delay. It studies judge and judicial employees accountability and the discussion related to this judicial accountability and the State. Finally, it presents some procedural issues related to such actions.

O ataque por negaÃÃo de serviÃo ficou conhecido a partir do ano de 1988, tendo se tornado uma grave ameaÃa ao funcionamento das redes de computadores em todo o mundo. Quando essa modalidade de ataque està em curso a vÃtima recebe um incremento tÃo intenso na demanda pelos seus recursos computacionais, que os mesmos podem se tornar indisponÃveis aos usuÃrios. A despeito de existirem outras formas de ataques a redes de computadores, a negaÃÃo-de-serviÃo tem sido alvo de particular interesse da comunidade cientÃfica dedicada no estudo da seguranÃa de redes de computadores. Isto se deve à simplicidade com que este ataque pode ser desferido, aliada ao seu efeito devastador. AlÃm disso, a dificuldade que a vÃtima terà em se defender, dependerà da forma como o ataque se processa, sendo as formas de ataque caracterizadas como âdiretaâ, âindiretaâ, ou âdistribuÃdaâ. Na literatura especializada em seguranÃa existem trabalhos com variadas propostas para a abordagem deste problema, sendo predominante nas mesmas o carÃter de estado-da-arte. A tendÃncia que se acentua nas propostas à a da uniÃo de argumentos computacionais e matemÃticos. Nesta tese sÃo analisados alguns trabalhos que apresentam contribuiÃÃes relevantes para a resoluÃÃo do problema em estudo. Este conceito à uma conseqÃÃncia do âTeorema Integral de Cauchyâ, um dos mais importantes resultados da Teoria das VariÃveis Complexas. / The denial-of-service attack was unveiled in the year of 1988 and became a serious threat to the computer networks to carry on properly, around the world. When this kind of attack is going on the victim suffers so high increment in demanding computational resources, that they may become unavailable to the true users. Despite the fact that there exist other kind of computers network attacks, the denial-of-service attack is the target of a special interest by the scientific community, dedicated to computers network security. This is due to the simplicity in starting the attack, associated with its destructive effect. The difficulty in defending against this attack grows according to it is in a form âdirectâ, âindirectâ, or âdistributedâ. In the specialized literature dealing with security there are papers with varied approaches to this problem and the main feature is the predominant state-ofart. The stressed trend in the arised proposes is the joining of mathematical and computational arguments. In this thesis some papers are analysed with considerable contributions to the problem under study. An original idea dealing with this problem, based in concepts and tools of the Theory of Complex variables, is joined to this analysis. The mapping between the attack environment and the complex variables space is the form by which one may construct a method to determine an attacker IP number, through the use of the âwindind number of a path around a pointâ. This concept is a consequence of the âCauchyâs Integral Theoremâ, one the the most important results in the Theory of complex Variables.

Sustainable Behaviour through Nudging? : An Experimental Study on Nudging, Climate Change Denial and Political Orientation

Can nudging promote sustainable consumption behaviour? This study investigates if nudging promotes more environmentally-friendly purchases when applying either a default option or adding a product to elicit the attraction effect in a consumption situation of electronic products. The study further investigates sustainable consumption behaviour by looking at political orientation and the degree of climate change denial. The results show that nudging can promote significantly more environmentally-friendly purchases. The attraction effect was found to have positive effects, but not the default option. A higher proportion of environmentally-friendly purchases was further carried out by participants having a lower denial towards climate change. Climate change denial was also correlated with political orientation; participants evaluating themselves as right-wing oriented showed higher climate change denial, and proceeded with less sustainable purchases. Despite identifying positive effects of nudging on sustainable consumption behaviour, data also indicate an interaction effect between nudging and the sequenced presentation order of condition. This can be interpreted as a carry-over effect moderating the effect of nudging when it is presented after a control condition. This moderating effect is discussed as a potential limitation of nudging as a tool to affect people’s behaviour.
