Justiça e disciplina : análise das práticas de controle institucional na Polícia Militar do estado de Sergipe (2001-2009) / JUSTICE AND DISCIPLINE: analysis of practices of institutional control in the military police of the state of Sergipe (2001-2009).

This study entitled "Justice and Discipline: Analysis of Institutional Control Practices in the Military Police of the State of Sergipe (2001-2009)" aims to examine the practices of institutional control and consequent restatements in disciplinary power in the period between 2001 to 2009, whereas these restatements reflect the search for elements reaffirmation of the effective exercise of power practiced within the hierarchical relationships-disciplinary. The reaffirmation of the domain of military authority, at any given time, assumed the aspect of a discourse oriented legal grounds to punish the act. The emergence of "new" procedures of accountability and culpability of the offender characterized the concern of military authority regarding maintenance of disciplinary content of hierarchical relationships. Using the documentary research, based on publications made in bulletin Overall, the analysis focused practices of empowerment appealed also to speak of the subject, trying, through discourse agents, make an overview of the concepts and representations concerning discipline and justice. In the scenario presented by institutional PMSE during the period in question, the transgression appears as one of the categories of the phenomenon of misconduct, thoughtful, often from two angles: the relations disciplinary transgression in this case was taken as a result of disobedience, the penalty being applied in the form of educational intervention, the background takes misconduct in higher degree, considering it as a serious deviation from the behavior, distanced professional ethics and responsible for military cause problems, eg, the police violence. During selected view which tried to design transgression existing in the institution and how it justifies the notion of "disciplining" and criminal liability and administrative officer practiced by the military authority. Amid the data relating to punishments and disciplinary procedures and judicial perceive problems as the transparency of procedures, preventing often the external observation of practice and investigation of allegations of criminal offenses. There was also a more effective coercive apparatus for the application of disciplinary punishments related to the discipline of the troops, however, this efficacy contrasts with the results of established procedures for verification of complaints of abuse of power committed by military police. One of the factors affecting the poor visibility of the route taken by the procedure is precisely the institutional design given by the militarism that treats the misconduct as something that concerns the military world, undermining a broader understanding of the effects of violence and transgression committed by police. / O presente estudo intitulado Justiça e Disciplina: Análise das Práticas de Controle Institucional na Polícia Militar do Estado de Sergipe (2001-2009) tem por objetivo analisar as práticas de controle institucional e as conseqüentes reformulações no poder disciplinar ocorridas no período entre 2001 a 2009, considerando que estas reformulações refletem a busca por elementos de reafirmação do exercício efetivo de poder praticado no interior das relações hierárquico-disciplinares. A reafirmação do domínio da autoridade militar, num dado momento, assumiu a faceta de um discurso orientado para a fundamentação legal do ato de punir. A emergência de novos procedimentos de responsabilização e de culpabilização do transgressor caracterizou a preocupação da autoridade militar quanto à manutenção do conteúdo disciplinar das relações hierárquicas. Utilizando da pesquisa documental, baseada nas publicações feitas em boletim geral, a análise direcionada às práticas de exercício de poder recorreu, também, à fala dos sujeitos, tentando, por meio do discurso dos agentes, fazer um apanhado das representações e das concepções relativas à disciplina e à justiça. No cenário institucional apresentado pela PMSE, no período em questão, a transgressão aparece como uma das categorias do fenômeno de desvio de conduta, pensada, freqüentemente, a partir de dois ângulos: o das relações disciplinares, nesse caso a transgressão era tida como resultado da desobediência, sendo a penalização aplicada sob a modalidade de intervenção pedagógica; o segundo plano toma o desvio de conduta em grau mais elevado, considerando-o como grave desvio do comportamento, distanciado da ética profissional militar e responsável por originar problemas como, por exemplo, o da violência policial. No período selecionado tentamos visualizar qual a concepção de transgressão existente na instituição e como esta fundamenta a noção de disciplinarização e de responsabilização criminal e administrativa do policial praticada pela autoridade militar. Em meio aos dados relativos às punições e processos disciplinares e judiciais percebemos problemas quanto à transparência dos procedimentos, inviabilizando, muitas vezes, a observação externa das práticas de apuração das transgressões e denúncias de crime. Verificou-se, também, uma maior eficácia do aparelho coercitivo disciplinar quanto à aplicação de punições relacionadas à disciplina da tropa, entretanto, essa eficácia contrasta com os resultados de procedimentos instaurados para verificação das denúncias de abuso de poder cometidos por policiais militares. Um dos fatores condicionantes da pouca visibilidade do percurso feito pelo procedimento é, justamente, o desenho institucional conferido pelo militarismo que trata o desvio de conduta como algo que diz respeito ao universo militar, prejudicando uma compreensão mais ampla dos efeitos da violência e da transgressão cometidas por policiais.

Com efeito, nas últimas décadas, tem crescido o número de doenças mentais diagnosticadas em crianças, especificamente, que consideraríamos normais pela perspectiva de Canguilhem (2010), mas que o olhar médico-científico as considera portadoras de doenças mentais. Assim, discursos ou dispositivos de poder psiquiátricos são constituídos para transformar comportamentos diferentes em patologias de modo que possam agir sobre os corpos, autorizadamente. Dentre eles, está o Transtorno do Déficit de Atenção e Hiperatividade (TDAH), analisado como objeto empírico nesta pesquisa, que se constitui num campo discursivo mais amplo denominado medicalização (CONRAD, 1992; ROSE, 2001; FOUCAULT, 1988; ILLICH, 1975), composta por diversas instituições como: psiquiatria, indústrias farmacêuticas, escolas, família, leis, associações de portadores do transtorno e mídias não especializadas. Esta constituição ocorre pelo deslocamento analítico de um comportamento do âmbito sociocultural para o campo médico que passa a ser diagnosticado e tratado como se fosse patológico. Para levantar as informações a respeito do TDAH, analisamos as falas de 5 psiquiatras, obtida por meio de entrevistas semiestruturadas, 114 reportagens do jornal Folha de São Paulo, publicadas no período compreendido entre 1997 e 2011, o site da Associação Brasileira de Déficit de Atenção (ABDA) e algumas de suas produções (congressos, materiais informativos e textos de seus membros) e, finalmente, os Projetos de Lei (PL’s) em tramitação nas casas legislativas da cidade e do estado de São Paulo e da Federação. Valendo-nos de importantes conceituações pertinentes à Genealogia do Poder e à Arqueologia do Saber (FOUCAULT, 2007; VEYNE, 2011), bem como à Teoria do Discurso (HOWARTH, 2000), procuramos compreender de que modo o discurso medicalizante produz efeitos de poder sobre os corpos, transformando a falta de atenção e o excesso de atividade da criança em transtorno mental. Percebemos que isto é feito, dentre outras finalidades, para ampliar a performance ou o desempenho dos indivíduos, exigido tanto pelas escolas quanto pela economia de nossa sociedade. Tal exigência constitui-se na sociedade denominada normalizada (FOUCAULT, 2006), de risco (BAUMAN, 2008; BECK, 2010) ou de controle (DELEUZE, 1992), em que os possíveis prejuízos para o indivíduo e para a sociedade devem ser contidos por meio do controle dos corpos. Para tanto, a ciência, baseada nos conhecimentos da genética e da neurologia, disseca o corpo em suas partes doentes, constituindo uma nova forma de sujeição (DELEUZE; GUATTARI, 1996), o anormal. A anormalidade se apresenta na fronteira entre os comportamentos esperados e os desviantes, na medida em que estes últimos surgem como embaraço à sociabilidade e, principalmente, à produtividade. Normalizar seria então a função tanto do poder disciplinar quanto do biopoder, poderes sobre a vida (FOUCAULT, 1988) que agem sobre os corpos e a população, respectivamente, sintetizados nesta pesquisa com o nome crítico de medicalização. Além disso, ao constituirmos este campo discursivo, percebemos que, embora haja resistências, a medicalização da criança por meio do TDAH no Brasil tem triunfado em suas pretensões, tendo, na promulgação das leis e na identificação do transtorno apropriada pelo senso comum, as derradeiras fronteiras do poder sobre os corpos. / This research shows us that we are living in the era of medicalization, of the disorders, and pathologies (CONRAD, 1992; ROSE, 2001; VICENTIN, 2010). In the last decade the number of mental diseases diagnosed, specifically in children, who we consider normal from Canguilhem’s (2010) perspective, but the medical-scientific eye consider mental disorder has grown. This way discourses or mechanisms, which allows the psychiatric community to change different behaviors in pathology in a way that they can act on the bodies authoritatively. Amongst them is the Attention Deficit Hyperactivity Disorder (ADHD), analyzed as an empirical object of this research, which is a broader discursive field identified as medicalization (CONRAD, 1992; ROSE, 2001; FOUCAULT, 1988; ILLICH, 1975), composed of various institutions such as: psychiatry, pharmaceutical companies, schools, families, justice system, associations of people with the disorder, and non-specialized media. This happens when there is an analytic displacement of a socio-cultural behavior into a medical field to be diagnosed and then treated as if it was pathologic. To collect information about ADHD, we examined the discourse of five psychiatrists, gathered thought previously given interviews, 114 reports from the newspaper ‘Folha de São Paulo’, published during the period between 1997 and 2011, the site of the Association of Attention Deficit (ABDA) and some of its productions (meetings, informative materials and texts of its members), and finally, the Bills (PL's) in progress in the legislative house in the city, the state of Sao Paulo and the Brazilian Federation. Making use of important concepts which we considered relevant to the Genealogy of Power and the Archaeology of Knowledge (FOUCAULT, 2007, VEYNE 2011), and the Theory of Discourse (HOWARTH, 2000), we are seeking to understand how the medicalizalization discourse produce effects on the bodies, transforming the lack of attention and the over activity present in a child in a mental disorder. We noticed that it is done, amongst other reasons, to enhance or to improve the performance of individuals, a demand made not only by the schools, but by the economy of our society. This demand appears to be identified in society as normalized (FOUCAULT, 2006), in risk (BAUMAN, 2008; BECK, 2010), or controlled (DELEUZE, 1992), where to avoid possible harm to the individual and to society, the bodies must to be kept under control. That is why science, based in knowledge of genetics and neurology, dissects the body in illnesses, establishing a new form of subjection (DELEUZE; GUATTARI, 1996), the abnormal. The abnormality appears at the border between the expected behavior and deviating, to the extent that the latter appears as embarrassment to sociability, and especially to productivity. To normalize would then be not only a function of the disciplinary power, it would be also part of the biopower, the power over life (FOUCAULT, 1988) which acts over the bodies and the population, respectively, synthesized in this research critically named as medication. Moreover, when we opened this field of discourse, we realized that although there is resistance, the medicalization of children due to ADHD in Brazil has succeeded in its ambitions, and in the promulgation of laws and the proper identification of the disorder by common sense, the ultimate boundaries of power over the bodies.

Patients and their use of medicines : a discourse analysis of encounters with nurse prescribers

Patients' use of medicines is widely recognised as sub-optimal with a high proportion of patients with a long-term condition not taking their medicines as prescribed. Research and policy guidance emphasise the importance of partnership within the patient-prescriber encounter in enhancing patients' use of medicines. There is however considerable evidence that this is not usually achieved by medical prescribers, limiting the extent to which shared decision-making occurs about prescribed medicines. There is a general assumption that nurse prescribers, who within the United Kingdom have comparable prescribing rights to medical doctors, demonstrate greater abilities in collaborative working with patients leading to an enhanced use of medicines. Research evidence is however limited, particularly in relation to the ways in which patients' use of medicines is discussed and negotiated within the patient-nurse prescriber encounter. This study focused on the management of patients' use of medicines within the patient-nurse prescriber encounter. Seven nurse prescribers, working within a number of clinical specialities in both primary and secondary care settings, were recruited to the study together with their patients who were living with one or more long-term conditions (n=21). Data collection involved the non-participant observation of out-patient consultations to examine the management of patients' use of medicines within the encounter and semi-structured interviews with both patients and prescribers. Discourse analysis was undertaken to examine underpinning assumptions, views and beliefs regarding the management of patients' use of medicines. Asymmetry was evident within the encounters with prescribers controlling the agenda for discussion and interrupting patients' attempts to demonstrate their knowledge. Patient accounts of the moral approach adopted in managing their condition in the context of their everyday lives were also ignored. Biomedical and contrasting moral discourses are examined. An interpretive framework derived from the work of Michel Foucault is used to explain the operation of disciplinary, pastoral and bio-political power within the encounter and the extent to which subjugation of patients' knowledge and resistance were evident. Foucault's concept of technologies of the self is examined to explore its potential application in enhancing patients' medicines use.

Konstruktionen av det normala förskolebarnet: En Foucaultinspirerad textanalys / The Construction of the Normal Preschool Child: A Foucault-Inspired Text Analysis

Denna uppsats undersöker vilken påverkan som olika maktaspekter har på förskolebarnet. Studiens syfte är att ur fyra av förskolans policydokument utröna hur förskolebarnet konstrueras. Det teoretiska perspektiv som har använts är en verktygslåda som är inspirerad av Foucaults tankar angående makt: disciplinär makt, biomakt, diskurs och genealogi. Det är fyra olika policydokument som har undersökts: Barnstugeutredningen (del 1), Pedagogiskt program för förskolan, Lpfö 98 och Lpfö 18. För att visa hur det normala och patologiska barnet konstrueras i förskolan har dokumenten analyserats med ett diskursanalytiskt förhållningssätt som tydligt involverar Foucaults maktperspektiv. Diskursanalysen visar vilka egenskaper som anses vara önskvärda för förskolebarnen att internalisera, vilka diskurser som är synliga och vilken påverkan olika historiska händelser har på konstruktionen av barnet. Analysens resultat visar att det inträffar olika diskursförskjutningar beroende på hur samhällsstrukturen ser ut i det givna sammanhanget, vilket också har en påverkan på hur barnet konstrueras. Det normala barnet konstrueras efter de normer och värderingar som förespråkas i den rådande diskursen. Det patologiska barnet anses framför allt vara barn med annan kulturell bakgrund som inte lever upp till de förespråkade normerna. En reflektion av resultaten visar att den allt snabbare samhällsutvecklingen, där de sociala klyftorna ökar, bidrar till en situation i förskolan som är svårhanterlig och komplex. En slutsats som dras är att det är av vikt för barnen att förskolan är likvärdig, och för att förskolan ska bli likvärdig bör vissa punkter i läroplanen revideras. / <p>Examinator har godkänt att fulltexten byts ut på grund av en smärre justering som inte påverkar uppsatsens innehåll. Disciplinary Mythologies: A Rhetorical-Cultural Analysis of Performance Enhancement Technologies in Sports

In sports discourse, the relationship between athletics and technology is often paradoxical. On the one hand, modern sports rely on technology at every level, from training and tracking of players to the equipment and apparel used by athletes to the game strategies and playing fields themselves. Nearly all of these technologies are intended to increase athletic performance on some level. And yet, certain performance enhancement technologies can be criticized for being antithetical to the spirit of sports, which is framed as being a strictly natural and pure human endeavor. Using a rhetorical-cultural methodological approach, popular sports discourse is analyzed to investigate how arguments in contested spaces between sports and technologies get (re)negotiated and (re)articulated to fit within a sports social language that emphasizes "pure" and "natural" ideals of sport. This often results in a dichotomy where the sport/technology relationship is either black boxed, thus being subsumed in the sport social language and becoming transparent and the relationships unarticulated, or the technology is regulated out of the sport through rules and bans. The reason for this articulation is attributed in large part to the deep humanism embedded in the sport social language. How a shift to a posthuman perspective would effect sports discourse is explored. These conclusions about underlying values in sports discourse lead to the formation of a new theoretical framework called disciplinary mythologies. Building off of Foucault's disciplinary power, Scott's disciplinary rhetorics, and Barthe's mythologies, disciplinary mythologies are discrete units of persuasion that both construct and constitute claims by drawing upon layered narratives and shifting associations that lose their context when entering the realm of myth. Two specific disciplinary mythologies are discussed—the level-playing-field topos and the nostalgia enthymeme—and it is shown how sports discourse often draws upon them to shape arguments and actions.

[pt] A articulação entre psicanálise e educação para pensar o mal-estar na escola remonta aos primórdios da constituição da primeira. Se podemos encontrar em S. Freud uma oscilação entre o papel inibidor que caberia à educação e, por outro lado, um veio libertário, na medida em que esta acolhesse em seus objetivos a realidade pulsional na criança, há uma outra linha de pensamento na psicanálise que vai de S. Ferenczi a D. W. Winnicott, que permite outros encaminhamentos para a abordagem deste tema, especialmente na sua expressão atual. Esta tese objetiva investigar o que pode a psicanálise frente ao mal-estar na escola atual usando como ferramentas a genealogia do poder disciplinar e do biopoder em M. Foucault para compreender a emergência da categoria criança-aluno, os conceitos de norma e normalização para discutir os processos de medicalização e de patologização de crianças e de jovens no ambiente escolar na sociedade de controle e, finalmente, o pensamento de D. W. Winnicott e sua teoria do amadurecimento psíquico e seus desdobramentos. Aponta-se, ainda, para a propriedade desta teoria da constituição subjetiva precoce e de seus desdobramentos, que permitem pensar as formas de inserção na cultura, para os encaminhamentos diferentes do mal-estar na escola atual, compreendido como despotencialização do viver criativo. / [en] The articulation between psychoanalysis and education to think about the discontent in school dates back to the beginnings of the constitution of the former. If we can find in S. Freud an oscillation between the inhibiting role which had to be done by education and, on the other hand, a libertarian trace, in that this hosts into its objectives the instinctual reality in the child, there is another line of thought in psychoanalysis that goes from S. Ferenczi to D. W. Winnicott which allows other referrals to this theme approach, especially in its current expression. This thesis aims to investigate what psychoanalysis can do against the discontent in the current school using as tools the genealogy of the disciplinary power and the biopower in M. Foucault to understand the child-student category emergency, the standard and standardization concepts to discuss the medicalization and pathologizing processes of children and youth in the school surroundings in the control society and, finally, D. W. Winnicott s thought and his psychic maturing theory and its developments. It is still aimed to the property of this theory of the early subjective constitution and its developments, which allow to think the forms of insertion into the culture, to the different referrals of the discontent in the current school, understood as creative living disempowerment.

Au sein des groupements de l’économie sociale, le rapport entre la personne morale et ses membres est un rapport particulier et unique. Cette spécificité tire sa force de l’esprit altruiste et éthique du secteur solidaire. Elle tire sa force aussi des principes humains et financiers qui règnent au sein de ce type de groupement. Par conséquent, on a pu affirmer que le principe phare qui influe le plus sur ce rapport reste celui de double qualité. Ce dernier permet d’associer le membre aux affaires sociales du groupement et de le faire, en plus, participer activement tout au long de son adhésion. Cependant, cette particularité du rapport est menacée par plusieurs facteurs, les uns sont d’ordre interne et liés aux règles de fonctionnement et aux problèmes récurrents du financement des dits groupements et les autres sont externes et plus attachés au libéralisme et la mondialisation des échanges et plus particulièrement la politique européenne axée sur lalibre concurrence au marché face à des sociétés de type capitaliste qui ne cessent d’attaquer les groupements de l’économie sociale pour les banaliser et les faire disparaitre / Within companies of social economy, the relationship between the corporation and its members is a special and unique one. This specificity derives its strength from the altruistic and ethical mind of the solidarity sector. It also draws its strength from human and financial principles that prevail in this kind of companies. Therefore, we could confirm that the guidingprinciple that most affects this relationship is that of a dual quality. This latter allows the association of the member to the social affairs of the company making it, in addition to that, actively participating throughout the process. However, this particular relationship is threatened by several factors. Some are internal and related to operating rules as well as the persistent problems in the financing of the abovementioned companies. The other factors are external and more linked to liberalism and to the globalization of trade and particularly the European policy based on free competition in the market versus capitalist societies that keep on attacking the companies of social economy for the sake of trivializing and getting rid of them

The aim of this essay was to examine the justifications of the swedish government to perform medical age assessments on unaccompanied refugee children seeking asylum in Sweden. These governmental justifications were analyzed through Michel Foucault's theory of disciplinary power as well as through anthropological research on classification of age. The empirical material consisted of a selection of websites from different authorities that process medical age assessments. These were then studied through critical discourse analysis. The essay showed that these justifications can be understood as an expression of disciplinary power, where medical age assessments discipline individuals to docile bodies. Furthermore, the analysis also showed that the governmental justifications were partly founded upon western concepts of how a child is supposed to be and what a child is entitled to.

In this thesis I am concernced with a Foucauldian analysis of neoliberal government and application of this concept in the Petr Nečas's government. The Foucauldian analysis of power is a constant critical process that is supposed to modify according to changing terms. Foucault argues that the core of the art of government is a conflict. He doesn't understand the modern history as a history of law and peace. From the Foucauldian point of view the modern history has always been the history of conflict of two races. The winnig race determines law and rules of the whole society. It means that law and freedom are tools of governance. The basis of Foucault's concept is a relationship between power, knowledge and subject. This relationship constitutes technologies of governance. Foucault talks about three techniques - pastoral power, disciplinary power and bio-power. The bio-power is especially in the modern age. The modern art of government uses knowledge of experts (statistics, analyses, reports) for conduct of conduct. The inidividuals are not only the recepients of effects of power, but also they are distributors of power.
