Firstly, it begins from the historical development about Human Rights identifying the Human Dignity as a presystemic principle and points out illegal police performance thorough torture practice outer element searching for the real truth unprovided of performance organization. It still analyses the Human Dignity and Human Rights custody, specially those which fall upon the Police performance and knowledge. Furthermore, it establishes a linking between the public safety policy in São Paulo State, in Brazil and in Mercosul. This study deepens in the role of Police Academy and its teaching staff, in collecting data about the teachers, what is taught in teachers training and development and what is practiced by Civil Police. Finally, the thesis brings out the perspectives to be faced and proposes actions that culminate in Human Dignity custody pointing out that the investigation police needs to aim the Human Rights performance / A tese examina o papel da Academia de Polícia de São Paulo no ensino da disciplina Direitos Humanos e o impacto desse conteúdo programático na realidade da atuação Policial Civil de São Paulo. Parte de um escorço histórico sobre os Direitos Humanos, identificando a Dignidade Humana como um princípio présistêmico. Aponta os traços mais visíveis da atuação policial ilegal por meio da prática da tortura elemento mais exterior de uma atuação de busca da verdade real desprovida de meios organizados de atuação. Analisa ainda os instrumentos de tutela da Dignidade Humana e dos Direitos Humanos, em especial aqueles que incidem sobre a atuação policial e que também devem ser de conhecimento do policial civil. Na mesma esteira, estabelece uma ligação entre as políticas de segurança pública em São Paulo, no Brasil e no Mercosul. O estudo aprofunda-se ainda no papel da Academia de Polícia de São Paulo e do seu corpo docente ao levantar, em pesquisa de campo, dados sobre o que conhecem os professores, o que ensinam os cursos de formação e de aperfeiçoamento e o que praticam os policiais civis. Finalmente, a tese aponta desafios e perspectivas a serem enfrentados e propõe ações que culminam na tutela da Dignidade Humana, apontando que a polícia de investigação necessita ter como escopo de atuação os Direitos Humanos

It defines the person with deficiency in our juridical system, enlarging the list of the Ordinances ns. 3.298/1999 and 5.296/2004, based in the international legal system and in the jurisprudence. The development of the concepts of human dignity, equality and non discrimination are the foundations for the creation of affirmative actions, seeking to the social inclusion of the persons with deficiency, and they are object of a fast approach. In Brazil, the equalization of access opportunities to the job market for persons with deficiency is looked for through the adoption of a system of quotas or legal reserve. The Brazilian system of quotas forces to the persons with deficiency recruiting in the formal market of work, through contract between employee and employer, or through the use of reserved vacancy in public contest. The compulsory nature of person with deficiency recruiting, the increase of the fiscalization by the Labor Department and by the Labor Public Prosecution Service and the recruitings without any planning are cause of legal and social questions. To guarantee the economical function of the companies and to motivate the Brazilian system of quotas, this work proposes the adoption of fiscal and social security measures, the creation of subsidies and the alteration of the Law n. 8.742/93, in order to increase the forecast of a temporary suspension of the payment of the benefit of the special attendance when of the beginning of a labor activity of any species, until the person with deficiency returns to the inactivity. The person with deficiency social inclusion is accompanied of a series of important subjects, treated by the work, that should be faced by the State and by the whole society / A dissertação de mestrado demonstra a trajetória da pessoa com deficiência na busca do reconhecimento de seus direitos, enfocando a proteção prevista em diversos diplomas internacionais voltados à reconstrução dos valores humanos, na Constituição Federal de 1988 e em diversas leis infraconstitucionais. Define quem é a pessoa com deficiência em nosso ordenamento jurídico, ampliando o rol constante nos Decretos ns. 3.298/1999 e 5.296/2004, com fundamento no ordenamento internacional e na jurisprudência. O desenvolvimento dos conceitos de dignidade humana, igualdade e não discriminação são os fundamentos para a criação de ações afirmativas, visando à inclusão social das pessoas com deficiência, e são objeto de uma rápida abordagem. No Brasil, busca-se a equiparação de oportunidades de acesso ao mercado de trabalho da pessoa com deficiência, através da adoção de um sistema de cotas ou reserva legal. O sistema de cotas brasileiro obriga à contratação de pessoas com deficiência no mercado formal de trabalho, por meio de contrato entre empregado e empregador, ou através da utilização de vaga reservada em concurso público. A obrigatoriedade de contratação de pessoas com deficiência, o aumento da fiscalização do Ministério do Trabalho e do Ministério Público do Trabalho e as contratações sem qualquer planejamento são causa de questionamentos legais e sociais. Para garantir a função econômica da empresa e incentivar o sistema de cotas brasileiro, propõe este trabalho a adoção de medidas fiscais e previdenciárias, a criação de subsídios e a alteração na Lei n. 8.742/93, no sentido de acrescentar a previsão de uma suspensão provisória do pagamento do benefício da assistência especial, quando do início da atividade laboral de qualquer espécie, até que a pessoa com deficiência volte à inatividade. A inclusão social das pessoas com deficiência é acompanhada de uma série de questões relevantes, tratadas no trabalho, que devem ser enfrentadas pelo Estado e por toda a sociedade

The Brazilian Civil Code, published in 2002, despite the ability to relate to the constitutional system of protection of human dignity, not encompassed in its content the admission of full autonomy of persons with disabilities. Nevertheless, the Federative Republic of Brazil became a signatory to the International Treaty on the Rights of Persons with Disabilities, which promoted a paradigm shift on the focus of the concept of disability, which, of course, sparked a significant impact on the study of theories of disabilities and its corollaries. Brazilian law inclusion of people with disabilities (Law no. 13,146 - 2015), called the Disabled status, in obedience to the fundamental principles of the Convention on the Rights of Persons with Disabilities, raised transformation in the parental system of disability and, consequently, the procedural issues relating to the protection of the disabled person. The changes brought about by People with Disabilities Statute generated sequels in the Civil Law inherent institutions such as marriage and interdiction, and Civil Procedure, like the reflections in prescription and decay and the institution of the new decision-making tool supported. / Após a ratificação em 2009 por parte do Brasil da Convenção sobre os Direitos da Pessoa com Deficiência, editada em 2007, a sistemática jurídica atinente à teoria das incapacidades e seus desdobramentos sofreu modificações intensas. O Código Civil brasileiro, editado em 2002, em que pese a aptidão para se relacionar com a sistemática constitucional de proteção da dignidade da pessoa humana, não abarcou em seu conteúdo a admissão da integral autonomia das pessoas com deficiência. A despeito disso, a República Federativa do Brasil se tornou signatária do Tratado Internacional sobre os Direitos das Pessoas com Deficiência, sendo promovida uma mudança paradigmática sobre o enfoque do conceito de deficiência, o que, naturalmente, deflagrou consequências significativas no estudo das teorias das incapacidades e seus corolários. A lei brasileira de inclusão da pessoa com deficiência (Lei nº. 13.146-2015), denominada de Estatuto da Pessoa com Deficiência, em obediência aos preceitos fundamentais da Convenção sobre os Direitos das Pessoas com Deficiência, suscitou transformação no sistema pátrio de incapacidade e, por consequência, nas questões processuais relativas à proteção da pessoa com deficiência. As mudanças trazidas pelo Estatuto da Pessoa com Deficiência geraram sequelas em institutos inerentes ao Direito Civil, como o casamento e interdição, e Processual Civil, a exemplo dos reflexos na prescrição e decadência e na instituição do novo instrumento de tomada de decisão apoiada.

This reform is also known as agrarian expropriation, especially under the perspective of the consequences of collective occupation of rural property in the process of inspection or administrative assessment, or that is about to judge the respective action of agrarian expropriation. One concern that guided this study was to indicate the list of government initiatives to try to contain conflicts in the field, as well as to check to the most diverse jurisdictional understandings these incursions resulted. As theoretical support of this work, the normativity, the relevance of the principle of human dignity and of the nature protection and the centrality that the principle of social function bears in the current stage of "evolution" of parental rights were analyzed. This occurred without forgetting that there was an expansion of the content, inserted in a context of class struggle, a process of flows and inflows, advances and setbacks. We sought to accomplish an interpretation more in line with the normativity of the constitutional provisions, in view of the binding and normative force of the constitutional principles, especially of the social function of property. The intention was to resolve the apparent conflict between fundamental rights, since the balance between the respective constitutional values, aiming to achieve the right to access to land as social right, therefore, fundamental right. / O presente trabalho propõe um estudo sobre a interpretação dos dispositivos legais que constituem o novo marco normativo de um dos principais institutos jurídicos de atuação oficial alusivo à reforma agrária, que é a desapropriação por interesse social para fins de reforma agrária. Esta também é conhecida por desapropriação agrária, notadamente sob o prisma das consequências da ocupação coletiva do imóvel rural em vias de vistoria ou avaliação administrativa, ou que está por ajuizar a respectiva ação de desapropriação agrária. Uma preocupação que norteou o presente trabalho foi indicar o rol de iniciativas governamentais na tentativa de conter os conflitos no campo, bem como verificar os mais diversos entendimentos jurisdicionais que estas incursões ocasionaram. Como suporte teórico do trabalho, analisaram-se a normatividade, a relevância do princípio da dignidade da pessoa humana e da proteção à natureza e a centralidade que o princípio da função social ostenta no atual estágio de evolução do direito pátrio. Isso sem desprezar que houve uma ampliação do conteúdo, inserido num contexto de luta de classe, num processo de fluxos e influxos, avanços e retrocessos. Buscou-se realizar uma interpretação mais consentânea com a normatividade das disposições constitucionais, numa perspectiva da força vinculante e normativa dos princípios constitucionais, notadamente da função social da propriedade. A intenção foi solucionar a aparente colisão entre direitos fundamentais, a partir da ponderação entre os respectivos valores constitucionais, visando concretizar o direito ao acesso à terra como direito social, portanto, o direito fundamental.

Le concept de travail décent à l'épreuve du droit de l'Union européenne / The concept of decent work put to the test of European Union law

Le concept de travail décent a été présenté par le Directeur général du Bureau international du travail, en 1999, comme l’objectif prioritaire de l’Organisation internationale du travail permettant à chaque femme et chaque homme d’exercer une activité dans des conditions de liberté, d’équité, de sécurité et de dignité. Il regroupe quatre piliers interdépendants que sont l’emploi, la protection sociale, le dialogue social et la promotion des droits au travail. De manière inédite, l’OIT impose un cadre d’action pour tous les États membres. Evoluant en fonction des conditions socio-économiques de chaque État membre, le concept de travail décent est susceptible d’être défini localement tout en ayant un contour universel. La traduction du concept est facilitée par le biais des programmes par pays de travail décent (PPTD), relevant de la coopération technique du BIT, et des indicateurs mesurant le travail décent. Le concept apparaît alors comme un objectif de portée universelle et non comme une norme juridique. Si la coopération technique de l’OIT facilite la réalisation du travail décent, son action normative est également essentielle. L’action normative doit aussi s’orienter vers le concept de travail décent, comme le montrent la Convention du travail maritime adoptée par la Conférence internationale du travail en 2006 et la Convention n°189 concernant le travail décent des travailleurs domestiques adoptée en 2011. Toutefois, perçu comme un slogan politique pour redonner une visibilité à l’OIT, fragilisée par le contexte de la mondialisation, le concept de travail décent a été critiqué pour son caractère minimaliste et ignoré au sein de l’UE. La confrontation entre le concept de travail décent et le droit de l’Union révèle alors un paradoxe entre l’accroissement des conditions de vie et de travail indécentes au profit d’un renforcement du droit du marché du travail ainsi que du droit du marché intérieur et l’engagement de tous les États membres de l’UE d’être liés à la Déclaration de l’OIT de 1998. Pourtant, la situation économique et sociale actuelle au sein de l’Union européenne interroge sur la nécessité et la possibilité d’intégrer le concept de travail décent, qui révèle une approche particulière du travail, en droit de l’Union européenne. En effet, la réflexion sur un régime de travail réellement humain centrée sur les valeurs de justice sociale et de dignité humaine trouve tout son sens dans le contexte actuel de la gouvernance économique au sein de l’Union européenne et des mesures d’austérité envisageant le travail sous l’angle du marché et des échanges. La justice sociale dans le sens que lui a donné la Déclaration de Philadelphie de 1944 puis le concept de travail décent, c’est-à-dire celui de l’action, est aujourd’hui indispensable pour la protection des personnes et de l’environnement. La situation actuelle au sein de l’UE constitue donc un enjeu pour l’OIT dans sa capacité à imposer la traduction du concept de travail décent en droit social européen et pour l’UE elle-même. Le concept de travail décent propose des solutions pour l’action normative, il implique des exigences pour le législateur et le juge de l’UE. A l’instar de l’OIT, l’UE doit orienter son action normative vers le concept de travail décent pour renforcer la place des droits sociaux fondamentaux face aux libertés économiques. Cette nouvelle orientation nécessite alors pour l’UE de prendre appui sur les instruments de l’OIT, en particulier sur ses conventions et déclarations ainsi que sur la coopération technique prenant en compte ses spécificités. / The concept of decent work has been presented by the Director-General of the International Labour Office, in 1999, as an International Labour Organisation’s priority objective enabling every woman and man to exercise an activity in conditions of freedom, equity, security and dignity. This concept brings together four independent pillars that are employment, social protection, social dialogue, respecting, promoting and realizing the fundamental principles and rights at work. In a new way, the ILO imposes a framework of action for all Member States. Depending on the socio-economic conditions in each Member State, the concept of decent work is likely to be defined locally while having a universal outline. The translation of the concept is facilitated through Decent Work Country Programs (DWCPs) under ILO technical cooperation, and indicators measuring decent work. The concept of decent work therefore appears as an objectif of universal scope and not as a legal norm. If ILO’s technical cooperation facilitates the achievement of decent work, its normative action is also essential. Normative action must also be directed towards the concept of decent work, as reflected in the Maritime Labour Convention adopted, in 2006, by the International Labour Conference and in the Convention n° 189 concerning decent work for domestic workers adopted in 2011. The concept of decent work, seen as a political slogan to give visibility to the ILO, weakened by the contexte of globalization, was criticized for its minimalist nature and ignored within the European Union. The confrontation between the concept of decent work and the law of the European Union reveals a paradox between the increase in indecent living and working conditions in favor of a strengthening of labor market law and market law and the commitment of all EU member states to be linked to the ILO Declaration of 1998. Yet, the current economic and social situation in the European Union raises the question of the need and possibility of integrating the concept of decent work, which reveals a particular approach to work, in European Union law. Reflection on humane conditions of labour centered on the values of social justice and human dignity makes sense in the current context of economic governance in the European Union and the austerity measures considering the work from the perspective of the market and trade. Social justice in the sense given to it by the Declaration of Philadelphia of 1944 and then the concept of decent work, that is to say the principle of action, is today indispensable for the protection of people and the environment. The current situation in the EU is therefore an issue for the ILO in its own ability to impose the translation of the concept of decent work into European social law and for the EU itself. The concept of decent work proposes solutions for normative action and thus it implies requirements for the legislator and the judge of the EU. Like the ILO, the EU must direct its normative action towards the concept of decent work to strengthen the place of fundamental social rights in the face of economic freedoms. This new approach requires the EU to build on ILO’ instruments, in particular on its conventions and declarations and on technical cooperation taking into account its specificities.

Fair access to environmental justice in poor nations: case studies in Bangladesh

The thesis is about environmental values that we encounter in our everyday life. The thesis also talks about environmental justice dialogues and tensions that play in Bangladesh. The thesis, in the first place, explores how an environmental planning and resource management approach causes a particular type of environmental injustice; i.e., non-recognition of access to the decision making process of local ethnic communities, which identifies them as adivasi meaning indigenous, poses a threat to their livelihood and culture, and obstructs the process of environmental protection in Bangladesh. / The existing theories of environmental justice and four case studies conducted in Bangladesh have been used to interrogate the research findings. I argue, along with Low and Gleeson (1998) that for environmental justice, recognition of environmental needs for every entity as an ingredient of human dignity should be basis of the planning process. The research findings also suggest that , at all levels of decisions, fair access to decision, information and justice for all entities should be an integral part of environmental planning and resource management. / The thesis explores avenues for fair access to justice, meaning redress and remedy of environmental injustice, in the context of Bangladesh. I argue that capillaries of justice such as Salish, a process and institution for public interest negotiation (PIN) embedded in Bangladesh culture, can be reinvented. In addition, access to information should be a prerequisite for meaningful deliberation at all levels of decision making and dispute resolving processes.

This thesis discusses the issues of public guardianship in the current practical and legal context. It deals with human rights, the question of the limitation of incapacitation, and the conditions that must be met. I present here, what the different types of guardians are, or what are the rights and obligations of a guardian. I think about the ethical issues in conjunction with guardianship, that relate to human dignity and freedom. In conclusion, through talks I'm trying to look into practice of public guardianship and determine what problems the public guardians deal with.

Ulteriormente serão abordados os princípios da razoabilidade e da proporcionalidade, os quais se tornam imprescindíveis ao alcance de uma interpretação justa e eficaz no que tange à proteção insculpida na Lei 8.009/90. Por fim após fixarem-se as premissas necessárias à viabilização da interpretação mais adequada das normas postas sob apreço no presente passa-se a propor a relativização da impenhorabilidade dos bens de família para a satisfação de créditos trabalhistas através de parâmetros de razoabilidade e proporcionalidade na ponderação de valores conflitantes. / Salvador
