The thesis deals with the rights and human dignity protection with people suffering from dementia. The thesis examines the way in which human rights are guaranteed and safeguarded in international human rights law documents, but especially the way in which the Czech Republic approaches the problems, particularly social services which follow standards of social services. The thesis looks for an answer whether standards of social services quality are sufficient guarantee of human rights and dignity protection with persons, specifically with people suffering from dementia in the home with special regime. To find it out, there is used analysis of worked out standards of social services quality Human rights protection of particular social services provider. There are suggested possible resources leading to safeguarding of human rights and dignity protection with people suffering from dementia.

This thesis follows the insufficiently mapped-out issue of restriction in social services and investigates the ways in which it is used towards clients. First-mentioned is the evolution of social services towards its current concept. Afterwards, important terms pertaining directly to the practical issues of social services are defined, based on the social services act. The definition of restrictions and restrictive measures, in accordance with current legislation, follows and their concept is confronted with the concept of human rights and human dignity.The work concludes with descriptions of situations where the clients human rights are violated, their solutions and also possible ways how to prevent the violation of human rights in such cases.

The social values of labor and free enterprise are the foundations of the Federative Republic of Brazil. Decent work is constitutionally guaranteed human right, without any form of discrimination and able to provide life with dignity. This dignity which was raised to a guiding principle, the basic text Maximum 1988. However, discrimination in social, economic and political is as old as human history. She endures in time, in different areas, in different ways and also excludes or diminishes women in the labor market. Despite this have more years of education than men and have professional skills needed to perform the duties or function that aims remains sidelined, particularly in the private sector in its various segments, at all stages of the bond employment, from selection and recruitment even after the termination of the contract. A woman receives lower wages than men for the same work performed under the same conditions, have less opportunity to rise and career, and when the mass layoff, becomes a priority. On the other hand, never the legal framework, including the internal standards possessed so protective of women, public policy, backed by the phenomenon of constitutionalization of the principles of human dignity and non-discrimination. No embargoes, complaints, lawsuits, terms of conduct adjustment and statistical data show that gender discrimination still persists, pulsates in our society. Brazilian society can only be acclaimed egalitarian, justice, brotherhood, solidarity and free from bias as states in the preamble of the Charter Citizen of 1988, when we have no more people excluded from the labor market, due to all forms of discrimination, including gender ratio. / Os valores sociais do trabalho e da livre iniciativa são fundamentos da República Federativa do Brasil. O trabalho decente é direito humano constitucionalmente garantido, sem quaisquer formas de discriminação e capaz de propiciar vida com dignidade. Dignidade essa que foi alçada a princípio norteador, basilar no Texto Máximo de 1988. Entretanto, a discriminação nas relações sociais, econômicas e políticas é tão antiga quanto a história da humanidade. Ela perdura no tempo, nos diversos espaços, nas diversas formas e exclui ou inferioriza também a mulher no mercado de trabalho. Em que pese essa possuir mais anos de estudo do que o homem e ter qualificação profissional necessária para o exercício do cargo ou função que almeja, continua sendo preterida, particularmente no setor privado, em vários dos seus segmentos, em todas as fases do vínculo de emprego, desde a seleção e recrutamento até mesmo após o término do contrato. A mulher recebe salários inferiores aos dos homens pelo mesmo trabalho executado e nas mesmas condições, tem menos oportunidade de ascensão e promoção profissional e, quando da dispensa em massa, passa a ser prioridade. Por outro turno, jamais o arcabouço jurídico, inclusive o interno, possuiu tantas normas protetivas à mulher, de ordem pública, lastreadas no fenômeno da constitucionalização dos princípios da dignidade da pessoa humana e da não discriminação. Sem embargos, denúncias, ações judiciais, termos de ajuste de conduta e dados estatísticos demonstram que a discriminação em razão de gênero ainda persiste, pulsa em nossa sociedade. A sociedade brasileira somente poderá ser aclamada igualitária, justa, fraterna, solidária e livre de preconceitos, como enuncia no preâmbulo da Carta Cidadã de 1988, quando não mais tivermos pessoas excluídas do mercado de trabalho, em razão de quaisquer formas de discriminação, inclusive em razão de gênero.

Les fondements du droit des sépultures / Foundations of the right of burials

La sépulture est souvent appréhendée à titre d’exception ou par une superposition de notions : copropriété familiale, bien familial, chose hors commerce, indivision perpétuelle, droit réel spécial... Cette approche disparate dissimule l’existence d’un droit des sépultures qui peine, en conséquence, à constituer un droit unifié. Le droit des sépultures se trouve fractionné en plusieurs branches : droit civil, droit pénal et droit public. A travers elles, apparaissent de nombreuses problématiques, liées à la nature et au régime proposés. Pour ces raisons, il est nécessaire d’aborder le droit des sépultures par la recherche de ses fondements, inchangés depuis le droit romain et le droit médiéval. Le premier fondement est le sacré ; le second la communauté. Tous deux prennent leur source dans l’histoire du droit et continuent d’exister dans le droit positif. Ils font apparaître une unité du droit des sépultures, autour d’une double fonction : assurer la séparation du mort et du vivant et perpétuer le culte des morts. Du point de vue anthropologique, le sacré, premier fondement, se distingue du religieux, et se manifeste selon deux opérations : la délimitation d’une frontière entre sacré et profane par la séparation, puis la protection de ce nouvel espace délimité par la répression de toute atteinte. Pour les sépultures, ces deux opérations sont effectuées respectivement par l’extracommercialité et par la protection pénale. Le premier mécanisme est issu du droit romain et montre une protection originale de la sépulture ; toute activité juridique qui n’est pas incompatible avec le respect des morts est autorisée. L’autre mécanisme concerne l’incrimination de violation de sépulture, qui perpétue sa dimension sacrée. Le second fondement est communautaire : il est apparu pour les sépultures de famille avec les communautés médiévales, à une époque où les biens et les personnes étaient soudés en un groupe familial unique. Désormais adapté par l’affectation familiale, un tel fondement se maintient dans notre droit avec un régime de propriété collective, à travers la transmission successorale restreinte au groupe familial et un principe égalitaire, ce qui fait de la sépulture une véritable propriété communautaire. Bien sacré, propriété communautaire, les fondements des sépultures mettent en exergue des dimensions originales de la propriété. / Burials are often considered in terms of acceptions or superimpositions of notions: family co-ownership, family property, off-trade affairs, joint possession, specific real right… This multi-entry approach conceals the existence of a right of burial which, as a consequence, is difficult to define as a unified right. The right of burial is divided up into various branches— civil law, criminal law, public law—which rise various questions linked to the very nature if the different systems. For this reason, it is necessary to tackle the right of burial from the point of view of its foundations, which have not changed since the establishment of Roman law and Medieval law.The first founding principle concerns the sacred; the second is about the community. Both originate in legal history and are still valid in the field of positive law. They show a unity in the right of burial as regards two main functions: ensure the separation between the living and the dead and keep up the traditional practice of ancestor worship. From the anthropological viewpoint, the sacred—the first principle—distinguishes from the religious, and is expressed in two main missions: the definition of a frontier between the sacred and the profane by the separation, then the protection of this new space delineated by the suppression of any violation. For the burials, these two missions are respectively accomplished by a position out of commerce and by the criminal procedure. The first mechanism comes from Roman law and shows an original protection of the burial process; every legal activity which is not incompatible with the respect of the dead is allowed. The other mechanism concerns the incrimination of the violation of the burial process and its sacred nature. The second founding principle is about the community: it was created for family burials by medieval communities, at a time when properties and people were seen as a unique family unit. Nowadays adapted by the family affectation, such a principle is maintained in our legal system because of a collective ownership regime, through the transmission of the succession restricted to the family and an egalitarian principle, which turn burials into a property of the community. Sacred property, property of the community, the founding principles of burials bring to light specific dimensions of the concept of property.

This thesis is concerned with finding a relationship between the principles of Catholic social teaching and the written views of the Freedom and Direct Democracy - Tomio Okamura party as presented on the party's website. At the beginning of the thesis the reader is briefly introduced to individual principles of Catholic social teaching. For the purposes of this thesis five principles have been chosen which are mentioned in the Compendium of the Social Doctrine of the Church. These are the principles of human dignity, the common good, universal destination of goods, subsidiarity, and solidarity. Then the reader is acquainted with the basic views of the Freedom and Direct Democracy - Tomio Okamura party (SPD). By way of indicative research on the particular views of SPD, three topics are then formulated, which are most often mentioned by SPD. These consist of the European Union, foreign policy and migration. Comparison of these most frequently mentioned topics with Catholic social teaching and other relevant resources creates a base for further confrontation between Catholic social teaching principles and the views of SPD. A critique of sex and power within the womanist liberation theology: human dignity-relationship perspective

“The power of sex to dominate and the ability of power to obtain sex in order to dominate” is at the crux of the researchers’ investigation. The researcher problematizes the usage of power for the attainment of sexual favours. At the heart of this research is the question, what is at the root of the exploitation and “sexifying” of power by either the granter or the recipients of sexual favours. The researcher utilises various lenses in exploring the research problem. Such lenses include a social lens which zooms in at the social power possessed by men over women in society and a theological lens which zooms in on the domination of men over women in scripture. In an attempt to explore the subject at hand, the author explores the role of patriarchy, unequal opportunities between men and women and poverty as some of the primary proponents for those who offer themselves as sex objects to those in power. In most cases, it is women who are at the suffering end of poverty; it is also women who are forced to use their bodies for sex, this, therefore, means that women are doubly oppressed. Part of the socialised “sexual oppression” of women is the notion that women were created for marriage, work, labour and the pleasure of men. Anthropologically, men and women are the crown of creation and are worthy of dignity. It is, therefore, a necessity for women to reclaim their dignity. The researcher is aware of the complex nature of sex which varies from negative to positive experiences depending on the individual. In a society that views sex as a commodity and is permissive in its perception of sex, in a society that has a high rate of pornography, swinging and swapping. The researcher probes the “humanising” of sex so that it is not just a physical activity but an intimate act of love and affection. The principles for the above involves viewing sex as personal and relational; sex as exclusive and unique; sex as fruitful and productive; sex and selfless and sacrificial and an acknowledgement of sex as multi-dimensional. Though the writer comes from a religious background and is the Wesleyan tradition, though she converses with a faith community in Eersterust as part of her quantitative research; she does not evade confronting the reality of the bible as a document flawed with patriarchy, clothed in culture and set in a particular context. The author who is Wesleyan draws from this rich heritage and compares the times of John Wesley which were characterised by, “Champagne, dice or a neighbour’s spouse” to the South African context. She utilises the Wesleyan quadrilateral to draw these parallels. All these findings led the author to the conclusion that conversations, training, safe space and capacitating of those in power, those abusing power, those attracted to power must be held for the restoration of human dignity with particular reference to women. The church remains a powerful and efficient platform for the above. The Church can no longer evade her role in rectifying the damage caused by patriarchy as assumedly condoned by the bible. Denna uppsats behandlar den katolska kyrkans syn på grunden för mänskliga rättigheter och religionsfrihet. Idén om mänskliga rättigheter började ta fast form under upplysningen på 1700-talet. Vid den tiden var dock katolska kyrkans syn på de mänskliga rättigheterna inte förenlig med den sekulära uppfattningen. De demokratiska principerna och mänskliga rättigheterna, inklusive religionsfrihet, integrerades i den katolska socialdoktrinen först genom Andra Vatikankonciliet (1962–1965), även kallad Vatikan II. Syftet är dels att undersöka hur den katolska kyrkan argumenterar för mänskliga rättigheter och religionsfriheten efter Vatikan II, dels att analysera relevanta skrifter och kanoniska bestämmelser i jämförelse med FN:s Allmänna förklaring och konventioner om de mänskliga rättigheterna. Uppsatsens tes är att området mänskliga rättigheter är ett tvärvetenskapligt akademiskt fält där den katolska teologin också har relevans i diskussioner kring hur mänskliga rättigheter kan rättfärdigas. För att nå syftet används flera metoder. Genom text- och argumentanalys av skrifter från Vatikan II kan det konstateras att det finns vissa skillnader mellan den katolska kyrkans argumentation för mänskliga rättigheter och de sekulära argumenten. Analysen visar att grunden för mänskliga rättigheter och religionsfrihet enligt katolska kyrkan är den mänskliga personens värdighet. I detta avseende är Jürgen Habermas teori om människans värdighet, som ofta benämns teori om människovärde, relevant att användas som teoretiskt ramverk. En begreppsanalys gällande de kursiverade begreppen görs även i uppsatsen. Som ytterligare metoder används juridisk metod och kanonisk tolkning i rättsavsnittet.  Jag argumenterar för att katolska kyrkans människosyn ger en ökad förståelse för vad religionsfrihet innebär. Med tanke på mångfalden av religioner och traditioner i den postmoderna världen bör teologer även involveras i diskurser om religionsfriheten. Därför föreslår jag att mänskliga rättigheters dimensioner utvidgas till att ta mer hänsyn till teologiska människorättsargument. / This essay deals with the Catholic Church's view of the basis of human rights and freedom of religion. The idea of ​​human rights began to take shape during the Enlightenment in the 18th century. At the time, however, the Catholic Church's view of human rights was inconsistent with secularism. Democratic principles and human rights, including freedom of religion, were first integrated into Catholic social doctrine through the Second Vatican Council (1962–1965), also known as Vatican II. The purpose is partly to examine how the Catholic Church argues for human rights and freedom of religion after Vatican II, and partly to analyse relevant writings and canonical provisions in comparison with the UN Universal Declaration and Conventions on Human Rights. The thesis of this essay is that the field of human rights is an interdisciplinary academic field where Catholic theology also has relevance in discussions about how human rights can be justified. To achieve the purposes, several methods are used. Through a text- and argument analysis of writings from Vatican II, it can be stated that there are certain differences between the Catholic Church's arguments for human rights and the secular ones. The analysis shows that the basis of human rights and religious freedom, according to the Catholic Church, is the dignity of the human person. In this respect, Jürgen Habermas' theory of human dignity, often referred to as human worth (människovärde), is relevant to be used as a theoretical framework. A concept analysis regarding the italicized concepts is also done in the essay. As additional methods, legal method and canonical interpretation are used in the legal section. I argue that the Catholic Church's view of human beings gives a greater understanding of what freedom of religion means. Because of the diversity of religions and traditions in the postmodern world, theologians should also be involved in discourses on freedom of religion. Therefore, I propose that dimensions of the human rights be extended to take more account of theological human rights arguments.

In this thesis, I have studied the United Nations concluding observations on Sweden in relation to international human rights obligations. Specifically, in regards to the International Convention on the Elimination of All Forms of Racial Discrimination (ICERD) and the Convention on the Rights of the Child (CRC).  The Committee on the Rights of the Child have, in their Concluding Observations from 2023, expressed a deep concern about continued racism and discrimination of many children in Sweden. Meanwhile, the Committee on the Elimination of Racial Discrimination has recommended Sweden to take immediate measures for the purpose of eliminating all forms of racial discrimination.  In terms of critical analysis, the aim of this thesis has been to study how the Swedish state's international human rights obligations for the purpose of eliminating racial discrimination relates to the implementation of children's rights according to the principle of non-discrimination. According to my study, it is necessary for the Swedish state to promote and respect the human dignity inherent in every child, to be able to guarantee every child within the jurisdiction the rights under the CRC. A central example is the child's right to education in alignment with general human rights principles. Therefore, it is required for the state to prevent the normalization of racism in Sweden, in accordance with the international human rights obligations under the ICERD. This includes, for example, the prohibition of racist organizations in national law, for the purpose of eliminating racist hate speech, and the elimination of racial profiling by national law enforcement. Many children's living conditions and access to the rights under the CRC are affected by racism in several ways, through structural and everyday racism, when they themselves are exposed to racism and when people in their close surroundings experience racism. This has led me to the conclusion that active and immediate measures by the Swedish state, for the purpose of eliminating racial discrimination, are necessary for the possibility of guaranteeing the children who are victims of racism their rights in alignment with the CRC.
