Evaluation of the international law regarding humanitarian intervention in human rights abuses not breaching international peace and security

Thesis (LLM)--Stellenbosch University,2004. / ENGLISH ABSTRACT: This study exammes, m stages of development, the existing law regarding humanitarian intervention, problems in respect of this law and cases of intervention. More specifically, intervention in human rights abuses not breaching international peace and security but rather posing a so-called threat to peace is examined. This information is used to consider whether more adequate provision can be made regarding circumstances of intervention to stop situations of grave human rights abuses sooner. From the law regarding humanitarian intervention, it is evident that the institution of intervention is illegal under the present UN legal system. Yet, in a time when the human rights culture has become so important that it forms part of the basis of international law, effective intervention is not being authorised by the Security Council. As a result, other actors have been intervening in cases of grave human rights abuses. These interventions need to be appropriate and well managed. Since the protection of human rights is as valid in non-democracies, as in any democratic state form, the study finds that human rights will benefit from dependence on legitimate authority. Attributing more importance to the Uniting for Peace Resolution could expand the role of the General Assembly. Humanitarian intervention also needs to be coupled with a commitment to address the causes of human rights abuses through conflict resolution and social reconstruction. The study concludes with some criteria/guidelines for the establishment of the legitimacy of intervention. / AFRIKAANSE OPSOMMING: Hierdie studie is - binne 'n raamwerk van ontwikkelingstydperke - 'n ondersoek na die bestaande reg aangaande humanitêre ingryping, probleme tenopsigte daarvan en gevalle van ingryping. Veral ingrypings in menseregte-skendings wat nie internasionale vrede en sekuriteit skend nie, maar eerder 'n sogenaamde bedreiging vir vrede is, word ondersoek. Die inligting wat so bekom is, word gebruik om te oordeel of meer gepaste voorsiening gemaak kan word waarvolgens situasies van growwe menseregte-skendings deur ingryping gouer beëindig kan word. Die reg aangaande humanitêre ingryping toon dat ingryping onwettig is in die bestaande regsisteem van die Verenigde Nasies. In 'n tyd waarin menseregte so belangrik geword het dat dit ten grondslag lê van internasionale reg, word effektiewe ingrypings nogtans nie gemagtig deur die Veiligheidsraad nie. Gevolglik gryp ander partye in om teen situasies van growwe menseregte-skendings op te tree. Hierdie ingrypings moet daarom gepas wees en goed bestuur word. Aangesien die beskerming van menseregte net so geldig is in ander staatsvorms as in demokrasieë, bevind die studie dat menseregte sal baat daarby indien dit afhanklik is van legitieme gesag. Voorts kan die rol van die Algemene Vergadering aangaande die beskerming van menseregte uitgebrei word deur groter waarde te heg aan die "Uniting for Peace"-resolusie. Dit is verder nodig dat humanitêre ingryping gekoppel word aan 'n verbintenis om die oorsake van menseregteskendings aan te pak deur konflik-resolusie en sosiale heropbou. An exploration into managerial perception and its influence on performance in cross cultural setting : the case of Japan International Cooperation Agency's support for development

There is a wealth of studies which suggest that manager's positive perceptions/expectations can considerably influence organisational performance; unfortunately, little empirical evidence has been obtained from development studies. This first time research explores how Japanese aid workers' perceptions towards the local staff affects their behaviour and performance in cross-cultural project settings. Moreover, this research focuses on the perceptual and behavioural trait differences of successful and unsuccessful aid workers. With cooperation from Japan International Cooperation Agency (JICA), 244 valid responses were obtained from the aid workers (managers) through a webbased survey. As a result of statistical analysis, positive causal relationships were confirmed between perception related factors and behaviour related factors and the organisational performance variable. These results strongly suggest that aid worker's positive perceptions result in positive behaviour in local colleagues and subsequently higher organisational performance. In addition, it was discovered that the aid workers' positive perception/expectation about work and their local colleagues was related to higher organisational performance, whilst conversely, the negative perception on their part was generally associated with negative behaviour and lower organisational performance.Although the differences in perceptual tendencies suggested by that these findings apply to Japanese aid managers; however, as human nature is universal, positive perception and behaviour should bring out positive output in most organisations. It is recommended that there is a need for people-related and cross-cultural management skills to ensure successful future activities, and stress management competencies to maintain positive managerial perception on the part of aid workers.

The aim of this research is to highlight both the conceptual and practical factors that constrain attempts to link humanitarian assistance and development aid in political emergencies in Southern Africa by using the case study of Mozambique in the period between 1975-1995. Extensive use and reference to Norwegian relief and development aid during the above-mentioned period is made. Although cross-reference is made to other donor countries such as the Like-minded Group (comprising of Canada, Sweden, Denmark, Finland, the Netherlands, Norway and Switzerland) and UN agencies that supported Mozambique's transition from war to peace, the major focus is on Norway as she has traditionally been the sixth largest bilateral donor by the early 1990's and incorporated long-term development priorities in her programs.

Chaque année, quelques milliers de jeunes Québécois découvrent la coopération internationale, par le biais de stages dans des pays dits « en développement ». Si les retombées de ces stages sur les populations partenaires du Sud sont connues et régulièrement évaluées, il existe en revanche peu d'études de suivi des stagiaires à leur retour au Québec. Quel impact cette expérience a-t-elle eu sur ces jeunes? Quelles étaient leurs motivations au départ? Et comment leur engagement vis-à-vis des problématiques de développement a-t-il évolué ou s’est-il même maintenu suite à leur séjour? Comment leur expérience a-t-elle façonné leurs projets professionnels et leurs perceptions de l’avenir? Ce mémoire a pour objet de dresser un portrait de l’impact d’un stage de coopération internationale sur les jeunes stagiaires de retour au Québec. Pour ce faire, notre recherche s’appuie sur des données quantitatives et qualitatives recueillies auprès d’anciens stagiaires de l’ONG Mer et Monde. Les données quantitatives ont été collectées à l’aide d’un sondage effectué auprès de 367 anciens stagiaires et un entretien de groupe a fourni les bases qualitatives de la recherche. Les résultats de l’analyse suggèrent que le stage a très certainement une forte influence sur l’engagement et le mode de vie des jeunes à leur retour au Québec. À la suite de l’expérience à l’étranger, l’identité des enquêtés est notamment affectée par rapport à six aspects : l’ouverture sur le monde, la conscience écologique, la conscience sociale, le développement personnel, le rapport à l’« Autre », et les représentations de l’« Ailleurs ». Il apparait que ce sont tout autant les habitudes de vie, que le regard que les stagiaires portent sur le monde, qui se sont trouvés affectés. Et la spécificité d’une telle expérience et les processus à l’œuvre nous permettent d’assimiler ce type de stage à une expérience de développement du cosmopolitisme et de la conscientisation des jeunes Québécois. / Each year, several thousand young Quebecers discover International Cooperation, through internships in countries known as "developing." What impact did this experience have on these people? What were their motivations to start? And how has their commitment toward development issues changed? Did it even continue after their stay overseas? How has the experience shaped their professional projects and their perceptions of the future? This thesis main object is to picture the impact of international cooperation internships on young people when they return home. Our research is based on quantitative and qualitative data collected from alumni of the NGO Mer et Monde. Quantitative data were collected using a survey of 367 alumni, and a group interview provided the basis for the qualitative investigation. The results of the analysis suggest that the experience overseas has definitely a strong influence on the commitment and lifestyle of young people on their return to Quebec. Following the experience abroad, the identity of the respondents is particularly affected over six aspects: their openness to the world, their environmental awareness, their social consciousness, their personal development, their relationships to the "Others" and their representations of the "Elsewhere". It appears that it is as much the lifestyle, as the relationships and the ways of thinking that evolve through the internship. And the specificity of such an experience and the processes at work allow us to assimilate this type of internship with an experience of cosmopolitanism and awareness-raising of young Quebecers.

Resume in English Name of the thesis: "FATCA" and its projection into the Czech legal system Foreign Account Tax Compliance Act (alias FATCA), the law of the United States, is currently being much discussed topic not even in the Czech Republic, but within the European Union and also globally, as many developed countries are forced to implement its ideas due to their fear of possible sanctions from the USA. The purpose of this act is more efficient fight against the tax evasion of American taxpayers. Along with the adoption of this law the expert community has started to deal with possible issues related to its obeying by foreign entities. Czech Republic has decided to respond to this situation by concluding an intergovernmental agreement with the US government and by adoption of implementing statute to this agreement to avoid any conflicts. This diploma thesis tries to describe the actual status of the fight against tax evasion in the Czech Republic and the United States of America, but also at the international level, as well as to point out the most important definitions of FATCA and to analyze the associated issues. Organised hypocrisy? African union and the international criminal court

Submitted in partial fulfilment of the requirements for the degree of Master of International Relations in the Faculty of Humanities Department of International Relations, 2016 / A feud between the African Union (AU) and the International Criminal Court (ICC) has been dragging for a while now. The indictment of President Omar Hassan Ahmad alBashir of Sudan and President Uhuru Kenyatta and his deputy president William Ruto in Kenya altered the cosy relations between the two organisations. Firstly, the AU contends that the ICC cannot prosecute heads of states that have immunity under international law. Secondly, the ICC disturbs the ongoing peace processes with its investigations. The AU accused the ICC of selecting African states for prosecution; as a protracted form of imperialism by prevailing western powers. Withstanding, some of the AU member states that are party to the ICC have willingly signed up to its jurisdiction. Besides, the AU’s founding documents support the fight against grave atrocities. Nonetheless, the AU has failed dismally to live up to the principles it endorses- which tantamount to hypocrisy. The contradictory rhetoric of the AU towards the ICC is not exclusive to the AU, but to international organisations due to conflicting pressures in external environments. The paper explains this empirical phenomenon by applying Organised Hypocrisy (OH) to capture such contradictory behaviour prone to international organisations. / XL2018

La facilité de communication et de télécommunication a pour corollaire l'accroissement de la criminalité et plus particulièrement de la criminalité internationale. On peut se poser la question de savoir si le droit camerounais répond aux exigences de la mondialisation en matière de lutte contre la criminalité internationale. Le constat peut en premier lieu se décliner en un sentiment de satisfaction en ce qui concerne les normes internes de lutte contre la criminalité, qui ont une incidence sur la sphère internationale. Ensuite, il est décevant en ce qui concerne l'intégration des normes d'incrimination des infractions internationales par nature et des modalités de collaboration avec les juridictions pénales internationales, d'où la nécessité de l'amélioration de la législation pénale camerounaise. / The development of communication and telecommunication has as a corollary the increase in crimes and in particular international crimes. The question may there for be raised whether Cameroonian penal law responses to the exigencies of the world in the fight against international criminality. A close examination of the above question reveals that at first sight, it seems satisfactory as regards internal norms for fight against crime, which in certain circumstances have an incident on the international atmosphere. On the other sight, it is not satisfactory because international offences by their nature have been simply ignored in Cameroonian criminal law. The state of Cameroon is not in the mode to cooperate with this jurisdiction. There is the need for reforms to ameliorate the penal legislation of the country.

La coopération décentralisée, brique de l’Aide publique au développement et action extérieure des collectivités territoriales, existe légalement depuis 1992. L’intérêt pour la thématique "eau et assainissement" ainsi que pour les pays de la Méditerranée, nous a amené à mener notre recherche dans les Territoires palestiniens, territoires souffrant du manque d’eau. Ces actions de coopération nécessitent une coordination des parties prenantes sur le territoire partenaire. C’est cette coordination que questionne cette recherche. Pour cela les enjeux de la coopération décentralisée ont été comparés entre la littérature et le terrain, ce qui nous a permis de nous intéresser plus particulièrement à l’enjeu du transfert de connaissances. En effet, les actions de formation ont une part de plus en plus importante dans les projets de coopération décentralisée, du fait notamment des difficultés financières des collectivités territoriales. La littérature du transfert inter-organisationnel a aussi été mobilisée lors de cette recherche. Nous sommes ensuite revenus sur les différentes pratiques managériales liées à la gestion de projet, au suivi de projet, à la mise en place de consultations publiques, etc. Nous avons pu voir que la communication publique était peu existante et que d’autres difficultés existaient comme la gestion du turn-over. Nous avons souhaité comprendre quels pouvaient être les impacts liés à cela, ainsi que les solutions envisageables. Lorsque nous nous sommes intéressés aux difficultés, la coordination des parties prenantes est apparue comme primordiale à améliorer / Decentralized cooperation projects, an aspect of the development aid and external action of local authorities, has legally existed since 1992. Simultaneous interest in water and sanitation issues and in Mediterranean countries motivated us to focus our research in the Palestinian Territories, many of which suffer of a lack of water. These cooperative actions require a coordination of the stakeholders on the partner territory. This research questions the efficacy of these coordinated efforts applied to the water and sanitation field. Herein, issues of decentralized cooperation have been compared between the literature and a field study, which allowed us to focus more particularly on the issue of knowledge transfer. Indeed, training accounted for an increasingly important share of decentralized cooperation projects, due in particular to financial difficulties of local authorities. This is why we focused on knowledge transfer’s literature, inter-organizational transfer actually as it does not meet the same difficulties as private organizations (with holding information, power games, an unstable relationship, etc.) but conversely it is rarely assessed and thus warrants investigation. We also followed up on the different management practices related to project management : project monitoring, implementation of public consultations, etc. We found that public communication is scarce and found others difficulties such as frequent management turnovers. We wished to understand the impact of frequent turnover and solutions to the problems they may create
