Positive Administrative Control: A Construct for Assessing Managerial Influences on Rates of Misconduct in Prison

abstract: The most prominent theories for explaining the incidence and prevalence of misconduct in prison are deprivation (Clemmer, 1940; Sykes, 1958; Colvin, 1992), importation (Irwin and Cressey, 1962; Harer and Steffensmeier, 1996; Cao Zhao, and Van Dine, 1997), and administrative control (DiIulio, 1987; Useem and Kimball, 1989; Useem and Reisig, 1999). Administrative control does not supersede deprivation and importation theories, but rather adds to them by asserting quality management is essential for the maintenance of an orderly environment jeopardized by the effects of deprivation and importation. Even though research has supported administrative control, researchers have disagreed over which aspects of management are most effective for mitigating disorder, and have thus far only proven that poor management leads to administrative breakdowns in policies and practices that predicate disorder. This dissertation introduces the concept of positive administrative control, based on social exchange theory, as the mechanism prison administrators should use to induce staff to act in accordance with agency desires and avoid administrative breakdowns. The results show that when prison employees experience quality relationships with their supervisors, they are more likely engage with inmates in a similar fashion, which is associated with reductions in misconduct rates. At the same time, when prison employees are supported and rewarded for their good behavior, they are more likely to actively monitor inmates, which is associated with increases in misconduct rates. Additionally, the results support importation theory by demonstrating that the aggregated criminogenic characteristics of inmates in a prison are representative of cultural influences on prison misconduct. Based on these findings, recommendations are made to restructure leadership training to emphasize relational leadership skills that positively influence staff to act in accordance with agency desires and more closely follow policy guidelines. It is also recommended that future studies consider including aggregated demographic variables in studies of misconduct in order to capture cultural/environmental influences that may otherwise be missed, and should avoid overuse of composite variables, in particular institution security level. / Dissertation/Thesis / Doctoral Dissertation Criminology and Criminal Justice 2015

Demonstra- que, embora o discurso jurídico-penal afirme que uma das finalidades da pena privativa de liberdade é reinserir o condenado na sociedade, após o cumprimento de sua pena, esse desiderato não é efetivamente alcançado e o discurso resta deslegitimado, sendo que o trabalho prisional não mostra-se capaz de inverter essa lógica. Sustenta-se, ainda, na tese, que, a prisão, estigmatiza, prisoniza, degrada, produz e reproduz a criminalidade, destinando-se a um segmento determinado dentro da sociedade, representado pelos miseráveis, ou consumidores, falhos, que não habilitando-os ao trabalho quando egressos do sistema prisional. O nascimento da prisão, o modo como estruturou-se associada ao trabalho, a apropriação que o Direito fez dessa instituição, e a sua prevalência, enquanto punição na atualidade, premissas necessárias, a compreensão deste complexo fenômeno. / The analysis identified the relationship between arrest, prison labor and re-socialisation. Consist in the main question developed into this work. For the purposes of its argument, although the legal-criminal speech affirms that one of the aim in punishment without freedom is reinsert the convict into society, after fulfiled the terms of your penalty, this desideratum is effectively not reached and the speech not remains legitimate, being that prison labor does not show itself capable of reversing this logic. During the narrative, the arrest destining itself to definitive segment of the society, represented for the villains, or consumers defective, is unable to re-socialize, creates a stigma, excludes from society, debases social coexistence, in addition to producing and reproducing crime, who are not qualified to work when they leave the prison system. These thesis evaluate the birth of the arrest, the way as it was structuralized, the Laws appropriation of this institution and its prevalence, just similar to punishment in the present time.

A escola por trás dos muros da prisão: percepções de alunos detentos sobre educação, religião e vida cotidiana / School behind prisons walls: the perception of inmate-students about education, religion and everyday life

Este estudo procura compreender como os detentos elaboram a vida cotidiana na prisão e, em que medida o acesso aos dispositivos da educação e da religião disponíveis no cárcere podem contribuir para a reintegração social do indivíduo recluso. A pesquisa foi desenvolvida na perspectiva de que a população carcerária é constituída majoritariamente de pessoas marcadas pela vulnerabilidade social e que não tiveram acesso aos direitos fundamentais ao exercício da cidadania. Para estes indivíduos, o espaço escolar é percebido como espaço de sociabilidade e também de oportunidade de mudança, uma vez que, possibilita vislumbrar caminhos alternativos à vida criminal. As observações foram realizadas em quatro escolas localizadas em unidades prisionais do Rio de Janeiro. Trata-se de um estudo de caráter etnográfico que utiliza a narrativa dos presidiários sobre educação e religião como recurso metodológico. Através de depoimentos e entrevistas, procura identificar experiências que produziram significados no contexto das escolas existentes no interior das prisões e que revelam formas de elaboração da vida cotidiana pelos alunos detentos. / This studys intention is to understand how inmates elaborate their everyday life in prison and to what extend education and religion available prisons facilities can contribute to the social re-education of these incarcerated persons. The research have been conducted under the perspective that the prison population is manly composed by persons who have been marked by social vulnerability and not given the access to the fundamental rights and citizenship. For those persons, the prison school is seen as a place of sociability and as an opportunity of change as well, once it portrays alternative ways to criminal life. The observation was done in four different schools locate in prisons units in Rio de Janeiro. This paper has an ethnographic perspective that uses prisoners narratives about education and religion as a methodological resource. Thru testimonies and interviews it seeks to indentify experiences that have produced meaning and reveal ways to elaborate everyday life by the inmate-students in the context of the schools inside the prison system.

To make a survey of this issue qualitative approach was chosen, using the method of semi-standardized interviews by Diocesan charity in České Budějovice. 6 female volunteers, who are active pen pals with prisoners, took part in the research. The coordinator of this project was also interviewed to get general view of this issue. The objective of the thesis was to find out how is the project Prison correspondence being developed in Czech prisons. Another objective was to find out how female volunteers view the risks associated with participation in the project.

Cette recherche, menée dans le cadre d'un doctorat de sociologie sous la direction de Philippe Combessie, repose principalement sur une enquête de 24 mois dans des ateliers de création artistique installés dans la maison d’arrêt pour hommes du centre pénitentiaire de Marseille, que nous avons conjuguée à une enquête de 13 mois dans le centre éducatif fermé de Montfavet. Le travail engagé a surtout reposé sur la volonté d'examiner le maillage entre art, prison et société, considérant finalement que l'enfermement le plus visible pouvait, quand il devenait le point central d'une expérience artistique de collaboration entre le dedans et le dehors, permettre de mener une réflexion sur d'autres types de cloisonnements à l’oeuvre dans la société. Prenant appui sur un dispositif de création collaborative, développé avec des groupes de participants incarcérés et de la société civile, nous nous sommes questionnée sur son sens, ses fonctions, ses effets, à trois niveaux : individuel, institutionnel et sociétal. Nous avons envisagé cette action artistique comme un terrain d’expérimentation de transformations multiples et avons élaboré comme point d’appui conceptuel la notion de triple inertie. Il nous fallait alors tenter une analyse qui ne compartimente pas les impacts en fonction des différents champs de répercussion, s'appuyant sur une perspective d'analyse des agencements préexistants et des réagencements produits. C'est ainsi qu'a émergé une problématique centrale, constituant une armature pour structurer l'ensemble des questions que nous souhaitions abordées dans ce travail, et qui peut ainsi se formuler : en quoi l'expérience artistique collaborative en prison, dans une dynamique transformative, constitue une mise en mouvement et un dépassement des inerties et frontières carcérales à trois niveaux indissociables, individuel, institutionnel et sociétal? / This research, led for the purpose of a PhD in sociology under the supervision of Philippe Combessie, is based on a 24 months long study in the artistic experience workshops set up inside the Marseille correctional institution, combined with a 13 months study in Montfavet’s closed educative center. The work that has been undertaken rested upon the ability to examine the links between, art, prison and society, arguing that the most visible imprisonment can, when it becomes the central point of an artistic experience of collaboration between the inside and the outside, give the possibility to think of new forms of confinement at work in society. This project was developed according to an apparatus of collaborative creation established with various groups of participants that were either in custody or coming from civil society. Its meaning, its functions, and its effects, were questioned on three levels: individual, institutional, and societal. This artistic action came about as a space of experimentation for various transformations and gave the possibility to coin the notion of triple inertia, hereby used as conceptual tool. It was important to bring about an analysis that did not divide the impacts in terms of the various fields of repercussion, and instead, relied on an analysis of both pre-existing layouts, and the new forms of layouts produced. That is how the central issue emerged, becoming the framework that would structure the totality of the questions that were to be discussed in this work, and that can be stipulated as such: How does the collaborative artistic experience in prison, through a transformative dynamic, constitute a movement as well as an overcoming of inertias and prison frontiers on three inseparable levels, individual, institutional and societal.

Trabalho em cadeia - uma análise do cotidiano de trabalho dos agentes de segurança penitenciária no estado de Minas Gerais / Chain work - an analysis of the everyday work of prison guards in the state of Minas Gerais

Este trabalho investigou a relação entre construção da subjetividade e condições de trabalho, realizando um estudo junto aos agentes de segurança penitenciária do estado de Minas Gerais. A pesquisa foi desenvolvida junto a agentes de segurança penitenciária do estado que trabalham ou trabalharam em algumas das unidades mineiras, através de conversas sobre o trabalho e também acompanhando as atividades destes profissionais em uma das unidades do estado. O trabalho traz uma melhor compreensão do papel das prisões na manutenção da desigualdade social e qual o impacto disto para os agentes de segurança penitenciária que passam a se aperceber como parte desta engrenagem. E ainda se apercebem diante das mesmas condições que os presos, tanto socialmente, fora das unidades, como dentro das unidades em seu momento de trabalho. Todas as contradições encontradas ao longo de trabalho trazem desdobramento para a vida dos agentes de segurança penitenciária e estão analisadas no texto. A pesquisa apontou que não só os detentos sofrem com as condições precárias de aprisionamento no Brasil, mas também os agentes que ali trabalham e que não há pequenas alterações possíveis no cotidiano que sejam capazes de transformar esta realidade a fim de minimizar seu impacto subjetivo. O único horizonte vislumbrado para a transformação deste ambiente insalubre de sofrimento é a sua extinção e este trabalho pretendeu contribuir para a construção de argumentos a este favor / This study investigated the relationship between construction of subjectivity and working conditions, conducting a study with the prison guards in the state of Minas Gerais. The research was conducted with the prison guards of the state who work or have worked in some of the local units, through conversations about work and following the activities of these professionals in one of the penitentiaries. The work brings a better understanding of the role of prisons in maintaining social inequality and what the impact of this for prison guards who come realize themselves as part of this gear. They realize that they are on the same conditions as the prisoners, both socially, outside the units, as within the units at the time of work. All the contradictions found at this workplace have a subjective impact in those workers and them are analyzed in the text. The survey showed that not only the inmates suffer from the poor conditions of imprisonment in Brazil, but also the agents who work there and that there is little potential changes in daily life that are able to transform this reality in order to minimize its subjective impact. The only glimpsed horizon for the transformation of this unhealthy environment of suffering is its extinction and this work aims to contribute to the construction of arguments in this favor

A capitalização do tempo social na prisão : a remição no contexto das lutas de temporalização na pena privativa de liberdade

O trabalho identifica e analisa a relação entre prisão e tempo, a partir das perspectivas dos agentes sociais envolvidos nos contextos penitenciários – Juízes, Administradores de estabelecimentos carcerários e Presos. Os dados coletados, os quais têm como eixo o instituto da remição da pena privativa de liberdade, identificam as dinâmicas e estratégias de capitalização do tempo prisional e da disciplina dos apenados. A pesquisa permite uma percepção mais crítica da complexidade dos ambientes carcerários, desvelando dinâmicas de temporalização – experiência e sensação social do tempo – que estão inseridas num contexto permeado por conflitos e estratégias de dominação entre os agentes sociais e no qual se identificam processos compatíveis com uma noção de campo (no sentido Bourdieusiano) e seu correlato jogo. / This paper work identifies and analyzes the relationship between prison and time, from the perspectives of the social agents' involved in the penitentiary contexts - Judges, prison establishments administrators and prisoners. The collected data, which have as axis the institute of the redemption of the private penalty of freedom, identifies the dynamics and strategies of capitalization of the detention time and the discipline of the prisoners. The research allows a more critic perception of the complexity of the prison atmospheres, revealing temporary dynamics - experience and social time sensation - that are inserted in a conflicts permeated context and domination strategies among social agents which identify suitable processes with a field notion (in the sense Bourdieusiano) and its correlates game.

A finalidade desta pesquisa foi estudar os aspectos socioculturais de um ambiente penitenciário, que podem influenciar o ensino e a prática de atividades físicas coletivas (AFC) por mulheres presas identificadas como os outros, conforme interpretações de referências teóricas dos Estudos Culturais. Dentre os objetivos específicos pretendíamos identificar as motivações para a prática de AFC; avaliar e monitorar os possíveis efeitos da prática de AFC e investigar evidências sobre a ocorrência de aprendizagem significativa, por meio da análise de mapas conceituais e textos dissertativos criados pelas próprias mulheres presas. As análises dos resultados obtidos indicaram que o estudo das motivações para a prática de AFC foi importante para desenvolver atividades físicas que correspondessem às expectativas das mulheres presas, como os Jogos Cooperativos, que incentivaram a participação e evitaram desistências. O uso do questionário DALDA permitiu a identificação e monitoramento semanal de fontes e sintomas de estresse, além de motivar a reflexão crítica das mulheres presas sobre os seus hábitos cotidianos no ambiente cultural penitenciário. A avaliação da percepção subjetiva de esforço (PSE) possibilitou o monitoramento de intensidade das sessões de AFC. Assim, ambos os métodos contribuíram para a promoção de saúde e qualidade de vidas das mulheres presas. Todos esses procedimentos vivenciados ativamente pelas mulheres presas proporcionaram processos de diferenciação progressiva e reconciliação integradora, que foram evidenciados em mapas conceituais e textos dissertativos, indicando a ocorrência de aprendizagem significativa em alguns casos. Os métodos e procedimentos utilizados nesta pesquisa foram eficientes e pouco invasivos para à privacidade e integridade das mulheres presas. Portanto, podem ser recomendadas para a elaboração programas educacionais de intervenção em saúde pública, por profissionais da área da saúde e de atividades físicas. / The goal of this research was to study the social and cultural aspects of a prison environment, which may influence the teaching and practice of collective physical activities (CPA) by women prisoners identified as \"others\" as interpretations of theoretical references of Cultural Studies. Among the specific objectives intended to identify the motivations for the practice of CPA, evaluate and monitor the possible effects of the practice of CPA and investigate evidence for the occurrence of significant learning, through the analysis of concept maps and texts created by women prisoners themselves. The analysis of the results indicated that: a) the study of the motivations for the practice of CPA was important to develop physical activities that correspond to the expectations of women prisoners, as Cooperative Games that encouraged participation and avoided dropouts. The use of the DALDA questionnaire allowed identification and weekly monitoring of sources and symptoms of stress and motivate critical reflection of women prisoners about their daily habits the cultural prison. The evaluation of ratings of perceived exertion (RPE) allowed the monitoring intensity of sessions CPA. Thus, both methods have contributed to the promotion of health and quality of lives of women prisoners. All these procedures experienced by women prisoners actively provided progressive differentiation processes and integrative reconciliation, which were found in conceptual maps and texts, indicating the occurrence of significant learning in some cases. The methods and procedures used in this research were effective and less invasive to the privacy and integrity of women prisoners. Therefore, can be recommended for the development of educational programs in public health intervention, by professionals in the health and physical activity.

The general objective of the reseach was discuss the prison institution and it's porosity, using as exemple the language of the internal, that is, the use and the non use of different forms of comunication, action where we can observe the relation that each internal has with the prison institution and between them. It was possible to observe a relation between the use and non use of certain forms of comunication among the internals and how they stand front of the institutionalization. The importance of this work is evidenced, considering the statistical data. Currently, Brasil has six times the amount of imprisoned of the end of 80's decade, owning the fifth largest female imprisoned population. The research was produced from the bibliographical revision about the theme, analysis of disponibilized data by the administration of the prison ant the realization of direct observation in CRESF for approximately one year. With the research was possible to evidence that the total institution, concept defended by Erving Goffman, presents porosity in the case fo the referenced female prison. In this sense, affirms that doesn't have a mortification of the "me" in a homogeneous way that reach all the internals. The use or non-use of the language elaborated by the internals reveals the diversity existent and the relation that each internal has with the institution, how some consider the prison a place or a non-place. / A presente dissertação expõe os resultados da pesquisa realizada no Centro de Reintegração Social Feminino na cidade de Foz do Iguaçu (CRESF). O objetivo geral da pesquisa foi discutir a instituição prisional e suas porosidades, usando como exemplo a linguagem das internas, ou seja, o uso e o não uso de diferentes formas de comunicação, ação que podemos observar a relação que cada interna possui com a instituição prisional e entre elas. Foi possível observar uma relação entre o uso e o não uso de certas formas de comunicação entre as internas e como se posicionam diante da institucionalização. A importância deste trabalho é evidenciada considerando os dados estatísticos. Atualmente, o Brasil possui o sêxtuplo da quantidade de encarcerados do final da década de 1980, possuindo a quinta maior população carcerária feminina do mundo. A pesquisa foi produzida a partir da revisão bibliográfica sobre o tema, análise dos dados disponibilizados pela administração da prisão e a realização da observação direta no CRESF por aproximadamente um ano. Com a pesquisa pôde-se evidenciar que a instituição total, conceito defendido por Erving Goffman, apresenta porosidades no caso da prisão feminina referenciada. Nesse sentido, afirma-se que não há uma mortificação do eu de uma forma homogênea e que atinge a todas as internas. O uso ou não-uso da linguagem elaborada pelas internas demonstra a diversidade existente e a relação que cada interna possui com a instituição, como algumas consideram a prisão um lugar ou um não-lugar.

Esta tese analisa quatro livros publicados entre 2000 e 2001, quando foi lançado um grande número de livros escritos por homens encarcerados: Diário de um detento, de Jocenir, Sobrevivente André du Rap (do Massacre do Carandiru), de André du Rap e Bruno Zeni, Memórias de um sobrevivente, de Luiz Alberto Mendes, e Vidas do Carandiru, de Humberto Rodrigues. Sustento que a disposição material desses livros e o modo como a matéria narrativa é enformada sejam indícios de que as narrativas do cárcere brasileiro tragam as marcas dos modos de sociabilidade daquele ambiente, em que se reconhece a condição de preso, mas se almeja o estatuto de escritor. / This work analyses four books published between 2000 and 2001, when there was a boom of prisoners narratives: Diário de um detento, by Jocenir, Sobrevivente André du Rap (do Massacre do Carandiru), by André du Rap and Bruno Zeni, Memórias de um sobrevivente, by Luiz Alberto Mendes, and Vidas do Carandiru, by Humberto Rodrigues. I argue that the material disposition of these books and the way the narrative substance is constructed are signs that the narratives from Brazilian prisons carry marks of the sociability of that environment, in which one acknowledges the condition of prisoner, but also aims at a writer status.
