Previous issue date: 2011-04-26 / This work, focusing on the financing of Social Security, intends
to conduct three checks: first, the existence of deviations in the application of
the funds raised for this financing, including from a formulation of one concept
of deviation. Second, to examine potential imbalances produced by these
possible deviations, from the perspective of Systems Theory, using, in addition,
terminology from Communicational Theory. And third, to probe the possibility
of complementary application of Chaos Theory to the problem of deviations, if
found. The overall result of these investigations, through the dialecticalempirical
method, will contribute to the perception of the importance of
compliance with the constitutional application of resources to finance the Social
Security / Este trabalho, focalizando o custeio da Seguridade Social,
pretende realizar três verificações: a primeira, a existência ou não de desvios na
aplicação dos recursos arrecadados para este financiamento, inclusive a partir da
formulação de um conceito de desvio. A segunda, examinar os desequilíbrios
que esses possíveis desvios produziriam, sob a ótica da Teoria dos Sistemas,
utilizando-se, em adição, terminologia própria da Teoria Comunicacional. E a
terceira, perscrutar a possibilidade de aplicação complementar da Teoria do
Caos à problemática dos desvios eventualmente encontrados. O resultado global
destas investigações, por meio do método empírico-dialético, deverá colaborar
para a percepção da importância do cumprimento constitucional da aplicação

Previous issue date: 2012-11-28 / This paper aims at tracing the connection between sickness-assistance and
disability retirement with the provision pension and rehabilitation and the
professional qualification. The goal is to show that if there was a program of
rehabilitation and professional habilitation and if it were applied to the
policyholders apart for disability, besides these ones have a chance of
qualifying to another profession, the INSS would no longer afford the benefits
and raise again with social contributions by the policyholders return to work, as
well as rescuing the principle of human dignity for the worker being rehabilitated
and professionally qualified.
Therefore, the effectiveness of rehabilitation programs and professional
qualification would make INSS to have great savings for failing to pay benefits,
and also to start receiving social security contributions, and mainly, would
guarantee the policyholders the right to return to working life, preserving, as a
consequence, their human dignity / O presente trabalho tem como objetivo traçar a ligação entre o auxílio-doença e
a aposentadoria por invalidez com a prestação previdenciária reabilitação e a
habilitação profissional. Tem-se como meta demonstrar que se existisse o
programa de reabilitação e habilitação profissional e se o mesmo fosse
aplicado aos segurados afastados por incapacidade, além destes terem a
chance da qualificação para outra profissão, o INSS deixaria de bancar os
benefícios e voltaria a arrecadar com as contribuições sociais pelo retorno do
segurado ao trabalho, bem como, resgataria o princípio da dignidade da
pessoa humana por ter sido o trabalhador reabilitado e habilitado
profissionalmente.
Portando, a eficácia do programa de reabilitação e habilitação profissional faria
com que o INSS tivesse uma grande economia por deixar de pagar os
benefícios e, ainda, por passar a receber as contribuições sociais e,
principalmente, se garantiria ao segurado o direito de volta à vida laboral,
preservando-se, como consequência, sua dignidade humana

Previous issue date: 2014-09-11 / The purpose of this paper is to discuss the extent to which the current tools for funding
the social security may interfere with the prevention in the work environment by means
of the extra-taxation attribute. Based on the study of the development of the
fundamental rights and, in particular the social rights, this paper contextualizes where
the social security and the guarantee of a healthy work environment are inserted.
Following, by tracing the development of the social security in Brazil and in the world,
it seeks defining how the social risk was formerly handled until the achievement of the
tools used nowadays applying the concept of Social Security System provided for in the
1988 Federal Constitution. After that, the form of funding of the social security system
is extensively analyzed for the social contributions, and specifically the social security
contributions, to be categorized and for the legal system applicable to them to be
defined. Subsequently, the funding tools used in the social security system, aimed at
funding the benefits paid in the event of occupational diseases and accidents, are
individually analyzed. Such list of tools comprises the Occupational Accident Insurance
[Seguro contra Acidentes do Trabalho SAT], the additional SAT amount and the
Accident Prevention Factor [Fator Acidentário de Prevenção FAP]. The actions for
payment of reimbursement to the public treasury for social security expenses arising out
of wrongdoings are also analyzed. Thus, we demonstrate that the development of the
social security is closely related to the attribution of the extra-taxation characteristic to
the social security contributions, given that such characteristic allows the use of the
contributions as a tool to promote the protection of the work environment, uncovering
the new posture the social security assumed to minimize social risks and, consequently,
to stand up for the social rights / A presente dissertação tem o objetivo de analisar em que medida as ferramentas atuais
de custeio da previdência social podem interferir na prevenção do meio ambiente de
trabalho, por meio do atributo da extrafiscalidade. Partindo do estudo da evolução dos
direitos fundamentais e, especialmente, dos direitos sociais, este trabalho contextualiza
onde está inserida a previdência social e a garantia do meio ambiente de trabalho
saudável. Em seguida, pela análise do desenvolvimento da previdência social no Brasil
e no mundo, busca-se a definição das formas anteriores de tratar o risco social até se
chegar aos instrumentos utilizados nos dias atuais, conceituando-se o sistema de
Seguridade Social previsto na Constituição Federal de 1988. Adiante, merece exame
aprofundado a forma de financiamento do sistema de seguridade social, para
caracterização das contribuições sociais e, especialmente das contribuições
previdenciárias, definindo-se o regime jurídico a elas aplicável. A partir de então,
analisa-se individualmente cada uma das ferramentas de financiamento utilizada pelo
sistema de previdência social, as quais têm como objetivo o custeio dos benefícios
pagos em razão da ocorrência de acidentes e doenças do trabalho. Estão inseridos, neste
rol, o Seguro contra Acidentes do Trabalho - SAT, o adicional do SAT e o Fator
Acidentário de Prevenção - FAP. Ainda, analisam-se as ações regressivas
previdenciárias, que objetivam o ressarcimento dos cofres públicos das despesas
previdenciárias determinadas pela ocorrência de atos ilícitos. Ao final, demonstra-se que
a evolução da previdência social está estreitamente relacionada com a atribuição do
caráter extrafiscal às contribuições previdenciárias, tendo em vista que essa
característica permite que as contribuições sejam usadas como ferramentas de incentivo
à proteção do meio ambiente de trabalho, revelando a nova postura ativa da previdência

Previous issue date: 2013-03-15 / The pension benefits of pensions of the General Welfare, paid according to the precepts of the Constitution of 1988 the population residing in the counties of Maranhão point to their significant participation in the local economy. To understand the experience of social security benefits in the municipalities of Maranhão, is essential to look back on the origins of Social Security, as well as its deployment and evolution in Brazil as a public policy of the State and Society. The reflections of the presence of social security benefits on the local economy maranhenses observed either in the composition of the municipal GDP, as in the composition of household income, both calculated by the IBGE. Social indicators HDI and Gini Index from 1991 to 2000 and the Municipal Development Index also reflect the importance of social security benefits for the welfare of the municipal population. The adoption of a policy of regional economic development in the territory Maranhão, combined with the globalized world economy, it is salutary for the municipal economy and Social Security. Maintaining the By-laws of Public Welfare in the Constitution is an important tool in achieving the development and achievement of welfare and social justice for millions of Brazilians. / Os benefícios previdenciários de aposentadorias e pensões do Regime Geral de Previdência Social, pagos conforme os preceitos da Constituição Federal de 1988 à população residente nos municípios do Maranhão, apontam para a sua significativa participação na economia local. Para entender a experiência dos benefícios previdenciários nos municípios do Maranhão é indispensável um olhar retrospectivo sobre a origem da Previdência Social, assim como a sua implantação e evolução no Brasil como uma política pública do Estado e da Sociedade. Os reflexos da presença dos benefícios previdenciárias na economia dos municípios maranhenses podem ser observados tanto na composição do Produto Interno Bruto municipal, como na composição da Renda das famílias, ambos calculados pelo IBGE. Os indicadores sociais como IDH, Índice de Gini e Índice de Desenvolvimento Municipal também refletem a importância dos benefícios previdenciários para o bem estar da população municipal. A adoção de uma política regional de desenvolvimento econômico no território maranhense, articulada com o mundo econômico globalizado, é salutar para a economia municipal e para a Previdência Social. A manutenção dos regramentos da Previdência Social Pública no texto constitucional é uma ferramenta relevante no alcance do desenvolvimento e na conquista do bem-estar e da justiça social para milhões de brasileiros.

The study was conducted to determine the key obstacles to strategy implementation at the Social Security Commission. The objective was to establish various factors that inhibit successful strategy implementation and explore alternative approaches that could be adopted to facilitate effective implementation of strategic decisions.
The data was collected through questionnaires distributed to the personnel of the institution. 34 respondents out of a population of 56 participated in the study. The results showed serious lack of change management practice which could be regarded as the reason why resistance to change from the majority of the personnel is being experienced. Indications are also prevalent from the results obtained that show lack of ownership of the implementation process.
In addition, lack of commitment to achieve positive results, lack of control of the implementation plan, ineffective information sharing methods as well as negative organizational culture are influencing the outcome of the strategy implementation process. / Business Management / M. Text in Afrikaans / Social security is an important instrument of government to reduce the risks of economic
insecurity to indivi~uals and the community. Social security usually consists of social insurance
(for example pensions, unemployment insurance and workmen's compensation) and social
assistance (for example social pensions, disability grants and maintenance grants). In view of
South Africa's low economic growth, high and rising unemployment, widespread poverty, skew
distribution of income and the disintegration of the family, social security requires urgent
attention. This issue is even more pressing during the political transition since most policy
measures and institutions are reconsidered, while pressure on government expenditure increases.
This study commences with a discussion of basic aspects of social security, such as its definition,
the rationale for social security in a market economy, the possible influence on economic
behaviour, targeting, the financing of social security through a payroll tax and general taxation
and the financing of a national pension fund.
One of the sources of information of social security is the experience of other countries in this
regard. The second part, which constitutes the core of the study, involves a comparative study of
social security. After a general discussion on comparative studies, the origin and development of
social security in welfare states (the USA, Britain and the Netherlands) and developing countries
(Chile, Mexico, Guatemala, Cuba and Sri Lanka) are studied. African countries and the
"miracle" countries of the East also receive brief attention. The main emphasis is on equity and
efficiency, and aspects such as affordability, financing, targeting, the extension of coverage, a
negative income tax, traditional social security and specific programmes that could be of
importance to South Africa.
In the last section the origin and development of and the fiscal scope for social security are
discussed. Besides social insurance and assistance, programmes such as in-kind transfers, public
works programmes and tax expenditure receive attention. Aspects of social security such as
poverty alleviation, means testing, take-up rates, administration and corruption are discussed,
while recommendations are made on topics such as a "voluntarily" national pension scheme,
employment creation programmes and food stamps. / Bestaansbeveiliging is 'n belangrike instrument in die hande van die owerheid om die risiko' s van
ekonomiese onsekerheid vir individue en die gemeenskap te verminder. Bestaansbeveiliging
bestaan gewoonlik uit maatskaplike versekering (waaronder pensioene, werkloosheidsversekering
en ongevalleversekering) en maatskaplike bystand (byvoorbeeld maatskaplike pensioene,
ongeskiktheidstoelaes en onderhoudstoelaes). In die lig van Suid-Afrika se lae ekonomiese groei,
hoe en stygende werkloosheid, wydverspreide armoede, skewe verdeling van inkome en
gesinsverbrokkeling, verg bestaansbeveiliging dringende aandag. Die aangeleentheid is des te
dringender gedurende die politieke oorgangsperiode waartydens die meeste beleidsmaatreels en
instellings in heroorweging geneem word en daar voortdurend druk op die owerheid is om meer

Ter inleiding word enkele kemaspekte van bestaansbeveiliging bespreek, waaronder die definisie
daarvan, die rasionaal vir bestaansbeveiliging in 'n markekonomie, die moontlike invloed van
bestaansbeveiliging op ekonomiese gedrag, die rol van teikenstelling, die finansiering van
bestaansbeveiliging deur middel van 'n loonstaatbelasting en algemene belastings en die
finansiering van 'n nasionale pensioenfonds.
Een bron van inligting oar bestaansbeveiliging is die ervaring van ander lande op hierdie terrein.
Die tweede gedeelte, wat die kern van die studie is, behels 'n vergelykende studie van
bestaansbeveiliging. Na 'n inleidende bespreking oar vergelykende studies in die algemeen, word
die ontstaan en ontwikkeling van bestaansbeveiliging in welvaartstate (die VSA, Brittanje en
Nederland) en in ontwikkelende lande (Chili, Mexiko, Guatemala, Kuba en Sri Lanka) bestudeer.
Afrikalande en die "mirakel-lande" van die Coste kry oorsigtelik aandag. Die nadruk in die
gedeelte val veral op billikheid en doeltreffendheid en aspekte soos bekostigbaarheid,
finansiering, teikenstelling, uitbreiding van dekking, negatiewe inkomstebelasting, tradisionele
bestaansbeveiliging en programme wat vir Suid-Afrika van betekenis kan wees.
In die laaste gedeelte word die ontstaan en ontwikkeling van en die fiskale ruimte vir
bestaansbeveiliging in Suid-Afrika bespreek. Benewens maatskaplike versekering en bystand, kry
programme soos in natura oordragte, openbare werke-programme (werkskeppingsprogramme) en
belastinguitgawes aandag. Aspekte van bestaansbeveiliging soos armoedeverligting, die
middeletoets, opneemkoerse, administrasie en korrupsie word bespreek en aanbevelings word

O presente trabalho tem por intuito analisar o contexto de proteção social em que estão inseridos os trabalhadores brasileiros que emigraram ao Japão no passado e ainda permanecem naquele país ou que tenham retornado ao Brasil, comparando-se os sistemas de seguridade social japonês e brasileiro. A comparação em questão visa expor as medidas colocadas em prática não apenas para eliminar a dupla tributação, mas também para garantir os direitos sociais desses trabalhadores migrantes por meio da aplicação do Acordo Previdenciário Brasil-Japão. O resultado desta pesquisa pretende, por fim, contribuir para o conhecimento dos pesquisadores brasileiros de Direito sobre o tema e, oportunamente, proporcionar reflexões sobre as questões eventualmente suscitadas. / This study aims at analyzing the social protection context in which participate the Brazilian migrant workers who migrated to Japan and there are settled down or are back to Brazil, by comparing the Japanese and the Brazilian social security systems. This comparison is driven to introduce the measures which have been taken, not only for the purposes of avoiding double taxation, but also to ensure the social rights of these migrant workers, by means of applying the Brazil-Japan Social Security Agreement. Finally, the results of this research intend to contribute to the knowledge of the Brazilian legal researchers on this subject and, timely, to yield considerations on the possibly arisen issues.

The present study deals with the autonomy of the Municipality and their own System of Social Security, and its consolidation with the Charter of 1988. The subjective right of municipal public server in the face of possible non-existence of a own System of Social Security in which can link pension changes addressing the relevant public servers, highlighting the changes provided for in the Constitutional Amendment n. 20/1998 and on the Constitutional Amendment n. 41/2003. Fixing the roof of remuneration of the General System of Social Security for retirements and pensions granted to public servants, conditioned the establishment of private pension funds. / A Constituição de 1988 elevou o Município à condição de ente federado, atribuindo-lhe autonomia política, administrativa e financeira. O presente estudo trata da autonomia do Município e sua relação com os Regimes Próprios de Previdência Social RPPS, e sua consolidação com a Carta de 1988. O direito subjetivo do servidor público municipal face à eventual não existência de um RPPS no qual possa vincular-se. Abordando as relevantes alterações na previdência dos servidores públicos, destacando-se as mudanças previstas na Emenda à Constituição n. 20, de 1998, e na Emenda à Constituição n. 41, de 2003. A fixação do mesmo teto de remuneração do Regime Geral de Previdência Social RGPS para as aposentadorias e pensões concedidas aos servidores públicos, condicionado a instituição dos fundos de previdência complementar.

Le contradictoire est sans nul doute une exigence qui s’impose à toute société. Contredire c’est se dire l’un l’autre. Pris dans la sphère juridique, il s’agit du droit de savoir et de discuter. Il est composé de deux éléments intrinsèques : la communication et la discussion. Ces deux éléments appartiennent à un ensemble plus large des étapes d’un processus décisionnel, à savoir l’information sur la procédure, condition d’un contradictoire effectif, la communication entre les parties des prétentions juridiques et des pièces sur lesquelles elles se fondent, la discussion sur ces pièces et enfin la motivation de la décision, le prolongement nécessaire de la contradiction. Les composantes du contradictoire s’adaptent à la particularité de la procédure, et plus spécifiquement aux procédures non juridictionnelles du droit de la sécurité sociale. Le « siège naturel » du contradictoire étant la décision, une classification des décisions prononcées par les organismes de sécurité sociale à l’encontre des usagers est réalisée afin de repérer les manifestations du contradictoire au sein de cette branche. La recherche offre alors un panel de décisions soumises au respect de cette exigence procédurale, qui incite à plaider pour la reconnaissance d’un principe du contradictoire dans les procédures non juridictionnelles du droit de la sécurité sociale. / The contradictory certainly is a requirement that is obligatory to every community. To contradict is to tell one another. In the legal sphere, it is about the law of knowing and discussing. It is composed of 2 fundamental elements : communication and discussion.These 2 elements belong to a wider whole of the steps of the decision-making process such as information about procedure and condition of an effective contradictory. Communication between the parts, legal claims and legal documents on which they are based. The discussion on these documents and finally the motivation of the decision. The needed extension of contradiction.The contradictory components accomodate to the characteristic of the procedure and more specifically to the juridictional proceedings of social security law. The « natural place » of the contradictory being the decision, a classification of legal decisions pronounced by the social security agencies against users is made in order to recognize the contradictory protests within this branch. The research offers a panel of decisions submitted to the respect of this procedural requirement which prompts the litigation of the acknowledgement of a contradictory principle in the non juridictional procedures in the law of social securit
