Žemės naudojimo valstybinė kontrolė Alytaus ir Lazdijų rajonuose / The Recearch of Land Use Control Procedures in Alytus and Lazdijai District

Žemė yra ribotas, pažeidžiamas ir niekuo nepakeičiamas gamtos išteklius, nuo kurio priklauso mūsų gyvenimas. Žemės naudojimo valstybine kontrole siekiama užtikrinti, kad valdant ir naudojant žemę būtų laikomasi Lietuvos Respublikos žemės įstatymo bei kitų įstatymų, kurie susiję su žemės naudojimo priežiūra. Siekiant užtikrinti tinkamą žemės naudojimą, susiduriama su įvairiais pažeidimais. Tyrimas atliktas siekiant nustatyti žemės naudojimo valstybinės kontrolės darbų organizavimo problemas, trukdančias pasiekti efektyvų kontrolės vykdymą. Tyrimo objektu pasirinktas žemės naudojimo valstybinės kontrolės vykdymas Alytaus ir Lazdijų rajonuose 2007–2009 m. Tyrimams panaudoti literatūros šaltinių analizės, alternatyvų paieškos, lyginamosios ir vertinamosios analizės ir loginio mąstymo metodai. Baigiamajame darbe išanalizuoti žemės naudojimą ir valstybinės kontrolės vykdymą reglamentuojantys teisės aktai, Nacionalinės žemės tarnybos prie Žemės ūkio ministerijos ir Alytaus bei Lazdijų rajonų kontrolės vykdymo veiklos ataskaitos. Išnagrinėjus teisės aktus, jų praktinį taikymą ir kontrolės vykdymo veiklos ataskaitas, nustatytos problemos, apibūdinti nustatyti pažeidimai – žemės naudojimo ne pagal nustatytą pagrindinę paskirtį (žemės ūkio paskirties žemės apleidimo), savavališko žemės užgrobimo, riboženklių sunaikinimo, derlingojo dirvožemio nesaugojimo, savavaldžiavimo atvejai. [toliau žr. visą tekstą] / In order to determine whether the land is used rationally and purposefully, state control of land use is performed. By the state control of land use one strives to ensure that while managing and using land, the land law and other laws of the Republic of Lithuania related to land use care are obeyed. While trying to ensure the appropriate use of land, a lot of different offences can be met. The research was carried out in order to find out the problems of state control of land use which might be the obstacles of effective control implementation. During the research the object selected was the research of land use control procedures Alytus and Lazdijai district in 2007-2009 year. During the research the analysis of literature sources, alternative search, comparative and evaluation analyses and methods of logical thinking were used. In Master Work the use of land and legal acts that regulate state control implementation and control implementation work reports of National Land Service under the Ministry of Agriculture and Alytus, Lazdijai district were analyzed. A critical investigation of the impact of on-consumption alcohol outlets on land use compatibility in residential areas in the Umjindi local municipality area of jurisdiction, Mpumalanga Province.

The compatibility of on-site consumption alcohol outlets as land use is predicted by the acceptance level of the utility or disutility they enjoy amongst residents in a neighbourhood. The density of alcohol outlets is argued in literature as correlating to the significant positive rate of amenity effects that include property crime, alcohol related arrests, drunk-driving, fatal and severe alcohol-induced accidents, violence and assault amongst many others. The problems associated with on-site consumption alcohol outlets have been insistently brought to the attention of the Umjindi Local Municipality in the Ehlanzeni District area in Mpumalanga Province by the residents of the Emjindini neighbourhood. The study is based on the hypothesis that the high density of on-site consumption alcohol outlets contributes to the incompatibility of such outlets with residential areas. In addressing the research sub-questions and validating the research hypothesis, the study adopted various methods (including land use surveys, interviews, administration of questionnaires, literature review and document review) for the collection, analysis, interpretation and discussion of data. The study reveals that the higher density of alcohol consumption outlets is significant in areas of low socioeconomic status. The Emjindini Townships are located with the density of 1 on-site consumption alcohol outlet per 263 people. Liquor legislation in South Africa leaves a lot to be desired in its guidelines for alcohol outlet density, public participation, location radius and local authority involvement. In addition, our findings showed that the significantly unacceptable level of impact thereof is experienced especially in the night, in areas characterised by the high density of on-site consumption alcohol outlets. The on-site consumption alcohol outlets are seen as compatible land uses in residential areas for the reason that, the unacceptable level of impact is insignificant during the day. The adoption of preferred and practical guidelines related to the locality and density of on-site consumption alcohol outlets, compatibility performance standards and public participation are recommended for policy and practice. Holes in the Historical Record: The Politics of Torture in Great Britain, the United States, and Argentina, 1869-1977

While many politicians gain national or international acclaim, domestic political activists are rarely remembered for their dedication and, similarly, their sufferings. More specifically, the acts of female political activists, and the harsh punishments they endure following government pushback, are not appreciated or acknowledged by popular histories. Across Great Britain, the United States, and Argentina, three women played crucial roles in advancing reform against unjust government policies. Josephine Butler (1828-1906) was a pivotal character in repealing laws allowing for the government regulation of prostitution, the Contagious Diseases Acts, in Great Britain. Similarly, Alice Paul (1885-1997) was essential in achieving the ratification of the Nineteenth Constitutional Amendment in the United States—granting universal suffrage. Lastly, Azucena Villaflor (1924-1977) was one of the first people, man or woman, to openly oppose the Junta dictatorship in Argentina and openly advocate for the release of information on desaparecidos. Despite advancing such important policy reform, all three women increasingly faced physical suffering, torture or death at the hands of their respective state governments. Amid a lack of media coverage or biased, partial media coverage paired with the direct confrontation of male government leaders, noncombatant activists were unjustly treated in violation of their fundamental human rights. Progressive, forceful voices for positive change are consistently dismissed as crazy, extreme or irrational, rather than praised for their efforts. In exploring the cycle of violence surrounding the treatment of political activists, it appears nationalist histories are often void of past government faults.

In work are discussed the state‘s institutions privacy policy in internet. Also in the work is analyzed court practice in cases related with the violations of personnel data security in the state‘s institutions; disputed new project of Personnel data law and given suggestions how to solve problems related with personnel data security in the state‘s institutions. The regulation of personal data is one most important nowadays social phenomenon. Majority of state’s institutions personnel uses, plans to create and administer computerized personal data accumulation, transmission and etc. systems. Hospitals and other health supervision institutions accumulate and regulate personnel data of patients. Tax administration institutions accumulates information about inhabitant income and govern a huge personnel data bases, which systematizes information not only about resident income but also about their work place, family status and etc. Last year practice display that personnel data are related with personal life of a resident becomes a service, which helps commercial structures to increase profit. Understanding the value of such personal information majority of commercial subjects is inclined to neglect demands to honor the individual right to privacy. That is why state’s institutions, regulating personnel databases must ensure the security of it. Partiremos do necessário reconhecimento do alto grau de militarização da sociedade brasileira promovido pelo especializado projeto de propaganda anticomunista e difusão da doutrina de segurança nacional em prol da inserção do Brasil no capitalismo global sob a liderança dos Estados Unidos. A transição democrática não será completa sem a destruição das engrenagens militarizadas que permitiram a tortura, o extermínio e abalaram o livre exercício de direitos políticos por cidadãos brasileiros. A reforma da polícia tem por finalidade essencial conter a repetição de graves violações de direitos humanos perpetradas pela mão policial, a partir do reconhecimento de que identidades de grupo antagônicas – ontem comunistas, hoje populações negras e pardas marginalizadas – facilitam a concretização do projeto de segurança elitizado e de manutenção das desigualdades sociais na sociedade neoliberal. / [en] This study aims to defend the institutional reform of Brazilian police as a key mechanism of transitional justice, attuned to the modern phase of the transitional justice project that seeks to put together transitional mechanisms, and the needs of the society they are applied to, with the main purpose of promoting positive peace whilst reconciliation and reduce antagonistic social identities and recognizing the material effects of conflicts to achieve feasibility of forgiveness. It s necessary to recognize that Brazilian society is heavily militarized and that this militarization is a consequence of the specialized anti-communist propaganda and dissemination of national security doctrine promoted by the military government to effectively include Brazil in the global capitalism under the leadership of the United States. The transition to democracy will not be complete without the destruction of militarized gears that continuously facilitate torture, extermination and jolt the free exercise of political rights for Brazilian citizens. The military presence in the domestic public security, management and control of the military police is a dictatorial legacy that hinders the democratic development of the police institution in pursuing minority protection and safeguarding the free exercise of fundamental rights. The reform intends to contain the repetition of serious human rights violations perpetrated by the police, recognizing that antagonistic group identities - yesterday communist, today black and brown marginalized populations - facilitate the implementation of the elitist security project and maintenance of social inequalities in the neoliberal society.

Secondly, a theoretical explanation of the problem is offered. This is followed by an exposition of the empirical study which is focused on the perception of road users in the Pretoria municipal area relating to four aspects namely; traffic legislation and traffic law enforcement, traffic violations, adjudication of traffic offences and punishment of traffic offenders. Lastly, the prevention of traffic violations and crimes and specific prevention strategies are conducted and discussed. The research report is concluded with specific conclusions and certain recomendations are offered to deal with the problem. / Die navorsing is toegespits op die problematiek random verkeersoortredings en -misdade. Eerstens word aandag aan die omvang van die probleem geskenk. Tweedens word daar op die teoretiese verklaring van die probleem gekonsentreer. Magister Legum - LLM (Criminal Justice and Procedure) / This is a study of Zimbabwe's National Peace and Reconciliation Commission Bill (hereafter NPRC Bill). The NPRC Bill seeks to bring the National Peace and Reconciliation Commission (hereafter NPRC) of Zimbabwe into operation. The NPRC is a truth commission set to promote post-conflict justice, national peace and reconciliation in Zimbabwe. The study discusses the prospects of establishing an effective NPRC in Zimbabwe by examining the provisions of the NPRC Bill. The view of the paper is that, without proper guidance from a comprehensive law, the NPRC is bound to be a victim of its own failure.
