This diploma thesis deals with the issue of restitution disputes according to Act No. 229/1991 Coll. on the regulation of ownership relations with land and other agricultural property. The reason for this topic was the experience of the author of the diploma thesis on restitution disputes, scope and judicial jurisprudence dealing with this issue. The thesis deals with the procedural aspects of restitution disputes, as well as with the substantive law-making aspect of both legal regulation and rich judicial jurisprudence. The diploma thesis systematically describes the most important types of restitution disputes - disputes about the restitution of original removed real estate, disputes about the existence of claims of entitled persons to compensation for immovable properties which can not be restituted, disputes about the correct value of claims of authorized persons and disputes about the grant of specific substitute real estates owned by the Czech Republic as a replacement for real estate that can not be restituted. The work emphasizes the breakthrough and current judicial jurisprudence of the Supreme Court of the Czech Republic and the Constitutional Court of the Czech Republic. Le texte Si 10,19-11,6 a été peu étudié pour lui-même. La critique textuelle préconisant actuellement l’étude de chaque version pour elle-même plutôt que la reconstruction, ce texte a été étudié dans quatre versions (H, G, Syr, La), en essayant de dégager leurs différences majeures et leurs orientations de fond. À partir de cette péricope, trois thèmes importants dans le Siracide ont été retenus : la crainte de Dieu, la sagesse et la Loi. Partant de la notion de « crainte de Dieu » dans le Deutéronome, dans les Psaumes et dans les livres des Proverbes, de Job et du Qohélet, puis dans le Siracide, les liens avec "la sagesse" et avec "la Loi" sont considérés chez Ben Sira. Si 1 et Si 24 sont deux textes incontournables permettant d’approfondir la relation de « la crainte de Dieu » avec « la sagesse » et avec « la Loi ». La relation étroite entre ces notions conduit à se demander si elles ne représentent pas finalement trois aspects d’une même réalité. / Few specific studies have been devoted to Ben Sira 10:9-11:6. Since textual criticism favors the study of each version separately rather than the reconstruction of an « original » text, the present thesis examines the four versions (H, G, Syr, La) and attempts to identify their major differences and their respective fundamental orientations. On the basis of this pericope, three important themes in Ben Sira have been identified: the fear of God, wisdom and the Law. Taking as a point of departure the notion of “the fear of God” in Deuteronomy, in the Psalms, and in the books of Proverbs, Job and Qoheleth and then in Ben Sira, the study examines the relationships of this theme with “wisdom” and “the Law”. Si 1 and Si 24 are two indispensable passages that allow an in depth understanding of the relationship between “the fear of God”, “wisdom” and “the Law”. The intimate relation between these notions leads us to ask ourselves if they do not represent three aspects of the same reality.

Determination Of Sea Level Trends And Vertical Land Motions From Satellite Altimetry And Tide Gauge Observations At The Mediterranean Coast Of Turkey

A radar altimetry satellite measures the height of sea surface globally. However, tide gauges, measuring Sea Level Height (SLH), are set up on the Earth surface. Hence, SLHs are involved in vertical motion of the Earth crust. In this study, vertical motions of Earth crust have been separated from sea level variations. After clustering of SSH observations with K-means approach, two outlier detection methods Pope and Interquartile (IQR) Tests are implemented in data. Afterwards, each altimetry measurement is relocated to the center point of own cluster by means of geoid height derived from Earth Gravitational Model 2008 (EGM08). Before application of Principal Component Analysis (PCA) to see behavior of SSH inbetween clusters, Lomb Scargle algorithm is run to realize power spectrum of every clustered observations distinctly. Besides, tide gauge measurements are used for extracting 68 constituents with T_Tide program from hourly tide gauge observations. Then, predicted signal is produced by means of classical tidal harmonic analysis. To get monthly and daily mean values of hourly data, MSDOS Processing and Quality Controlling Software (SLPR2) has been run and the results are compared with Permanent Service for Mean Sea Level (PSMSL) monthly mean sea level values. Afterwards, the trends from altimetry, tide gauge and GPS are investigated to reveal vertical land motion. This study shows that sea level is rising every year more or less 7 mm at the Mediterranean coast of Turkey. Although Iskenderun tide gauge subsides 50 mm every year, the other stations do not show huge amount of vertical motion.

Scribal culture in Ben Sira (Sir 38:1-15; 41:1-15; 43:11-19; 44-50)

The Book of Ben Sira, written at some point between 198 and 175 BCE, is a Second Temple Jewish wisdom text which regularly echoes or quotes the Hebrew Bible. A recent area of study in biblical scholarship has been that of scribal culture, written sources and physical remains left behind by societies with manuscripts and a scribal profession. While scholarship on Ben Sira has centred on his use of texts and on his sociocultural background, these issues might be better understood by examining Ben Sira through the lens of scribal culture as understood in biblical scholarship. This thesis proposes first to study the primary data of Ben Sira closely in order to discern characteristics of Ben Sira's individual scribalism or personal compositional style. This can then be compared to other evidence of ancient scribal culture. The central argument of the thesis is that the lens of scribal culture tells us more about the complexity of this ancient composition. Chapter One introduces the thesis and covers scholarship on Ben Sira and on scribal culture. Chapter Two examines the portrayals of Noah (Sir 44:17-18) and Phineas (Sir 45:23-26), exploring how Ben Sira uses one major biblical source in each. Looking at the portrayals of Hezekiah-Isaiah (Sir 48:17-25) and Josiah (Sir 49:1-3), Chapter Three highlights the harmonization of multiple sources. Chapter Four examines Ben Sira's lines on weather (Sir 43:11-19) in order to evaluate the relationship between quotation and literary model. Chapter Five approaches the sociocultural and textual spheres on the subjects of death and the body (Sir 41:1-15). Chapter Six investigates Ben Sira's perspectives on physicians (Sir 38:1-15) in the light of ancient medicine. Each of the selected passages shed a slightly different light on the scribalism of Ben Sira.

Die Untersuchung betrachtet das Verhältnis der Schriften 4., 5. und 6. Esra zueinander. Während die Apokalypse 4. Esra als Referenztext für neutestamentliche Schriften Gegenstand zahlreicher Untersuchungen ist, wurden 5. und 6. Esra bisher lediglich als christliche Hinzufügungen abgetan und nicht in einer bedeutungsvollen Beziehung zu 4. Esra verstanden. Auf Grund der syrischen Tradition, die 4. Esra als geschlossene Schrift überliefert, wird oftmals übersehen, dass in den lateinischen Traditionen 4. Esra ausschließlich im Zusammenhang zu 5. und 6. Esra bezeugt ist. Die Arbeit greift methodische Ansätze aus der alttestamentlichen und Apokryphenforschung auf, um das Verhältnis der drei Schriften zueinander zu beschreiben. Handelt es sich um eine willkürliche Zusammenordnung der Schriften oder lassen sich Ordnungsprinzipen und durchgängige Konzepte erkennen, die eine Lesart als zusammenhängende und aufeinander bezogene Gesamtschrift 2. Esdras nahe legen? Die Arbeit geht dabei auf verschiedenen Ebenen vor: Zunächst werden die mittelalterlichen Manuskripte, die die früheste vollständige Bezeugung der Schriften darstellen, analysiert und ausgewertet. Wesentlich ist hierbei, dass die Schriften zwar immer im Zusammenhang zueinander überliefert wurden, jedoch in sehr unterschiedlichen Anordnungen in den jeweiligen Manuskripten enthalten sind. Auf synchroner Ebene werden zentrale Konzepte der einzelnen Schriften exegetisch herausgearbeitet und zueinander in Bezug gesetzt. Schließlich werden narratologisch und daramaturgisch die Erzählbögen der Einzelschriften analysiert und ausgewertet, ob und wie ein Gesamthandlungsbogen von 2. Esdras erkennbar ist. Gerade an der literarischen Figur des Esra zeigt sich, wie die unterschiedlichen Anordnungen jeweils andere Aspekte der Figur in den Vordergrund rücken. Die literarische Gestalt des Esra selbst wird zur Projektionsfläche für die Intentionen der späteren Tradentenkreise. Daher stellt die jeweilige Anordnung der Schriften einen bewussten und sinnhaften Ausdruck der theologischen Konzeptionen der Tradentenkreise dar. / The study is focused on the relation of 4th, 5th and 6th Ezra. While the Apocalypse 4th Ezra as a reference text for New Testament writings is the subject of numerous studies, 5th and 6th Ezra are normally dismissed as Christian additions and are not understood in a meaningful relationship to 4th Ezra. Due to the fact that the Syriac tradition testifies 4th Ezra as an independent writing, it is often ignored, that the Latin tradition exclusively features 4th Ezra in the context of 5th and 6th Ezra. The study employs methodological approaches from the 361 Old Testament and Apocryphal research to investigate the relation between the three writings. Should it be regarded as a random compilation of writings or are there indications for a structural order or underlying concepts and motifs, which suggest an interrelated reading as a composed writing of 2nd Esdras? The study engages the subject with different approaches of research: first of all the medieval manuscripts representing the oldest complete sources for the writing of 2nd Esdras are evaluated. It is to be considered, that while all three writings are featured, the order of arrangement of the writings varies in the different traditions. In a synchronic exegetical analysis of the texts main themes and concepts are retraced and put in perspective to each other. Finally in a narratologic and dramatic point of view the plots and the arc of suspense of each writing is examined and considered in perspective of an underlying plot and understanding of 2nd Esdras as one story line. Especially in regard to the literary character of Ezra the different arrangements of the text emphasize different theological aspects of the character. The figure of Ezra itself becomes a projection space for the intentions of the later recipients. Therefore each arrangement of the writings can be regarded as a deliberate and meaningful expression of the theological concept of the recipients.
