Judicial enforcement of arbitral awards is necessary where there is no voluntary compliance by the relevant parties. Courts world-wide may refuse to enforce arbitral awards if such enforcement would be contrary to the public policy of their countries. This is known as ‘the public policy exception to the enforcement of arbitral awards’. It is enshrined in the New York Convention on the Recognition and Enforcement of Foreign Arbitral Awards 1958 (New York Convention) and the UNCITRAL Model Law on International Commercial Arbitration 1985 (Model Law), which are two of the most prominent international instruments in promoting and regulating international commercial arbitration.The public policy exception is one of the most controversial exceptions to the enforcement of arbitral awards, causing judicial inconsistency and therefore unpredictability in its application. It is often likened to an ‘unruly horse’, which may lead us from sound law. The International Law Association’s Resolution on Public Policy as a Bar to Enforcement of International Arbitral Awards 2002 (ILA Resolution) endorses a narrow approach to the public policy exception – namely, refusal of enforcement under the public policy exception in exceptional circumstances only. The ILA Resolution seeks to facilitate the finality of arbitral awards in accordance with the New York Convention’s primary goal of facilitating the enforcement of arbitral awards. The courts of many countries refer to this as the New York Convention’s ‘pro-enforcement policy’, which demands a narrow approach to the public policy exception.This thesis explores the main controversies and complexities in the judicial application of the public policy exception from an Australian perspective. It is a critical analysis of the prevalent narrow approach to the public policy exception. It examines the extent of the ILA Resolution’s suitability and applicability in Australia, considering past problems experienced by the courts of other countries, the distinctive features of the Australian legal system, and future challenges confronting the Australian judiciary. It examines when and how the Australian judiciary may need to swim against the tide by departing from the narrow approach to the public policy exception. For instance, such departure may be appropriate for ensuring that their application of the public policy exception neither causes nor condones injustice, and thereby preserves the integrity and faith in the system of arbitration. The author’s perspective throughout this thesis is that of an academic lawyer, as she has not had the benefit of practical experience in this area of the law.The recommendations throughout this thesis are tailor-made for the Australian judiciary. They are Australian in perspective yet international in character. They canvass certain issues not addressed in the ILA Resolution, encouraging the Australian judiciary to participate in the ongoing debate and the ultimate resolution of those issues. In doing so, this thesis contributes to refining the judicial application of public policy in determining the enforceability of arbitral awards. 77 Resumé The topic of this thesis is Relation between Arbitration proceedings and Rules of Civil Procedural Law. The thesis focuses on arbitration regulated by Act No. 216/1996 Coll., On Arbitration Proceedings and Enforcement of Arbitral Awards and looks for similarities in the proceedings in front of the ordinary courts, which is primarily regulated by the Act no. 99/1963 Coll., Civil Procedure Code. Arbitration uses provisions of the Civil Procedure Code in cases where the legislation provided by Act. No. 216/1996 is missing completely or is not sufficient. The work is divided into seven main chapters, which are further divided into sub- chapters. The first chapter describes rules for procedural managements of the arbitration proceedings. It draws attention to the legal possibility for the parties to agree on their own rules of procedure in the management and suggests that the parties' agreement may also directly refer to the legal provisions of the court proceedings. The next two chapters deal with theoretical introduction to the use of the Code of Civil Procedure in arbitration. It should be in the interest of every state to provide favourable conditions for holding an international commercial arbitration on its territory. It brings not only international recognition and improves competitiveness and; the holding of an arbitration on a territory of a given states also brings new financial resources. One of the ways how to provide favourable conditions is the adoption of the UNCITRAL Model Law. Above all, it brings legal certainty and easy orientation to foreign entities that are not familiar with national arbitration laws. The adoption of the UNCITRAL Model Law by the Czech Republic would be a step towards more favourable conditions for international commercial arbitration and would bring the aforementioned advantages.

This thesis deals with arbitration. The aim of the thesis is to determine whether arbitration has a future in of Czech Republic and whether it can compete with court proceeding considering its regulation in the Act on arbitration. The thesis enables the confirmation or disproof of hypotheses claiming that arbitration represents a parallel to dispute resolution in civil proceedings, that the amendment of the Act on arbitration from the year 2016 is a step in the right direction, and that general courts do not intervene in the arbitration proceedings. The diploma thesis is divided in two chapters, the first chapter discusses alternative disputes resolution and the second chapter analyzes arbitration. Within the second chapter, the attention is focused on the concept of arbitration, its contemporary regulation and types, arbitrability, arbitration ageement, arbitrator, principles, process and ending of arbitration.

L’arbitrage est la motivation première de la création de l’Organisation pour l’Harmonisation en Afrique du Droit des Affaires (OHADA) pour lutter contre l’insécurité juridique et promouvoir son développement. Cet arbitrage s’inspire des règles matérielles de l’arbitrage international qui accorde une importance particulière à la volonté des parties.L’arbitrage dans l’espace OHADA est régi par le Traité, un acte uniforme et le règlement d’arbitrage de la Cour Commune de Justice et d’Arbitrage(C.C.J.A).Le droit de l’arbitrage a certes amélioré le cadre normatif surtout dans les pays qui n’en disposaient pas, mais au bout de plus d’une décennie d’existence, cet arbitrage est confronté à de nombreuses difficultés d’application. Ces difficultés proviennent de ces acteurs (parties, arbitres et juge national).Ainsi, notre réflexion vise à analyser les difficultés d’application à partir du contentieux arbitral et à proposer des mesures susceptibles d’améliorer le droit et la pratique de l’arbitrage. / Firstly, arbitration should be a primary motivator for the creation of the Oganization for Harmonization of Business Law in Africa to fight against the legal insecurity and promote development. This arbitration taites it’s inspiration from rules of international arbitration which gives a particular importance to the will of the parties. The arbitration in the OHADA zone is governed by its Treaty and an uniform act as well as the rules of arbitration of the common Court of justice and Arbitration(CCJA).The Law of arbitartion has certainly improved the legal framework especially in the countries which do not have it. However, after several years of existance. this arbitration is confronted with several difficulties of application. This difficulties originated from its its various parties i.e. Therefore, our reflection aims at analysing the difficulties of application which originates from the arbitration dispute and to propose measures which could improve the Law and the practice of Arbitration.
