M.B.A. / An investigation into the application of judicial case management in the South African civil court system to enhance quality and access to justice. Background The South African judicial system, and in particular, the lower Courts have been plagued by inefficiency and inadequate use of its resources. This, in turn, has lead to inordinate delays in the prosecution of both civil and criminal matters. This research will however focus on the civil prosecution of cases. Ultimately, the quality of service being provided to both internal and external customers is lacking and is evidenced by the slow pace of cases through the system. The civil justice system in South Africa is in need of an overhaul as the quality of the service provided by the courts has been questioned extensively. The focus of this research is to look at judicial case management as well as some of the current factors that may be responsible for the delays in the civil justice system and to propose judicial case management as a possible solution to enhance quality in the South African judicial system. Related to the concept of quality are productivity and efficiency and, by implication, these areas may also be improved. Accordingly, this study will assess the current situation in the South African civil justice system and investigate if judicial case management will assist in achieving quality and productivity. IV Objectives The overall objective of this study is to formulate recommendations to enhance quality and access the civil justice system. To reach the above aim, the following objectives are relavant: 1.3.1 Conduct interviews with members of the public and legal professionals involved in the civil justice system in South Africa to assess their perceptions of the system. 1.3.2 During the interviews, elicit recommendations on how the system may be improved with particular emphasis on judicial case management. 1.3.3 Conduct a literature review of relevant and available literature that investigates developments in the British, Canadian, Australian and part of the American legal system, respectively. 1.3.4 Describe and analyse the data collected. 1.3.5 Compare the data collected in the South African context with developments in international judicial systems. 1.3.6 Make recommendations with a view to improving quality in the South African civil justice system. Design and data collection A qualitative research paradigm will be used for this study. Primary data was collected using the semi-structured interview method and the in-depth interview methods, respectively, in order to determine the views among some legal professionals in the province of Gauteng as well as certain members of the public. Documentary secondary data was also used in this research project in addition to the primary data collection methods. Conclusions In summary, the conclusions can be drawn that: there are problems in the South African civil justice system that lead to increased costs, unnecessary delay and complexity of the system; the causes of the problems are related to a wide variety of issues that range from, inter alia, human resources, training, operational issues, jurisdiction of courts, the structure and functioning of the courts, pleadings and the rules of court; there is a need and a willingness for judicial case management, despite some opposition, but that nature and form thereof will have to be the subject of discussion. Recommendations Recommendations to improve the system range from improving statistical analyses; increasing the public participation process in law making; improving the sheriffs services and service of process; improving the management and administration of the courts; introducing alternative dispute resolution and possibly mandatory dispute resolution; addressing procedural issues and finally, introducing some form of judicial case management.

Various articles in De Rebus refer to this shortcoming. There also appears to be an over-supply of qualified attorneys which means that the establishment of a legal practice might become a reality before the necessary experience as professional assistants or partners in an established practice has been obtained. The aim of this research was to investigate the factors which have the greatest impact on effective office administration in a legal office, and the influence of technology on administrative efficiency. During this process a model was also developed for the effective completion of tasks in a legal practice. The target population for the study comprised 429 legal practices rendering service in the Cape Metropole at the commencement of the study. Information was obtained through conducting an extensive literature study of local as well. as overseas magazines and books, and visits were paid to 30 local legal practices. Personal observation of the administrative functions in a legal practice was also undertaken by the author. A structured questionnaire was developed and sent to legal practices selected on a random basis. Data obtained from lawyers, secretaries and office managers was processed statistically. In the first place the data was frequentially analysed. Consequently, by using the restricted linear regression method, the author endeavoured to identify the factors which make the largest contribution to the effectiveness of the administrative function in a legal practice.

The diffusion of e-government in the Gauteng provincial government.

Business Administration (MBA) / This study examines the extent to which the e-government innovation, the Employee Self Service, has diffused or been adopted by employees within the Gauteng Provincial Government. The study draws on the diffusion model which involves employees' perceptions of five key attributes of innovations namely, Relative Advantage, Compatibility, Complexity, Trialability, and Observability, to determine their relative influences on the rates of adoption and or non-adoption of the Employee Self Service. The results of the study demonstrate the relevance and usefulness of determining which attributes of innovations are perceived to be the most important, as informing a strategy for the successful introduction of the Employee Self Service as an e-government initiative. Findings show that respondents have generally adopted the Employee Self Service.

Migration into South Africa has been, and still is, a result of many different factors that include economic reasons and seeking political refuge. This migration wave has also taken its toll on the country’s leadership skills and strategies as well as the Immigration Department as regards the issuance of legal documents to migrants to be able to stay legally in the country. Leadership is usually revered in Africa, but this places pressure to perform well on the country’s existing leadership in relation to the control of migration and the maintenance of peace within the borders of the country. The study aimed to identify whether the leadership is performing the way it is supposed to perform. Is the leadership performing with character and competence and are they taking responsibility for their actions when dealing with the public as this matter affects the public sector. Statistics South Africa has an estimate of number of the migrants flowing into the country and the Department of Home Affairs does not have an accurate number of the migration flow, due to the daily rapid movement at the border posts. It is known, however, that the number of migrants into the country has increased and continues to increase, and this poses a challenge for the leadership. One of the recommendations that emerged from the findings of the study is that more programmes and workshops should be undertaken to equip the civil servants in the Department of Home Affairs as they are all leaders in various ways and are also representatives of the Department. The perceptions of crime intelligence manager's on the organisational structure of the crime intelligence division of the South African Police Service.

The term' intelligence failure' has been coined in light of the so called '911' terrorist attack on the United States of America. The general view of security experts is that this catastrophe could have been prevented had there been an effective and efficient homeland intelligence structure. This has subsequently led to a major drive to reform the intelligence service in that country. This line of thought is now beginning to manifest in South Africa with regard to the crime situation. In order to combat crime effectively the police must be able to access qualitative expertise, knowledge and an effective intelligence gathering capability, so that any challenge or contingency may be addressed in an appropriate manner. The continual availability or relevant and accurate crime intelligence is a crucial factor in augmenting the effectiveness of the South African Police Service in executing and fulfilling its functions and obligations. This has prompted the researcher to investigate the perceptions that exist around the organizational structure of the police's intelligence capability. The South African Police Services is organized into a number of divisions that have been categorized along the principles of work specialization. A survey based study was undertaken on the SAPS Crime Intelligence Division. The main objective of the research project was to study the perceptions of Crime Intelligence Manager's on the organizational structure of Crime Intelligence with regard to the organizational strategy, authority relationships, co-ordination and control, resource utilization and training and skills development, in respect of the matrix and divisional organizational structure. The units of analysis were the forty three Area Heads of the Crime Intelligence structure that have a countrywide spread. Two research question need to be answered in this project. The first question attempted to determine what are the perceptions of the Area heads with regard to the organizational structure dimensions in respect of the matrix and divisional structure? The second question related to whether there was a relationship between the biographical data and the organizational structure dimensions? A total of thirty seven respondents comprised the sample. A thirty eight item, questionnaire was used as the research instrument. Category analysis by frequencies and percentages was conducted on the collected data to establish common themes and trends. The results indicated that there is overwhelming support for the divisional organizational structure. The matrix structure was found to be the source of dysfunctions such as role conflict, management confusion and frustration, conflicting authority relationships and poor co-ordination and control processes. The cross tabulation of the biographical data against the organizational structure dimensions and not reveal any significant relationships between them, that could possibly underpin the choice of the divisional organizational structure. The reasons advanced for this by the researcher is largely centered on the homogeneous culture that pervades the organization. This culture has been postulated as the main determinant of the perceptions that are held by the Area heads on most fundamental issues, such as organizational structure. The primary research objectives of this study are the following: _ To identify mechanisms to continuously improve the level of service delivery within the department in accordance with set standards. _ To identify mechanisms to continuously measure, analyse and improve processes within the department in order to meets and exceed customer expectations. _ To create a culture and platform for continuous improvement within the Government Sector. _ To create an enablement mechanisms for staff to execute their duties effectively. It is anticipated that the research will lead to an improvement in the current state of service delivery at the Department of the Premier: Directorate Organisational Development, by identifying and providing possible solutions that impedes service delivery.

Data management in the Gauteng Department of Social Development

Thesis presented in partial fulfilment for the degree of Master of Management (in the field of Public Sector Monitoring and Evaluation) to the Faculty of Commerce, Law, and Management, University of the Witwatersrand, 2016 / Data management in the public sector has become a primary driver for decision-making and planning, however, there is a limited research on data management within South African public sectors with the exception of the health sector, which has widely studied the existing data management systems as case studies of health management information systems (HMIS). Using Theory of Change to determine the intended results of data management in the Gauteng department of Social Development, the study aimed to examine data management in the Gauteng department of Social Development and the use and application of data in evidence-based planning and decision-making in programmes of the department. A qualitative research strategy with a case study design was employed. Data for the study was collected from ten participants of the Strategic Planning, Monitoring and Evaluation unit using open-ended interview schedule, from three executive management managers using closed-ended questionnaires, and from documentary analysis in the Gauteng department of Social Development. The collected data was analysed using thematic analysis and content analysis. The study found that the Gauteng department of Social Development has moderate data management systems in place, as some of the key attributes of data management were not explored and exploited to the fullest by the department. In addition, the research findings revealed that there is poor use of data in decision-making and planning. This study contributes significant new knowledge to the existing body of monitoring and evaluation literature and public administration in South Africa. / XL2018

Development and validation of a framework for e-government readiness measurement

Submitted in fulfillment of the requirements of the Master of Technology Degree in Information Technology, Durban University of Technology, Durban, South Africa, 2014. / This study reports on the design of a framework for measuring e-government readiness. Particular attention is paid to providing a measurement framework that is feasible for municipalities and supports their efforts to utilize e-government for the benefit of the society and the economy. The evaluation of e-government readiness for municipalities can provide a useful barometer to measure the critical needs of citizens. In addition, it can be useful for improving the effectiveness of government services and could assist information communication technology industry to access information for implementing efficient infrastructures to support the delivery of e-services. The model of e-government readiness measurement as reported in this dissertation is based on heterogeneous factors of supporting e-services, individual citizens, technological infrastructure, government and supporting industry. The readiness measurement process utilized data obtained from a survey of 219 government employees from 4 municipalities in Eastern Cape Province of South Africa. The partial least square method was used to determine the relationship between the measured factors. The study results revealed the measurement factors to be significant determinants of municipality e-government readiness with an overall goodness of fit performance of 0.81 and predictive power of 0.68. In addition, a response based segmentation approach of finite mixture partial least squares is applied to uncover unobserved heterogeneity in government employees. The study findings show that the main difference characterising the two uncovered segments of population heterogeneity lies in the internet accessibility using computers. The impact of government readiness and technology readiness on predicting e-government readiness is stronger for the first segment than for the second segment. The segment specific analysis clearly shows that the impact of factors that influence the readiness of e-government can differ vastly, depending on the background of participants. The study findings generally provide a foundation for policymakers and technology practitioners who are interested in propagating e-government readiness awareness across the country. In addition, factors that determine the e-government readiness could provide new insights for future studies on e-municipality service improvement evaluations.
