Produits dérivés, risques de marché et "Gharar" : recherche d'une alternative islamique / Derivative products, market risks and "Gharar" : in search for the islamic alternative

La position actuellement dominante parmi juristes et théoriciens de la Finance Islamique penchant vers l’interdiction des produits dérivés dans les Institutions Financières Islamiques, la recherche d’une alternative à ces produits, en particulier pour la gestion des risques de marché, constitue l’un des axes de recherche fondamentaux concernant l’avenir de cette école de pensée et de ce type d’institutions. Ainsi, ce travail de thèse s’intéresse d’abord à l’inférence des significations financières contemporaines possibles du concept islamique dit de « Gharar interdit » (litt. « risque interdit ») en l’opposant notamment à la prise de risque permise, puis, à partir des résultats correspondants, à l’exploration et proposition d’instruments alternatifs aux dérivés. Sur le premier aspect, cette recherche est partie du patrimoine du Fiqh (« jurisprudence ») islamique, et a mobilisé des outils qualitatifs et numériques d’analyse, tout en s’inspirant de la méthode de l’idéaltype de Max Weber. Sur le second, elle a mis en oeuvre une enquête combinant littérature et terrain, avant de faire passer les instruments obtenus par un filtre construit à partir des résultats du premier aspect. Ce travail a principalement permis de jeter une lumière nouvelle sur les théories de la prise de risque et du Gharar en Islam, de repérer et de discuter les zones d’ombre à l’origine des débats contemporains, de dresser un état des lieux de la recherche d’alternatives, d’identifier et de comprendre un phénomène nommé trappe à réplication, et surtout, de proposer une voie générale de sortie, utilisant la théorie islamique du besoin et de l’intérêt général, l’idée de partage du risque et celle d’alternative. / The currently prevailing position among Islamic Finance’s jurists and theorists being to prohibit derivative products in Islamic Financial Institutions, the search for an “Islamic” alternative to these products, in particular for market risks’ management, constitutes one of the fundamental axes of research concerning the future of this school and type of institutions. Thus, this doctoral work deals with the inference of the possible contemporary meanings of the Islamic concept called “prohibited Gharar” (litt. “prohibited risk”) while opposing it to the permissible risk-taking, then, based on the corresponding findings, it deals with the exploration and proposal of alternative instruments to derivatives. On the first aspect, this research used texts of Islamic Fiqh (“jurisprudence”), and mobilised qualitative and numerical tools of analysis, while drawing on Max Weber’s method of the idealtype. On the second, it implemented a survey combining literature and field study, before passing the obtained instruments through a filter constructed from the results of the first aspect. This work has mainly contributed to shed a new light on the theories of risk-taking and Gharar in Islam, to identify and discuss the shadow areas behind contemporary debates, to draw up an inventory of research on alternatives, to identify and understand a phenomenon called replication trap, and especially, to propose a general way out, using the Islamic theory of need and public interest, the idea of risk-sharing and that of alternative.

Prison overcrowding : a penological perspective

The World Prison Brief Walmsley (2001:2) reveals that there are 8,7 million people held in penal institutions throughout the world, either as pre-trial detainees or having been convicted and sentenced. Although the rising prison population in South Africa is of great concern, it is certainly not just a South African problem, but an international phenomenon. Prison overcrowding and the resultant financial and human rights problems related to this phenomenon, remain one of the paramount concerns of both developed and developing countries. Overcrowding of prisons negates the rehabilitation of offenders, undermines human dignity in correctional facilities and renders the safety and security of offenders and the community vulnerable. Another problem facing the Department of Correctional Services is the control of communicable diseases and viruses, particularly HIV/AIDS and Tuberculosis. The problem of overcrowding facilitates the easy spread of communicable diseases among inmates. Imprisonment as a sanction remains a reality. Providing alternatives to imprisonment, for example, community based-sanctions, does however ensure that a significant number of offenders can be dealt with in a more balanced manner. Alternative sanctions to incarceration can be more successful, less costly to the state, have fewer negative implications and will lighten the load for the criminal justice system, hence reducing overcrowding. In order to reduce the overcrowding in prisons there has to be a reduction in the number of both awaiting-trial and sentenced prisoners. Reducing the inflow of offenders from the courts to the prisons and trying to get minor offenders in prison to be released should accomplish this. Courts and magistrates must break away from centuries of reliance on imprisonment as punishment. If more people show interest in the human rights of incarcerated prisoners, then further effort will be placed on resolving the overpopulation problem facing the Department of Correctional Services. / Criminology and Security Science / (D. Summaries in English and Afrikaans / In the following theoretical study the phenomenon of boot camps is described within a penological perspective, as it has originated and developed and is applied in the United States of America. The primary aim of this study is to obtain the Magister Artium degree. Secondly, it sheds light on an alternative method of dispensation of offenders, more specific juvenile offenders, in the criminal justice system. The investigation is intended to make a modest contribution to the content of penology. Knowledge and insight obtained can serve as guidelines for future research in respect of and application of boot camps in South Africa. The planning and functioning of boot camps is taken into account and the rationale behind boot camps as an effective institution of punishment is investigated. This was done against the background of the elements of punishment, over-population of prisons, cost-effectiveness, residivism and rehabilitation. The study is of importance for South African circumstances, because of the increasingly over-population of prisons and the negative effect of imprisonment, especially on juveniles. / In die hieropvolgende teoretiese studie word die verskynsel van boot camps soos wat dit in die Verenigde State van Amerika ontstaan en ontwikkel het en toegepas word, binne 'n penologiese perspektief beskryf. Die beskrywing het in die eerste plek ten doel om die graad Magister Artium te verwerf. Ten tweede werp dit Jig op 'n alternatiewe beskikkingsmetode vir oortreders, veral jeugoortreders, in die regsplegingstelsel. Die doel van die ondersoek is om 'n beskeie bydrae tot die vakinhoud van die penologie te lewer. Kennis en insig wat ingesamel is kan as rigtingwyser dien virtoekomstige navorsing met betrekking tot en toepassing van boot camps in Suid-Afrika. Die beplanning en funksionering van boot camps word in oenskou geneem en die rasionaal van boot camps as 'n effektiewe strafinrigting is ondersoek. Dit is gedoen teen die agtergrond van die elemente van straf, gevangenisoorbevolking, koste-effektiwiteit, residivisme en rehabilitasie. À travers la biographie intellectuelle d’un réformateur et rédacteur en chef de Boston, Benjamin O. Flower (1858-1918), de la création de son magazine, The Arena, en 1889 à sa mort, cette thèse explore les ambiguïtés du progressisme et ses « étranges combinaisons théoriques », selon l’expression de l’historien Robert Wiebe. Flower considérait la corruption, la pauvreté et la faillite morale de la société américaine comme des maladies physiques et spirituelles : les idées hétérodoxes de son temps (populisme, socialisme, expérimentations sociales dans le reste du monde mais aussi médecines et spiritualités alternatives) illustraient l’esprit américain de liberté et se révélaient autant de remèdes pour régénérer l’homme et la société. Flower entendait faire de ses magazines une « arène » où débattre librement pour provoquer un nouveau « Grand Réveil » et assurer le progrès de l’humanité. La fin de sa vie voit Flower aux prises avec les ambivalences de sa lutte pour la liberté. Pendant les années 1910, lors de sa croisade pour la « liberté médicale », il lutte contre la volonté de l’American Medical Association de contrôler les médecines alternatives et contre le projet du gouvernement fédéral d’établir un ministère de la Santé. Sa défense de la liberté de la presse face à la censure de la poste le mène ensuite à travailler pendant la Grande Guerre pour un journal anticatholique, The Menace. Ces controverses sur le sens du progrès et de la liberté permettent de comprendre les fractures culturelles qui divisent le réformisme et, à la faveur de l’érection d’un seul et vrai récit de la modernisation, la relégation de son progressisme antimonopolistique dans les marges de l’histoire. / By using as a case study the intellectual biography of Boston reformer and editor Benjamin O. Flower (1858-1918) from the founding of his magazine, The Arena, in 1889 to his death, this dissertation explores the ambiguities of progressivism and revisits its “strange theoretical combinations,” to use historian Robert Wiebe’s phrase. Flower considered the corruption, the poverty and the moral bankruptcy that plagued turn-of-the-century America as physical and spiritual diseases – the nonconformist ideas of his time (populism, socialism, social experiments in the rest of the world, but also alternative medicine and spiritualities) illustrated the American spirit of freedom and could cure and regenerate individuals and society. Flower wanted his magazines, notably the aptly named Arena, to function as an open forum where ideas could be debated freely, thus bringing about a new « Great Awakening » and ensuring progress. At the end of his life, Flower grappled with the ambivalences of freedom. In the 1910s, he fought for “medical freedom,” struggling against the American Medical Association’s move to control alternative medicine and against the creation of a federal Department of Health. He also defended freedom of the press against postal censorship, which led him to work for an anti-Catholic newspaper during the Great War, The Menace. These controversies over the meaning of progress and freedom shed light on the cultural gaps which divided reformism and led to the advent of the modernization narrative and, as a result, to the relegation of antimonopoly progressivism to the margins of history.

The subject of diploma thesis is the evaluation of commercial chains, cheese category, in Czech Republic. The methodology is based on the multicriteria rating of alternatives. In the evaluation of commercial chains may take into account the large number of criteria are used, here are 26, which evaluates 14 alternatives (stores). To evaluate the commercial chains are used preferences of general public and experts. The main objective of the diploma thesis is to determine which store is the best for customers (general public) and for professionals, and then to compare the results.Secondary objective is to explore the possibility of using the multicriteria rating of alternatives methods in praxis.

This dissertation examines nursery/garden centre compliance with Invasive Alien Plant (IAPs) legislation in eThekwini and uMsunduzi, South Africa. Despite South African governmental programmes, an apparent lack of public awareness regarding IAPs persists. The cost to clear IAPs in South Africa is estimated to be 12 billion Rand over 20 years. Nurseries/garden centres should be able to increase customer awareness of IAPs. However, Government regulation/instruction of nurseries/garden centres seems inadequate. A mixed methods approach involving quantitative and qualitative analyses of questionnaires, observations and interviews was used in this study. There was little evidence that nurseries/garden centres stocked/sold CARA plants. However, they were stocking/selling NEMBA plants in spite of knowing CARA, NEMBA and indigenous alternatives. There is little interaction with relevant government/industry programmes. It is recommended that the Department of Environmental Affairs institute a IAPs Advisory Committee to see to the dissemination and provision of relevant information and training concerning IAPs to the industry.

<p>The reason for performing an Environmental Impact Assessment (EIA) is to incorporate environmental concern in different kinds of plans and projects. The purpose of such an assessment is to identify and describe direct, indirect and cumulative environmental impacts.</p><p>Geographical Information System (GIS) is a tool that can be used to combine spatial extension of both sensitive areas and different environmental impacts in a quick and easy way. Because of that, descriptions of environmental impacts and motivation of different standpoints on a specific issue can be more correct and easier to make if GIS is used as a tool.</p><p>Hence, GIS can contribute to improve the quality of Environmental Impact Assessments. If the benefits of using GIS are to out weight the costs, geographical information of satisfactory detail, actuality and accuracy need to be available at reasonable prices.</p><p>In this paper, case studies are carried out for three different geographical analyses to investigate the use of GIS as a tool in EIA. From these case studies, more general conclusions about the benefits and limitations of using GIS for Environmental Impact Assessments are also drawn. The criteria, after which benefits and limitations of GIS have been estimated, are data availability, time consumption for performing the analyses and how the results from the performed analyses can make impact assessments easier, motivate different standpoints and increase the comprehensiveness of the EIA-report.</p><p>The three different GIS-analyses includes calculation of pollution load in a catchment area, estimation of the visual impact from planned buildings and generation of alternative locations for underwater pipes. These analyses have been applied on one ongoing EIA for a freight terminal and one ongoing EIA for an underwater wastewater transmission pipe. The analyses in these case studies have been undertaken with ArcGIS software using the extensions “Spatial Analyst” and “3D Analyst”.</p><p>It is shown in this study that due to uncertainty in available model values and the time consuming data manipulation, it is unlikely that calculations of pollution loads with GIS will be used to any larger extent in EIA. To carry out visual assessments with help of GIS to estimate visual impacts is on the other hand assumed to be useful in EIA-work. Both to assess impacts and to estimate how changes in building design can alter those impacts. To use GIS to produce alternative locations for underwater pipes is also considered valuable in EIA-work, even though there is a considerable lack of data to predict the environmental class of marine areas and the connections between available data and real environmental values are weak. However, the risk of damaging vulnerable and high valued marine areas should decrease when applying this type of analyse.</p> / <p>Miljökonsekvensbeskrivningar (MKB) genomförs för att möjliggöra att hänsyn om miljön tas vid olika typer av exploateringsprojekt och exploateringsplaner. Syftet med en miljökonsekvensbeskrivning är att identifiera och beskriva direkta, indirekta och kumulativa miljöeffekter.</p><p>Geografiska informationssystem (GIS) är ett verktyg som kan användas för att snabbt och enkelt kombinera rumslig utsträckning av både känsliga områden och olika miljökonsekvenser. GIS kan därför användas för att underlätta beskrivningar av miljökonsekvenser och motivera olika ställningstaganden. Därigenom kan GIS bidra till bättre grundade och mer rättvisande miljökonsekvensbeskrivningar. Men för att vinsterna av att genomföra GIS-analyser ska överstiga kostnaderna krävs att geografisk information av tillräcklig detaljeringsgrad, aktualitet och säkerhet finns att tillgå till rimliga kostnader.</p><p>Syftet med denna studie har varit att genom fallstudier undersöka om tre olika GIS-analyser kan användas som verktyg i miljöbedömningar med idag tillgänglig data, samt att utifrån fallstudierna dra mer allmänna slutsatser om vinster och begränsningar av att använda GIS i miljökonsekvensbeskrivningar. De kriterier som har använts för att bedöma vinster och begränsningar är tidsåtgång för analyserna, tillgång på data samt hur analyserna kan vara ett stöd i MKB-arbetet genom att underlätta beskrivningar av konsekvenser, motivera ställningstaganden som görs och öka rapportens begriplighet.</p><p>De tre genomförda GIS-analyserna innefattar beräkning av föroreningsbelastning inom ett avrinningsområde, bedömning av byggnaders landskapspåverkan genom synlighetsanalys samt generering av förslag till alternativ ledningsdragning för en undervattensledning. Dessa analyser har tillämpats på en pågående MKB för en detaljplan för en partihall och en pågående MKB för en avloppsvattenledning under vatten. Analyserna i fallstudierna har genomförts i programmet ArcGIS med tilläggen ”Spatial Analyst” och ”3D Analyst”.</p><p>Studien visar att det på grund av osäkerheter i tillgängliga schablonvärden och tidsåtgång för databehandling är osannolikt att beräkning av föroreningsmängd inom ett avrinningsområde med GIS kommer att användas till någon större utsträckning i MKB. Att med GIS genomföra synlighetsanalyser för att utvärdera landskapspåverkan bedöms däremot kunna användas i MKB, både för att bedöma påverkan och för att utvärdera hur en förändring i en byggnads utformning kan förändra den påverkan. Även att med GIS generera förslag till alternativa ledningsdragningar under vatten bedöms kunna fylla en funktion i MKB trots att tillgången på data för att kunna beskriva olika marina områdens naturvärden är klart bristfällig och kopplingen mellan tillgängliga data och verkliga naturvärden är osäker. Denna typ av analys bör ändå minska risken att värdefulla och skyddsvärda marina områden skadas vid lednignsdragning.</p>

- The issue of the concept of criminal custody The thesis provides a comprehensive overview of selected issues relating to criminal custody, one of the means of securing an accused person for the purposes of criminal proceedings and sentence execution, provided for in the Act on Criminal Procedure. After a concise introduction, the thesis examines the historical development of custody as regulated in the Act No. 141/1961 Coll., on Criminal Procedure. Limits of restricting personal liberty are then discussed from the viewpoint of the Czech Constitution and international commitments of the Czech Republic. The principle part of the thesis deals with material and formal custody law. It defines the term 'custody' and elaborates on the conditions of the imposition of custody, especially with regard to the particular grounds of custody. The section dealing with formal custody law is focused on the provisions regarding the decision process on custody, custody hearing, the examination of the existence of grounds of custody, the maximum duration of custody and the setting off a custody period against a term of imprisonment when the accused is found guilty. The Alternatives to Unconditional Prison Sentence Goal of this diploma thesis is to give a list of alternative punishments which are meant to be alternatives to unconditional prison sentence. These alternative forms in substantial criminal law are the forms which present specific reaction on crime and are not compound with imprisonment. First chapter contains a historical development of alternative forms of punishments. It deals with origins of penalty in law and in public life. There is mentioned a ground-breaking work of Italian philosopher Cessare Beccaria, the starting of alternatives in the second half of 19th century, theirs crisis during the Second World War and also reborn associated with a movement of restorative justice from the seventies of 20th century. Next chapter which is the main part of this diploma thesis is concerned with alternative punishments. There were chosen to be described these punishments: Suspended sentence based on suspension of imprisonment under the condition of living a proper life. Next one is house arrest which places a convict in his home in the specific time which is set in the judgement.
