The Problem Of Freedom In The Context Of The Law Of Causality In Kant

The main concern of the thesis is the problem of reconciliation of freedom and natural causality and to investigate how Kant makes a room for freedom. Kant, firstly, in &ldquo / Analytic&rdquo / , constitutes the conditions of knowledge upon which the objective validity of the law of causality entirely rests. This process of constitution also determines the limits of experience. On the other hand, Kant, in &ldquo / Dialectic&rdquo / , postulates freedom as a noumenal cause together with the law of causality. Transcendental freedom, in this case, is a problematic concept which transcends the limits of experience, as it seems to destruct the unity of experience. However, Kant gives up neither the law of causality nor the idea of freedom, but rather he insists upon the idea that they can exist together without contradiction by asserting the distinction between phenomena and noumena as different grounds on which these two different types of causalities rest. According to Kant both are indispensable, as the former is necessary for the knowledge and the latter is absolutely needed for morality. In this context this thesis aims to explain the objective validity of natural causality which is proved in Second Analogy and the transcendental ground of the idea of freedom which is established in the solution of Third Antinomy in Kant&rsquo / s Critique of Pure Reason. And it is discussed whether Kant&rsquo / s solution of this issue is satisfactory and legitimate or not.

Este trabalho versa sobre a antinomia da faculdade de conhecimento, também conhecida como paradoxo de Zeller, que Schopenhauer refere no primeiro livro de O mundo como Vontade e representação. Essa questão tem sido bastante discutida na história do pensamento schopenhaueriano e permanece ainda hoje como um problema em aberto. Desde os primeiros leitores de Schopenhauer, a antinomia da faculdade de conhecimento foi apontada como um problema de solução difícil, quando não impossível, e explicada de maneiras diversas. Algumas vezes, apontou-se a heterogeneidade das teorias sobre as quais o pensamento schopenhaueriano se ergue; em outras, a antinomia foi atribuída a erros de interpretação da filosofia kantiana; por vezes, remeteram-na a um dualismo em que se chocam materialismo e idealismo, ou realismo e idealismo, e há ainda outras visões. Nesta tese, propomos uma interpretação alternativa, que toma as dificuldades da filosofia schopenhaueriana como constitutivas, e, sem pretender justificá-la nem impugná-la, busca sua compreensão a partir das questões teóricas com as quais o filósofo se defrontou. Como resultado, encontramos que Schopenhauer evidencia a insuficiência tanto do idealismo quanto do realismo para a explicação completa e correta do mundo, bem como a mútua exigência entre ambos. A complementaridade entre os pontos de vista opostos do idealismo e do realismo impõe que sejam articulados, embora sua combinação origine os diversos problemas presentes na obra schopenhaueriana, entre os quais está a antinomia da faculdade de conhecimento. Adicionalmente, analisamos outras questões e dificuldades que surgiram no pensamento de Schopenhauer, algumas mencionadas pelo filósofo, outras não. / This work deals with the antinomy of the faculty of knowledge, also known as Zeller\'s paradox, to which Schopenhauer refers in the first book of The world as Will and representation. This question has been much discussed in the history of Schopenhauer\'s thought and still remains today as an unsolved problem. Since the early readers of Schopenhauer, the antinomy of the faculty of knowledge was pointed out as a problem of difficult solution, if not impossible, and explained in different ways. At times, the heterogeneity of the theories on which Schopenhauer\'s thought stands has been pointed out; other times, the antinomy was attributed to errors in the interpretation of Kantian philosophy; for many times referred to a dualism in which collide materialism and idealism, or realism and idealism; and there are still other viewpoints. In this thesis, we propose an alternative interpretation, which takes the difficulties of Schopenhauer\'s philosophy as constitutive, and not pretending to justify or contest it, we search for an understanding from the theoretical questions with which the philosopher faced. As a result, we find that Schopenhauer evidences the inadequacy of both idealism and realism for the complete and correct explanation of the world, as well as the mutual demand between them. The complementarity between the opposing viewpoints of idealism and realism demands they to be articulated, although their combination gives rise to the various problems present in Schopenhauer\'s work, among which is the antinomy of the faculty of knowledge. In addition, we analyzed other issues and difficulties that arose in Schopenhauer\'s thought, some mentioned by the philosopher.

Aristotelovo řešení Zenónových paradoxů / Aristotle's solution of Zeno's paradoxes

(in English): Aim of present paper is to reconstruct and compare Aristotle's solution of Zeno's paradoxes of motion from Books VI and VIII of his Physics. Aristotle claims that there is difference between these two solutions. There is difference in charakter of question which is posed by Zeno. In book VI. the question is concerning the possibility of traversing infinite distance in finite time. In book VIII. this question is asked about time itself. It is here, in book VIII, where we should find the right solution to paradoxes of motion. In this paper I shall look into the nature of this difference between solution in book six and in book VIII, and I will find out if there si some consquence for Aristotle's conception of magnitudes.

Cette thèse étudie le rôle de la pensée morale et politique dans la tragédie moderne (XVIe-XVIIIe siècles), en se concentrant sur un ensemble de pièces néo-latines, françaises, italiennes et anglaises qui représentent la mort du dictateur romain Jules César, auxquelles on a joint Cinna de Corneille. Pour susciter les passions tragiques, la fable doit représenter un personnage, ou un groupe de personnages, qui passe du bonheur au malheur à la suite d’une « faute » moralement ou politiquement ambiguë. Cet enchaînement est particulièrement tragique lorsque la « faute » est au moins partiellement involontaire et résulte d’une forme de nécessité : la tragédie manifeste alors le poids de la « fortune morale ». L’ambiguïté de la « faute » tragique peut revêtir diverses formes ; dans les Mort(s) de César, elle réside d’une part dans le fait que les personnages sont contraints d’agir dans une situation caractérisée par plusieurs antinomies, d’autre part dans le fait que leurs motivations paraissent à certains égards contraires aux justifications qu’ils avancent. La tragédie moderne est profondément réfractaire à la pensée casuiste contemporaine – sous les diverses formes qu’elle prend dans la théorie de l’invention rhétorique, la philosophie morale et politique et l’historiographie –, car elle laisse irrésolus les « cas » moraux et politiques qu’elle expose. Mais Cinna, première « tragédie à fin heureuse » du répertoire français, montre comment il est possible de parvenir à la réconciliation et à une issue moralement et politiquement satisfaisante par-delà les antinomies tragiques. / This dissertation investigates the functions of moral and political thought in modern tragedy (16th-18th centuries), focusing on a group of Neo-Latin, French, Italian and English plays which represent the death of the Roman dictator Julius Caesar, as well as on Corneille’s Cinna. In order to provoke the tragic emotions, a fable must represent a character or a group of characters whose fall from happiness into mishap is a consequence of a morally or politically ambiguous “flaw”. This sequence is particularly tragic when the “flaw” is at least partially unintentional and results from a kind of necessity : tragedy thus manifests the importance of “moral luck”. The ambiguity of the tragic “flaw” may arise from different circumstances ; in the plays representing the death of Caesar it consists on the one hand in the antinomies which the characters must face, on the other hand in the fact that their motivations appear in some ways contrary to the arguments they use in order to justify themselves. Modern tragedy is profoundly extraneous to contemporary casuistry (as developed in the rhetorical theory of invention, in moral and political philosophy and in historical writing), in that it leaves moral and political “cases” unsolved. However, Cinna, the first happy-ending tragedy in the French theatre, shows how reconciliation and a morally and politically satisfying ending are possible despite the tragic antinomies.

The environmental implications of the local-state antinomy in Australia

An antinomy is a contradiction between a principle and its opposite, where there is a compelling case for accepting both. This thesis adopts the antinomy of local-state government in Australia as its central conceptual theme, describing it with the following defensible, but contradictory principles that:¶ · Australian local governments are statutory agencies of Australia’s state governments, with no power or authority beyond that which is ascribed to them by the states (the outside-in principle); and¶ · Local governments in Australia are independent agencies whose authority and interests transcend their regulatory powers by nature of their attachment to their local area (the inside-out principle).¶ The central conceptual theme of the antinomy of local-state government shapes the overall thesis, as well as providing the focus for its introduction and conclusion. The thesis induces elements of the antinomy and structures much of its discussion around these key issues. It does not try to prove or resolve the antinomy. Instead the thesis uses the concept to explore and develop its second complex theme - the practical and applied experience of Australian local governments (LGs) as they attempt to deliver beneficial environmental outcomes. The great bulk of the substantive work presented in the thesis focuses on descriptions and analyses of LGs’ environmental work and the contexts within which they do it. The thesis contends that the local-state antinomy underpins many problems facing Australian LGs as they attempt to deliver beneficial environmental outcomes. Four research questions are addressed. They are:¶ · How can Australian LG capacity to deliver beneficial environmental outcomes be understood?¶ · Within this capacity, what are the environmental outcomes now being achieved by Australian LGs?¶ · How can Australian local government extend its capacity to deliver beneficial environmental outcomes? And¶ · What are the implications of the local-state antinomy on Australian LG capacity to deliver beneficial environmental outcomes?¶ This thesis reviews literature on Australian LG, LG environmental work, and the methods that are appropriate in investigating these questions. The overall thesis uses scientific, grounded theory and action research methods and draws on ideas from symbolic interactionism. Parts of the thesis also use environmental risk assessment, gap analysis techniques, case study and comparative analysis. The goal of generating grounded theories led to a strong focus on the development and exploration of analytical categories and the relationships between them. One such category summarises the relationship between LG and state government (SG), whereby LGs are identified as the inside sphere of government, while the SG is one of several outside spheres. Environmental efforts that impact between the spheres are described in relation to their source and impact, using this terminology, so that inside-out initiatives are driven by LGs but impact more broadly, and outside-in initiatives are driven by states but impact on local areas.¶ Two extensive studies are presented, each stemming primarily from one side of the local-state antinomy. The first is a quantitative, statewide study of local (and state) government implementation of the Queensland Environmental Protection Act. That process is considered a predominantly outside-in environmental initiative, in that LG interest and authority for that work stem directly from a SG statute. For simplicity, this is referred to as an outside-in study. That study involved the development and application of the Comparative Environmental Risk Assessment Method, that enabled the assessment of the environmental and other outcomes from the Queensland legislation.¶ The outside-in study is complimented by comparative case studies that mostly reflect inside-out environmental initiatives as they are defined and described by LGs. Again, this required the development of innovative research methods, specifically a comparative case study method. 34 case studies gathered from different types of LGs across Australia are presented, each representing an attempt by LG to deliver beneficial environmental outcomes.¶ In answer to the research questions, LG capacity to deliver environmental outcomes can be understood when the antinomy is examined through the research methods and analytical categories developed and presented here. LGs are delivering significant beneficial environmental outcomes, both as agents of SGs and through their own initiatives. Improving LG capacity to deliver environmental outcomes primarily requires a respect for LG perspectives, and for LG priorities, which inherently include a focus on their own local areas. State governments can build effective partnerships between the spheres and enhance LG environmental capacity by recognising and supporting LG’s own priorities, while assisting their engagement with broader strategic objectives.

Detalham-se, assim, os objetivos e os métodos dos tratados internacionais em matéria tributária, os quais visam a evitar a ocorrência do fenômeno jurídico da bitributação. Concluída a análise do procedimento de internalização desses tratados pelo ordenamento brasileiro, há a possibilidade de surgirem conflitos entre a norma internacional recepcionada e a lei interna anterior ou superveniente. E, por essa razão, apresentam-se os critérios gerais e específicos adotados pela doutrina e pelo Supremo Tribunal Federal para solucionar antinomias jurídicas. / The present dissertation aims to analyze the form of reception of international tax treaties by the Brazilian domestic order. For this to happen, it is important to verify the form as the international law is related with the domestic law. By presenting the International Tax Law as one of the branches of the Public International Law, it is also relevant to study the international treaties as one of the main sources of the International Law, along with the way how the Executive and the Legislative participate of its ratification. Besides that, the dissertation also points for international tax treaties objectives and methods to avoid the double taxation. After the reception of these international treaties, it can appear conflicts with the internal order. And that is te reason to study the general and specific methods adopted by the doctrine and the Federal Supreme Court to solve the legal antinomies.

O procedimento crítico adotado organiza uma periodização das obras dos cancionistas particulares, reconhecidos num "contexto de obras" mais geral. A partir disso, empreende-se a compreensão do sentido histórico destas obras frente ao contexto de época. Tendo em vista a definição de tal contexto, recorreu-se à crítica da "noção de MPB" (Música Popular Brasileira), chegando-se à conclusão de que esta noção é uma impostura conceitual. Por isso, fez-se necessária a avaliação de referenciais críticos que tratassem da dinâmica histórica da experiência musical brasileira. Para efeitos de análise, trabalhou-se com a avaliação do projeto musical de Mário de Andrade, reconhecendo a bossa nova como um desdobramento contraditório da "utopia do som nacional" do modernista. Em seguida, a fim de consolidar conceitos e categorias sobre a experiência musical brasileira, levando em consideração o pressuposto da análise histórica materialista calcada nas mediações estéticas, organizou-se a interpretação dos métodos críticos de José Ramos Tinhorão e José Miguel Wisnik. Aí, reconheceu-se não apenas o reforço de certo referencial teóricometodológico, mas a ressonância de problemas cuja cristalização inicial está na própria experiência musical estudada. De posse das categorias críticas anteriormente consolidadas, apresenta-se os primeiros anos das obras de Chico Buarque e Paulinho da Viola como um período de maturação de antinomias estéticas que sedimentam em forma... (Resumo completo, clicar acesso eletrônico abaixo) / Abstract: This thesis organizes a historical interpretation of the work of two important names of Brazilian musical experience, namely: Chico Buarque de Hollanda and Paulinho da Viola. The critical procedure adopted organizes a periodization of the works of particular musicians, recognized in a more generally "context of works". From this, it undertakes to understand the historical meaning of these works in the epochal context. In view of the definition of such a context, one appealed to the criticism of the "concept of MPB" (Brazilian Popular Music), coming to the conclusion that this notion is a sham conceptual. Therefore, it was necessary to evaluate the critical benchmarks that treat the historical dynamics of Brazilian music experience. To the analysis, one worked with the evaluation of the musical project of Mario de Andrade, recognizing Bossa Nova as a contradictory split of "utopia of national sound" of the modernist. Then, in view of consolidating concepts and categories on the Brazilian musical experience, taking into account the assumption of historical materialist analysis based on aesthetic mediation, one organized the interpretation of critical methods of José Ramos Tinhorão and José Miguel Wisnik. In them, it was recognized not only the strengthening of certain theoretical and methodological references, but the resonance of problems whose initial crystallization is in the very musical experience studied.
