Après une intrusion chaotique dans la théorie de la responsabilité pénale, l’imputabilité peut aujourd’hui apparaître comme une donnée d’essence classique. Elle répond à une définition subjective faisant consensus en doctrine et supposant l’addition du discernement et d’une volonté libre de l’agent. Dans le prolongement, elle est unanimement entendue comme constituant le fondement de la responsabilité pénale. Cependant, la cohabitation entre les différentes conditions de la responsabilité pénale, en particulier entre les concepts de culpabilité et d’imputabilité, n’est peut-être pas aussi pacifiée qu’il n’y paraît. En réalité, la question de l’indépendance des notions n’a jamais été clairement résolue, car leurs composantes respectives participent des conditions subjectives à l’engagement de la responsabilité pénale. Pourtant, la question est loin d’être anecdotique, en particulier si l’on considère certaines institutions fondamentales du droit pénal, au rang desquelles figurent les notions d’infraction et de complicité. Il apparaît ainsi, à l’analyse, que la définition traditionnelle de l’imputabilité mérite quelques ajustements, conduisant à une reconfiguration du champ de la condition de liberté relevant de l’imputabilité. Cette recherche vise aussi à établir que l’imputabilité est une donnée étrangère à l’infraction concrètement commise. Cette place spécifique au sein de la responsabilité pénale, mettant en évidence le lien entre l’imputabilité et la sanction infligée en rétribution de l’infraction commise, permet d’adopter une vision plus large du concept, susceptible d’affronter le bouleversement consécutif à l’entrée du droit pénal dans l’ère de la post-modernité. Cette dernière, que l’on pourrait associer au néopositivisme pénal du début du siècle, s’est accompagnée d’une résurgence des concepts de risque et de dangerosité. L’impact de cette évolution sur l’imputabilité peut apparaître radical : rupture du caractère unitaire de la notion, émergence du concept d’imputation à l’égard des personnes morales, voire même effacement pur et simple de l’imputabilité à l’égard des personnes physiques. Pourtant, des modalités de restauration de l’exigence d’imputabilité seront envisagées sur les terrains substantiel, par le truchement de l’imputabilité comprise comme capacité pénale, et processuel – par des propositions concernant les procédures pensées en considération de la psychologie de l’agent. Au bout du compte, il apparaît que l’imputabilité est de nature à jouer un rôle décisif dans l’organisation d’une cohabitation raisonnée avec le concept de dangerosité, en condamnant la prise en compte de la dangerosité seulement hypothétique sans exclure la possibilité d’une rétention après la peine. / After a chaotic intrusion in the theory of penal liability, imputability can today appear as a classical notion. The general doctrinal consensus is that it depends on a subjective definition, implying the offender’s discernment and free will. Moreover, the notion of imputability is unanimously considered as the basis of penal liability. However, cohabitation between the various conditions of penal liability, particularly between the concepts of guilt and imputability, may not be as steady as it seems. Indeed, the independence of these notions has actually never been clearly demonstrated, for their respective components represent the subjective conditions creating penal liability. Nevertheless, this topic is far from being anecdotal, specifically among several fundamental institutions of criminal Law, in which the notions of infraction and complicity are involved. Thus, the definition of imputability may deserve some adjustments, and imply, consequently, a reworking of the release condition coming under imputability. This study also aims at proving that imputability is an irrelevant element to the concretely committed offence. This specific part in penal liability, highlighting the link between imputability and the penalty imposed in response to the committed offence, enables a wider vision of the concept that could help facing the upheaval resulting from the entry of criminal Law in the post-modernity era. The latter, that one could associate with the beginning of the century’s penal neopositivism, also implied the resurgence of the concepts of risk and dangerousness. The impact of this evolution about imputability may seem radical : end of the unitary aspect of the notion, emergence of the concept of imputation towards legal entities, and even total erasure of imputability towards natural persons. And yet, some solutions to the reconstitution of the exigence of imputability will be developed, not only in a substantial approach, where imputability will be understood as penal capacity, but also in a procedural approach – thanks to suggestions of procedures taking the offender’s psyche into account. In the end, imputability seems to play a major part in the organization of a balanced cohabitation with the concept of dangerousness, by condemning a strictly hypothetical consideration of dangerousness, without excluding a potential reservation after the penalty.

Arbetet i särskolan ska förbereda för vuxenlivet, och sex- och samlevnadsundervisningen ska bedrivas utifrån ett främjande perspektiv med fokus på sexualitet, identitet, normer och jämställdhet. I Skolinspektionens aktuella granskning av sex- och samlevnadsundervisningen framkommer betydande brister. Den här studien vill öka kunskapen om pedagogers föreställningar om sexualitet och sex- och samlevnad avseende elever med intellektuell funktionsnedsättning i särskolan. Undersökningen utgörs av semistrukturerade intervjuer med pedagoger i gymnasiesärskolan. Utifrån ett normkritiskt perspektiv har insamlad empiri analyserats med hjälp av begreppen cripteori, normalitet och empowerment i syfte att beskriva och tolka hur pedagogerna i särskolan förhåller sig till eleverna och deras förmåga och rätt till sin sexualitet. Olika teman har konstruerats ur empirin för att definiera attityder, normer och förhållningssätt. Resultatet visar pedagoger med oerhört engagemang i ett svårt ämne där de känner sig ensamma och utsatta utan pedagogiskt stöd. Eleverna visar en stor önskan att passa in, de skäms för att gå i särskolan och gör allt för att inte framstå som avvikande. Osäkerheten hos pedagogerna är av central betydelse samtidigt som den normkritiska medvetenheten i undervisningen behöver stärkas. Slutsatsen är att kompetensutveckling och pedagogisk vägledning inom särskolan är avgörande för detta viktiga men känsliga ämne. / The work in school for students with special needs should prepare for adult life, and sex and cohabitation education should be based on a promotion perspective with focus on sexuality, identity, norms and gender equality. The School Inspectorate's current review of sex and cohabitation education reveals significant shortcomings. This study aims to increase knowledge about educators' perceptions of sexuality, and sex and cohabitation, regarding students with intellectual disabilities. The study consists of semistructured interviews with educators in special needs upper secondary school. Based on a norm critical perspective, collected data has been analyzed using the concepts of crip theory, normality and empowerment for the purpose of describing and interpreting how the educators relate to the students, their ability and right to their own sexuality. Different themes have been constructed from the collected data in order to define attitudes, norms and approaches. The result shows educators with huge commitment in a difficult field where they feel lonely and vulnerable without pedagogical support. The students show great desire to fit in, they are ashamed of going to special school and do anything to not appear deviant. The insecurity within the educators is of central importance and there is little norm critical awareness in the teaching. The conclusion is that knowledge development and pedagogical guidance within the special needs upper secondary school is crucial in this important but sensitive field.

Contrairement au législateur français, le législateur polonais n'a pas donné de définition du concubinage. Nonobstant cette différence, les éléments constitutifs du concubinage dans les deux systèmes légaux se ressemblent. Le concubinage se caractérise tant en France qu'en Pologne par: l'absence de lien juridique entre les concubins, la monogamie, la stabilité et la continuité et la communauté de vie. Dans les deux pays, le concubinage n'est pas juridiquement inorganisé. Le concubinage ne fait naître aucun droit ni obligation entre concubins, que ce soit sur le plan personnel ou patrimonial. / After leaving the world of disapproval, concubinage has integrated the social order and consequently the legal order. In French law, cohabitation is legally defined. In Poland, a legal definition of cohabitation does not exist. Notwithstanding this difference, the elements of cohabitation in the two legal systems are similar. Cohabitation is characterized in France and in Poland by the absence of a legal relationship between partners, monogamy, stability and continuity, and community of life. In both countries, concubinage is not legally organized. Cohabitation does not create any rights or obligations between the cohabitants, whether in a personal, property or financial sphere. Property relationships of cohabitants and their liquidation pose many difficulties. In order to legally qualify the economic acts of the cohabitants, it is necessary to retrospectively analyse the facts.

The purpose of this study is to explore how people construct their intimate
relationships, and to describe the patterns of connection and disconnection and
their meanings within the social and cultural contexts of these relationships. It
attempts to describe how the participating couples' relationships may or may not
have changed due to the research process consisting of reflections and joint
story telling, and the interventions of the researcher.
Social constructionism is the epistemological framework of this study and indepth
unstructured interviews with a cohabiting and a married couple were
conducted. Hermeneutics was the method used to analyse the data.
The participants' stories were recounted through the researcher's lens in the form
of themes characterising their relationships. A comparative analysis was
undertaken between the common themes identified in the two participating
couples and literature.
The information gained could assist couples and professionals in respecting

consideration the present South African position, legal comparison, the moral
argument, and the influence of the Constitution of South Africa. The different forms
of the de facto marriage in its wide interpretation are reviewed and the following
relationships are discussed: cohabitation relationships; customary marriages;
marriages resulting from religious traditions; and homosexual relationships.
It is found that the present South African legal position is very unsatisfactory. Several
suggestions for amendments are made, and the unique characteristics of the South
African situation to be taken into consideration in forming a new approach, are
highlighted. It is pleaded that the legal profession accept the challenge to create, with

Le sujet principal de ce texte est une forme très ciblée de ségrégation démographique : la ségrégation selon le type de famille. Cependant, puisque la répartition spatiale des familles mariées, des familles en union libre, des familles monoparentales à chef féminin et de celles à chef masculin ne dépend pas uniquement de leur structure, il faut aussi considérer d'autres facettes de leur identité, notamment leurs caractéristiques socio-économiques et ethnoculturelles. La combinaison de ces facteurs engendre une ségrégation croisée que nous explorons avec les données du recensement de 2006 pour la région métropolitaine de Montréal. Nous utilisons d'abord des indices de ségrégation pour mettre en évidence une ségrégation familiale "brute", puis nous avons recours à des modèles de locational attainment pour déterminer l'effet "net" du type de famille sur le revenu médian du quartier de résidence et sur la distance qui sépare ce quartier du centre-ville. Nous trouvons qu'il existe une interaction importante entre l'appartenance ethnoculturelle, le revenu familial et le type de famille ce qui nous conduit à relativiser les résultats de recherches qui ne prennent pas en compte l'hétérogénéité interne des types de famille. / The main topic of this text is a narrowly defined form of demographic segregation: segregation by family type. However, since the spatial distribution of married, cohabiting, lone-mother, or lone-father families does not depend solely on their structure, we must also consider other aspects of their identity, including their socio-economic and ethno-cultural characteristics. The combination of these factors produces a cross-segregation that we investigate using 2006 census data for the Montreal metropolitan area. We first use segregation indices to highlight a "raw" family type segregation and we then use locational attainment models to determine its "net" effect on the median household income of the neighborhood and on the distance between the neighborhood and the city core. We find a significant interaction between ethnicity, family income and family type which leads us to put in perspective the findings of studies that do not take into account the internal heterogeneity of family types.

quant aux rapports interpersonnels entre les membres de couples non mariés.
Pourtant, leur nombre augmente considérablement et, en 2001, il y avait 1 158
410 couples en union libre au Canada, dont 508 525 vivaient au Québec. Les
conjoints de fait des autres provinces canadiennes ont revendiqué un statut
juridique d'égalité de droits avec les couples mariés, ce qui a donné lieu à
plusieurs décisions de la Cour suprême du Canada et à la mise en vigueur de
lois visant l'encadrement juridique de la rupture de ces conjoints de fait. C'est
ainsi que toutes les provinces canadiennes, sauf le Québec, imposent une
obligation alimentaire entre conjoints de fait à la rupture. La présente étude
utilise les méthodologies d'analyse proposées par les théories légales féministes
pour aborder la situation juridique de la famille québécoise dans un contexte
historique et social afin de suggérer la mise en place d'un cadre légal des
rapports interpersonnels des conjoints de fait. Afin de favoriser une plus grande
égalité et une solidarité familiale, l'auteur propose l'établissement d'une
obligation alimentaire compensatoire entre les membres des couples québécois
non-mariés, avec enfants. / Quebec is the only Canadian province that does not impose legal obligations
regarding interpersonal relations between the members of unmarried couples. In
2001, there was 1 158 410 unmarried couples in Canada, of which 508 525 were
living in the province of Ouebec. Common law spouses from other provinces
have claimed equal legal status with married couples, which lead to many
decisions from the Supreme Court of Canada and to provincial legislations
regarding their separation. Thus, ail Canadian provinces except Ouebec impose
alimentary support on common law spouses at separation. This study uses the
methodology of feminist legal theories to approach the legal situation of Quebec
families in a historical and sociological context to propose a legislation regarding
interpersonal relations within unmarried couples. According to the author, there
should be a compensatory obligation of support between the members of
unmarried couples with children to favor equality and familial solidarity.
