Este trabalho se propõe narrar o surgimento e a evolução da legislação do Direito de Autor tendo como referência o livro, pois ele foi o primeiro objeto a se beneficiar desse direito e, ainda hoje, é de relevante importância no desenvolvimento da legislação autoral. Nesse sentido, a pesquisa oferece reflexões acerca dos desafios impostos pela reprodução digital das obras literárias, tendo em vista o desejável equilíbrio entre duas áreas aparentemente conflitantes: o interesse individual dos titulares de direito pela proteção da obra e o interesse social pelo acesso ao conhecimento dentro da problemática decorrente das inovações tecnológicas, suas implicações internacionais e o conflito com as normas internas, o que culminará na proposta da reforma da lei de Direito de Autor pelo Ministério da Cultura. / This study paper is a proposal to review the evolution of the law of copyright. As a reference book, it was the first object to take advantage of this right and continues to play an important role in the development of copyright legislation. The research goal is to outline the challenges of the digital reproduction of works, providing a clear articulation of the desired balance between two seemingly conflicting objectives: the individual interests related to copyright holders and the social interest groups in accessing the knowledge within the problems arising from technological innovations. Technical innovation challenges include the domestic and international implications that culminated in the proposal to review the Brazil Copyright Law suggested by the Ministry of Culture.

Licensiering utgör ett viktigt verktyg inom upphovsrätten och har en stor praktisk betydelse för såväl upphovsmän som rättighetsutnyttjare och andra. Avtalslicensen är en nordisk rättsfigur som framtagits för att klarera rättigheter vid massutnyttjanden av upphovsrättsligt skyddade verk och ger möjlighet att utnyttja verk av utanförstående upphovsmän utan att inhämta tillstånd. Upphovsmännens rättigheter tillvaratas genom rätt till ersättning och erforderliga skyddsregler. Nyligen genomförda nationella lagändringar tillsammans med lagstiftningsprojekt på EU-nivå har aktualiserat avtalslicenskonstruktionen och dess funktion. De nationella lagändringarna har utvidgad avtalslicensbestämmelserna som nu omfattar fler tillgängliggöranden, fler verkstyper och fler rättssubjekt än tidigare, något som ger såväl positiva som negativa effekter på marknadens parter. Inom EU har direktiv om kollektiv rättighetsförvaltning och andra lagstiftningsprojekt såsom en gemensam EU- rättslig upphovsrättslagstiftning föranlett frågor om avtalslicensens framtid. Avtalslicenser har funnits i Sverige sedan 1960-talet och fortsätter att utvecklas och utvidgas i takt med att nya tekniska lösningar uppstår. Ett mer globalt, gränsöverskridande samhälle skapar nya förutsättningar och nya möjligheter men kan även ge upphov till nya problem. De upphovsrättsliga organisationerna är välfungerande i Sverige vilket är en förutsättning för att konstruktionen skall fungera på ett tillfredställande sätt. Stor kollektiv anslutning och transparens kan identifieras som anledningar till konstruktionens framgång i Sverige. Utvidgningen av avtalslicenserna tyder också på ett stort förtroende för rättsfiguren från samtliga parter. Vidare ger nya avtalslicenser möjligheter att utveckla nya innovativa tjänster där strömmade tjänster kommer att spela en central roll i framtiden. Avtalslicensens framtid är beroende av många faktorer, bland annat utvecklingen inom EU där det sker ett kontinuerligt arbete för att harmonisera medlemsstaternas upphovsrättsliga lagstiftning. Idéer om gemensam EU- registrering av upphovsrätt och en harmoniserad EU-rättslig upphovsrättslagstiftning kan komma att bli avgörande för avtalslicensernas framtid.

El principal objetivo de éste proyecto de investigación es la definición de una arquitectura que permita la protección y gestión de los derechos digitales en un entorno de gestión de contenido multimedia, siguiendo estándares abiertos siempre que sea posible. A fin de conseguir dicho objetivo, se analizarán y considerarán múltiples estándares e iniciativas relacionados.En primer lugar se aborda la definición de una arquitectura preliminar basada en MPEG-21 que permite la protección y gestión de los derechos digitales (DRM) aplicables a contenido multimedia. Más adelante, se presenta una arquitectura genérica y se describen diferentes implementaciones desarrolladas en proyectos nacionales y europeos, como AXMEDIS, VISNET II, Linked-Work y GILDDA. El análisis incluye casos de uso, aspectos de seguridad y la propuesta de una metodología de prueba o test. En el caso de Linked-Work, se detalla una implementación específica, resaltando los conceptos clave que la hacen diferente de otros sistemas de DRM. / The main goal of this research project is to define a generic architecture for the protection and management of digital rights in a multimedia content management scenario following open standards as much as possible. In order to achieve this goal, several standards and initiatives will be analysed and taken into account.First, a MPEG-21-based preliminary architecture for the protection and management of digital rights for multimedia content is tackled. Later on, a more general architecture is defined. Several implementations are described such as those in several Spanish and European projects such as AXMEDIS, VISNET II, Linked-Work and GILDDA. The focus in made on use cases, security features and a testing methodology. Linked-Work details a specific implementation, emphasising on the key concepts that make it different from other kind of DRM systems.

Title of the thesis: Current issues of the copyright of the EU: transformation of the copyright in the information society The aim of this master's thesis is to analyse the current issues of the copyright of the EU and identify possible future trends, which should find their way to the upcoming third wave of harmonisation by European Commission. Therefore the master's thesis is based on the analysis of the issues identified for the revision of European copyright by European Commission itself in the recent public consultation. The issues were analysed in three steps to attend the aim. Firstly, the scope of identified issues for revision of the law is analysed. It was assumed, that the issues presented by Commission are requesting legislative action because of the lack of applicable solutions or due to high rate of legal uncertainty. Secondly, the current state of European copyright in issues was tested for striking the fair balance of stakeholder in the light of the utilitarian theory of copyright. Based on the previous two steps, possible future trends recommendable for the revision of the European Copyright were identified. Résumé: Limits of work of copyright in visual art This diploma thesis primarily deals with the concept of copyright work in the current Czech law and its relation towards works of contemporary visual art. The main aim of this thesis is to carry out a complex analysis of conceptual features of work of copyright under the Czech Copyright Act No. 121/2000 Coll. (including key and not always properly interpreted terms such as work of art, originality, or creativity) and then to apply these features to examples of the world's major works of visual art from the twentieth and twenty-first century. Author of this thesis tries to find out whether even specific works of visual art "meet legal requirements" imposed on works of copyright and thus may enjoy the copyright protection in the Czech legal system. It is the effort to identify boundaries between works of copyright and objects which are not under the protection of copyright law what is reflected in the title of this diploma thesis. Originality is the most basic requirement for the copyrighting of a work and may be viewed as the mirror image of copyright infringement. In terms of section 2(3) of the Copyright Act, a work remains eligible for copyright even if the making thereof involved an infringement of copyright in some other work. However, a certain aspect or a feature of a work (relating to the “substantial part” requirement for copyright infringement; “substantial part” being understood from a hypertext rather than a linear point of view) cannot be infringing and original. In this thesis, the South African legal understanding of the originality concept is determined from case law. Specific attention is given to the meaning of “skill” and “labour”; the protection afforded to mere labour in South Africa and certain selected other jurisdictions; how the subjective nature of the originality test is affected by the “meritorious distinctiveness” requirement; and the degree of own skill and/or labour required for a work to be original and consequently protected. The present literary concept of originality is derived from literary discussions that appeared in newspapers and other publications in the wake of six “plagiarism scandals” which each caused a furore in Afrikaans literary circles. Even though the terminology used by littérateurs differs from that used in legal circles, originality essentially means the same for littérateurs and lawyers. Skill and/or labour as required by law is reflected in the literary “crucial distance” concept. The fact that a sufficient degree of skill and/or labour is required is reflected in the fact that the literary standard of a work is determined on the basis of how “tightly woven” a work is. Although a general protection of original ideas would negatively influence the free flow of information, measures for the protection of ideas are developing, particularly in the United States of America, where ideas (especially in the film industry) are a very valuable commodity. As Swarth proposes, applying the “novelty” and “concreteness” criteria in inverse ratio to each other could help to create an environment where idea purveyors and prospective buyers felt more free to negotiate and enter into agreements over original ideas. Postmodernism, a contemporary interpretative strategy that reaches into nearly every aspect of modern society, is discussed with specific reference to its interaction with originality. The influences of two phenomena of postmodernism on the originality concept, namely hypertext and Chaos theory, are investigated. Recommendations are made regarding measures aimed at the retention of talented authors and the original content of works in the wake of plagiarism scandals, while still holding the wrongdoer responsible for his actions. Increased focus is put on available jurisdiction, especially jusrisdiction of The Court of Justice of the European Union. The UCDR - A Source For Innovation or the Downfall of the Fashion Industry : A Comparative Analysis of Whether the Unregistered Community Design Right is Adequate for Small Fashion Businesses in the EUParkan, Sanna January 2021 (has links)
The fashion industry is one of the largest industries in world, yet the priority of creating an adequate protection for the industry can be questioned. Thankfully, the EU introduced the UCDR in the early 21st century, which grants protection for the appearance of a design of it reaches the requirements of novelty and individual character. The aim of this thesis has been to examine whether the UCDR is adequte for small fashion businesses and designers trying to gain a foothold in the industry. The larger businesses are not of interest as they have the resources to go through court-proceedings. As the UCDR is quite a new protection and the thesis aims to see if it is in fact the best protection for small fashion businesses, a comparison have been made with three national legislations within the EU; France, UK and Sweden. All requirements and aspects of the UCDR and the national legislations have been analysed with the finding that the UCDR, even though the french legislation is more generous in giving out protection, is the best protection for small businesses within the EU. The UCDR ensures that the copyist is caught whilst interpretations are allowed. Nevertheless, it has been found that there is a need for clarification regarding whether a design first disclosed in a third country can gain protection, if it is made available within the EU before the circles specialised operating within the Community become aware of the design. Furthermore, the time it takes to go through litigation exceeds the lifetime of the design which has been allegedly infringed. This makes the UCDR:s deterrent effect lower, although not non-existent. At the end of the thesis, suggestions have been made as to how these issues can and/or should be solved, and a basis for a future discussion have been made.
