This thesis carried out an analysis of various aspects of liability for defects in the contract of sale under the New Civil Code. The text discusses general liability and displays special treatment contracts. The thesis includes a division of defects, deals with a liability for defects focused on the sale contract and a contract for work. Further specification party beneficiary rights of defective performance and other rights to the settlement of total loss. There are given rights principles and procedures of the defects of the complaint procedure. The text contains rules on liability for defects in international trade. The thesis is the comparison of new and old legislation, the most significant changes and an overview of the consequences of changes to the consumer.

Avec l’apparition de plusieurs sources d’obligations en droit romain (le contrat et le délit), les juristes ont cherché à classer ces sources. Cela a commencé avec la classification des Institutes de Gaius. Cette étude propose d’étudier l’évolution de la classification des sources des obligations depuis son apparition en droit romain jusqu’à ses aspects les plus récents. Elle porte en conséquence sur les classifications doctrinales de l’ancien droit, la classification présente dans le Code civil et son interprétation par la doctrine du XIXe siècle, et les évolutions de cette classification au XXe siècle sous l’influence du droit allemand notamment. / With the appearance of several sources of obligations in Roman law (contract and torts), jurists sought to classify these sources. That started with the classification of Gaius in his Institutes. This study proposes to study the evolution of the classification of the sources of the obligations since its appearance in Roman law until its most recent aspects. It relates consequently to doctrinal classifications of the former law, classification present in the Civil code and its interpretation by the doctrines of the 19th century, and the evolutions of this classification at the 20th century under the influence of the German right in particular

In that regard, it is necessary to ask how International Private Law should react tobe in accordance with the new scenarios.In this article, the author examines the general and patrimonial aspects of International Private Law that he considers must be redefined, comparing the current dispositions of the Peruvian Civil Code with international regulations and national reform projects, and introducing a modification proposal for each topic. / El Derecho Internacional Privado ha venidosufriendo diversos cambios y modificaciones, al ritmo del fenómeno de la globalización, porel cual las relaciones entre los ciudadanos dediversos países se han ido haciendo más frecuentes y complejas. Presented diploma thesis deals with concepts from the real estate practice and people, who are employed in this practice. The thesis provides a look at contracts used in the real estate practice and their changes according to the passing of the new Civil code. The thesis is mapping changes in the real estate business as a follow-up to the passing ot the new cadastral act. Focus is also put on new definitions of some terms related to the real estate branch, as the new Civil code stipulates. The thesis studies present level of education of real estate brokers and possibilities of further education in this branch. Within the scope of the diploma thesis a questionnaire has been elaborated, which mapps fundamental issues of the real estate business. The questionnaire is also focused on prepared bill about providing of services of the real estate brokers.

On 1 January 2014 the new Civil Code no. 89/2012 Coll., which affected many areas, came into force. This thesis deals with the changes that have an impact on real estate activities. To the change of the Civil Code no. 40/1964 Coll. an introduction of new Cadastral law no. 256/2013 Coll. is closely related. Influence of this Cadastral law on a real estate practice is also described in this work. The conclusion summary of this work is a mapping of changes and an assessment of the extent to which they affect a real estate practice.

This master´s thesis deals with the basic principles of the Land Register, comparing those principles on the basis of previous legal regulation in effect until the end of 2013 and current legislation, where from the 1st January 2014 came to force Act no. 256/2013 Coll., on Land Registry (Cadastral Act) and Act no. 89/2012 Coll., Civil Code. Many changes, important for principles of the cadastre, are enshrined in these regulations. Thesis describes particular principles and states the most important changes, that occured in connection with the new legislation. It explains these changes theoretically and also practically on simple examples for better understanding of the principle.

In 1866, the Austrian Civil Code (Allgemeines bürgerliches Gesetzbuch - ABGB) was translated into English for the first time by the Viennese lawyer Josef Maximilian Winiwarter. This is a story about the agency and empowerment of this important legal translator and how his translation influenced other translators and texts. The first part of this dissertation explores Winiwarter's life and his motivations for translating the ABGB into English and introduces the premise that Winiwarter's text was pivotal in creating a standard of legal terminology and phrasing for future civil-law texts in English. With the help of case studies and context-oriented research, the second part maps out the agency of Winiwarter and the influence his landmark translation has had on other translators and legal practitioners. It showcases two additional English translations of the ABGB, one in the mid-twentieth century and the other in the early twenty-first century, in order to substantiate just how influential Winiwarter's translation was, even a century later. The final part looks at the recommendations and strategies of Winiwarter and his successors in an attempt to offer practical guidance to legal translators based on the Winiwarter tradition and the research carried out in the dissertation. [1] Legal regulation of an animal in the Civil Code Abstract The content of the thesis consists in the legal regulation of the animal in the Civil Code. The aim of the thesis is to provide a comprehensive overview and analysis of all provisions in which the animal is explicitly designated by law as an element of legal relationship, and assess whether and to what extent the legislator respects the special nature of the animal and the principle of dereification, to which the Civil Code has subscribed. The private law regulation is also to a limited extent placed in opposition to the public law, which is often used to demonstrate the imperfection of the regulation in the Civil Code. The thesis is divided into an introduction, four chapters and a conclusion. The first chapter deals with the concept of an animal, especially in the context of the aforementioned dereification. In addition, the possibilities of applying the provisions on things to living animals are addressed here as well. The second chapter covers the animal in the context of property rights. It focuses mainly on specific ways of acquiring ownership of the animal and their mutual internal contradictions. [pt] A presente dissertação tem como objeto o estudo do silêncio previsto no artigo 111 do Código Civil de 2002, isto é, o silêncio enquanto comportamento apto a qualificar manifestação de vontade para o negócio jurídico, segundo seus pressupostos legais. Diz o referido artigo que [o] silêncio importa anuência, quando as circunstâncias ou os usos o autorizarem, e não for necessária a declaração de vontade expressa. Sendo assim, este trabalho, limitado ao âmbito do Direito Civil brasileiro, procura estabelecer, com clareza, quais são os pressupostos de aplicação do silêncio enquanto instituto jurídico, à luz da norma que orienta a sua interpretação no caso concreto. O trabalho parte da análise de dois julgados do Superior Tribunal de Justiça, que mencionam o artigo 111 do Código Civil de 2002, sem, contudo, observar os aspectos fundamentais do instituto. Em seguida, o texto se volta para a investigação dos significados dos silêncios mencionados nos Códigos Civis de 1916 e 2002, procurando discernir o seu conteúdo normativo, passando, ato contínuo, para a análise da importante obra desenvolvida por Miguel Maria de Serpa Lopes, jurista brasileiro que mais aprofundou os estudos sobre o silêncio no Direito Civil, em 1937. Na sequência, o texto procura estabelecer dogmaticamente as premissas sobre as quais opera a manifestação de vontade por meio do silêncio, para qualificá-lo, estabelecendo seu melhor termo e sugerindo identidade própria para sua forma. Após, portanto, definir o que é o silêncio previsto no artigo 111 do Código Civil de 2002, este trabalho se propõe a estabelecer o que ele não é, ou seja, cuida de discernir o silêncio de outros institutos comportamentais (i.e. reserva mental, boa-fé objetiva, nemo potest venire contra factum proprium, suppressio e abuso do direito), ocasião em que são citadas diversas decisões judiciais para ilustrar como os tribunais confundem o silêncio previsto no artigo 111 do Código Civil com outras figuras de Direito Civil. Por fim, esta dissertação esclarece o conteúdo dos pressupostos necessários à qualificação do silêncio enquanto comportamento apto a manifestar vontade, para que o intérprete possa, mediante os corretos instrumentos, valer-se da norma específica com tanta história, notadamente relevante para os negócios jurídicos. / [en] The objective of this master thesis is to analyze the meaning of the party s silence under the article 111 of the Brazilian Civil Code of 2002; i.e., silence as a behavior capable of qualifying an expression of a party s will for a legal transaction, considering the legal requirements applicable thereto. The aforementioned article states that [t]he silence implies consent, when circumstances or habits and customs authorize it, and an express declaration of will is not necessary. Therefore, this work, limited to the scope of Brazilian Civil Code, seeks to clearly establish what are the assumptions for the application of silence as a legal institute, according to the legal norm that guides its interpretation in the specific case. The thesis departs from the analysis of two cases ruled by the Superior Court of Justice, in which article 111 of the Civil Code of 2002, was mentioned without observing its essential aspects. Following that, the thesis investigates the meanings of the silence element provided for in the Civil Codes of 1916 and 2002, discerning its normative content. Then, it reviews the literature of Miguel Maria de Serpa Lopes, a brazilian jurist who has developed the most complete study on meaning of silence in Civil Law, in 1937. Subsequently, the text seeks to dogmatically establish the premises to qualify the expression of will through silence, establishing its best terms and suggesting its own identity for its form. After defining the true meaning of silence provided for in article 111 of the Civil Code of 2002, this work proposes to distinguish the silence from other behavioral doctrines (i.e. mental reserve, good faith, nemo potest venire contra factum proprium, suppressio and abuse of law). In this context, several court decisions are mentioned to illustrate how the courts confuse the silence doctrine set forth in article 111 of the Civil Code with other figures of Civil Law. Finally, this dissertation clarifies the content of the assumptions necessary for the qualification of silence as a behavior capable of expressing will, to make the specific norm useful in practice.

This diploma thesis describes the principles of valuation of assets. In this thesis there are mentioned basic concepts of banking. It carries out a detailed analysis, description and comparison of selected valuation methodologies used by banks and methodologies used in appraiser´s work, who prepares evaluations for banking institutions. Based on the findings an analysis of the different methodologies is made.
