The legal protection of cross-border climate-induced displaced persons in Southern Africa / Daniël Nicolas DüringDüring, Daniël Nicolas January 2013 (has links)
The purpose of this study is to determine the extent to which existing law could provide a legal basis for the protection of cross-border, climate change displaced persons, with a particular focus on Southern Africa. Before such an analysis can be made, however, it is important first to determine what climate change displacement exactly implies. By means of integrating and refining existing legal terminology and ideas the study attempts to disentangle the international contention on the subject and proposes that individuals who are forced from their countries of habitual residence as a reaction primarily to climatic push factors which pose an existential threat to their right to life are most in need of protection and may be referred to as cross-border climate change displaced persons.
As climate change displacement is expected to occur primarily on the sub-regional geopolitical level of governance, the inclusion of regional, AU, and sub-regional, SADC, elements is important for the practical feasibility of this study. Southern Africa's particular vulnerability to the effects of climate change, making the advent of large numbers of climate change displaced persons in the area a reasonable prediction for the future, further justifies this study's chosen scope.
After analysing the different legal branches of refugee law, human rights law and environmental law for each geopolitical level of governance referred to, this study concludes that: While there are several potential provisions in law that could provide protection to persons displaced by climate change, a sufficient protection framework can be derived only from the composite characteristics of different branches of law. Therefore, it is recommended that a matrix approach is followed when providing legal protection to climate change displaced persons. Because different fields of law provide more prominent protection in different spheres of governance, it is also recommended that the configuration of a legal protection matrix be adjustable to particular circumstances. The purpose of the dissertation is to establish a framework with which to assess the prospective gains from regional monetary integration among five neighboring countries in East Africa: Burundi, Kenya, Rwanda, Tanzania, and Uganda. The neo-classical theory assumes that economic and monetary union would stimulate additional growth in such a union as a whole, with the trickle-down effects of overall development, and would enhance factor mobility, solving the problem of regional disparity automatically. Past experiences of African regionalism have shown that countries that participated in a monetary union were able to pursue credible monetary policies. This economic performance has been credited to their monetary policy discipline. Since countries in East Africa are small both in terms of their individual populations and the respective sizes of their economies, the study concludes that regional integration is a useful way of increasing their economic clout and bargaining power on the global scene. / Economics / Thesis (M. The thesis investigates the extent to which cross-border taking of evidence in civil and com-mercial matters in relation to Switzerland, South Africa, Botswana, Namibia, Nigeria, and Uganda is allowed. Such evidence-taking is not only governed by the domestic law of the state seeking evidence abroad and that of the state where the relevant means of proof are located, but also by public international law, and more specifically by the concept of sovereignty. The ad-missibility of the cross-border taking of evidence under public international law depends on whether or not evidence-gathering in civil litigation is regarded as a judicial act, which violates sovereignty when performed on foreign territory, or as a purely private act. In the first case, the evidentiary material has to be obtained through channels of international judicial assistance. Such assistance can either be rendered based on the basis of an international treaty, or through courtoisie internationale. No international judicial assistance is necessary in cases of a so-called “transfer of foreign evidence”, provided no compulsion is applied which infringes the sovereignty of the foreign state.
The thesis analyses the taking of evidence abroad based on the Hague Evidence Convention, and the Hague Procedure Convention. It further expounds how evidence located in Switzer-land, Botswana, Namibia, Nigeria, and Uganda can be obtained for the benefit of civil proceed-ings pending abroad in the absence of any relevant international treaty. The thesis also exam-ines under what conditions a litigant in civil proceedings in the aforementioned countries may request evidence to be taken on foreign soil. The position of cross-border taking of evidence in civil and commercial matters in the said countries is assessed, and suggestions are made on how such status quo may be improved. The thesis makes an attempt to establish the basic prin-ciples for a convention on evidence-taking in civil and commercial matters between South Af-rica, Botswana, Namibia, Nigeria, and Uganda. The development of such principles, however, is only possible once the similarities and differences in the procedure for the taking of evidence and the means of proof in the relevant laws of the aforesaid countries have been identified. / Public, Constitutional, & International / LL.D.

The subject-matter of the presented thesis is cross-border healthcare in the European Union. The thesis focuses deeply on the overall evaluation of the recently adopted Directive on patients' rights. The primary objective of this thesis is to comprehensively analyse the new legislation on cross-border health care within the European Union, i.e. Directive on patients' rights. Based on theoretical findings, the thesis aims to assess the potential impact of the Directive on the provisions of cross-border healthcare within the European Union and its influence on the healthcare system in the Czech Republic. The contents of the thesis is divided into four chapters. The first chapter is introductory and provides information concerning the relevant provisions of primary law that provides European Union with competences in the area of health. The second chapter deals with the developments of the legal framework for cross- border healthcare in the European Union and clarifies in detail the specific nature of cross- border health care. This association is studied from different perspectives, which embrace its foundation, development, legal definition, organization structure, financing, institutional interests, purpose and mainly the issue of Small Project Fund. The practical part of the thesis is focused on the analysis of amount of finances, cooperating subjects and the number of realized projects in individual subsidy programmes, in which the Small Project Fund participated. The preference of Czech municipalities on small projects is supported with an analysis and closing questionnaire survey.

La protection du consommateur en droit international privé européen passe par les règles protectrices de conflit de lois et de conflit de juridictions spécialement conçues pour les contrats transfrontières de consommation. Ces règles contribuent au rééquilibrage du rapport contractuel de consommation transfrontière et font peser sur le professionnel la charge des coûts de l’internationalisation du contrat de consommation. Sous réserve de certaines améliorations qui pourraient être apportées, la méthode choisie par le droit international privé européen est globalement satisfaisante. En revanche, son champ d’application est trop restrictif. Avec le critère d’ « activité dirigée », le modèle européen est actuellement fondé sur la distinction entre les consommateurs passifs et actifs. Le bénéfice des règles protectrices est réservé aux premiers. Cette distinction ne doit pas conduire à l’absence de protection pour les seconds. Dans cette thèse, il est proposé d’introduire des règles protectrices au bénéfice des consommateurs actuellement exclus du régime protecteur. Cette protection ne doit pas passer par l’extension du champ d’application des règles protectrices existantes aux consommateurs actifs mais par l’établissement d’un second régime protecteur parallèle pour ces consommateurs, inspiré par l’idée de mieux encadrer l’autonomie de la volonté et d’atteindre un bon compromis entre la protection du consommateur et le respect des intérêts du professionnel. / Consumer protection in European private international law is carried out through protective choice-of-law and jurisdiction rules which are specially designed for cross-border consumer contracts. These rules help balancing the bargaining power and make the professional bear the internationalization cost of consumer contract. With some improvements which should be brought to the existing rules, the method used in European private international law in matters relating to consumer contracts is generally satisfactory. On the other hand, its scope is too narrow. With the criterion of "directed activity", the European model is based on the distinction between passive and active consumers. Only passive consumers are covered by the protective rules. This distinction must not lead to the lack of protection for active consumers. In this thesis, it suggests that European private international law provide protective rules for consumers currently not covered. However, the protection must not be carried out by extending the scope of existing protective rules to active consumers but by establishing a second set of protective rules inspired by a better regulation of freedom of contract and a good compromise between professional’s interests and consumer protection.

Depuis 2002, la lutte contre l'insécurité routière est devenue une priorité nationale. Cette dernière s'est traduite par une politique répressive dite de « tolérance zéro » à l'égard des contrevenants et délinquants au Code de la route. Cette répression, à la fois administrative et pénale peut cependant se heurter à certaines difficultés lorsque l'infraction revêt un caractère d'extranéité, car commise par un conducteur titulaire d'un permis de conduire délivré par une autorité étrangère ou à l'aide d'un véhicule immatriculé à l'étranger. L'absence ou quasi-absence de répression de ces infractions, outre ses conséquences sur l'insécurité routière, est source d'un profond sentiment d'inégalité tout particulièrement dans les zones transfrontières et nécessite donc de nouvelles réponses. Sur le plan administratif, ces nouvelles réponses résident entre autres dans l'extension de la portée transfrontalière d'une mesure administrative mais également par le développement d'un permis de conduire à points propre à l'Union Européenne. Sur le plan pénal, ces nouvelles réponses passent par une coopération renforcée entre les États afin de pouvoir identifier les propriétaires de véhicules dans les cas où le véhicule n'est pas intercepté par les forces de l'ordre. L'instauration de systèmes automatisés de contrôle de la circulation routière nécessite de la part des États et de l'Union européenne un développement de l'échange transfrontalier d'informations. / Fighting to achieve road safety has been a top national priority since 2002. It has led to the so-called « zero-tolerance » policy with highway code delinquents and traffic offenders. This repression which is both administrative and penal may however prove problematic should the offence bear an extraneous aspect, when it is committed by a driver with a foreign driving licence or when the vehicle was registered abroad. That such offences never or quasi-never be punished besides the consequences on road safety, gives rise to a deep feeling of inequality particularly in cross-border areas and therefore calls for new answers. Administratively speaking, the new answers lie, among other things, in a widening of the cross-border range of administrative measures, but also in developing a driving licence with a penalty point system specific to the EU. Penally speaking such new answers suppose a closer cooperation among states so as to be able to identify vehicle owners should the vehicle fail to be intercepted by the police. Introducing automated control systems of road traffic requires that states and the EU increase cross-border information exchange.

A recente crise financeira global trouxe para o centro do debate internacional o tema da regulação dos mercados de capitais e, com ela, suas diversas qualificações como um fator responsável pela crise. O trabalho tem como foco entender o papel da cooperação internacional em matéria regulatória e, particularmente, a existência de incentivos, preferências, ideias e instituições inerentes à cooperação entre estados. Para tanto, realiza uma análise sistêmica de iniciativas regulatórias tomadas por quatro países entre 2007 e 2011, com o fim de verificar a existência de padrões, modalidades específicas e os caminhos da cooperação na regulação do mercado de capitais. Tendo como gatilho a eclosão da crise financeira global, os principais resultados apontam para um efetivo escrutínio doméstico das recomendações internacionais editadas e, em consequência, uma ampliação do conceito de cooperação regulatória. O que se verifica é que, além das atividades de supervisão e enforcement, emergem iniciativas regulatórias com diversos elementos e formatos comuns, que levam em conta a interação dos determinantes políticos e consequências econômicas advindos desse momentum. / The recent global financial crisis brought to the center of international discussion the debate concerning the regulation of capital markets, including its many variances, as a factor responsible for the crisis. The focus of this work is on the role of international cooperation in regard to regulation, with specific attention given to particular aspects such as the existence of incentives, preferences, ideas, and institutions inherent to cooperation between states. As such, this dissertation will provide a systematic analysis of regulatory initiatives taken by four countries between the years 2007 and 2011. The goal was to verify the existence of patterns, specific models, as well as pathways to cooperation in the regulation of capital markets. The principle results suggest an effective domestic scrutiny of international recommendations driven mostly by the outbreak of the global financial crisis, and as a result a broader concept of what is understood as regulatory cooperation. Besides new measures of supervision and enforcement, the work verified the emergence of regulatory initiatives, with both common elements and formats that take into consideration the interaction of political determinants and economic consequences arising from this momentum.

Al?m disso, o modus agendi trans-local, profundamente enraizado na regi?o, ? suscept?vel tanto de ser causa para a resist?ncia a qualquer projeto que tente controla-lo ou alter?-lo, quanto de servir como base para novos regimes de coopera??o. / This thesis identifies local actors? perceptions on the operationalization of the New Agenda for Cooperation and Border Development (New Agenda) in the Brazilian- Uruguayan cross-border region (Bucbr), emphasizing the relationship between formal (state) and informal (non-state) actors and processes. After fifteen years, local actors? engagement in New Agenda?s projects, and compliance with its agreements and frameworks were extremely low. If the New Agenda should be considered a response to local demands, why was/is there such low engagement and compliance of local actors with its projects and agreements? To answer this question, this thesis draws from International Relations theories a plural, reflectivist and constructivist approach that enables the employment of ?perception? as a relevant analytical variable. The use of interviews and the application of an electronic survey are the main primary sources. Bibliographical research and official statistics are applied for contextual data. Historical analysis is employed for comprehending the relationship between state and non-state actors in the social construction of the Bucbr. This thesis finds that compliance and engagement have little to do with a border culture of informality and illegality. They are related more to a New Agenda?s deficient institutionality and the perpetuation of ignorance toward the social reality of the Bucbr and the demands of local actors. The issues of engagement and compliance of local actors with the New Agenda is intimately linked with the unsatisfactory state offer of institutionality capable to turn the Bucbr into a legal and normative space in which the region could implement, autonomously, local development strategies for its cross-border populations. Such an institutionality would potentially change the way formal and informal actors relate. Moreover, the deeply rooted trans-local modus agendi of the region is likely to be either cause for resistance of any project that attempts to control or change it or the basis of novel cooperative regimes. / Cette th?se identifie les perceptions des acteurs locaux sur la mise en ?uvre du Nouveau programme de coop?ration et de d?veloppement frontalier (NPCDF) dans la r?gion frontali?re du Br?sil-Uruguay (Rfbu), soulignant la relation entre les acteurs et les processus formels (?tat) et informel (non ?tatique). Apr?s quinze ans, l?engagement des acteurs locaux envers des projets du NPCDF et la conformit? aux accords et cadres ont ?t? extr?mement faibles. Si le NPCDF doit ?tre consid?r? comme une r?ponse aux demandes locales, pourquoi y a-t-il eu peu de participation et de conformit? des acteurs locaux ? ses projets et accords ? As áreas tropicais são consideradas propensas a doenças infecciosas e recentemente apresentaram desenvolvimento econômico com aumento do turismo doméstico e internacional de seus habitantes. Há um aumento de viagens internacionais com maior risco potencial para a importação de doenças, particularmente nos últimos 10 anos, e o novo quadro de surtos globais no século 21. A promoção de viagens seguras destes turistas no destino é um novo desafio para os governos receptores. Alguns países desenvolvidos com tradição turística, como os signatários da Convenção Schengen, implementaram políticas para lidar com o eventual custo de saúde de viajantes de áreas tropicais. Outros destinos, como os Estados Unidos, mantiveram suas políticas de saúde para turistas. Visando identificar a real condição de saúde destes novos turistas de países emergentes, estudamos os problemas de saúde dos turistas brasileiros no exterior, comparando o fluxo de viagens, o custo de saúde antes e depois da implantação da Convenção Schengen, a exposição potencial para algumas doenças infecciosas no intuito de sugerir medidas para proteção e prevenção desses viajantes brasileiros. Não há evidência de transporte de doenças por viajantes brasileiros para seus destinos turísticos. Países que adotaram seguro saúde obrigatório para os turistas brasileiros não apresentaram maiores custos de saúde, tendo queda relativa do fluxo turístico do Brasil, em comparação a países sem restrições. Além disso, o transporte aéreo e eventos internacionais de massa, como a Copa do Mundo e os Jogos Olímpicos, permitiram a transmissão de doenças para o Brasil, com introdução do vírus Zika e reintrodução do vírus do sarampo. A rápida transmissão mostra a importância das medidas preventivas que incluem o reforço da vacinação de grupos específicos, o alerta de higiene pessoal adequada e outras ações para evitar possíveis surtos devido ao elevado tráfego de viajantes nos eventos. No turismo doméstico, o potencial risco de transmissão de doenças infecciosas negligenciadas, como Leishmaniose Visceral, cuja disseminação se intensificou por deslocamento de animais de estimação; e da esquistossomose humana pelo aumento das mudanças climáticas e de atividades de lazer em áreas naturais, promovem maior exposição dos viajantes internacionais e nacionais. A rede atual de prevenção e proteção para viajantes no Brasil, composta por clínicas de medicina de viagem, mídias com recomendações para viajantes e centros de imunização tornam-se importantes na prevenção de contágio dos turistas e reduzem consideravelmente o número de atendimentos pós-viagem. Quando usada, fornece aos viajantes brasileiros proteção para as principais doenças infecciosas preveníveis ale de orientação para se evitar situações de risco em viagem, sendo um modelo de política pública interessante. Alguns protocolos para a entrada dos viajantes demonstram ser uma atitude adequada para melhorar a segurança dos viajantes e de seus países, bem como novas medidas preventivas são necessárias para evitar a disseminação de surtos de doenças infecciosas. / Tropical areas are considered prone to infectious diseases and have recently presented economic development with increased domestic and international tourism of its inhabitants. There is an increase in international travel with greater potential risk for diseases importation, particularly in the last 10 years, a new global outbreak chart in the 21st century. The promotion of safe travel of these tourists at destination is a challenge for recipient governments. Some developed countries with a tourist tradition, such as the Schengen Convention, have implemented policies to deal with the possible cost of health of travelers from tropical areas. Other destinations, as the United States, have maintained their health policies for tourists. Aiming to identify the real health condition of new tourists from emerging countries, we studied the health problems of Brazilian tourists abroad, comparing flow, health cost before and after the implementation of the Schengen Convention, their potential exposure to some infectious diseases, to suggest measures for protection and prevention of these Brazilian travelers. There is no evidence of diseases\' transport by Brazilian travelers to their destinations. Countries that adopted mandatory health insurance for Brazilian tourists did not present higher health costs, only a relative drop in Brazil\'s tourism flow compared to unrestricted countries. In addition, with air transport and international mass events, such as the World Cup and the Olympic Games, allowed the importation of diseases into Brazil, with the introduction of the Zika virus and the reintroduction of the measles virus. The rapid transmission shows the importance of preventive measures that include reinforcing of vaccination, adequate personal hygiene alert, and other actions to avoid possible outbreaks due to the high traffic of travelers at events. In domestic tourism, the potential risk of transmission of neglected infectious diseases, such as Visceral Leishmaniosis, whose spread was intensified by displacement of pets; and human schistosomiasis by increasing climate change and leisure activities in natural areas, promoting greater exposure of international or national travelers. The current network of prevention and protection for travelers in Brazil, composed of travel medicine clinics, media with recommendations for travelers and immunization centers is effective in preventing infection of tourists and greatly reduces the number of post-trip visits. When used, it provides Brazilian travelers with a protection for the major preventable infectious diseases and education to avoid risky travel situations, an interesting model of public police. Some protocols for travelers\' entry prove to be an appropriate attitude to improve the safety of travelers and countries, as well as new preventive measures are needed to prevent the spread of infectious disease outbreaks.
