Le dualisme juridictionnel en matière de propriétés publiques / Jurisdictional dualism in the field of public property

La construction jurisprudentielle réalisée par les juges, au long des siècles, a permis de poser progressivement les critères de répartition que l’on connaît aujourd’hui. La systématisation de ces différentes strates jurisprudentielles montre que l’on est passé d’une répartition anarchique des compétences sous l’Ancien Régime, à une répartition basée sur un critère organique, pour finalement évoluer vers la finalité de l’action administrative au milieu du XIXe siècle. Le modèle actuel de répartition, qui répond peu ou prou à la distinction classique héritée du XIXe siècle, ne permet pas un partage harmonieux des compétences. Ainsi, la dualité domaniale ne saurait constituer le critère de répartition des compétences juridictionnelles. Les évolutions du droit positif attestent de la nécessité de dépasser la façon dont s’exprime le dualisme juridictionnel au sein de la propriété publique. La reconnaissance d’une propriété publique distincte de la propriété privée ouvre la voie à une réflexion d’ensemble. Les prérogatives du juge judiciaire sur le domaine privé constituent l’obstacle majeur à une potentielle unification. Aussi, une refonte de ce contentieux passe, nécessairement, par la remise en cause de l’assimilation du domaine privé à la propriété privée et le lien suranné entre la propriété et la compétence du juge judiciaire. Une définition organique de la propriété publique, qui fonderait le contentieux non plus sur l’affectation du bien mais sur la personnalité publique du propriétaire, impliquerait certes d’abandonner les catégories actuelles de répartition, mais permettrait de mettre fin à la dislocation des compétences. / Setting the criteria for the distribution of public property disputes among private and public law courts has been a progressive judicial construction, realized over the centuries. The systematization of the different jurisprudential ‘layers’ shows that, from a quite chaotic division of competences under the Old Regime, we evolved towards an organic criterion, to finally reach the criterion of the goal of administrative action in the mid-19th century. The actual model, which more or less corresponds to the classical distinction inherited from the 19th century, does not allow for a coherent division of competences. Domain duality is not an appropriate criterion for the distribution of public property disputes among private and public law jurisdictions. Positive law evolutions illustrate the need to overcome the current manifestations of jurisdictional dualism in this field. The distinction between public and private property opens the way for a comprehensive reconsideration of the matter. The powers of the private law judge on the private domain constitute a major obstacle in the potential unification of the jurisdictional treatment of public property disputes. Renovating this field of litigation requires questioning the assimilation of the private domain to private property and overcoming the outdated connection between the notion of property and the competence of the private law judge. I argue for an organic definition of public property, following which, the choice of competence and procedure would not anymore be based on the use of the property at stake but on the public nature of the legal personality of its owner. While this would imply abandoning current categories, it would put an end to a long standing jurisdictional disorder.
