Poder constituinte derivado de equivalência às emendas constitucionais: os tratados de direitos humanos após a EC nº 45/04 / Derived constitutional power of constitutional amendments equivalence: the human rights treaties after the Constitutional Amendment nº 45/04.

Samir Dib Bachour 09 May 2014 (has links)
The theory of Constitutional Amendments Equivalence of Derived Constitutional Power seeking to embrace fully the phenomenon of legal approval of international treaties and conventions on human rights as equivalent to constitutional amendments, pursuant to §3º of art. 5º of the Constitution, inserted by Constitutional Amendment nº 45/04. After critically describing the constitutional, jurisprudential and doctrinaire panorama in that was engendered in this new device of art. 5º and the procedure by which the incorporation of the Convention on the Rights of Persons with Disabilities and its Optional Protocol was approved as equivalent to the Amendments, follow three essential parts that make up the approach to the subject. The first is directed to describe the presence of a new manifestation of constituent power, with the goal of providing solutions coherent and consistently backed into a theoretical framework common to all the problems involved, which will be examined specifically from the issues faced in Part II. The third part is more tied to material issues, to worry about the object of constitutional equivalence: if this includes the entire international diploma; exclusively human rights therein, or also rules otherwise, abstracting and projecting findings from the concrete experience of the Convention. The most intense contribution to legal thought is evidently in the identification of a new type of constitutional derived power; but also in the conceptualization of equivalence to constitutional amendments norms; when pointing the exact object of §3º of art. 5º; revealing the complexity of the phenomena involved in the introduction of the Convention and its Optional Protocol; the delimitation of the spectrum of equivalent to constitutional amendments norms; and in obtaining greater theoretical conformity with the fundamentals of the constitutional and international legal systems, from entanglement between the theories of law and the State; and the disciplines of constitutional law; international law; and human rights

Equivalência de estímulos e responder por exclusão em idosos com e sem comprometimento cognitivo / Stimulus equivalence and responding by exclusion in elderly subjects with and without cognitive impairment

Mariana Ducatti Almeida 05 September 2014 (has links)
The aging process can cause cognitive impairments that, if aggravated, may lead to the diagnosis of dementia, with Alzheimers Dementia (AD) being the most common. Alzheimers Dementia is a neurodegenerative disease that primarily affects memory and language. Teaching procedures based on the paradigm of stimulus equivalence and on teaching by exclusion, although successfully tested in different populations with developmental problems, have generated little research with elderly people with cognitive impairments. This paper presents three studies, with different but complementary aims. Study 1 aimed to assess whether institutionalized elderly people without AD would form classes of equivalent stimuli from a procedure of teaching conditional relationships among dictated words, photos, printed names of professions and degrees of relatedness; additionally, it aimed to verify whether these relationships would be maintained over a month, using three maintenance tests. Five hospitalized elderly subjects underwent teaching of arbitrary relationships in a linear training structure with the teaching of new relationships by exclusion. Equivalence tests were conducted following the teaching phase, and after five, 15 and 30 days. All the elderly subjects demonstrated performance by exclusion in the teaching phase and learned all the relationships within the minimum number of programmed teaching blocks (except for one participant). All the subjects presented the formation of equivalence classes. Four of the elderly subjects presented maintenance of these classes in all the maintenance tests. The procedure, therefore, was effective for these elderly subjects and generated equivalence formation, despite their hospitalization condition. Study 2 aimed to assess whether institutionalized AD patients would demonstrate performance by exclusion and learn the conditional relationships between four dictated names and four photos, in a teaching by exclusion procedure. Six elderly women diagnosed with AD underwent pairing to the sample tasks, in which the relationships between dictated sample and photos were taught by exclusion. Despite all the elderly women responding by exclusion in the first presentation of a new sample stimulus and its corresponding comparison in at least two of the three trials in which this performance was possible, only two maintained this relationship throughout the other trials and learned the relationships taught. Possible reasons for this behavior are discussed. Study 3 evaluated whether hospitalized elderly subjects, with AD and cognitive impairments, would form equivalence classes from the teaching of arbitrary relationships using a one-to-many training structure, a procedure of delayed hints and teaching by exclusion. Four elderly subjects underwent the teaching of conditional relationships among visual stimuli (written names, photos and names of professions). All learned the relationships taught within the minimum number of programmed blocks, however, they presented difficulty forming equivalence classes and maintaining such relationships in the maintenance tests at five and eight days. The teaching procedures employed were efficient in generating the learning of relationships, however, such learning, in these elderly subjects, did not support the formation and maintenance of equivalence classes.

Atualmente, pesquisas relacionadas a tal abordagem abarcam diversos temas, dentre eles, a tradução. / The theory of Languages in Contact was developed from the investigation and from the description of linguistic phenomena that result from the contact between languages in bi or multilingual persons and societies. Currently, research related to this approach includes various themes, among them, translation. However, the relation between linguistic contact and translation seems to be scarcely investigated in academic and scientific fields. On the other hand, since Linguistics amplified its analysis object Translation Studies have been investigated the phenomena from the linguistic point of view in addition to the literary one. Thus, this thesis aims at linking Languages in Contact and Translation Studies, both belonging to the greatest area Linguistics and Literature. In order to do that, it aims at investigating the linguistic interferences based on the phenomena described by Weinreich (1970) and the translation modalities proposed by Aubert (1998) in the translation of the short story “Tenth of December” (SAUNDERS, 2013) to Brazilian Portuguese, done by José Geraldo Couto, “Dez de Dezembro” (SAUNDERS, 2014). In order to achieve the total amount of the investigated data noun phrases of the source text were selected and classified according to the tags created to each category of linguistic interferences and of translation modalities present in the target text. Then, the data were saved on TXT file and annotated within Notepad++ software, on a XML file. Combined with the stylesheet (XSL) the annotation of the text allows to achieve the total amount of each category, in absolute numbers, on a HTML file. Results found after the investigation of the corpus show the prevalence of linguistic interferences in North American English direction, that is, the noun phrases are nearer to the source language. Concerning the translation modalities the options selected indicate little distance between the translated text and the source text. However, the small differentiation in percentage between the categories nearer to the source language and the ones nearer to the target language demonstrates some linguistic proximity, in the analyzed corpus, between Brazilian Portuguese and North American English. Equally, classification of the translation modalities more present in the corpus, according to the scale proposed by Aubert (1998), shows some equivalence between the source text and the target text. Based on quantitative and qualitative analyses of each category of linguistic interference and of translation modality, it was possible to trace parallelisms between both of them. This investigation allows to relate Languages in Contact and Translation Studies.

Les contraintes de reformulation en traduction de Littérature de jeunesse français-arabe / Reformulation constraints in translation of children"s literature

Al-Aghbari, Jassas 24 January 2011 (has links)
Our work consists in studying the constraints that affect translator’s decisions in the phase of reformulation. Applied to the field of children’s literature, translation is viewed as an act of communication which is not only linguistic: it is also conditioned by extralinguistic elements that involve reciprocal influences between communication and local culture. The literature translated for this audience is presented as a sub-system part of the general literary host society. It is, therefore, subject to conditions and constraints of production and dissemination of literary system for young lectors. The analysis for the young lectors makes it possible to highlight the values of both culture and morality that every society seeks to instill in its young readers. Whoever wants to seize the methodological procedures and purposes of the translating process in this area is constrained by the nature of the subject, to consider a study of the dynamics of literature and translation for children in the host context. In the Arab world, factors such as parents, publishers, spatiocultural specificities, authors, translators and also illustrators play a major role in what is written for young audiences. From a standpoint of translation studies, these constraints are considered as "norms" that define the operational framework that govern any translation for young lectors. The concept of ’social norm’ as defined by Toury, is central to all communication, because it identifies the relationship between a society and its literary and translation process. During the translation process, these norms are converted into translational constraints that may be cultural, political or ideological in the sense that they govern the decision and the influence of the translator during the phase of reformulation. What are the observable elements that allow us to identify these constraints and how do they interact to each other and with the translation process in general and in particular with the reformulation? Above all, what is the translation approach that would maximize results in light of these constraints? These are the final questions to which this work attempts to provide some answers.

The relation between classical and quantum mechanics

Taylor, Peter January 1984 (has links)
This thesis examines the relation between classical and quantum mechanics from philosophical, mathematical and physical standpoints. It first presents arguments in support of "conjectural realism" in scientific theories distinguished by explicit contextual structure and empirical testability; and it analyses intertheoretic reduction in terms of weakly equivalent theories over a domain of applicability. Familiar formulations of classical and quantum mechanics are shown to follow from a general theory of mechanics based on pure states with an intrinsic probability structure. This theory is developed to the stage where theorems from quantum logic enable expression of the state geometry in Hilbert space. Quantum and classical mechanics are then elaborated and applied to subsystems and the measurement process. Consideration is also given to spacetime geometry and the constraints this places on the dynamics. Physics and Mathematics, it is argued, are growing apart; the inadequate treatment of approximations in general and localization in quantum mechanics in particular are seen as contributing factors. In the description of systems, the link between localization and lack of knowledge shows that quantum mechanics should reflect the domain of applicability. Restricting the class of states provides a means of achieving this goal. Localisation is then shown to have a mathematical expression in terms of compactness, which in tum is applied to yield a topological theory of bound and scattering states: Finally, the thesis questions the validity of "classical limits" and "quantisations" in intertheoretic reduction, and demonstrates that a widely accepted classical limit does not constitute a proof of reduction. It proposes a procedure for determining whether classical and quantum mechanics are weakly equivalent over a domain of applicability, and concludes that, in this restricted sense, classical mechanics reduces to quantum mechanics.

Summarizing the Results of a Series of Experiments : Application to the Effectiveness of Three Software Evaluation Techniques

Olorisade, Babatunde Kazeem January 2009 (has links)
Software quality has become and persistently remains a big issue among software users and developers. So, the importance of software evaluation cannot be overemphasized. An accepted fact in software engineering is that software must undergo evaluation process during development to ascertain and improve its quality level. In fact, there are too many techniques than a single developer could master, yet, it is impossible to be certain that software is free of defects. Therefore, it may not be realistic or cost effective to remove all software defects prior to product release. So, it is crucial for developers to be able to choose from available evaluation techniques, the one most suitable and likely to yield optimum quality results for different products - it bogs down to choosing the most appropriate for different situations. However, not much knowledge is available on the strengths and weaknesses of the available evaluation techniques. Most of the information related to the techniques available is focused on how to apply the techniques but not on the applicability conditions of the techniques – practical information, suitability, strengths, weaknesses etc. This research focuses on contributing to the available applicability knowledge of software evaluation techniques. More precisely, it focuses on code reading by stepwise abstraction as representative of the static technique, as well as equivalence partitioning (functional technique) and decision coverage (structural technique) as representatives of the dynamic technique. The specific focus of the research is to summarize the results of a series of experiments conducted to investigate the effectiveness of these techniques among other factors. By effectiveness in this research, we mean the potential of each of the techniques to generate test cases capable of revealing software faults in the case of the dynamic techniques or the ability of the static technique to generate abstractions that will aid the detection of faults. The experiments used two versions of three different programs with seven different faults seeded into each of the programs. This work uses the results of the eight different experiments performed and analyzed separately, to explore this fact. The analysis results were pooled together and jointly summarized in this research to extract a common knowledge from the experiments using a qualitative deduction approach created in this work as it was decided not to use formal aggregation at this stage. Since the experiments were performed by different researchers, in different years and in some cases at different site, there were several problems that have to be tackled in order to be able to summarize the results. Part of the problems is the fact that the data files exist in different languages, the structure of the files are different, different names is used for data fields, the analysis were done using different confidence level etc. The first step, taken at the inception of this research was to apply all the techniques to the programs used during the experiments in order to detect the faults. This purpose of this personal experience with the experiment is to be familiarized and get acquainted to the faults, failures, the programs and the experiment situations in general and also, to better understand the data as recorded from the experiments. Afterwards, the data files were recreated to conform to a uniform language, data meaning, file style and structure. A well structured directory was created to keep all the data, analysis and experiment files for all the experiments in the series. These steps paved the way for a feasible results synthesis. Using our method, the technique, program, fault, program – technique, program – fault and technique – fault were selected as main and interaction effects having significant knowledge relevant to the analysis summary result. The result, as reported in this thesis, indicated that the functional technique and the structural technique are equally effective as far as the programs and faults in these experiments are concerned. Both perform better than the code review. Also, the analysis revealed that the effectiveness of the techniques is influenced by the fault type and the program type. Some faults were found to exhibit better behavior with certain programs, some were better detected with certain techniques and even the techniques yield different result in different programs. / I can alternatively be contacted through: qasimbabatunde@yahoo.co.uk

ISTQB : Black Box testing Strategies used in Financial Industry for Functional testing

Saeed, Umar, Amjad, Ansur Mahmood January 2009 (has links)
Black box testing techniques are important to test the functionality of the system without knowing its inner detail which makes sure correct, consistent, complete and accurate behavior or function of a system. Black box testing strategies are used to test logical, data or behavioral dependencies, to generate test data and quality of test cases which have potential to guess more defects. Black box testing strategies play pivotal role to detect possible defects in system and can help in successful completion of system according to functionality. The studies of five companies regarding important black box testing strategies are presented in this thesis. This study explores the black box testing techniques which are present in literature and practiced in industry as well. Interview studies are conducted in companies of Pakistan providing solutions to finance industry, which is an attempt to find the usage of these techniques. The advantages and disadvantages of identified Black box testing strategies are discussed, along with it; the comparison of different techniques with respect to most defect guessing, dependencies, sophistication, effort, and cost is presented as well.

Monoidal equivalence of locally compact quantum groups and application to bivariant K-theory / Equivalence monoïdale de groupes quantiques localement compacts et application à la K-théorie bivariante

Crespo, Jonathan 20 November 2015 (has links)
This dissertation deals with the notion of monoidal equivalence of locally compact quantum groups and its applications. We generalize to the case of regular locally compact quantum groups, two important resultst concerning the actions of compact quantum groups. Let G1 and G2 be two regular locally compact quantum groups monoidally equivalent. We develop an induction procedure and we build an equivalence of the categories, whose objects are the continuous actions of G1 and G2 on C*-algebras. As an application of this result, we obtain a canonical equivalence of the categories of equivariant KK-theory for actions of G1 and G2. We introduce and investigate a notion of actions on C*-algebras of mesured quantum groupoids on a finite basis. The proof of the second equivalence relies on a version of the Takesaki-Takai duality theorem for continuous actions of measured quantum groupoids on a finite basis. We conclude by defining and studying a notion of equivariant Hilbert modules for actions of mesured quantum groupoids on a finite basis.

Étude historique, épistémologique et descriptive de la synonymie / A historical, epistemological and descriptive study of synonymy

Doualan, Gaëlle 21 November 2015 (has links)
This thesis studies theoretical and epistemological aporia of synonymy. These problems are concentrated in the theoretical weakness of synonymy in comparison with its empirical success both in usage and dictionaries. This theoretical weakness originates in the history of the notion: at first, synonymy had been defined by Aristoteles and was afterwards subjected to transformations during the following centuries. With the beginning of modern linguistics, scientific definition of synonymy had been built from the distinctive synonymy of French synonymists. The fundamental notions of modern linguistics, such as the opposition between language and discourse, had been applied to synonymy whereas it had been elaborated before their conception. Synonymy can hardly be submitted to modern linguistics theoretical frameworks without generating theoretical difficulties. The distinctive approach centers the study of synonymy on semantic differences whereas synonymy is based on approximate semantic equivalence. History of synonymy sheds light on aporia and helps to distance from it and to center the notion on the semantic equivalence because they make synonymy possible and on discourse because that is where sense emerges. This breaks off with the synonymy which is solely based on semantic differences between synonymic lexical items. An onomasiological and textual approach is set up to propose a new scientific framework to synonymy: this approach consists in the detection of lexical networks showing semantic relations appearing in context. To test this approach, lexical networks of vice and virtue vocabulary are studied in seventeenth century French texts treating moral themes.

Interprétation et traduction d’expressions figées du français vers le serbe dans un corpus littéraire contemporain / Interpretation and translation of phrasemes from French into Serbian in a corpus of contemporary literature

Ralić, Sara 24 November 2015 (has links)
This thesis proposes an analysis of a phraseme as a complex, stable, variable and dynamic linguistic sign, and as a translation problem based on a corpus of contemporary French literature and its Serbian translations. The discourse highlights the distance between the meaning of a model and the meaning of a phraseme that is semantically accomplished and embedded in a text. One of its possible realizations is a pun that does not only consist in transgressing the syntactic criteria but in developing a new global signified, serving the speaker’s discursive strategies. This work identifies linguistic mechanisms specific to lexical frozenness that are inevitable in the act of translation, and incompatibilities between the problems of translation and properties of a given phraseme. Its translation problems in a literary text, whose narrative progression it shapes, exceed the dichotomy between a domesticated translation and a foreignized translation. Translation problems result from the way in which the speaker establishes the link between the conceptualization inherent to a phraseme, built itself on the basis of pre-existing concepts - hence the mental image and the connotative surplus value - and the reality to which the speaker applies it. Its translation, given its pragma-semantic complexity, necessarily requires a source-oriented approach in the interpretative phase and a target-oriented solution.
