L’abondante littérature existante sur la vie politique haïtienne, œuvres de propagande ou de réprobation des gouvernements, fait de l’histoire politique un lieu de règlement de compte, ce qui donne une allure de polémique passionnée aux textes de nos aînés. Avec cette thèse, nous rejoignons et nous contribuons au travail de quelques rares spécialistes, universitaires de sciences humaines et sociales, qui cherchent à renouveler l’histoire politique haïtienne. Étudier les mécanismes de la prise du pouvoir exécutif en Haïti, ce n’est pas seulement le fait de dénoncer des élections truquées, des coups d’État, des insurrections qualifiées à tort de révolution ; mais c’est surtout une volonté de montrer de nombreux efforts qui ont été faits pour instaurer un régime démocratique et moderniser la vie politique haïtienne. L’objectif du travail, c’est de montrer comment Haïti passait de l’acclamation du chef d’État aux insurrections, des armes aux bulletins de vote et aboutir au suffrage universel. / The Abundant literature on the Haitian political life, as works of propaganda or disapproval of the governments, fact of the political history a place of settling of score, which gives a pace to impassioned polemic concerning the written documents of the elder generation of historians. This thesis, join and contribute to the work of some rare social scientists, which seek to renew Haitian political history. Studying the mechanisms of the executive seizure of power in Haiti does not mean denouncing faked elections, putsch, revolts, that are wrongly qualified of revolution. But it especially concerns a will to show the efforts which were made to establish a democratic regime and to modernize the Haitian political life. The objective of this work is to explain how Haiti has passed from the acclamation of the Head of State to insurrections, from weapons to polls, and from polls to the vote for all.

Moreover, a comparative part describing the administrative justice and the gradual elimination of the separation of powers in Germany in the thirties was added. In terms of government structure, the constitutional system of the Czech Republic is based on the principles of the parliamentary form of government. That means executive powers are vested in the Government (Council of Ministers), which is accountable to the Parliament through the vote of confidence. The Head of State as a pouvoir neutre plays usually a representative and integrating role in this system. On the contrary the President lacks the political accountability and the Parliament (or another voting body) does not have any direct way of holding him accountable for his action. Except for high treason he also cannot be prosecuted for his actions during his term. The Government therefore usually influences the exercise of his powers by countersigning his acts or decisions. Nevertheless, the role of the Czech President within the constitutional system is not only ceremonial; through his powers he can also actively participate in the adoption of political decisions. He can even exercise some of his expressly granted powers not subject to approval of the Government or any other constitutional body. As instituições estão dispostas irracionalmente e sem coerência, permitindo a indevida cumulação (fusão) das funções de chefia de Estado, de chefia de governo e de gestão da Administração Pública em mãos de uma Presidência da República. Tratam-se de funções com finalidades, princípios e protocolos de trabalho complemente diversos, não podendo jamais serem cumuladas da forma como se encontram. A separação Estado, governo e Administração Pública é, portanto, medida que se impõe e a única saída possível para dotar o país da estabilidade e do consensus necessários para vencer as suas violentas crises. / Brazil has been going through one of the most troubled times in its history. A fragile and divided country without a consensus for basic structural reforms that are greatly needed, or rather, the way in which its political organs of state are internally disposed. Institutions are disposed irrationally and without coherence, allowing Presidency of the Republic office cumulates the functions of head of state, head of government and management of public administration. These are functions with completely different purposes, principles and protocols of work, which cannot be cumulated under one office. The separation of State, Government and Public Administration is therefore a necessary measure and the only possible way out to give the country the stability and consensus needed to overcome its violent crises.

En droit algérien, comme en droit français, la Production de la norme juridique passe par plusieurs étapes, depuis la phase de préparation jusqu’a l’ application, elle subit l’intervention de plusieurs acteurs législatifs qui créent un déséquilibre des pouvoirs en matière d’initiative entre les deux chambres du parlement , que vient atténuer la révision constitutionnelle algérienne de 2016, ensuite entre le parlement et le pouvoir exécutif, ce dernier a la maitrise sur toute la procédure législative en matière de débat législatif jusqu’a son adoption, le texte reste toujours au stade de projet tant que le veto du président de la république par la demande d’une seconde lecture ou pour retard de promulgation n’est pas levé. Ce n’est pas pour autant que le texte devient applicable, car en dernière étape le texte demeure tributaire du conseil constitutionnel qui, une fois saisi, peut modifier, ou tout simplement rejeter tout le texte pour une inconstitutionnalité. Est-il pour autant vrai qu’en Algérie, le parlement est dépossédé de sa fonction initiale, qui est la production de la norme juridique. O objetivo do trabalho é compreender a sua construção a partir da apreensão da lógica da tomada de decisão do legislador brasileiro na definição de sua trajetória profissional. Para isso, o estudo procurou estabelecer as motivações dos membros da Câmara dos Deputados diante das opções de carreira que se apresentam, no sentido de permanecer ou não na arena legislativa. A questão analisada é se a instituição está
oferecendo atrativos aos seus membros para sua permanência, ou se estes estão alocados em outras instâncias. A hipótese-teste é a de que o Poder Executivo tem atraído os membros do Legislativo, desenhando um padrão de carreira política no qual as arenas se intercalariam Executivo e Legislativo assim como as esferas federal, estadual e municipal. A tese está estruturada em uma revisão das literaturas estrangeira e brasileira sobre carreira política, apresentando também um exame dos modelos de recrutamento e permanência na carreira parlamentar. São consideradas as influências de dois elementos estruturais da lógica política no Brasil. O primeiro é a estrutura federativa adotada no país a partir da Constituição de 1988 e o segundo é o seu sistema eleitoral e partidário, sobretudo o papel dos partidos políticos e do tipo de recrutamento de candidatos na adoção das estratégias de carreira de seus representantes. the Executive has proven an effect of attraction on the members of the Legislature, drawing a pattern of political career in which the legislative and executive arenas are
interspersed, as well as federal, state and municipal levels. The thesis is structured in a literature review about foreign and Brazilian political career, with a detailed analysis
of models of recruitment and retention in parliamentary career. The influence of two structural elements of the political logic in Brazil is considered. The first one is the
federal structure adopted by the country since the Constitution of 1988, and the second one is its electoral system and party, especially the role of political parties and
the type of candidates recruitment in the adoption of their representatives career strategies. The aim is to understand the way the framework created by the
combination of these characteristics determines, enables or prevents the construction of political careers in Brazil and their ambitions. The data collected in the survey
include the elections for the House of Representatives and for the office for Mayor in all municipalities in Brazil happened in the last 20 years. The Antiquities Act of 1906 : The Public Response to the Use of Presidential Power in Managing Public LandsGrover, Barbara L. 21 April 1998 (has links)
President Clinton created Grand Staircase-Escalante National Monument on September 17, 1996. The Antiquities Act of 1906 gives the president power to establish national monuments on public lands through presidential proclamation. The Act has been used to create national monuments in places such as Muir Woods, Grand Canyon, Mount Olympus, Jackson Hole, and the 1978 Alaskan d-2 lands. Its use has also produced negative public response, manifested as demonstrations, lawsuits, and congressional bills.
In spite of significant legal and legislative challenges, the Antiquities Act and most of the monuments established through its use remain. The negative public response to the Act and the monuments has not been able to dissuade presidents from using executive authority. In each of the controversial cases the scope of the Antiquities Act was expanded in regards to the values being protected, monument size, or land use. The public had little influence in reversing that expansion.
The Antiquities Act was designed as a tool to provide protection to threatened lands. It has protected federal lands, and in many cases the national interest. The historic and scientific values of once controversial monuments such as the Grand Canyon, Muir Woods Mount Olympus, Jackson Hole, and the d-2 lands, are now indisputable. These monuments have evolved to represent part of our natural national heritage. Only time will tell if the same can be said for Grand Staircase-Escalante National Monument.

L'objet de la présente thèse est de procéder à l'étude comparée des doctrines et jurisprudences françaises et allemandes consacrées au principe de la séparation des pouvoirs. D'origine philosophique, ce principe n'est pas, aujourd'hui, dépourvu d'effets juridiques pratiques, comme le montrent les problèmes récents, soulevés dans la jurisprudence du conseil constitutionnel et de la cour constitutionnelle allemande. Toutefois, on ne saurait comparer la mise en oeuvre d'un principe dans deux ordres juridiques différents sans faire l'effort d'un retour nécessaire sur la genèse doctrinale de ce principe, sans apporter au travail comparatif une dimension d'histoire de la culture juridique dans les pays comparés. Le point essentiel de ce travail serait d'expliquer les développements jurisprudentiels les plus récents à la lumière de l'histoire des doctrines. Si notre travail sera essentiellement centré sur une comparaison franco-allemande, il doit rester ouvert à toute perspective intéressante que pourraient fournir, sur le sujet, d'autres jurisprudences nationales et européennes. / The thesis focuses on the german constitutional case law and doctrine relating to the principle of the separation of powers. The analysis of the problems concerning the meaning of the rule deducted under article 20 paragraph 2 of the German Basic Law of 23 May 1949 point up its practical application today. The interpretation of the solutions of the Federal Constitutional Court constitues the main part of this research however it is impossible to globally appreciate and understand the principle of the separation of powers without make the necessary effort to explain its genesis in the german constitutionnal law. Ergo, the theories of the Vormärz also the thought of the legal scolars of the Empire and the Weimar Republic are an important key stage that permit to grasp the present form of the principle in the decisions of the judge. The functional justice or the theory of the substantial decision complete the definition of the constitutional separation of powers. The concretisation of these integral elements of the principle create the system of checks and balances that govern the conflicting relations between legislative, executive and judicial powers.

The President performs many roles, but one role of increasing importance over time is that of Chief Manager of the Economy. In the era of the modern presidency, there has been a growing institutionalization of the executive branch’s management of the economy. Presidents approach economic management differently depending upon their personalities, management style, and their time within both the crisis and the administration. Three case studies will be used to explore the differences and similarities in presidential actions during times of economic crisis: these case studies will examine the presidencies of Franklin D. Roosevelt, Richard M. Nixon, and William J. Clinton. The different methods and policy actions taken by these presidents are described as change oriented economic policy, electoral gain economic policy, and preemptive economic policy. This research will examine these methods to determine: 1.) How did each president approach economic policy? 2.) Were their approaches similar to a domestic policy or foreign policy? and 3.) What factors influence these approaches?
