Dada sua definição e a forma como opera na atualidade, o refúgio pode ser caracterizado por dois momentos: o anterior à determinação do status de refugiado - o qual congrega as condições de vida que levam à fuga e legitimam o reconhecimento como refugiado -; e o posterior - o qual consiste das condições de vida no país de acolhida (a chamada fase de proteção). O instituto do refúgio vincula dois âmbitos que visam garantir a proteção internacional do indivíduo: o regime internacional dos direitos humanos e o regime internacional dos refugiados. Atualmente, tem-se reconhecido a relação entre essas duas esferas, principalmente no que se refere à aproximação histórica e filosófica, contudo, ainda há posicionamentos que defendem a não-existência de tal vinculação. Esse trabalho visa desenvolver uma análise sobre a relação existente entre direitos humanos e refúgio nos momentos anterior e posterior à determinação do status de refugiado. Em relação ao primeiro, visando demonstrar a impossibilidade de desvinculação entre a concepção contemporânea da proteção internacional dos refugiados e o reconhecimento e a garantia dos direitos humanos, argumenta-se, a partir de uma revisão bibliográfica, que a violação de direitos humanos é sempre o motivo que leva à determinação da condição de refugiado. No que concerne ao segundo, visamos analisar como o ACNUR, principal organismo para o trato da questão, tem se manifestado em relação aos direitos humanos dos refugiados nos países de acolhida - partindo do exame de algumas de suas publicações e apontando como a política internacional tem se configurado como fator central para a forma como o ACNUR se expressa em relação à violação desses direitos nos países de refúgio. / Given its definition and the way it operates in the present, the refuge can be characterized by two moments: the one before the refugee status determination process - which comprises the life conditions that lead to the flight and justify the admission of a refugee in another country -; and the one after this process - which consists of the life conditions in the asylum country (the so-called protection phase). The refuge bonds two domains which aim to assure the international protection: the human rights international regime and the refugee international regime. Presently, it has been recognized that there is a fundamental tie between these two spheres, mainly in relation to the historical and philosophical approximation, nevertheless, there still are opinions which advocates against such linking. This research aims to develop an analysis about the relation that exists between human rights and refuge in the moments before and after the refugee status determination. In respect to the first, aiming to demonstrate the impossibility of disconnecting the contemporaneous concept of international protection and the recognition and guarantee of human rights, starting from a bibliographic review, it is argued that the human rights violation is always the reason that yields to the refugee status determination. Regarding the second one, we aim to analyze how the UNHCR, main organization for dealing with the issue, has manifested its opinions about the refugee human rights in the asylum countries - using as parameter some of its publications and revealing how the world politics has been a key factor to the way this agency expresses itself respecting to the rights violations in the asylum countries.

[pt] O presente trabalho realizou análise acerca do conceito de Grave e Genera-lizada Violação de Direitos Humanos (GGVDH), a fim de investigar quais são as fundações da definição ampliada de refugiado e como se deu a sua construção no Brasil. Através de pesquisa bibliográfica e documental, os dados usados nesta Dissertação de Mestrado foram coletados das seguintes fontes: teses, dissertações, livros e artigos; relatórios do governo, de organizações internacionais e não go-vernamentais; tratados, declarações e legislações. Esta dissertação buscou apre-sentar a arquitetura protetiva internacional da pessoa humana, investigando as conexões com os diversos mecanismos do Direito Internacional dos Direitos Hu-manos, suas complementaridades, seus regimes e aplicações regionais e nacionais para, então, explorar a trajetória do refúgio no Brasil não somente até a construção do conceito de GGVDH pelo governo, mas também no seu reconhecimento. Em um primeiro momento, deu-se a apresentação do arcabouço jurídico internacional, sua interdependência e relevância para a proteção humana, culminando na Decla-ração de Cartagena (1984) e seus processos revisionais. Posteriormente, desen-volveu-se o histórico brasileiro em matéria de refúgio, chegando ao período de redemocratização e incorporação do conceito de GGVDH pela Lei n° 9.474/1997. Por fim, passou-se à breve análise do reconhecimento de refúgio no Brasil por GGVDH, no intento de mapear o posicionamento do governo frente a essa defini-ção, sua aplicação e limitações, apontando algumas nuances e conclusões. / [en] The present study undertook an analysis about the concept of Gross and Generalized Violation of Human Rights (GGVDH), in an attempt to understand what the foundations of the extended definition of refugee are and how it has been constructed in Brazil. Through a bibliographic and documental research, the data used in this Master s Thesis was collected from the following sources: theses, dissertations, books and articles; reports from government, international and non-governmental organizations; treaties, declarations and legislation. This thesis sought to present the international protective architecture of the human person, investigating its connections with the various mechanisms of International Human Rights Law, their complementariness, regimes, regional and national applications to then, explore the refuge trajectory in Brazil, not only until the construction of the GGVDH concept by the government, but also its recognition. Initially, the international legal framework was presented, their interdependence and relevance to the human protection, culminating in the Cartagena Declaration (1984) and its revision processes. Subsequently, it demonstrated the Brazilian history in terms of refuge, up until the period of re-democratization and incorporation of the GGVDH concept by the Law n 9.474/1997. Finally, it presented a brief analysis of the refugee status recognition under GGVDH in Brazil, in an attempt to map the gov-ernment’s position in relation to this definition, its application and limitations, pointing out some nuances and conclusions.

<p>This paper studies the structural issues concerning possible human rights violations found in the Dublin Regulation; An EU regulation aiming to allocate a responsible member state to a third-country-nationals asylum application. It is one of the criticized legal documents within the scholarly field of human rights. Hence, this study aims to study the details of the regulation to find out the elements of the regulation that are prone to human rights violations. Asking the question: What are some details of the Dublin Regulation that could potentially result in human rights violation of the third-country nationals seeking international protection within the territory of member states? Hence, exploring the gap found between the regulation and human rights of the asylum seekers. This was done by a normative legal analysis study of the law, studying the text of the regulation, relevant human rights law, and jurisprudence from two courts of law: ECHR and ECJ. The findings of the study highlights, first, the regulation upholds only the superficial elements of human rights law. Second, the regulation assumes that every member state is a safe country. Third, there is an imbalance of responsibility on either of the two or more member states involved. These are the details of the regulation highlighted in this study that is potentially the result of possible human rights violations and the criticism of the topic. </p>

Introdução: Em muitos países, em especial naqueles pobres e de renda média, há dificuldades para melhorar os indicadores de morbi-mortalidade materna e neonatal, mesmo com a universalização do acesso à assistência, como no Brasil. Muitas vezes são as concepções de gênero que orientam a prática dos profissionais e a organização dos sistemas e serviços de saúde típicos, o que resulta em sobrevalorização da tecnologia e minimização ou mesmo invisibilidade de seus efeitos adversos. As narrativas sobre desrespeitos, abusos, e maus-tratos às mulheres evidenciam a ocorrência de uma modalidade específica de violência institucional, recentemente nomeada como violência obstétrica. Neste trabalho, o termo é entendido como o desrespeito aos direitos da mulher na assistência a sua saúde sexual e reprodutiva, tendo em vista seus direitos humanos básicos e inalienáveis. A Iniciativa Hospital Amigo da Mulher e da Criança (IHAMC) foi proposta em 2015 para superar esse quadro. Objetivos: Mapear os facilitadores e obstáculos de um piloto de implementação da IHAMC para a superação da violência obstétrica, em especial nos critérios \"liberdade de movimentação no trabalho de parto e parto\" e \"presença de acompanhante de escolha da mulher\". Métodos: Este trabalho integra um piloto de implementação da IHAMC em duas maternidades do SUS, com análise dos dados produzidos na etapa inicial no campo paulistano da pesquisa (2016-17). Foram realizadas entrevistas individuais e atividades em grupo com gestores, profissionais de saúde e usuárias do serviço; observação do serviço e análise dos dados do Sinasc da maternidade. Foi criado um grupo de trabalho com gestores, profissionais da assistência, pesquisadores e usuárias para analisar os problemas identificados e atuar sobre eles. Resultados: As visões de gestores e profissionais de saúde contrastam com a observação e os relatos das mulheres, com verificação de interdições ao exercício do direito a acompanhante e à liberdade de movimentação no trabalho de parto e parto. Também foram recorrentes as falas no sentido de responsabilizar as mulheres pelas dificuldades que elas enfrentam na internação para o parto. Os atores envolvidos mostram disposição para aprimorar a qualidade da assistência, e propuseram mudanças nesta direção, algumas já em andamento. Conclusão: A IHAMC pode ser uma boa estratégia para superar a violência obstétrica em contextos como o brasileiro, uma vez que coloca em debate a qualidade da assistência tendo em vista os direitos das mulheres e propicia a incorporação dos atores envolvidos na solução dos problemas, contribuindo para sua solidez e sustentabilidade. / Introduction: In many countries, especially in poor and middle-income ones, there are difficulties in improving maternal and neonatal morbidity and mortality, even with universal access to care, as in Brazil. Often it is the gender conceptions that guide professionals\' practices and the organization of typical health systems and services, which results in overvaluation of technology and minimization or even invisibility of its adverse effects. The narratives about disrespect, abuses, and mistreatment of women show the occurrence of a specific modality of institutional violence, recently named as obstetric violence. In this thesis, the term is understood as the disregard for women\'s rights while caring for their sexual and reproductive health, in view of their basic and inalienable human rights. The Mother-Baby Friendly Birthing Facilities Initiative (MBFBF) was proposed in 2015 to overcome this situation. Objectives: To map out the facilitators and obstacles of a MBFBF implementation pilot to overcoming obstetric violence, particularly with respect to the criteria \"freedom of movement in labor and birth\" and \"presence of women\'s companion of choice\". Methods: This study is part of a MBFBF implementation pilot in two SUS maternity hospitals, with an analysis of the data produced at the initial stage in the São Paulo site of research (2016-17). Individual interviews and group activities were conducted with managers, health professionals and users of the service; observation of the service and analysis of Sinasc maternity data. A working group was created with managers, health professionals, researchers and consumers to analyze and act on the problems identified. Results: The visions of managers and health professionals contrast with the observation and women\'s reports. It was verified that right to presence of a support person and freedom of movement in labor and birth were denied to women. There were recurrent statements blaming women for the difficulties they face during hospitalization. However, all actors involved showed a willingness to improve quality of care, and proposed changes in this direction, some already in progress. Conclusion: The MBFBF can be a good strategy to overcome obstetric violence in contexts such as Brazil, since it raises the issue of quality of care with regard to women\'s rights and allows the incorporation of the actors involved in the solution of the problems, contributing for its solidity and sustainability.

Le fonctionnement harmonieux de ce système suppose l’existence d’un organe indépendant chargé, entre autres, de veiller à l’équilibre général du dispositif et d’assurer une interprétation uniforme des normes communautaires.Dans le cadre de l’UEMOA comme de La CEDEAO, cette fonction de protection est exercée par des organes juridictionnels intégrés dont la mission principale consiste à veiller au respect du droit dans l’interprétation et dans l’application des Traités constitutifs.L’objectif visé, à travers cette contribution, est de faire observer que le dispositif de protection mis en place fonctionne, d’une part, par les mécanismes de coopération institués entre les cours de justice et les autres composantes du système communautaire et d’autre part par le contrôle juridictionnel exercé sur les organes communautaires et les Etats membres. / After being freed from colonization, the West African States have set up commonly economic integration organizations to promote their economic and social development.The creation of the majority of those organizations is based on the European example and they have an independent legal personality and a body with specific rules in charge of integrating uniformly the internal legal environment of the different Member States.The harmonious functioning of the system requires, among others, the existence of an independent structure designed to take control of the general balance organization and achieve a uniform interpretation of the Community norms. Within the framework of the WAEMU as well as in the ECOWAS, this protective function is delegated to integrated judicial bodies whose main mission consists in making sure that a submission to the law related to the interpretation and compliance with Treaties is effective.The goal of such a contribution is to point out that the settled protection device is functioning, on the one hand, by the cooperation mechanisms introduced by justice courts and the other components of the Community system and, on the other hand, by the judicial control over the community structures and the Member States.

The thesis is focused on the examination of the scope of Article 14 of the European Convention of Human Rights, theoretical framework, and legal basis of the concept of discrimination. The paper presents an analysis of the caselaw of the European Court on Human Rights, how the latter operationalises the issue of inequality, and which inaccuracies of interpretation it leaves. The primary aim is to challenge the system of protection against discrimination under the Article 14 as well as the role of the national actors in its development. The thesis examines the level of compliance among signatories of the Convention with its anti- discriminatory provisions and focuses on the individual capacities of the states to satisfy judgements of the European Court on Human Rights. The usage of the comparative approach also helps to analyse the role of local non-governmental organisations in the process of compliance with human rights obligations under the Convention among signatories. The thesis aims to show why the level of protection against discrimination differs from the one country to another and which obstacles they face on the path towards the respect for human rights.
