Esse trabalho busca rever e analisar diversas narrativas sobre a chamada \"crise do Sistema Interamericano de Direitos Humanos\" e a posição brasileira na relação com esse sistema. A perspectiva de vários atores envolvidos mostra suas concepções de si, dos demais agentes e da própria crise, bem como as mudanças de suas estratégias, possibilitando um vislumbre das dinâmicas políticas presentes em casos de \"alto perfil político\". Faz-se um breve histórico das relações entre o Brasil e o SIDH, e dos precedentes da crise. Foram entrevistados atores governamentais, da sociedade civil e da Comissão Interamericana, de modo a conferir um amplo panorama do caso e de seus múltiplos pontos de vista. O texto pretende discutir essas perspectivas, as conseqüências da crise sobre cada um dos atores analisados, bem como, propor a desconstrução do conceito de Estado monolítico para uma melhor compreensão de suas relações com outras instituições. / This article seeks to review and analyze the various accounts on the \"Inter-American Human Rights System crisis\" and the Brazilian positioning on it. The point of view of the many agents involved reveals their conceptions of themselves, the others and the crisis itself, as well as the changes in their own strategies, which allows a glimpse on the politic dynamics working in the so-called \"high-profile cases\". A brief history of the relations between Brazil and the IAHRS is presented, as well as the precedent cases of the crisis. Agents from the Brazilian governments, the civil society and the Inter-American Commission were interviewed in order to provide a wide outlook on the case and its multiple perspectives. The text intends to discuss these perspectives, the effects of the crisis on each of the studied actors, and to purpose a deconstruction of the monolithic concept of State to understand its relations with other institutions.

O objetivo desta tese é analisar como e por que a normatividade do sistema interamericano de direitos humanos sobre o tema da justiça de transição pôde exercer impacto sobre questões de direitos humanos no Brasil, Colômbia, México e Peru. Partindo da abordagem emergente na literatura de que os efeitos dos regimes internacionais de direitos humanos são condicionados por fatores domésticos dos países aos quais se dirigem suas normas e pressões, a pesquisa buscou delinear como a política doméstica influencia e medeia o impacto potencial dessas normas internacionais que compõem a cascata de justiça, salientando o papel de organizações não governamentais (ONGs) de direitos humanos e da cúpula do Judiciário local, já que tais atores são centrais tanto para o processo de justiça de transição quanto para a ativação e aplicação da normatividade do sistema interamericano. Nesse sentido, a partir de um desenho de pesquisa qualitativo que se baseou na realização de entrevistas semiestruturadas com atores da sociedade civil e magistrados envolvidos com a temática, além da consulta a fontes secundárias e sentenças judiciais, testamos a hipótese segundo a qual o sistema interamericano adquirirá aderência doméstica se e quando esses atores forem capazes de entendê-lo e instrumentalizá-lo como um mecanismo efetivo para o seu empoderamento. Assim, contrariamente à maioria dos estudos que privilegiam a ação do Executivo para explicar o impacto de normas e pressões internacionais de direitos humanos, nossas conclusões apontam para a necessidade de que as agendas de pesquisa sobre o regime internacional de direitos humanos e justiça de transição atentem mais para o papel e perfil dos atores judiciais e organizações litigantes de direitos humanos, pois os avanços em termos de direitos humanos passam muitas vezes pela mobilização de uma normatividade internacional que não pode ser entendida de maneira divorciada da agência de ONGs e magistrados. / The aim of this dissertation is to analyze how and why the norms of the Inter-American Human Rights System on transitional justice exerted an impact on human rights issues in Brazil, Colombia, Mexico and Peru. Based on the emerging theoretical approach according to which the effects of international human rights regimes are conditioned by domestic factors of the target-countries, our research seeks to unravel how domestic politics influences and mediates the potential impact of these international norms that comprise the justice cascade, highlighting the role of human rights non-governmental organizations (NGOs) and the local higher courts, since these actors are central both to the process of transitional justice and for the activation and enforcement of the Inter-American systems rules. In this sense, a qualitative research design based on semi-structured interviews with civil society actors and judges involved with the theme was adopted, in addition to the consultation of secondary sources and courts rulings. Then, from the analysis of this material, we tested the hypothesis that the Inter-American system will have a domestic impact if and when NGOs and local judges are able to understand and use it as an effective mechanism for their own \"empowerment\". Therefore, contrary to most studies that focus on Executives actions to explain the impact of international human rights norms, our conclusions urge the research agendas on the human rights international regime and transitional justice to pay more attention to the role and profile of judicial actors and domestic litigants, since human rights advacements are anchored on the mobilization of international norms that cannot be understood separately from the agency of NGOs and magistrates

Previous issue date: 2015-03-10 / This study aims to analyze the access to justice of the person in economic
vulnerability condition before the Inter-American Human Rights System and
the work of the Public Defender. Whereas the rights in addition to the forecast
need embodiment, and that sometimes the Government needs to be brought
to work in the protection of human rights, access to justice is an important tool
for the rights cease to be mere declarations of good intentions . The list os
rights nowadays includes not only the forecasts in national law, but also
existing in the international arena. It was found the main barriers to access to
justice commonly faced by economically vulnerable people and that the use of
international order can be an effective option for the protection of the victims.
Brazil is part of the Inter-American Regional System, as ratified the American
Convention on Human Rights. The Public Defender has the legal permission
to represent victims of human rights violations in international mechanisms
that are available. The Inter-American System has two protection
mechanisms, the Inter-American Commission and the Inter-American Court,
the latter being the only court in the system. The access of individuals to the
Inter-American justice system takes place through the Committee, as it is not
authorized individual petition to the Inter-American Court of Human Rights.
The figure of the Inter-American Defense, to be called if the victim does not
have legal representation was created. This prediction of the Inter-American
Defense makes clear the recognition of locus standi for the victims. But, it was
not yet recognized the jus standi, which would be very importante for the
realization of justice and ensuring access to the Regional System, as the
referral of the case to the Court through the Committee is discretionary / O presente estudo pretende analisar o acesso à justiça da pessoa em
condição de vulnerabilidade econômica diante do Sistema Interamericano de
Direitos Humanos e a atuação da Defensoria Pública. Considerando que os
direitos, para além da previsão precisam de concretização, e que por vezes o
Poder Público precisa ser provocado para atuar na proteção dos direitos
humanos, o acesso à justiça é importante instrumento para que os direitos
deixem de ser meras declarações de boas intenções. O rol de direitos hoje
abrange não só as previsões no ordenamento jurídico nacional, mas também
as existentes no cenário internacional. Foram identificadas as principais
barreiras ao acesso à justiça comumente enfrentadas pelas pessoas
economicamente vulneráveis e constatou-se que o recurso ao ordenamento
internacional pode ser opção efetiva para a proteção das vitimas. O Brasil é
parte do Sistema Regional Interamericano, visto que ratificou a Convenção
Americana de Direitos Humanos. A Defensoria Pública possui autorização
legal expressa para representar vitimas de violação de direitos humanos nos
mecanismos internacionais disponíveis. O Sistema Interamericano conta com
dois mecanismos de proteção, a Comissão Interamericana e a Corte
Interamericana, sendo essa última o único órgão jurisdicional do Sistema. O
acesso dos indivíduos ao Sistema de Justiça Interamericano se dá por
intermédio da Comissão, já que não é autorizada a petição individual perante
a Corte Interamericana de Direitos Humanos. Foi criada a figura do Defensor
Interamericano, o qual será designado caso a vitima não possua
representação legal. Essa previsão do Defensor Interamericano deixa claro o
reconhecimento do locus standi às vitimas. Mas,ainda não foi reconhecido o
jus standi, o que seria de primordial importância para a realização da justiça e
garantia de acesso ao Sistema Regional, já que o encaminhamento do caso
à Corte por intermédio da Comissão é discricionário

More than just simple cases in which a woman is a victim, these analyzed episodes show that the violence took place precisely because the victim was a woman. This dissertation is based upon quantitative and qualitative data concerning the occurrence of these cases in the Inter- American Human Rights System and the impact that this decisions had on womens human rights observance in the region and on the re-formulation of human rights concept itself.

La violencia obstétrica, constituye una problemática abordada desde distintos ámbitos y regulada en muchos países a nivel internacional. Los derechos humanos vulnerados que se vinculan con actos de violencia obstétrica han sido abordados y trabajados por distintos comités, informes y protocolos dentro del Sistema Interamericano de Derechos Humanos y el Sistema Universal de Derechos Humanos. El objetivo de esta investigación es analizar la situación de la violencia obstétrica y como el estado peruano ha venido dando respuesta frente a esta problemática. Ello, a partir del caso de Eulogia Guzmán y su hijo Sergio ante la Comisión Interamericana de Derechos Humanos. Este caso engloba un conjunto de hechos vinculados con vulneraciones a los derechos humanos, tales como el derecho a la salud, derecho a la vida, derecho a la dignidad humana, derecho a la salud materna y el ejercicio de los derechos humanos de las mujeres. Pues se evidencia que nuestro país tenía obligaciones vigentes en materia de estos derechos cuando aconteció este caso. En ese sentido Eulogia termina siendo víctima de la inacción e ineficacia del estado para garantizar el ejercicio de derechos plenamente reconocidos. / Obstetric violence constitutes a problem approached from different spaces and regulated in many countries at an international level. The violated human rights linked to acts of obstetric violence have been signed and worked on by different committees, reports, and protocols within the Inter-American Human Rights System and the Universal Human Rights System. The objective of this research is to analyze the situation of obstetric violence and how the Peruvian State has been responding to this problem. This, based on the case of Eulogia Guzmán and his son Sergio vs. the Inter-American Commission on Human Rights. This case included a number of facts related to human rights violations, such as the right to health, the right to life, the right to human dignity, the right to maternal health, and the exercise of women's human rights. According to that, it is evident that our country had obligations regarding these rights when this case happened. In this sense, Eulogia ends up being a victim of the inaction and ineffectiveness of the state to guarantee the exercise of fully recognized rights. / Tesis

The world has seen gradual evolution of regional human rights arrangements. The adoption by the UN General Assembly of the Universal Declaration of Human Rights on December 10, 1948, was followed by the creation of numerous regional instruments that address concerns of particular importance in the regional context. Three world regions, Africa, the Americas and Europe, have established their respective regional instruments together with the supervisory mechanism, such as commissions and courts.
The African Charter on Human and Peoples’ Rights, with its emphasis on group rights and individual duties challenges the Western liberal account of rights, as expressed in the Universal Declaration of Human Rights. The cultural differences brought to the fore not only the tension between individual and group rights but also the question as to whether of the universalism of human rights is possible. The study advocates for a moderate universalism of human rights, which can only be achieved through a dialogue among different cultural approaches to the notion of human rights.
This study examines the content and substance of human rights norms of the African system with a view to recommending the possible strategies for their reform. Its central thesis is, the system is rather weak and therefore needs to be reformed. Toward this end, the study analyses the provisions of the African Charter. Thereafter, it explores its weaknesses and proposes strategies for their reform. The African human rights mechanisms face a number of common and particular challenges. Previous issue date: 2015-12-11 / This study aims to analyze the implementation of judgments of the Inter-American
Court of Human Rights by States which recognized its contentious jurisdiction. Thus
aims at gradual improvement in human rights conditions in those locations by
developing proposals to harmonize legislations regarding the implementation of nonfinancial
terms of inter-American sentences minted in international cooperation. The
importance of this research rests on high rates of non-compliance of its indictments,
especially those obligations of doing and not doing imposed on States. Therefore, in
a sharing sovereignty reality, a viable direction for this scenario is the use of
cooperation tools. By seeing that only Peru and Colombia have these laws and
they not complied them satisfactorily the first proposal is based on the
implementation and improvement of these regulations, applying them successfully in
all States that are part of the compulsory jurisdiction of the Court; as an alternative,
the thesis alluded to the United Kingdom´s system, which greatly contributes to the
effective enjoyment of human rights. For the correct understanding, it was discussed
about the State devices: social formations, its historical and elements, the influence
of the globalization, the consequent of the sharing sovereignty and the emergency of
international organizations. Furthermore, the study examined the international
cooperation and its utility for the guarantee of effectiveness of human rights, by
analyzing its concepts, principles and its practical application nowadays. Human
rights were also the foundation of this thesis, as well as their structural apparatus and
its consequent international protection, reached the study of the inter-American
system for the protection of human rights. Finally, the thesis looking at each of the
States that recognized the contentious jurisdiction of the Inter- American Court to
understand each internal milestone about the protection of human rights and their
predictions of the implementation of international sentences. Thus, it was possible to
understand local necessities and connect them to the possibility of harmonization of
legislations by using cooperation tools. The study concluded that the effectiveness of
human rights sentenced by Inter-American Court would be assured, at least, legally / O presente estudo envolve a análise da implementação das sentenças da Corte
Interamericana de Direitos Humanos pelos Estados que reconheceram sua competência
contenciosa. Assim, objetiva a gradativa melhora nas condições dos direitos
humanos naqueles locais pelo desenvolvimento de propostas de harmonização das
legislações nacionais quanto à execução dos termos não pecuniários das sentenças
interamericanas, cunhadas na cooperação internacional. A importância desta pesquisa
repousa no fato de se constatarem altos índices de descumprimento das condenações
da Corte Interamericana, especialmente quanto às obrigações de fazer e de não
fazer impostas aos Estados. Assim sendo, em uma realidade de compartilhamento
de soberanias dos Estados, uma orientação viável para a transformação da situação
de descumprimento de condenações que envolvem os direitos humanos é justamente a
utilização de instrumentos cooperativos. Haja vista que apenas Peru e Colômbia
possuem estas legislações e ainda assim não efetivaram de maneira satisfatória -,
a primeira proposta se baseia na implementação e melhoria destas normativas,
aplicando-as satisfatoriamente em todos os Estados que integram a competência
contenciosa da Corte; como via alternativa, alude-se ao meio previsto no Reino
Unido, cujo qual contribui sobremaneira para o concreto gozo dos direitos humanos.
Para a correta compreensão, incorreu-se na indispensabilidade do exame de todo o
artefato estatal: primeiras formações sociais, desenrolar histórico, seus elementos,
influência da globalização e o consequente compartilhamento de soberanias e
emergência das organizações internacionais. Ademais, apreendeu-se acerca da
cooperação internacional e sua utilidade para com a garantia de eficácia dos direitos
humanos, discorrendo-se sobre sua conceituação, seus princípios e sua aplicação
prática contemporaneamente. Os direitos humanos também formaram o alicerce desta
tese, tendo sido averiguado seu aparato estrutural, bem como sua consequente
proteção internacional, chegando-se, assim, ao estudo do sistema interamericano de
proteção dos direitos humanos. Por fim, explorou-se casuisticamente cada um dos
Estados que integram a competência contenciosa da Corte Interamericana, justamente
para compreender cada um dos marcos internos de proteção dos direitos humanos e
suas previsões sobre o cumprimento das sentenças internacionais. Assim, viabilizou-se
a apreensão das necessidades locais e atrelou-as à possibilidade de harmonização
das legislações pelo compartilhamento das soberanias que, em última análise,
resumem-se a instrumentos cooperativos. Pressupõe-se, desta forma, que a eficácia
dos direitos humanos previstos nas condenações da Corte Interamericana estará, ao

Previous issue date: 2011-09-21 / This research aims to study the main cases of human rights violations involving the
Brazilian state, driven to within the American system of protection of human rights.
Ultimately, this study intended to investigate the decisions of the Inter-American
Court of Human Rights on these issues. For the correct understanding of the issue, it
was discussed the need to analyze some institutes of International Law, specifically
international organizations and human rights. Accordingly, with respect to international
organizations, the study examined its main points, covering its development history,
its concept, its modifications according to the claims of society and, finally, its
correlation to the protection and realization of human rights. Regarding the latter, the
research needed to elaborate on their exponential issues involving its historical
development, its conceptual determinations, the need for international protection and,
in agreement with this, their systems of protection, both universal (present within the
United Nations Organization) and regional (European, African, Arab and inter-
American). Because of the main points of the study, the protection system of greater
value was the inter-American system, enshrined in the Organization of American
States, specifically in their Commission and Inter-American Court of Human Rights.
The jurisdictionalization of this system is embodied in his Court, and, for a case of
violation come to its attention, the Commission needs to understand that the Court s
decision is essential. Thus, according to the survey, it was considered Brazil has a
crucial role in the development of inter-American system, but, paradoxically, it is a
major violator of human rights. The Brazilian state, in this sense, was sued by five
times in the Inter-American Court - Damião Ximenes Lopes (Case 12237); Gilson
Nogueira de Carvalho (Case 12058); Arley Joseph Escher and others (Case 12353),
Garibaldi (Case 12478), and Julia Gomes Lund and others (Case 11552). Just in
case of Gilson Nogueira de Carvalho it has not demonstrated that Brazil violated
human rights.The conclusion was that Brazil was not a strong supporter and
protector of human rights in the internalization and enforcement of these sentences.
Brazil has only fulfilled part of the sentences. Finally, the study concluded that the
inter-American system needs to enhance, despite its character of extreme importance
in the protection of human rights. In the Brazilian case, it should treat their sentences
more seriously to become a committed state not only to inter-American system, but
also to the protection and realization of human rights of its citizens / O presente trabalho tem por objetivo o estudo dos principais casos de violações de
direitos humanos, envolvendo o Estado brasileiro, levados ao âmbito do sistema
interamericano de proteção de direitos humanos. Em última análise, destina-se esse
estudo à investigação das decisões da Corte Interamericana de Direitos Humanos
nas referidas questões. Para a correta compreensão do tema, debateu-se sobre a
necessidade do exame de alguns institutos de Direito Internacional, especificamente
das organizações internacionais e dos direitos humanos. Nesse sentido, no que tange
às organizações internacionais, examinou-se seus principais pontos, englobando seu
desenrolar histórico, seu conceito, suas modificações de acordo com os reclames da
sociedade e, por fim, sua correlação para com a proteção e efetivação dos direitos
humanos. No que tange a esses últimos, viu-se a necessidade de discorrer sobre
suas exponenciais questões, envolvendo seu desenvolvimento histórico, suas
determinações conceituais, a necessidade de uma proteção a nível internacional e,
em concordância com essa, seus sistemas de proteção, tanto universais (presente
no quadro das Organizações das Nações Unidas), como regionais (sistema europeu,
africano, árabe e interamericano). Por ali se encontrarem as questões cruciais do
estudo, o sistema de proteção de maior valia fora o interamericano, consagrado na
Organização dos Estados Americanos, mais especificamente em sua Comissão e
Corte Interamericana de Direitos Humanos. A jurisdicionalização do referido sistema
encontra-se materializada em sua Corte, sendo que, para que um caso de violação
chegue ao seu conhecimento, necessário se faz o crivo anterior da Comissão.
Assim, de acordo com a pesquisa, entendeu-se ter o Brasil um papel crucial no
desenvolvimento do sistema interamericano, mas, paradoxalmente, constitui-se
como um grande violador dos direitos humanos. O Estado brasileiro, nesse sentido,
fora demandado por cinco vezes na Corte Interamericana nos casos Damião
Ximenes Lopes (Caso 12.237); Gilson Nogueira de Carvalho (Caso 12.058); Arley
José Escher e Outros (Caso 12.353); Sétimo Garibaldi (Caso 12.478); e Julia Gomes
Lund e Outros (Caso 11.552) -, tendo sido condenado em todos eles, à exceção do
caso Gilson Nogueira de Carvalho. Chegou-se à conclusão que, na internalização e
cumprimento das referidas sentenças, o Brasil não se demonstrou um fervoroso
defensor e protetor dos direitos humanos, pois veio cumprir apenas parte dos
dispositivos das referidas sentenças. Finalmente, pôde-se concluir, com esse
trabalho, que o sistema interamericano, obstante seu caráter de extrema importância
na proteção dos direitos humanos, necessita aprimorar-se para que a efetivação se
torne uma realidade nos Estados que dele fazem parte e, no caso brasileiro, deverá
o Brasil tratar suas condenações com mais seriedade para que, de fato, venha a ser
um Estado comprometido não apenas ao sistema interamericano, mas igualmente à
proteção e efetivação dos direitos humanos de seus cidadãos
