Determinace způsobu spáchání trestného činu / The Determination of Modus Operandi

The purpose of my thesis is to provide description of modus operandi. Specifically it is focusing on determining factors and their influence on modus operandi. It is divided into seven main chapters. Theory is supplemented with examples of forensic practice. The first chapter is providing the description of term modus operandi. This section is also including the part dealing with terminology. Following chapter is about components of modus operandi. The components are divided by their character and their degree of complexity. The third section is dealing with determination in general. The thesis continues by two chapters describing the determinants of modus operandi. The first section is analysis of objective determinants and the following part is about subjective factors. Section of determination is devoted an immense part of my thesis. The sixth chapter is describing mechanisms of formation modus operandi. Conclusion is dealing with forensic significance of modus operandi, concretely the significance for creation of investigative versions, forensic record "modus operandi systém", forensic identification and also for forensic prevention.

Forensic Handwriting Examination The aim of this thesis is to introduce the Forensic handwriting examination as one of the disciplines of Forensic identification, to describe its methods and procedures, and to demonstrate them on specific examples. The aim of the practical part of the thesis is to apply the findings described in the theoretical part of the thesis to the handwriting examination carried out by the author of the thesis, to experimentally verify some of hypotheses presented in the thesis, such as the influence of various factors on the handwriting of an individual, and to examine the most frequent methods of deliberate alteration of one's handwriting. The first chapter of the thesis is focused on the definition of the term "Handwriting Examination", on a brief examination of the history of this branch of forensic science, and on the analysis of its relations to other fields of forensic science, especially to the graphology. The following chapter describes the procedure of establishing one's handwriting habits, the influence of the Czech handwriting system taught to children, and some of the internal and external factors which influence one's handwriting. Title: The impact of physical activity on the quality of life of persons serving a term of imprisonment Aims: The main aim of this thesis is to detect, if the health-oriented fitness and the level of quality of life of persons serving a term of imprisonment increases after ten weeks of a regular exercise. Another aim is to find out, if the results of the observed aspects of persons who did take part in the exercise programme will be much different from those who did not. Methods: This is an empiric-theoretical research thesis. Four ensembles took part in this quantitative research. The ensembles I. (N=5) and II. (N=7) filled out a self- designed questionnaire about quality of life and were tested for health-oriented fitness with the Fitnessgram test battery. The partial motor tests evaluate endurance, muscle strength and flexibility. This measurement was hold before and after a ten weeks long organized exercise program. The ensembles III. (N=15) and IV. (N=15) only filled out the questionnaire of quality of life twice, in the same period as the ensembles I. and II. Results: The results showed a positive impact of regular physical activity on the physical condition of the participants, because most of them improved their health- oriented fitness. Rekonstrukce trestného činu / Reconstruction of a Crime

The main topic of this thesis is the reconstruction of a crime. These special means of evidence are regulated in the provisions of § 104d of the Criminal Procedure Code. This act takes place if the situation in which the crime was committed is to be restored, or if the circumstances related to the crime are to be restored, if the testimony of the suspect, accused, co-accused, injured party or witness, is to be examined, but only if other evidence provided in the proceedings is not sufficient to clarify the case. In the first chapter, the topic of the legal regulation of the reconstruction of a crime is set in a historical context. The current legal regulation of this institute in the Czech legal system follows. Furthermore, the concept, meaning and types of forensic reconstruction are analysed, which is compared to selected special means of evidence, for which it is often incorrectly confused. As the reconstruction of a crime is a complex and very important mean of evidence, the merits of this thesis are devoted to the preparation, planning, the actual execution, documentation and evaluation of this act. Furthermore, the thesis describes two examples of crime reconstruction from practice and ends with considerations de lege ferenda.

The graduating paper focuses on the digital image capture method in criminalistic and also on its legal regulation and practical resort in the law enforcement institutions‘ investigations of criminal acts. The digital image capture is one of the methods of digital image capture in criminalistic. Its structure contains digital photography and digital video recording. The digital photography is used for strategical and investigative photography. The usage of the digital image capture method investigating the criminal acts is not against the provision of the Criminal Procedure Code. This method is not regulated by any other legal instrument. It often happens that the media captured by the digital camera under investigation is not attached to the criminal case. It is the violation of the Criminal Procedure Code. The digital photography is used in the pretrial investigation institutions‘ work but the traditional photography is used as well. There are no anticipated procedures how to protect the digital photography and files from the substitution, forgery and erasure. The digital information can be protected by establishing the procedures of the standard operations. One of the ways to protect it is electronic signature.

This thesis is focused on police techniques of identification of persons used in Czechoslovakia between 1918 and 1938. The goal of this thesis was to show, how the police identification of persons should look like, in other words which techniques were used by criminologists, how they described them, which accomplishments and negatives they saw in them, who had to be identified and for which purpose. To answer all these questions I deal with political and administrative context of Czechoslovakia, police structure in Czechoslovakia between 1918 and 1938 and development of criminology, "bertillonage" and documents of identification (especially passports) in the first part of the text, where I mainly use secondary literature. Then I focus on analysis of three main techniques of identification used between 1918 and 1938, namely dactyloscopy, graphology and photography. In this part of the thesis, I use criminology manuals, published in the twenties and thirties. Finally, I work with the fourth technique of identification of persons, namely the description of persons, where I mainly use forms, which are in the criminology manuals. Criminology is a science dealing with the protection of citizens and state from infringement. Criminology uses mostly biological or genetic methods for crime detection. Forensic traces which are collected by forensic experts on the scene are the key items of those methods. Forensic genetics is among the most important forensic subdisciplines. Forensic genetics uses DNA analysis for identification. The main aims of this study are description and importance of biological, anthropological and genetic methods in criminology, different ways of forensic identification, division and collection of forensic traces, characterization and course of forensic DNA analysis and DNA profiling. The course of the investigation, the crime investigation methods, and the theoretical bases of that time, on which the forensic science was based, are thoroughly described on specific serious crimes. Šiame magistro baigiamajame darbe nagrinėta pakankamai nauja tema ,,Kriminalistinė homoskopinių pėdsakų charakteristika ir tyrimo galimybės“, kadangi Lietuvos kriminalistinėje literatūroje nėra aptinkamos tokios sąvokos kaip homoskopinis pėdsakas, nors yra mokslinių darbų, kuriuose tas pats pėdsakas vadinamas homeoskopiniu. Homoskopiniai pėdsakai yra žmogaus kūno dalimi palikti pėdsakai, kurie skirstomi į rankų, kojų (basų kojų pėdsakai, kartais randami ir avalynės viduje), dantų, nagų ir galvos paviršiaus pėdsakus. Pirmoje darbo dalyje trumpai išdėstyta, kas yra pėdsakai nagrinėjamos temos prasme bei pėdsakų rūšys. Vėliau aptariama kiekviena iš homoskopinių pėdsakų rūšių anatomiškai bei kriminalistiniu požiūriu – pateikiama pėdsakų charakteristika. Rankų pėdsakai yra dažniausiai aptinkami, tiriami bei pagal juos lengviausia identifikuoti asmenį, todėl jie yra aptarti pirmiausiai. Toliau yra pateikiamos kojų, dantų, nagų bei galvos paviršiaus (svarbiausias vaidmuo tenka lūpų bei ausų pėdsakams) pėdsakų charakteristikos. Pagal juos taip pat galima nustatyti asmens tapatybę, tačiau tai padaryti yra sunkiau nei rankų pėdsakų atveju. Kita vertus, gali būti nustatyta daug informacijos apie atskiras nusikalstamos veikos aplinkybes. Antroje darbo dalyje nurodyta, kokiose įstaigose Lietuvoje yra atliekami specialisto tyrimai bei ekspertizės. Be to, pateiktos homoskopinių pėdsakų tyrimo galimybės surandant, išryškinant, fiksuojant, paimant bei tiriant laboratoriniu būdu homoskopinius... [toliau žr. visą tekstą] / A quite new subject “Characteristics of Homoscopic Traces and Possibilities of their Investigation from the Point of View of Forensics” was analyzed in this master’s thesis, whereas it cannot be found such a concept as homoscopic trace, although there is some scientific work in which the same trace is called homeoscopic. Homoscopic traces are the ones that are left by human body parts and they are divided into handprints, footprints (barefoot and footprints in footwear), bite marks, fingernail scrapings and prints that are left by a surface of a head. The first part briefly sets out what is the meaning of the traces and their types within the topic of the thesis. Also each kind of the homoscopic traces are discussed anatomically and from the point of view of forensics, thus the characteristics of homoscopic traces are given. At first handprints are discussed because they are mostly detected and examined. Furthermore by using them it is easy to identify a person. Then the characteristics of footprints, bite marks, fingernail scrapings and prints left by a surface of a head (especially lip prints and ear prints) are represented. Using them we can also determine person’s identity but it is more difficult than using handprints. On the other hand, we can learn some information about individual circumstances of the crime.
