Sociální a politická regulace pracovní migrace v České republice / The Social and Political Regulation of Labour Migration: The Case of the Czech Republic

This dissertation is about the changes in the regulation of labour migration in the Czech Republic, specifically between the period of economic boom in 2007 and 2008 and the beginning of the global economic and financial crisis. The developments of labour migration processes and policies were studied in relation to the political economy of foreign direct investment and the rise of the competition state in the Czech Republic. The materialisation of these developments resulted in the Czech Republic's further integration into the global labour market. Labour migration policy changes in the case of the Green Card project, however, did not confirm the thesis that the Czech Republic's migration policy eventually became subordinated to the competition state project. Not only did the Ministry of Industry and Trade lack bureaucratic capital in the field of migration regulation but also, there were tensions between different notions of the competition state project while 'migration management' was reorganised in the interest of the Ministry of the Interior. Closely following struggles over the regulation of labour migration in the administrative and political fields, this dissertation contributes to literature on the labour migration perspective of the competition state. Die Niederlassungsfreiheit der Staatsangehörigen und der Unternehmen aus Mittel- und Osteuropa in der Europäischen Union

Die Arbeit untersucht aus der Perspektive der Arbeitsmigration die Niederlassungsrechte der Staatsangehörigen und der Unternehmen aus Mittel- und Osteuropa in der Europäischen Union im Zeitraum 1990-2009. Erörtert werden das relevante EU-Recht und die entsprechenden nationalen Regelungen am Beispiel Deutschland und Bulgarien. Behandelt werden u.a. unterschiedliche Fallkonstellationen, in denen die gewährten Niederlassungsrechte nicht zweckentsprechend genutzt werden. Untersucht werden dabei die rechtlichen Aspekte der unlauteren Nutzung der erwähnten Niederlassungsrechte als eine ungewöhnliche Form der legalen Migration aus Mittel- und Osteuropa. Diese können unter bestimmten Umständen als Mittel eines legalen Zugangs zu sonst gesperrten Arbeitsmärkten der „alten“ EU-Mitgliedstaaten dienen oder als Instrumentarium für eine Aufenthaltsverfestigung in Hinsicht auf die Versuche, durch die Niederlassungsrechte einen vorher unrechtmäßigen Aufenthalt in einem EU-Mitgliedstaat zu legalisieren. Die Untersuchung berücksichtigt die relevante Rechtsprechung im Bereich und verläuft komplex auf drei Ebenen - auf Ebene des internationalen Privatrechts Bulgariens, des EU-Rechts und des deutschen alten und neuen Ausländerrechts. / The dissertation examines the right of establishment of nationals and companies of Central and Eastern Europe (CEE) in the European Union from the perspective of labour migration. It discusses the relevant EU legislation combining the corresponding German and Bulgarian national regulations over the period 1990-2009. The dissertation presents inter alia different constellations, in which the right of establishment is not used according to the spirit and purpose of the law. It analyzes the legal aspects of such unfair practices as a nontypical form of legal migration from Central and Eastern Europe in the European Union. In the years preceding the EU accession 2004/2007 and in the transitional periods after that the labour markets of the “old” EU Member States were subject of restrictive regulations. That fact provoked the CEE nationals under certain circumstances to use the right of establishment improperly - as an instrument for a legal access to the aforementioned labour markets, as a tool for acquiring a permanent residence status in the host country or even as an attempt to legalize an illegal residence. The study takes into account the relevant EU and German case law and runs complex on three levels - on the level of EU law and on the level of the corresponding Bulgarian and German law.

A strategy for managing teacher migration in Southern Africa

International teacher migration has emerged as one of the key policy challenges confronting many countries, particularly in Southern Africa, with Botswana, South Africa and Zambia experiencing variable degrees of the cross-border movement of teachers. The aim of this research was to develop a strategy for managing teacher migration in Southern Africa, and balancing the right of individual teachers to migrate internationally, while protecting the integrity of vulnerable education systems and their human resources. The research comprised a literature review and an empirical study based on a mixed-methods research design combining the quantitative and qualitative research approaches. The literature study examined international teacher migration, including its main concepts, theories, causes and effects, while the empirical study assessed the statistical scope of teacher migration in Southern Africa (Botswana, South Africa and Zambia), its causes, effects, and management. A self-administered questionnaire was used to gather quantitative data from education officials, school principals and migrant teachers, while personal in-depth interviews were used to elicit complementary qualitative data from some experts on migration, education officials, teacher union leaders, school principals and migrant teachers. The results of the study revealed that teacher migration statistics and data were generally patchy and incomplete in Southern Africa; that international teacher migration in the region was driven by three main causes related to economic, political and salary conditions; and that teacher migration had both positive and negative effects on the education systems of Southern African countries, migrant teachers and their families. The findings further revealed that improving the management of teacher migration in Southern Africa required a systematic and coordinated approach involving sending and receiving countries, with reference to a common policy and legal framework supported by comprehensive teacher migration data. In this regard, and based on the identification of key principles and guidelines for teacher migration management, a model is proposed for the viable management of teacher migration in the Southern African region. / Educational Leadership and Management / D. La tesi si concentra sulla prevenzione dello sfruttamento lavorativo nel settore agro-alimentare. L’Italia è tenuta costantemente al centro delle riflessioni per offrire esempi puntuali, costantemente ‘situati’ all’interno di una visione globale, al crocevia tra il mercato del lavoro e le politiche migratorie. Lo studio criminologico del fenomeno è stato il punto di partenza per testare la capacità di prevenzione e contrasto dell’attuale sistema giuridico, analizzato secondo una logica stadiale. Facendo tesoro delle indicazioni provenienti dalla letteratura sociologica e dalla moderna vittimologia, la parte conclusiva è interamente dedicata alla proposta di una strategia di prevenzione/regolazione ispirata al dinamismo politico criminale introdotto dalla responsive regulation di John Braithwaite. Mettendo a sistema risposte innovative e buone pratiche, la tesi elabora specifiche raccomandazioni di policy, servendosi anche dei rami non penalistici dell’ordinamento giuridico. Una tale politica criminale multi-livello dovrebbe, prima di tutto, rafforzare il rifiuto sociale di qualsiasi forma di sfruttamento, sapientemente e gradualmente impiegando un variegato strumentario sanzionatorio al fine di costruire la conformità mediante il consenso ai precetti (auto-regolazione imposta, sanzioni amministrative con ‘messa alla prova’ e sanzioni penali come extrema ratio). L’analisi comparata delle legislazioni più innovative ha svolto un ruolo cruciale per l’elaborazione di una tale proposta. / The thesis focuses on the prevention of labour exploitation, specifically targeting the agri-food sector. Italy is at the centre of the reflection to provide for tangible examples within a global perspective, at the intersection of labour market and migration policies. A better knowledge of the phenomenon and its complexities has been the starting point for examining the ability of the current (intertwined) legal framework to deal with employers who breach the rules, from low-level non-compliance to serious criminality (i.e. slavery and trafficking). Accordingly, a preventive strategy has been designed bringing the theoretical framework of responsive regulation (Ayres-Braithwaite 1992) into the research on labour exploitation, in turn conceptualised as a form of corporate crime. Building further on existing ‘good’ laws and practices, specific policy recommendations have been provided utilizing all fields of law. Such a hybrid criminal policy should start by strengthening society’s rejection to any form of labour exploitation, strategically rising to more punitive remedies for the purpose of building compliance (i.e. mandated self-regulation, administrative sanctions with ‘corporate probation’ and criminal law as last resort). In doing so, a main contribution has come from comparative analysis.
