Thesis (Masters Diploma (Technology) -- Cape Technikon, Cape Town, 1997 / During the academic training of aspirant lawyers very little attention is paid to the administrative function of a legal practice. Various articles in De Rebus refer to this shortcoming. There also appears to be an over-supply of qualified attorneys which means that the establishment of a legal practice might become a reality before the necessary experience as professional assistants or partners in an established practice has been obtained. The aim of this research was to investigate the factors which have the greatest impact on effective office administration in a legal office, and the influence of technology on administrative efficiency. During this process a model was also developed for the effective completion of tasks in a legal practice. The target population for the study comprised 429 legal practices rendering service in the Cape Metropole at the commencement of the study. Information was obtained through conducting an extensive literature study of local as well. as overseas magazines and books, and visits were paid to 30 local legal practices. Personal observation of the administrative functions in a legal practice was also undertaken by the author. A structured questionnaire was developed and sent to legal practices selected on a random basis. Data obtained from lawyers, secretaries and office managers was processed statistically. In the first place the data was frequentially analysed. Consequently, by using the restricted linear regression method, the author endeavoured to identify the factors which make the largest contribution to the effectiveness of the administrative function in a legal practice.

Action research on leadership style, and relationships in an East London law firm

"Good leadership springs from a genuine passion for the work and a genuine concern for other people. Great Leaders are people who love what they do and want to share that love with others. " (Daft, 2005:20). During an informal discussion with my husband Hugo Daniels, the leader in this Action Research Case Study, it became apparent that lawyers do not attend a single module or complete a single subject during their formal training at university to obtain their law degree that is related to the field of leadership and how to lead, inspire and motivate followers. The discussion centered on the problems the leader was experiencing in his East London law firm, problems he believed to be as a result of his lack of knowledge in the field of leadership. And so this research project began. It was obvious from the start that to intervene in the firm in order to bring about change would need the participation of everyone in the firm. The first step towards facilitating change would be to change the leadership style of the director of the firm. He would be required to gain knowledge in the field of leadership and the effects that different leadership styles have on followers. At the same time staff's perception of the current leadership style would have to be determined, as well as the desired style for their leader. The research process could then begin, based on the needs expressed by the staff and with participation from all levels in the firm. The case involved 27 members of staff made up of three heads of departments, twenty three general staff members and the leader. Data was gathered through formal interviews with the leader and the heads of departments, as well as from personal journals kept by two heads of departments and the leader. General staff members were first asked to complete The Productive Practice Survey (Hall 1987) to determine their perceptions of the current leadership style in the firm and what they thought they needed from their leader if the firm is to move forward. The Productive Practice Survey (Hall 1987) was not used with the intention of gathering quantitative data, but rather as a means of gathering information of staff's perception in general while ensuring anonymity, so as to facilitate a discussion during a feedback session. The Productive Survey's (Hall 1987) content and working is explained in further detail in Chapter 3 on page 44. Initially participants were skeptical of the process and used the survey as a medium to lash out against the firm and Hugo Daniels as a leader, leaving no room for suggestions for improvement, an "it is what it is" approach. During the feedback session general staff members became more open when they realized that change would benefit them, as changes would be suggested by them and implemented with their participation. They became less reluctant about change and provided valuable input during the session. All participants understood that this Participatory Action Research intervention was only the beginning of change in the firm and the sustainability of the changes rests on the firm as a whole, and working towards it would be a continuous process not ending with the Participatory Action Research process.

Utilization of information technology to support information and knowledge management by law firms in Polokwane City

Thesis (Ph.D. (Information Studies)) --University of Limpopo, 2009 / This research report serves as an empirical investigation into the utilization of information technology to support information and knowledge management in law firms, as well as an attempt to design an information and knowledge management model for law firms. Members of the legal profession attached to law firms in the Polokwane City were investigated to find out how optimally they utilize information and communication technologies to support information and knowledge management in their daily operations. The research indicated that there are several ways in which information technology could be used to support the creation, organization, and transfer of information and knowledge in law firms, for the benefit of both lawyers and their clients . In order to provide for an empirical basis for this research, a survey research method, through the use of the questionnaires and interviews, was conducted, followed by a detailed content analysis of law firm websites. An in-depth literature review on the utilization of information technology to support information and knowledge management in law firms was also carried out to determine the findings of other studies that have been conducted elsewhere on the current topic. The results of this research showed that lawyers attached to law firms in the city of Polokwane appear to be non-users of information technology in as far as information and knowledge management is concerned. Most of the members of the law firms in the city seem to be utilizing information technology for basic purposes such as word processing, legal research, client billing, and communication through the e-mail. Other information and knowledge management tools, such as intranets, extranets and web portals, appear not to be utilized by most of the law firms in the city. Based on the findings of this research project, an information and knowledge network model, in a form of Wireless Local Area Network for the law firms in the Polokwane City, is proposed. This network could be utilized by law firms operating in the city to deposit, organize, retrieve, and share information and knowledge collaboratively through the use of information technology. Factors that should be taken into consideration in attempting to implement the proposed model are also discussed. At the end of the research report, some recommendations on encouraging lawyers to utilize information technology optimally are provided, together with recommendations for future research.

After getting the information about the main activities connected to the cycles studied, it was done a comparison with theoretical basis extracted from books, articles, sites and specialized magazines, mainly in the national ambit and some sources from North America. By using of case study tool, that was the use of a questionnaire with seven questions directed to the administrators of the fifties law offices more admired in Brazil in 2009, it has got some data related to more relevant aspects of revenue and payroll cycle, besides the questions of the fiscal aspects adopted and the professional productivity. The intention was to compare the law offices studied with the answers collected from the other offices selected from the list of the most admired of the country in 2009 of Anuário - Análise Advocacia 500 and to cross the data obtained by the case study with the theoretical sources developing the analysis of the results obtained / A proposta deste trabalho é a realização de um estudo de caso em dois escritórios de advocacia, de diferentes portes em relação ao número de advogados, a fim de levantar como os ciclos de receitas e gastos com pessoal são apresentados e quais seus impactos na medição da produtividade dos profissionais e no regime tributário adotado. A partir do levantamento do funcionamento das principais atividades ligadas aos ciclos estudados, foi realizada uma comparação com a base teórica extraída de livros, artigos, sites e revistas especializadas, principalmente no âmbito nacional, bem como algumas fontes do mercado norte-americano. Por meio da ferramenta de estudo de caso, que foi a utilização de um questionário com sete perguntas direcionadas aos administradores dos cinqüenta escritórios de advocacia mais admirados do Brasil em 2009, foram levantados dados com relação aos aspectos mais relevantes dos ciclos de receitas e gastos com pessoal, além das questões do regime de tributação adotado e a forma de remuneração dos profissionais em relação à medição da respectiva produtividade. As mudanças globais, as novas tecnologias e o aumento das expectativas dos clientes geram uma necessidade, cada vez maior, de um planejamento estruturado e coerente com a realidade. A conduta e a abordagem tradicionais na gestão dos escritórios de advocacia não mais garantem o sucesso e sobrevivência, sendo fundamental a adoção de uma forte orientação ao cliente e o conhecimento da concorrência para o sucesso nos dias atuais. O volume de informações jurídicas produzidas é muito grande, tornando a recuperação da informação desejada mais difícil. As constantes atualizações da legislação dificultam o trabalho dos advogados, pois tornou-se uma árdua tarefa para o profissional do direito encontrar a melhor informação dentre as várias disponíveis. Diante disso, este estudo de caso propôs a criação de um planejamento de gestão da informação para os escritórios de advocacia. A partir das informações coletadas nos questionários com os sócios, no levantamento de documentos e na observação direta foi realizada uma análise dos dados, a fim de determinar as forças e fraquezas do negócio. Essas serviram de base para determinar os objetivos estratégicos, tendo como destaque, aumentar o número de clientes, atender as demandas num tempo relativamente menor, melhorar a qualidade técnica na prestação dos serviços advocatícios e criar um banco de dados disponíveis para a atuação dos advogados dentro da organização. A grande dificuldade dos escritórios de advocacia é a recuperação das informações necessárias em tempo hábil, tendo em vista que em sua maioria não possuem um sistema estruturado de gestão de informação, foco desse estudo. Para isso usaremos o Gerenciamento Eletrônico de Documentos e Enterprise Content Management como ferramentas para o armazenamento das informações. Todo esse contexto acaba por exigir que os escritórios de advocacia se preocupem em ter um planejamento, bem como um posicionamento de mercado para que possam manter-se competitivos na gestão de seu negócio. / Information is an intrinsic component of every process in an organization. Global changes, new technologies, and increased customer expectations create a growing need for structured planning that is consistent with reality. Traditional conduct and approach in the management of law firms no longer guarantees success and survival, and it is fundamental to adopt a strong customer orientation and knowledge of the competition for success in the present day. The volume of legal information produced is very large, making the retrieval of the desired information more difficult. The constant updating of the legislation makes it difficult for lawyers to work, as it has become an arduous task for the legal professional to find the best information among the available ones. Given this, this case study proposes to create an information management planning for law firms. From the information collected in the questionnaires with the partners, in the collection of documents and direct observation will be performed an analysis of the data, in order to determine the strengths and weaknesses of the business. These will serve as a basis for determining the strategic objectives, with a focus on increasing the number of clients, meeting the demands in a relatively short time, improving the technical quality in the provision of legal services and creating a database available for the Organization. The great difficulty of law firms is the retrieval of necessary information in a timely manner, since most of them do not have a structured information management system, the focus of this study. For this we will use electronic document management and Enterprise Content Management as tools for storing information. This whole context ultimately requires law firms to be concerned with planning as well as market positioning so that they can remain competitive in running their business.

Processo judicial eletrônico: novos tempos para o trabalho da advocacia?

Esta pesquisa investiga como se dão as interações e as relações entre a tecnologia e o trabalho do(a) Advogado(a). O estudo tem o objetivo de analisar as condições atuais do trabalho na advocacia a partir das modificações trazidas pelo Processo Judicial Eletrônico – PJE. Busca-se apresentar o quantum o PJE tem condicionado a práxis cotidiana da atividade da advocacia. Temse como pressuposto teórico que o trabalho e a tecnologia não determinam o agir humano, sendo, pois, o ser humano livre para direcionador as facilidades trazidas pela tecnologia, as quais deveriam, em tese, proporcionar a melhoria nas condições materiais da vida das pessoas. Trata-se de pesquisa realizada a partir de questionários abertos que permitem, tanto uma análise qualitativa dos conteúdos de depoimentos escritos, quanto certa quantificação, via consolidação das respostas obtidas. São analisadas as transformações provocadas pela informatização do processo judicial em sua nova forma eletrônica – mudanças estas ocorridas a partir do advento da Lei 11.419/2006 – e a reestruturação do trabalho na advocacia brasileira nestes últimos anos. O problema que se pretende responder, em última análise, é o seguinte: Qual a potencialidade emancipatória da tecnologia para o trabalho do(a) advogado(a)? Ao final do estudo são apresentados os resultados obtidos na pesquisa quanto a: intensificação no trabalho do(a) advogado(a); modificações observadas na estrutura dos escritórios de advocacia; principais dificuldades dos(as) advogados(as) com o PJE; alterações na produtividade no trabalho dos(as) advogados(as); percepção dos(as) advogados(as) quanto aos impactos da implantação do PJE na saúde, e; algumas implicações de gênero, entre advogados e advogadas, para se para trabalhar com o Processo Judicial Eletrônico. / This research investigates how interactions occur and the relationship between Technology and the Work of the Lawyer. We seek to present the quantum the PJE has conditioned the daily praxis of advocacy activity. It has as theoretical assumption that the Work and Technology does not determine human action and therefore humans free to control the facilities brought by technology which should in theory provide the improvement in the material conditions of life people. This is research from open questionnaires that allow both a qualitative analysis of the content of the written reports, as some quantification via consolidation of replies. It analyzes the transformations caused by computerization of the judicial process in your new electronic form, these changes occurred since the enactment of Law 11.419/2006 and the restructuring of the work of Brazilian advocacy in recent years. The problem we intend to answer is the following: What is the emancipatory potential of technology to the work of the lawyer? At the end of the study presents the results obtained in the research regarding: intensification of labor lawyer, modifications in the structure of advocacy firms, lawyers 'main difficulties with the PJE, changes in work productivity of lawyers, lawyers' perception regarding impacts of the implementation of PJE in health and some gender implications between men and women lawyers to get to work with the Judicial Process Electronic.
