In my thesis "Residential tenancy agreement - Landlord's status and non-mandatory provisions of Czech residential tenancy law" I explore specific institutes of Czech residential tenancy law. I deal with contractual freedom of the parties to arrange their own rights and obligations that may differ from those that are prescribed by the Czech civil code. I also put emphasis on the new legislation that will come into effect in 2014, which is going to substantially change legal relations between lessors and lessees. Starting with basic legal requirements for lease agreement I then describe rights and obligations of the parties that stem from it. At the end I go over legal tenancy agreement termination options. Through the comparison of the law as it is and its impact on real life I attain the aim of my thesis: to show what is problematic in the Czech residential tenancy law.

1 RESIDENTIAL LEASE ABSTRACT This thesis aims to analyze current legal aspects of the residential lease which is regulated in the Act. No. 89/2012 Coll., the Civil Code. For better orientation in the text, the author divided this thesis into seven chapters, where she described the regulation in detail. The first chapter is dedicated to the current regulation of the lease. If the special regulation of residential lease is missing, it is necessary to use common regulation. The author described briefly the contractual parties, the subject of the lease, duration of the lease, and termination of the lease. The second chapter starts with the history of residential law and defines basic terms of the residential lease such as the house, the apartment, corporate housing, and cooperative apartment. The third chapter is devoted to the creation of the residential lease with the written contract and with the unwritten one. It takes into account the creation of residential lease by the other ways such as the death of lessee, the contract of accession, or marriage to the lessee as well. The subject of this master thesis is analysis and assessment of effective legal regulation of the lease of business premises under Act. No. 89/2012 Coll., the Civil Code, as amended. Author's discourse is ordered into nine chapters in which related legal institutes are gathered. In the first chapter the author defines aims of this master thesis and rationalizes the necessity of special legal regulation of the lease of business premises. The second chapter of this master thesis contains a general discourse about lease in which the author outlines the system of the legal regulation and then defines the lease with its four defining elements which are the subject of the lease, relinquishment of the subject of the lease to the tenant for use, temporary character of the lease and the fact that the landlord relinquish the subject of the lease to the tenant for use against payment of the rent. The aim of this thesis is to provide complex information on the characteristics of leasing, its cathegorisation and accounting issues including the comparison of leasing relationships outside of the Czech Republic, namely in Austria and in Slovakia. The work is divided into nine chapters, first three of them deal with general concept of leasing -- its history, various types and particularly with the legal framework of leasing in the applicable Czech legislation. The subsequent chapters focus on the lease agreement itself from the moment it comes to existence including the principal requirements of the agreement through changes that may occur during the existence of the agreement to its termination. The eighth chapter is intended to acquaint the reader with accounting of the lease transaction under the international financial reporting standards IFRS and to compare these accounting transactions with processes contained in the Czech accounting legislation. The last part of the work is based mainly on materials provided by IKB Leasing ČR s.r.o. and focuses on differences in the regulation of leasing relationship in Slovakia and Austria.

In the theoretical part I defined leasing. I mainly pointed out advantages and disadvantages, types of leasing, leasing process, tax and accounting aspects. In the practical part I compared three situations when buying a new car. Assignment of lease agreement, new leasing contract and loan financing. I made this comparison on the basis of administrative requirements, taxation and financial performance. On the basis of several methods and considerations I have concluded that the loan is the best way. Assignment of the lease agreement is at first sight very disadvantageous. Leasing is a specific accounting situation, which is often difficult for accountants too. A mistake can be easily made during accounting of leasing operations. Leasing is very complicated mainly from the tax point of view.

This thesis is focused on the analysis and comparison of rental apartments in Prostejov and all the factors that have the level of rents in the area of influence. The work presents textual and graphical part of a designated location according to the amount of rent in various parts of the city Prostejov flats of sizes 1 + 1, 1 + KK, 2 + 1, 2 + KK, 3 + 1, 3 + KK. These dispositions are examined and appreciation is shown in tables and graphs. The result is a calculation and comparison of individual dispositions rent flats and assess the factors that have influence on the price.

The dissertation is focused on the analysis of the institute of residential lease. At the beginning a brief historical progress of the legal regulations of the lease of the apartment is described with the reference to social circumstances which influenced it. Subsequently, attention is paid to the lease agreement as the legal reason for using an apartment. The dissertation deals also with the object of the lease agreement, i.e. with the apartment and its definition in the legal regulations, and also with the subjects of the lease agreement, i.e. with the landlord and the tenant. In the next part the dissertation describes rights and obligations of the contracting parties. A special chapter is dedicated to the rent, as one of the essential requirements of the lease agreement. Also the institutes of the subtenancy, passage of the lease of flat and exchange of the apartments are mentioned. Furthermore, the issue of the termination of the lease is elaborated in detail. The whole dissertation contains also important rulings of the courts and presents changes that will come into effect with new civil code.

Sous l'impulsion de l'Union européenne et de l'ouverture des marchés, le droit de l'énergie a considérablement évolué ces dix dernières années. Les textes en matière d'énergie solaire photovoltaïque se sont amplifiés depuis la loi « Pope » jusqu'aux lois « Grenelle I » et « Grenelle II », et récemment avec la loi n° 2015-992 du 17 août 2015 relative à la transition énergétique pour la croissance verte, suivies de nombreux décrets pour leur application et une jurisprudence de plus en plus abondante en la matière. Il en résulte un ensemble considérable de textes évolutifs et complexes dont l'accès reste difficile à appréhender et à appliquer. Cette instabilité des règles régissant la matière – certes inévitable au regard des nécessaires changements requis par toute innovation – est source d'insécurité juridique et s'avère extrêmement déstabilisante pour les acteurs du secteur en quête de visibilité. En outre, l'installation d'une centrale de production d'électricité photovoltaïque au sein de son habitation, est à la fois un projet d'investissement et une opération de construction immobilière, qui exige des garanties tant sur le plan financier qu'au niveau de la construction (sûretés et assurances) pour permettre de mieux maîtriser les risques et rassurer les parties au projet. Néanmoins, les nombreux freins contractuels, administratifs et financiers ralentissent le développement du photovoltaïque et se heurtent aux ambitions de promouvoir cette « électricité verte » sur l'ensemble du territoire et notamment parvenir à l'autonomie énergétique de l'île de La Réunion. Ainsi, cette étude présente et analyse le droit de l'énergie photovoltaïque, visant notamment le particulier à La Réunion, sous ses différents angles (fiscal, financier, contractuel, administratif, urbanistique, des responsabilités) – à jour des textes les plus récents – et en explicite les modalités d'application à la lumière des multiples textes réglementaires, législatifs, guides professionnels et de la jurisprudence, que ce soit celle des tribunaux ou des autorités de régulation. / Facing a weakening photovoltaic market and a sector already bedeviled recently by a huge increase of legal texts, private investors decrease. This thesis tackles legal framework concerning photovoltaic energy in Reunion Island. This will include the analysis of fiscal incentives such as investment grants and tax preferences, as well as more general environmental policy instruments (feed-in-tariffs and renewable subsidies and grants). Moreover, this will include the analysis of contracts such as loan agreement, sale contract, lease agreement and connection/Commissioning contracts, as well as more environmental aspect. At last, risks, insurances, liability comprising legal proceedings and guarantees will be studied in this thesis.
