El objeto de esta investigación es el riesgo de uso no autorizado de la tarjeta de crédito. Cuando una utilización fraudulenta de una tarjeta de crédito ha ocurrido es necesario decidir quién es responsable por los daños que dicho uso ilegítimo ha producido: el emisor de tarjeta de crédito, o el titular de la tarjeta, o el establecimiento adherido.La investigación analiza los diferentes supuestos de utilización no autorizada de tarjeta de crédito y fija las reglas de distribución de la responsabilidad en el sistema cuando dicho empleo ilícito se ha producido.Finalmente, la tesis desarrolla un conjunto de conclusiones con el objeto de proponer soluciones para obtener un mejor sistema de pagos y eliminar, tanto como sea razonable y posible, el uso fraudulento de tarjetas de crédito. / The object of this research is the risk of unauthorized use of credit card. When a fraudulent credit card's utilization has occurred is needful decide who is liable for the damages that this illegitimate use's produced: the card issuer, or the card holder, or the payee.The research analyzes the different supposes of unauthorized utilization of credit card and fixes the rules of the distribution of responsibility in credit card system.Finally, the thesis develops a group of conclusions with the object of propose solutions to obtain a better payment system and eliminate, as soon as be reasonable and possible, the fraudulent use of credit cards.
