-1- Abstract Counsel in the Criminal Proceedings: The objective of our Diploma Thesis is to analyze the currently valid law governing the counsel's position in the criminal proceedings, to evaluate its sufficiency or insufficiency and to provide views and proposals in the sense of 'de lege lata' and 'de lege ferenda', focusing more in detail upon some partial aspects which are closely related to the counsel's position during the criminal proceedings. Good quality law system relating to the counsel's position in the criminal proceedings, his/her process rights and obligations is an assumption for meeting the criminal proceedings purpose and is reflected in the possibility to provide to the accused efficient legal counselling and thus meet the accused person's right of defence and fair trial (process) which is guaranteed by the Constitution. The counsel as an actor operating in the criminal proceedings plays a significant role in enforcing the rights and justified interests of the accused. The counsellor masters the legal argumentation, strategy and tactics of the defence, is able to better formulate ideas, to draw ideas from the experience gained in former law suits, whilst for the accused person his/her position is entirely new and unknown, many time it is the first experience in life. It is inevitable to observe that, in an urban field any architectural enterprise is subject to changing political, financial, technological and cultural demands. The pressure of these ever-changing forces attempts to modify and replace the initial program and the activities associated with the architectural product. The lifespan and the success of the resulting edifice depend on its ability to respond to such changes. Nevertheless, these ever-changing forces are naturally ambiguous and unpredictable so that architectural program becomes indeterminate. This thesis claims that in order to deal with the programmatic indeterminacy in an urban context, a strategic approach should be employed throughout the design process. Therefore, the thesis critically analyzes the strategic way of design to understand its working principles via examining the Parc de la Villette competition project of Rem Koolhaas/OMA. The mechanism of strategic way of design, how it works, and how it is constructed are the main focus of the thesis.

This thesis is an exploring study. It is exploded which source and base of human resource (HR) executives¡¦ influence power come from. It is studied what factors of outside and insides impact the influence power.
In the process of study, it is used the method of the focus group interview. From the experience practices of human resource executive it could be analysis and understood how human resource executives to influence their boss, colleague, subordinate and so on. It could be referred for human resource workers or specials.
At last this study generalize the sources, base, and strategy and tactics of human resource executives¡¦ influence power, and propose some propositions as fellows:
Proposition 1: The highly position or title of HR executives, the effectively they could introduce HR function.
Proposition 2: The influent sources of HR executives mainly include business knowledge, capabilities, experience background, interpersonal relationship, performance of work, and personal characteristic. Those could push effectively the influent power.
Proposition 3: HR executives of new companies could easily develop their job than old companies.
Proposition 4: HR executives of foreign companies could easily develop their job than local companies.
Proposition 5: HR executives of affiliate companies could easily develop their job than central companies.
Proposition 6: HR executives of high tech companies could easily develop their job than heredity manufacture companies.
Proposition 7: the concept of boss could impact the function and job of HR executives. Maybe the bosses of heredity manufacture companies could be conservatism, so the HR executives of heredity manufacture companies must use special method or strategy of influence.
Proposition 8: the different strategies of influence for the object have interactive and reinforcing effect.
Proposition 9: The roles of HR executives¡¦ of different industries (e.g. high tech vs. heredity manufacture) are different. Accordingly strategies of influence for the subject or issues object are different.
Proposition 10: HR executives expect different influence effect, so they choose different strategies of influence.
Proposition 11: HR executives choose different strategies of influence because their personalities and preferences.
Proposition 12: HR executives choose different strategies of influence because their different levels (e.g. position or title)

The literature on manufacturing performance measurement underscores the importance of operational performance measures, as well as aggregate organisational measures. However, research aimed at quantifying and tracking such measures from both operational and organisational perspectives has been slow in forthcoming. The Manufacturing Operational Effectiveness (MOE) indicator introduced and tested in this study lends itself to both operational performance measures and aggregate organisational performance measures of the manufacturing system performance. The results of several simulation scenarios utilising actual manufacturing data clearly illustrate the utility of MOE. These results have both operational tactical and strategic organisational practical implications. Operational effectiveness and strategic competitiveness can be tracked and improved through the systematic utilisation of MOE.

Ce travail propose d’étudier la mobilisation du parler populaire lors de la couverture médiatique du match Égypte-Algérie par la presse généraliste et la presse spécialisée algérienne. Nos premières observations sur le traitement de l’évènement footballistique nous conduisent à supposer que le discours des journaux d’information générale n’est pas différent de celui des quotidiens de sport. La recherche propose, ainsi, de saisir les stratégies qui encadrent l’usage du parler populaire. Il s’agit d’analyser l’émergence d’une pratique info-communicationnelle qui peut s’inscrire dans une stratégie de pénétration du marché, à la recherche d’un lectorat élargi.L’analyse des jeux d’acteurs médiatiques, dans un contexte marqué par une crise mondiale de la presse écrite, envisage permet de montrer comment ces derniers ont recours au parler populaire, comme dispositif signifiant de captation et argument de vente. Pour appréhender cet enjeu, nous avons privilégié une approche qui ne néglige pas l’étude des identités éditoriales de chaque titre de presse. Nous proposons, de ce fait, de déconstruire les publications de quatre journaux de « référence », en défendant une méthodologie axée sur des aspects théoriques, alimentée par une analyse du discours, combinée à une étude quantifiée de l’évènement et appuyée sur les visions et discours d’autolégitimation sociale des professionnels algériens de l’information médiatique.Mots clés : Évènement médiatique, dispositif, cadre, co-construction, parler populaire, stratégie, tactique, identité éditoriale et loi de proximité. / This work suggests to study the mobilization of popular speech during the media coverage of Egypt-Algeria match by the French-written generalist press and the Algerian specialized press. Our first observations on the treatment of the football event, lead us to suppose that the discourse of the newspapers of general information is not different from the dailies of sport. Thus, the research suggests grasping the strategies which frame the use of popular speech. It consists of analyzing the emergence of a communicational-info practice that can be part of a market penetration strategy seeking for an enlarged readership.The analysis of media acting skills, in press global crisis context foresees to show how they make use of popular speech, as a significant capitation pattern and a selling argument. To apprehend this issue, it seems necessary to situate this work in an approach that does not neglect the study of editorial identities of each press title.Therefore, we suggest to deconstruct the publications of four "reference" newspapers by defending a methodology based on theoretical aspects. That methodology is supplied by discourse analysis combined with quantified study of the event and supported by the visions of Algerian professionals’ media information.Key words: Media event, device, framework, co-construction, popular speech strategy, tactics, editorial identity and proximity law
