Problematika potratu v dnešní společnosti / The issue of abortion in today's society

The issue of abortion in today's society The thesis tries to clarify the rational aspect of abortion. However a religious viewpoint is not the main topic of this thesis, the author does not leave it out and one separate chapter of this work is dedicated to it. The authoralso tries to find an answer whether it is possible to consider an abortion to be ethical and in what conditions. The thesis is trying to explain various aspects of abortion in the Czech Republic as well as abroad, it is also following a medical view - point and various executive methods of abortions. There is an aspiration to refer to the historical advancement of abort opinion and to resolve an origin of this problem. Disposition of this work is to disclose not only the moral aspects but also the feelings of the woman experiencing an abort including after-effects on her. The important chapter there is the postabortal syndrome which is not accepted as a medical diagnosis associated with psychological effects of abort. There is a short questionnaire inserted in the thesis which refers to some women's opinions and experiences. This diploma thesis deals with the issue of restitution disputes according to Act No. 229/1991 Coll. on the regulation of ownership relations with land and other agricultural property. The reason for this topic was the experience of the author of the diploma thesis on restitution disputes, scope and judicial jurisprudence dealing with this issue. The thesis deals with the procedural aspects of restitution disputes, as well as with the substantive law-making aspect of both legal regulation and rich judicial jurisprudence. The diploma thesis systematically describes the most important types of restitution disputes - disputes about the restitution of original removed real estate, disputes about the existence of claims of entitled persons to compensation for immovable properties which can not be restituted, disputes about the correct value of claims of authorized persons and disputes about the grant of specific substitute real estates owned by the Czech Republic as a replacement for real estate that can not be restituted. Illegitimate relationship of Přemysl Otakar II. and Anežka of Kuenring in the context of Přemysl's Austrian politics in the 1250s Hana Trachtová 2010 The aim of this thesis is to demonstrate how the private life of Přemysl Otakar II. was interconnected with his political activities in the 1250s. The assumption is that choosing Anežka of Kuenring as the king's mistress was not accidental, but that it was motivated, among other reasons, also politically. The work covers development of Bohemian-Austrian relations in the Middle Ages up to the early 1260s. It follows the progress of the struggle for the Babenberg heritage as well as other Přemysl's activities in the 1250s. It links Přemysl's political acts to his family issues and it also deals with his relation to the Kuengring family. Attention is also devoted to Přemysl's offspring born out of wedlock, his effort to legitimize three of them and to their further life stories.

The thesis Dr. Jan Herben - Journalist and Politician (1857-1936) maps the life of this distinguished journalist and politician of the late 19th and early 20th centuries from his studies till the end of his professional career. It is based on literature about Jan Herben or about the period of turn of the century, on periodicals of that time, and archive materials found in the Museum of Czech Literature in Prague and in Herben's summer house in Hostišov. It focuses mainly on the period of publishing the Čas periodical which under Dr. Jan Herben became the main daily of the Realist Party of Tomáš Garrigue Masaryk, on affairs linked to the publication of Čas, including the disputes over the authenticity of two ostensible early medieval Czech manuscripts, a wave of protests following publication of the first editorial Our Two Questions by Hubert Gordon Shauer, the Hilsner affair, or Dr. Jan Herben's accusation of embezzlement of funds collected for orphans in the town of Most. 1 Abstract This thesis aims to transparently elaborate the topic of damages in investment disputes. Chapter One is a brief introduction to the problem. It provides a short clarification of the concept and meaning of arbitration and its importance for the protection of investors; it also describes the principles of modern forms of investor protection. The end of the first Chapter includes a short introduction regarding the sources on damages in investment arbitration. Chapter Two deals with the issue of valuation. At the beginning the author approaches the issue in general, describing the basic terminology and definitions and providing the classification of the valuation methodology (Market-Based Approache, Income- Based Approach, Asset-Based Approach). This thesis discusses the alternative dispute resolution methods in trade relations. The main objective of this thesis is to describe and analyze ADR as a group of methods used to resolute disputes with focus on two main methods - mediation and arbitration. My objective is to describe the main principles of ADR, to compare their main advantages and disadvantages and to analyse the process of resoluting disputes by these methods. Another objective is to evaluate and analyze the development of ADR in the Czech Republic, their legal regulation and its current status. A short part of the thesis concerns about regulation of mediation in the EU and the analysis of implementation of the European Parliament and Council Directive 2008/52/EC dated May 21, 2008 to national legislation. Thesis is divided into five separate chapters. The first, introductory chapter only briefly discusses about dispute and conflict and ways they can be solved. The second chapter already characterizes ADR as a group methods of dispute resolution, its main principles, advantages and disadvantages and finally briefly describes some of the ADR. The third and fourth chapter focuses on the mediation, its principles, advantages, disadvantages, the mediation process and mediator. It monitors the development of mediation in the Czech republic and the current situation in the legal regulation of mediation in the country. The last chapter deals with arbitration. It describes its basic principles, advantages and disadvantages again. The conclusion discusses the czech Arbitration law and the forthcoming amendment.

Next aim was comparison the czech law with the law in Slovakia, when it was turned to the arbitration and disputes in the area of customers contracts. Then there was desribed and analyzed the problems of the arbitration centre position and the custumers contrancts with arbitration clause, according to the law effective before and after the day of the 1 st April 2012. In conclusion there was defined some changes in legislation.

Convergence of Copyright and Trademark Protection Key Words: Copyright, Trademark, Protection, Convergence Abstract: The thesis analyzes the concept of copyright and trademark protection in Czech law and the consequences of their simultaneous operation. The aim is to determine whether the existing legislation responds the current trends and demands in our society, where business and arts are becoming interconnected and where the boundaries between those disciplines are blurred. Both protections are initially assigned to theoretical context of legal branches of intellectual property and intangible property. The author also deals with current conception of ownership in Civil Code. Following chapters are based on the principles of civil (continental) law concepts of copyright law and industrial property law established in this part. Subsequently the regulation of copyright protection and trademark protection is discussed in two separate chapters. Those chapters are divided into identical sub-chapters to highlight similarities and differences of both legal institutes. The focus is on subjects of both protections, their beneficiaries, formation, content, duration, means, limitations, international context and the issues of licensing. Yet what is lacking is a contemporary analysis that concentrates on the current multipolar system in which the importance of economic alliances and power surpass military power, and how this affects weak states' foreign policy behavior and trade opportunities. This research therefore offers an empirical analysis on great power geopolitical competition between Russia and China over Turkmenistan's economic allegiance, specifically regarding its natural gas export, and seeks to explain how this geopolitical competition has affected Turkmenistan's foreign energy policy behavior as a weak state vis-á-vis these great powers. The diploma thesis describes the development of St. Anne and St. Lawrence Dominican convents in The Old Town of Prague during early modern period (mainly in the 17th and the 18th centuries). Both the indoor life and contacts with outside world are included in the description. Only three topics of the above-mentioned specialization could be seamlessly elaborated due to fragmentary sources. The introduction and first three chapters constitute a summary of sources and literature. Furthermore, they chronologically depict the history of the Dominican order and the particular convents. The fourth chapter deals with the relationship between the nuns and their dependants in the municipality of Radlice. The system of servile taxes withdrawals and visitations of the monastic farms are emphasized. The chapter finally records a concrete discord between the convent and Barbora Wlaška in the 16th century. The fifth chapter focuses on baroque sermon that were held during ceremonies of admission aspirants among the other nuns.
