Previous issue date: 2012-09-21 / O presente trabalho é o resultado de uma pesquisa empírica que buscou reconstruir toda a trajetória percorrida pela política pública que orienta o atual regime de tributação de lucros auferidos no exterior por controladas e coligadas de empresas brasileiras com o objetivo de compreender as razões que levaram o Brasil a adotar uma norma de antidiferimento demasiadamente ampla, quando comparada às normas de natureza similar adotadas na experiência internacional. Além disso, buscamos identificar a real extensão dos efeitos econômicos ensejados pelo regime brasileiro, em especial, frente ao processo de internacionalização produtiva que vem se fazendo cada vez mais presente na realidade de diversas empresas de capital nacional. Partimos da hipótese de que o regime vigente afeta negativamente às empresas que buscam internacionalizar parte da sua atividade produtiva. Os resultados da pesquisa são de grande importância e nos ajudaram a compreender melhor as causas de muitas das questões jurídicas que atualmente ocupam grande parte do debate acadêmico no direito tributário brasileiro. Defendemos a ideia de que, se os efeitos do regime brasileiro afetam negativamente a internacionalização produtiva, o regime poderá afrontar a Ordem Econômica Constitucional. / This thesis presents the conclusions of an empirical legal research that remade the path followed by the public policy adopted by Brazilian government to tax corporate foreign income in order to understand precisely the reasons that led Brazil to adopt an antideferral rule that is broader that the Controlled Foreign Company (CFC) rules adopted world wide. Besides, our objective was also to identify the economic effects on Brazilian transnational companies arising from Brazilian CFC rules, regarding the increasing internationalization process that Brazilian firms are making through in the past decade. We adopted the hypothesis that Brazilian tax regime affects negatively transnational companies that aim to internationalize part of their production. The outcomes of the present research are of a great value to achieve a better understanding about the causes of many legal questions that are currently being discussed among legal practitioners and scholars and faced by courts. Our opinion is that, if the economic effects arising from Brazilian tax regime affects the internationalization process of Brazilian firms, that may go against, in certain cases, the economic order settled by our Constitution.

To what degree developing countries gain from signing double tax treaties is being hotly
debated. In this paper, we analyze the Austrian tax treaty policy. Combining legal and
economic perspectives, we find that developing countries are likely to expect both positive
and negative impacts from signing a double tax treaty (DTT) with Austria. On the one hand,
the results of our econometric analysis suggest that middle-income countries that sign a DTT
with Austria may expect an increased number of foreign direct investment projects from
Austrian companies. On the other hand, the signatory states may suffer from limited
withholding taxation rights established in the DTTs for the source country, which could lead

Depuis les réformes fiscales du 20ème siècle, l’alignement de principe du droit fiscal sur le droit privé et la comptabilité s’est progressivement imposé en droit fiscal français. En matière de fiscalité des entreprises, un principe de connexion entre le droit fiscal et la comptabilité a été consacré sur le fondement de textes épars, de la jurisprudence, de la doctrine majoritaire et du pragmatisme de l’administration fiscale ; mais surtout au nom de l’unité opératoire du droit considérée en phase avec les impératifs du droit fiscal telles la simplicité, la sécurité juridique, l’imposition selon la capacité contributive. A l’aune des principaux impôts commerciaux, la connexion présente une portée très large qui se dédouble en connexion matérielle et formelle. A l’épreuve de l’adoption mondiale du référentiel comptable de l’IASB et de l’harmonisation de la fiscalité directe des entreprises au sein de l’Union Européenne, le droit français, bien que tiraillé, a fait le choix du maintien de la connexion dans le cadre de la convergence du PCG avec les normes IAS-IFRS sans le secours d’une véritable politique fiscale optimale devant tendre vers l’élargissement de l’assiette des impôts en contrepartie d’une réduction des taux et vers la réduction des coûts de conformité de l’impôt au moins au sein de l’Union Européenne. Mais, à la lumière de ces impératifs fiscaux, de la logique juridique et du droit fiscal américain, les potentialités de la déconnexion doivent être explorées notamment le projet d’ACCIS soutenu par la France et reposant sur une assiette autonome et élargie, l’admission optionnelle du bilan fiscal et la réduction des concepts fiscaux transversaux. / Since the tax reforms of 20th century, the alignment of tax law on private law and accounting gradually became the imperative principle under French law.Concerning business taxation, the principle of book and tax conformity has been established based on scattered provisions, the case law, the majority of tax scholars and the pragmatism of the tax authorities; but specially in the name of the operating unity of the law matching with the tax values such simplicity, legal certainty, taxation in accordance with ability to pay.With regard to the main business taxes, the book tax conformity has very wide reach which is both material and formal.Facing the worldwide adoption of the IASB accounting standards and the harmonization of the direct tax on businesses within the European Union, the French law, despite tension, chose the preservation of the book tax conformity in the process of the convergence of the General accounting plan toward the IAS-IFRS without the account of the optimal tax policy that must aim at broadening the tax base with rates reduction and the reduction of tax conformity costs at least within the EU.In the light of theses canons, legal logic, the example of the US law, the potentialities of a disconnection must be explored namely the current EU project of CCCTB, backed by France, based on a broad and autonomous tax base ; a fiscal balance sheet election; the reduction of transversal tax concepts.

This thesis is focusing on the major trends in the tax reform in the European Union. The direction of development from direct to indirect taxes is analyzed and it attempts to find some consistent trends in taxation between selected countries within groups of new and old member states of the European Union in 1995 - 2011. Firstly the text gives the reader an introduction to tax theory and the optimal design of tax system is presented. Thesis also focuses on the issue of tax policy in the European Union. It describes the main tax policy challenges and possible design of efficiency-enhancing tax reforms. The global macroeconomic model QUEST III is being introduced. This model is widely used by international institutions for the quantitative evaluation of the potential impacts of tax policies. Furthermore, the development and structure of the tax mix is analyzed as well as the overall tax burden and labour taxation in new and old member states of the European Union. In conclusion there is commentary to stated hypothesis that in recent years there has been increasing emphasis on indirect taxes, while the direct taxes were being reduced.

The thesis assesses measurements of the VAT efficiency. It compares the tax quota, implicit tax rate and VAT revenue ratio. The first chapter deals with theoretical foundations for a flat rate consumption tax. Following chapters discuss the perquisites for VAT efficiency calculations (comparing actual VAT revenue and theoretical amount of tax base). Following chapters assess the above mentioned calculations, with special respect to VAT Revenue Ratio, which is analyzed in detail and to which is presented a comparison across the EU countries. The thesis further analyses Policy Efficiency Ratio (policy gap) and Compliance Efficiency Ratio (compliance gap). In its conclusion it summarizes the information gathered and presents a number of possible improvements.

States are facing tough economic times as a result of the housing market bubble exploding. States have been declaring budget deficits and major program cuts, since revenues have not kept up with expenditures and rainy day funds have been practically exhausted. State tax revenues have decreased, resulting from a decline in income tax revenues, one of the major sources of revenues for a large number of states (41 in total). A majority of these states have come to depend heavily on the revenue they collect from income taxes, which can represent as much as 40% of state tax revenue. This thesis focuses on the impact that income tax revenue has on state budgets and how it affects certain expenditures. To provide a more complete understanding on how fiscal policy affects the citizen directly, this thesis compares the changes in state's total tax revenue and spending on education and health programs between states that levy income tax and states that do not. Data from the United States Census Bureau and the National Association of State Budget Officials was analyzed by calculating the growth rate and relevant elasticities during 2006-2010, the years before, during, and after the last recession. Results will show a difference in changes in revenue and expenditure between the two types of states and a more sensitive elasticity for non-income tax states for both revenue and expenditure. With a better understanding of how the tax base behaves and how revenue affects programs, an improved tax policy that could produce more efficient services for citizens might be created.

Необходимость налогового управления определяется в законодательстве по налогообложению, которое предусматривает разнообразные режимы в зависимости от ситуации, и допускает применять разные способы для определения такого элемента налоговой системы, как налоговая база, а также предполагает применение льгот. Помимо этого, у государства присутствует интерес в предоставлении бенефиций в целях стимулирования какого-либо сектора экономики, социального или экономического развития страны в части спланированной налоговой политики. В ходе написания магистерской диссертации был предложен новый принцип налогового планирования, заключающийся в дифференциации налога на прибыль в зависимости от видов экономической деятельности предприятий. А также предложена методика формирования налога на прибыль в зависимости от видов экономической деятельности предприятий согласно разработанному принципу. / In modern conditions, the importance of tax planning is increasing, it is determined by the following points: for organizations is a very heavy burden to comply with and fulfill tax obligations, and it is faced with such complexity as tax legislation, which is characterized by an unstable situation. The need for tax administration is defined in tax legislation, which provides for a variety of regimes depending on the situation, and allows for different ways to determine such an element of the tax system as the tax base, and also involves the use of benefits. In addition, the state has an interest in providing benefits in order to stimulate any sector of the economy, social or economic development of the country in terms of the planned tax policy. During the writing of the master's thesis was proposed a new principle of tax planning, which consists in the differentiation of income tax depending on the types of economic activity of enterprises. And also the technique of formation of the income tax depending on types of economic activity of the enterprises according to the developed principle is offered.

This dissertation empirically studies the interplay of government policies, finance, and economic development. More specifically, it considers the impact of corporate taxes on employment, of bank regulation on financial information sharing on banking stability and of banking crises on democracy. Two of the chapters focus on Sub-Saharan African (SSA) countries. The third one takes a more global perspective. Chapter 1 evaluates the impact of corporate income tax rates (CIT) on employment at the firm level for a sample of SSA countries. It finds that on average, firms employ more workers in countries with higher CIT rates. This is consistent with the fact that corporate tax revenues allow governments to provide public goods and infrastructure which are crucial to firm activities. We report estimation results to support this assumption. More specifically, while the marginal effect of CIT decreases with income level or with government expenditures, it increases with the level of democracy. Furthermore, we also find that the effect of CIT rates on employment works partially through improvements in the business environment in which firms operate. Chapter 2 assesses the effects of government policies setting the extent to which credit information on the credit history of borrowers is shared among lenders. It shows that credit information sharing stabilizes banks. Moreover, despite foreign banks having an informational disadvantage over domestic banks due to information frictions and would hence benefit more from credit information sharing, the results indicate that both types of banks are affected in the same way. This suggests that foreign banks rely on alternative strategies to compensate for their informational disadvantage in local markets. Lastly, Chapter 3 documents the impact of banking crises on the level of democracy. It provides evidence that democracy improves in the 10-year window following the occurrence of a banking crisis. The results also highlight the presence of several non-linearities. First, severe banking crises have larger effects on democracy than moderate ones. Second, the positive effect of banking crises on democracy is mostly driven by non-democratic countries. Finally, the bulk of the effect materializes from the third year after the crisis occurred. / Cette thèse étudie empiriquement l'interaction des politiques gouvernementales, de la finance, et du développement économique. Plus précisément, il examine l'impact de la fiscalité des entreprises sur l'emploi, de la réglementation bancaire relative au partage d'informations sur le crédit sur la stabilité bancaire, et des crises bancaires sur la démocratie. Les deux premiers chapitres se focalisent sur les pays d'Afrique subsaharienne. Le troisième adopte une perspective plus globale pour couvrir. Le premier chapitre évalue l'impact des taux d'imposition des sociétés (IS) sur l'emploi au niveau de l'entreprise pour un échantillon de pays d'Afrique subsaharienne. Ses résultats montrent qu'en moyenne, les entreprises emploient plus de travailleurs dans les pays où les taux de taxation des entreprises sont plus élevés. Cela s’explique par le fait que les recettes de l'impôt sur les sociétés permettent aux gouvernements de financer des biens publics et des infrastructures qui sont essentiels aux activités des entreprises. Nous présentons des résultats d'estimation pour soutenir cette hypothèse. Plus précisément, alors que l'effet marginal de l'IS diminue avec le niveau de revenu ou avec les dépenses publiques, il augmente avec le niveau de démocratie. En outre, nous constatons également que l'effet des taux d'IS sur l'emploi s'explique en partie par l'amélioration de l'environnement des affaires dans lequel opèrent les entreprises. Le second chapitre évalue les effets des politiques gouvernementales fixant la mesure dans laquelle les informations sur les antécédents de crédit des emprunteurs sont partagées entre les prêteurs. Il montre que le partage d'informations sur le crédit permet de stabiliser les banques. De plus, bien que les banques étrangères aient un désavantage informationnel par rapport aux banques nationales en raison de frictions d'information et bénéficieraient donc davantage du partage d'informations sur le crédit, les résultats indiquent que les deux types de banques sont affectées de la même manière. Cela suggère que les banques étrangères s'appuient sur des stratégies alternatives pour compenser leur désavantage informationnel sur les marchés locaux. Enfin, le chapitre 3 documente l'impact des crises bancaires sur le niveau de démocratie. Il fournit la preuve que la démocratie s'améliore dans la fenêtre de 10 ans suivant l’occurrence d'une crise bancaire. Les résultats mettent également en évidence la présence de plusieurs non-linéarités. Premièrement, les crises bancaires graves ont des effets plus importants sur la démocratie que les crises modérées. Deuxièmement, l'effet positif des crises bancaires sur la démocratie est principalement attribuable aux pays non démocratiques. Essays on the Effects of Corporate TaxationGbohoui, William Dieudonné Yélian 03 1900 (has links)
Cette thèse est une collection de trois articles en macroéconomie et finances publiques. Elle développe des modèles d'Equilibre Général Dynamique et Stochastique pour analyser les implications macroéconomiques des politiques d'imposition des entreprises en présence de marchés financiers imparfaits. Le premier chapitre analyse les mécanismes de transmission à l'économie, des effets d'un ré-échelonnement de l'impôt sur le profit des entreprises. Dans une économie constituée d'un gouvernement, d'une firme représentative et d'un ménage représentatif, j'élabore un théorème de l'équivalence ricardienne avec l'impôt sur le profit des entreprises. Plus particulièrement, j'établis que si les marchés financiers sont parfaits, un ré-échelonnement de l'impôt sur le profit des entreprises qui ne change pas la valeur présente de l'impôt total auquel l'entreprise est assujettie sur toute sa durée de vie n'a aucun effet réel sur l'économie si l'état utilise un impôt forfaitaire. Ensuite, en présence de marchés financiers imparfaits, je montre qu'une une baisse temporaire de l'impôt forfaitaire sur le profit des entreprises stimule l'investissement parce qu'il réduit temporairement le coût marginal de l'investissement. Enfin, mes résultats indiquent que si l'impôt est proportionnel au profit des entreprises, l'anticipation de taxes élevées dans le futur réduit le rendement espéré de l'investissement et atténue la stimulation de l'investissement engendrée par la réduction d'impôt. Le deuxième chapitre est écrit en collaboration avec Rui Castro. Dans cet article, nous avons quantifié les effets sur les décisions individuelles d'investis-sement et de production des entreprises ainsi que sur les agrégats macroéconomiques, d'une baisse temporaire de l'impôt sur le profit des entreprises en présence de marchés financiers imparfaits. Dans un modèle où les entreprises sont sujettes à des chocs de productivité idiosyncratiques, nous avons d'abord établi que le rationnement de crédit affecte plus les petites (jeunes) entreprises que les grandes entreprises. Pour des entreprises de même taille, les entreprises les plus productives sont celles qui souffrent le plus du manque de liquidité résultant des imperfections du marché financier. Ensuite, nous montré que pour une baisse de 1 dollar du revenu de l'impôt, l'investissement et la production augmentent respectivement de 26 et 3,5 centimes. L'effet cumulatif indique une augmentation de l'investissement et de la production agrégés respectivement de 4,6 et 7,2 centimes. Au niveau individuel, nos résultats indiquent que la politique stimule l'investissement des petites entreprises, initialement en manque de liquidité, alors qu'elle réduit l'investissement des grandes entreprises, initialement non contraintes. Le troisième chapitre est consacré à l'analyse des effets de la réforme de l'imposition des revenus d'entreprise proposée par le Trésor américain en 1992. La proposition de réforme recommande l'élimination des impôts sur les dividendes et les gains en capital et l'imposition d'une seule taxe sur le revenu des entreprises. Pour ce faire, j'ai eu recours à un modèle dynamique stochastique d'équilibre général avec marchés financiers imparfaits dans lequel les entreprises sont sujettes à des chocs idiosyncratiques de productivité. Les résultats indiquent que l'abolition des impôts sur les dividendes et les gains en capital réduisent les distorsions dans les choix d'investissement des entreprises, stimule l'investissement et entraîne une meilleure allocation du capital. Mais pour être financièrement soutenable, la réforme nécessite un relèvement du taux de l'impôt sur le profit des entreprises de 34\% à 42\%. Cette hausse du taux d'imposition décourage l'accumulation du capital. En somme, la réforme engendre une baisse de l'accumulation du capital et de la production respectivement de 8\% et 1\%. Néanmoins, elle améliore l'allocation du capital de 20\%, engendrant des gains de productivité de 1.41\% et une modeste augmentation du bien être des consommateurs. / This thesis is a collection of three papers in macroeconomics and public finance. It develops Dynamic Stochastic General Equilibrium Models with a special focus on financial frictions to analyze the effects of changes in corporate tax policy on firm level and macroeconomic aggregates.
Chapter 1 develops a dynamic general equilibrium model with a representative firm to assess the short-run effects of changes in the timing of corporate profit taxes. First, it extends the Ricardian equivalence result to an environment with production and establishes that a temporary corporate profit tax cut financed by future tax-increase has no real effect when the tax is lump sum and capital markets are perfect. Second, I assess how strong the ricardian forces are in the presence of financing frictions. I find that when equity issuance is costly, and when the firm faces a lower bound on dividend payments, a temporary tax cut reduces temporary the marginal cost of investment and implies positive marginal propensity of investment. Third, I analyze how do the intertemporal substitution effects of tax cuts interact with the stimulative effects when tax is not lump-sum. The results show that when tax is proportional to corporate profit, the expectations of high future tax rates reduce the expected marginal return on investment and mitigate the stimulative effects of tax cuts. The net investment response depends on the relative strength of each effect.
Chapter 2 is co-authored with Rui Castro. In this paper, we quantify how effective temporary corporate tax cuts are in stimulating investment and output via relaxation of financing frictions. In fact, policymakers often rely on temporary corporate tax cuts in order to provide incentives for business investment in recession times. A common motivation is that such policies help relax financing frictions, which might bind more during recessions. We assess whether this mechanism is effective. In an industry equilibrium model where some firms are financially constrained, marginal propensities to invest are high. We consider a transitory corporate tax cut, funded by public debt. By increasing current cash flows, corporate tax cuts are effective at stimulating current investment. On impact, aggregate investment increases by 26 cents per dollar of tax stimulus, and aggregate output by 3.5 cents. The stimulative output effects are long-lived, extending past the period the policy is reversed, leading to a cumulative effect multiplier on output of 7.2 cents. A major factor preventing larger effects is that this policy tends to significantly crowd out investment among the larger, unconstrained firms.
Chapter 3 studies the effects of the 1992's U.S. Treasury Department proposal of a Comprehensive Business Income Tax (CBIT) reform. According to the U.S. tax code, dividend and capital gain are taxed at the firm level and further taxed when distributed to shareholders. This double taxation may reduce the overall return on investment and induce inefficient capital allocation. Therefore, tax reforms have been at the center of numerous debates among economists and policymakers. As part of this debate, the U.S. Department of Treasury proposed in 1992 to abolish dividend and capital gain taxes, and to use a Comprehensive Business Income Tax (CBIT) to levy tax on corporate income. In this paper, I use an industry equilibrium model where firms are subject to financing frictions, and idiosyncratic productivity and entry/exit shocks to assess the long run effects of the CBIT. I find that the elimination of the capital gain and dividend taxes is not self financing. More precisely, the corporate profit tax rate should be increased from 34\% to 42\% to keep the reform revenue-neutral. Overall, the results show that the CBIT reform reduces capital accumulation and output by 8\% and 1\%, respectively. However, it improves capital allocation by 20\%, resulting in an increase in aggregate productivity by 1.41\% and in a modest welfare gain.
