La fonction dissuasive de la responsabilité civile est aujourd’hui remise en cause. La prolifération de régimes de responsabilité sans faute et le développement de l'assurance de responsabilité en sont les causes principales. Le droit privé a cependant une autre institution : la peine privée, qui a été établie précisément pour obtenir la dissuasion des faits illicites. Toutefois, elle a été méprisée en droit privé colombien, en raison d’un raisonnement imprécis consistant à rattacher la peine privée à la responsabilité. Ce travail cherche à éclairer la question, afin d'officialiser l'institution. / The deterrent function of tort law has been called into question. The causes are the increase of strict liability systems and the development of liability insurance. However, the private law has another institution, the private punishment, a civil remedy that has been established for deterring illicit behaviours. This institution has been ignored in Colombian private law, because of a mistaken idea regarding the nature of the remedy. This essay searches for clarify the issue, in order to make the remedy legally recognized.

Causation in the European Context Abstract The aim of this thesis is to provide an insight into the issue of causal link legislation in the European context. The author does not limit herself to an applicable Czech legislation, but also to the regulation pursuant to Principles of European Tort Law (PETL). An important part of this thesis is devoted to the relevant case law concerning causal link. The first part of this thesis contains an interpretation of the concept of causality in the context of non-legal sciences. Furthermore, the author generally deals with liability for damage and each of its presumptions. The second chapter analyses the legislation pursuant to the Civil Code, respectively the Code of Civil Procedure. It also includes a detailed analysis of the Czech courts' case law and recourse into the loss of chance doctrine. The third chapter deals with legislation under PETL, the fourth chapter provides an insight into the concept of causality in selected European countries (England, France and Germany). Finally, the author compares the legislative differences between the "European" and Czech regulation and she also deals with the issue of legislation de lege ferenda. The Concept and Development of Strict Liability in Czech Tort Law and its Inspirational Sources Abstract The thesis deals with an analysis of strict liability in Czech tort law taking into account the inspirational sources of its regulation, including in particular German and Austrian law, the Principles of European Tort Law (PETL) and the Draft of Common Frame of Reference (DCFR). Further, a historical and possible future development of strict liability is analysed as well as the risks for which strict liability is imposed. The thesis is divided into two main parts. The subject-matter of the first General Part is especially the concept of the strict liability and the reasons for its application. Further, some related problems are analysed in this part which are relevant for the legal theory as well for the legal practice (e.g. defences, contributory negligence, possibility of the concurrence of claims). The subsequent Special Part contains an analysis of the types of strict liability and consists of four main chapters. The first chapter deals with a short overview of the historical development of the strict liability in Czech tort law. Private Law & Public Space : The Canadian Privacy Torts in an Era of Personal Remote-Surveillance Technology

As increasingly sophisticated personal-use technologies like drones and home surveillance systems become more common, so too will interpersonal privacy conflicts. Given the nature of these new personal-use technologies, privacy conflicts will increasingly occur in public spaces. Tort law is one area of the Canadian legal system that can address interpersonal conflict and rights-infringements between people with no other legal relationship. However, building on a historical association between privacy and private property, the common and statutory law privacy torts in Canada fail to respond to such conflicts, I argue inappropriately. Privacy is an important dimension of public space, and the social interactions and relationships that arise in public spaces. Failing to recognize public space privacy in tort law leads to an overly narrow understanding of privacy, and can be considered contrary to binding precedent that says that the common law should evolve in line with (or at a minimum, not contrary to) Charter values. The Charter values of privacy, substantive equality, and expressive freedom support various reforms to the judicial understanding of the privacy torts in Canada. Privacy, also understood as "private affairs" or "private facts" in tort, should not be predicated on property, and can sometimes take on greater value in public spaces. Privacy interests should be assessed through a normative lens, with a view to the long-term implications of a precedent for both privacy and substantive equality. Courts should assess privacy through a subjective-objective lens that allows for consideration of the lived experiences and expertise of the parties, their relative power, and their relationships. Adopting these principles into the statutory and common law torts would permit tort law to serve as a legal mechanism for addressing interpersonal, technology-mediated privacy conflicts arising in public spaces. This will be a socially valuable development as such conflicts become increasingly common and potentially litigated.

Darbe atliekamas Lietuvos Respublikos civilinio kodekso (CK) ir Europoje vyraujančių deliktų teisės vienodinimo tendencijų – Europos deliktų teisės principų (PETL) ir Bendros principų sistemos projekto (DCFR) civilinės deliktinės atsakomybės sąlygų palyginimas, siekiant skirti ir įvertinti jų atitiktį dabartiniame Europos deliktų teisės harmonizavimo ir unifikavimo etape. Atliekant tyrimą apibendrinamos pagrindinės Vakarų Europos deliktų teisės tradicijos, pateikiama bendra PETL, DCFR ir Lietuvos deliktų teisės sistemos charakteristika. Daromos išvados, kad PETL ir DCFR grindžiamos generalinio delikto principu. Juose skiriamos ir detaliai konkretizuojamos visos, būdingos ir Lietuvos deliktų teisės sistemai, sąlygos, kurioms esant gali būti taikoma civilinė deliktinė atsakomybė – žala, kaltė ir priežastinis ryšys. Konstatuojamas esminis CK skirtumas nuo PETL ir DCFR nuostatų, apibrėžiant trečiųjų asmenų, turinčių teisę į neturtinės žalos atlyginimą, ratą. CK trečiųjų asmenų teisė į neturtinės žalos atlyginimą įtvirtinta tik nukentėjusiojo gyvybės atėmimo atveju. PETL ir DCFR tokią trečiųjų asmenų teisę numato ir nukentėjusiojo sveikatos sužalojimo atvejais. Kaltė pagal PETL ir DCFR nuostatas gali turėti ir tyčios formą. Pabrėžiama, jog tokia nuostata prieštarauja CK. Vertinant priežastinio ryšio sąlygą daroma išvada, jog CK įtvirtinta jos samprata neprieštarauja PETL ir DCFR nuostatoms. / Work carried out the Civil Code of the Republic of Lithuania (CC) and Europe prevailing trends in the convergence of tort law – the Principles of European Tort Law (PETL) and the Draft Common Frame of Reference (DCFR) civil tort liability in terms of comparison in order to allocate and assess their compliance with current European tort law harmonization and unification stage. The study summarizes the main Western European tradition of tort law, the general PETL, DCFR and Lithuanian tort law system performance. Conclude that PETL and DCFR based on the general tort principle. They are awarded and all the details down specific characteristic of the Lithuanian tort law system and the conditions, under which may be subject the civil tort liability – damage, fault and causation. Finding the essential difference between CC and the PETL, DCFR provisions under definition the circle of third parties, who are entitle to non-pecuniary damages. The right of the third parties by CC consolidated only the victim’s death. PETL and DCFR provide the third party under victim’s death and personal injury cases. Fault by PETL and DCFR provisions could have the form of intentional. Emphasized that such a provision is contrary to CC. Assessing the condition of causality, it is concluded, that the CC provides its conception in compliance with the PETL and DCFR provisions.

La situation environnementale actuelle et les prévisions y afférentes des experts,obligent à questionner l’appréhension du dommage à l’environnement par la responsabilitécivile et plus largement, des atteintes et risques d’atteintes à celui-ci.Cette réflexion porte ainsi sur les outils et mécanismes de ladite responsabilité, afin devérifier leur adaptation à ce dommage. Il s’agit d’identifier les carences du régime, et deformuler des propositions théoriques, techniques, ou pratiques, car d’importants efforts restentà fournir, tous domaines confondus, pour un droit effectif et efficace.Se trouvant à la croisée des problèmes et enjeux abordés, le secteur agroalimentairefait office de secteur-témoin, comme il en va de la responsabilité relative singulièrement à lasanté humaine, sans préjudice d’impacts autres des pollutions.Ces dommages étant majoritairement très difficiles à constater avec rigueur et àévaluer, en plus d’être onéreux à réparer –lorsqu’ils ne sont pas irréversibles–, leraisonnement suivi consiste à démontrer l’urgence de mieux adapter la responsabilité civile àceux-ci, par l’analyse de ses différents éléments, en tenant compte de la dualité qui lacaractérise. The following thesis considers the shortcomings and adequacy of tort law’stools and mechanisms for addressing these environmental concerns. Indeed, it is particularlydifficult to even ascertain most environmental offenses and estimate their cost, particularlywith regard to irreversible harms. Thus, the reasoning demonstrates the emergency of a betteradaptation of both corresponding liability and responsibility, through their different elements,including the duality that characterizes them. Here, we then offer theoretical, technical orpractical considerations, which may be of use in navigating this route.In considering these issues, the food proceeding industry serves as a particularly usefulmodel sector for the demonstration, as it has grappled with many of the same problems andstakes, including liability for human health, without prejudice to other pollutions’ impacts.Furthermore, we aim at rethinking the ill-adapted law to consider liability andresponsibility; this requires that we learn lessons from the results of the reasoning, andmanage with the particularities of interests and actors that intervene, or the larger room thatmust be devoted to the environment in social choices. Specifically, the goal of theanthropocentric approach is to enable to overcome skepticism towards environmentalconcerns, and to underline the fact that these offenses are fundamentally borderless.

De l'existence d'un principe de confiance légitime en droit privé / About the existence of a principle of legitimate expectation in private law

L’expression « Principe de confiance légitime » désigne généralement, dans la littérature juridique française, un principe de droit public qui s’est imposé dans différents pays et dans la jurisprudence de la Cour de Justice de l’Union européenne. Au-delà de ce domaine classique, certains auteurs soutiennent qu’un tel principe existe en droit privé français. Il s’agirait, selon une partie d’entre eux, d’un principe explicatif et d’orientation. Pour un autre auteur, il en existerait plusieurs. Ces incertitudes justifient une interrogation sur le bien-fondé de l’existence d’un, voire plusieurs, principe(s) de confiance légitime en droit privé. Dans l’hypothèse où la réponse serait positive, la fonction doit être précisée afin de déterminer si ce ou ces principes n’ont que des fonctions d’orientation – ou d’interprétation – et d’explication. La présente thèse répond par l’affirmative à la première de ces questions et par la négative à la seconde. Ainsi, la première partie de la thèse met en lumière le principe. Elle soutient que le régime des produits défectueux et le droit commun de la responsabilité civile sanctionnent, dans des hypothèses variées, la violation de la confiance légitime. Ce constat présuppose qu’il existe une norme juridique qui impose de respecter cette confiance, norme qui ne peut qu’être un principe général du droit, dans la mesure où sa généralité est telle qu’elle est de nature à inspirer d’autres normes. La seconde partie traite des effets du principe. Plusieurs sont identifiés et deux font l’objet de développements plus substantiels : le droit à l’exécution forcée et la fonction satisfactoire de la responsabilité civile. / The expression "Principle of legitimate expectation" is generally used, within the French legal literature, as a principle under public law which has already been established in several countries as well as exercised in the Court of Justice of the European Union jurisprudence. Beyond this classic area, some authors argue that such a principle does exist in private law. It would be, for a fraction of them, an explanatory and orientative principle. For another author, there would be several principles. These uncertainties justify interrogation on the basis of the existence of one, or even several principles of "legitimate expectation". Assuming that the answer would be positive, the function of the above-mentioned principle must be ascertained so as to determine if that or these principle(s) have for unique function orientation – or interpretation – and explanation. The present thesis tries to answer in the affirmative for the first question and to give a negative answer to the second one. The first part of this thesis highlights the principle. It argues that the legal frame of defective products regulations as well as the civil liability does punish, through several ways, the breach of the legitimate expectation. This observation assumes that there is a legal norm which requires to respect this legitimate expectation. This norm can only be considered as a general principle of law to the extent that, by virtue of its generality, it shall inspire other norms. The second part of the present thesis deals with the consequences of the principle of legitimate expectation. Several have been identified and two of them are subject to more detailed and substantial development : the forced execution related regulations and the satisfactory function of civil liability.

O estudo em comento tem por objetivo analisar se o instituto jurídico dos punitive damages, oriundo da Common Law, tem aplicabilidade no ordenamento jurídico nacional, particularmente no âmbito das relações de consumo. Para tanto, a presente obra, além de apresentar um panorama histórico da responsabilidade civil punitiva, expõe como tal responsabilidade vem sendo aceita no Brasil e conclui como sendo dois os seus principais instrumentos de atuação: a indenização punitiva e os punitive damages. Diferenciando-os, entendemos que os punitive damages eram os mais adequados a atual sociedade de consumo brasileira, por constituir-se um valor fixado em separado, com o intuito específico de punir e avaliado conforme a complexidade do caso pelo magistrado, conferindo dinamismo e eficiência às punições. Nesse sentido, propusemos os critérios que em nosso sentir seriam os mais adequados para a aplicação dos punitive damages e a fixação do quantum punitivo no âmbito das relações de consumo, bem como os fatores que justificam a aplicação do referido instituto jurídico nestas relações. Apresentamos, ademais, uma análise da aplicabilidade dos punitive damages nos ordenamentos jurídicos de Common e Civil Law que mais influenciam o ordenamento jurídico nacional. / This study aims to examine whether the legal institution of punitive damages, coming from the Common Law, is applicable in national law, particularly in the context of consumer relations. This essay, besides presenting historical overview of punitive liability, explains how this responsibility is being accepted in Brazil and concludes that there are two main instruments of action. The first instrument is based on the increase of the compensatory damages to punish the defendant. The other one is the punitive damages. We believe that punitive damages were more suitable to the current consumer society in Brazil, because it represents a value that is set apart, with the purpose of punishing and evaluated according to the complexity of the case by the magistrate, giving dynamism and efficiency to the punishment. In this sense, we proposed rules that in our opinion would be most suitable for the application of punitive damages and setting of the punitive quantum under products liability, as well as factors warranting the application of this legal institution in these relationships. We present, moreover, analysis of the applicability of punitive damages in the legal systems of Common and Civil Law that most influence Brazilian Law.
