Sujeitas de Direitos: história de vida de mulheres bolivianas, peruanas e paraguaias na cidade de São Paulo é uma pesquisa de história oral, guiada por seu conjunto de procedimentos em todas as etapas do trabalho. As entrevistas, a partir da história de vida de cinco mulheres migrantes, seguiram seus pressupostos e formaram o corpo do documento. Baseado nessas narrativas, feitas de forma colaborativa, buscou-se abordar a história do tempo presente a partir da migração de mulheres que vieram da Bolívia, Paraguai e Peru, e escolheram viver na cidade de São Paulo. A conquista de espaços urbanos, a liberdade relativa na escolha da profissão e a mobilidade como saída da opressão familiar foram discutidas, ao lado da criação de transnacionalização familiar e das atividades que exploram as vulnerabilidades da pessoa, como o trabalho escravo e o tráfico de pessoas / Subject of Rights: the life stories of Bolivian, Peruvian and Paraguayan women in São Paulo is an oral history research project, guided in its entirety by the methods guidelines. Focused on the life trajectories of five migrant women, the interviews follow the oral history procedures, and interviews also structure the core of the present document. Grounded on the narratives of these migrants, conducted in a collaborative manner, this projected aimed to tackle the present history of women from Bolivia, Paraguay, and Peru who chose to live in the city of Sao Paulo. We discuss the seizure of urban spaces, the relative freedom of choice of occupation and mobility as an exit from family oppression, in addition to the conception of household transnacionalization, and finally the activities that endanger the individual, such as slave labor and human trafficking

O estudo está embasado no processo histórico, como uma luz que permite estender a realidade atual compreendendo-a a partir das relações econômicas, sociais e políticas. Com a finalidade de exterminar de vez com a escravatura no Brasil, foi assinada a lei áurea em 1888, entretanto, apesar de vivenciarmos o século XXI, ainda deparamos com situações que sustentam o trabalhador que vivem em condições análogas ao de escravo, caracterizada como Escravidão Contemporânea. A ação de escravização de pessoas está implantada em um quadro de ordenamento do trabalho livre e estritamente, agregado aos cursos migratórios de trabalhadores rurais para o corte de cana, carvoarias, usinas de cana-de-açúcar, destilarias de álcool, à ocupação das fronteiras agrícolas bem como a implementação de projetos agroindustriais de reflorestamento. O tema que será exposto tem a ambição de atingir um estudo sobre a triste e aborrecida realidade que hoje aflige numerosos brasileiros em seu dia a dia que é o trabalho escravo contemporâneo. É fato que a cana de açúcar não é a fundamental atividade econômica que utilizam trabalho escravo, porém se computarmos o número de libertados por ramo de atividade, a cana sobe múltiplas posições. The study is based on the historical process, as a light that allows extending the current reality understanding it from the economic, social and political relations. In order to exterminate slavery in Brazil definitely, the aureate law was signed in 1888; however, despite experiencing the twenty-first century, we still encounter situations that sustain the worker who live in conditions analogous to slavery, characterized as Slavery Contemporary. The action of enslavement of people is implanted in a framework of free and strictly organized labor, added to the migratory courses of rural workers for the cutting of sugarcane, charcoal, sugar cane mills, alcohol distilleries, occupation of borders agricultural projects as well as the implementation of agroindustrial reforestation projects. The theme that will be exposed has the ambition to reach a study about the sad and boring reality that today affects many Brazilians in their day to day that is the contemporary slave labor. It is a fact that sugar cane is not the fundamental economic activity that uses slave labor, but if we compute the number of freed by branch of activity, sugarcane rises multiple positions. No atual cenário de globalização são verificadas diversas práticas de exploração laboral. O trabalho escravo é a forma de exploração laboral mais intensa que pode existir nos dias atuais. O tráfico de pessoas é uma prática criminosa crescente em nossa sociedade. No Brasil, em São Paulo, existem casos de trabalhadores imigrantes bolivianos vítimas de tráfico de pessoas e trabalho escravo. Esta pesquisa busca discutir os conceitos de trabalho decente, trabalho escravo, tráfico de pessoas, tráfico de migrantes, com o objetivo de focar na análise da exploração de imigrantes bolivianos em oficinas de costura de São Paulo. É argumentado que estes trabalhadores bolivianos, independentemente de seu status imigratório, possuem direitos laborais que devem ser respeitados. / In the present scenario of globalization many labor exploitation practices take place. Slave labor is the most intensive form of labor exploitation that exists nowadays. Human trafficking is an ascending crime in our society. In Brazil, in Sao Paulo, there are cases of Bolivian immigrant workers victims of human trafficking and slave labor. This research intends to discuss concepts of decent work, slave labor, human trafficking, migrant smuggling, in order to focus on the analyses of the exploitation of Bolivian immigrants in textile sweatshops in Sao Paulo. It is argued that these Bolivian workers, independently of their migratory status, have labor rights that should be respected.

Na região de Açailândia/Maranhão, que possui o terceiro Produto Interno Bruto (PIB) do estado e tem como principal fonte econômica as indústrias beneficiadoras de minério, ainda é comum nas fazendas e carvoarias os trabalhadores serem expostos às condições de trabalho escravo. Tais condições representam uma violação dos direitos fundamentais e dos direitos humanos dos trabalhadores. Estes indivíduos, mesmo após serem libertados, ainda estão vulneráveis ao aliciamento, face à ausência de políticas públicas para o enfrentamento deste problema social. Neste cenário, foi criado em Açailândia/MA o Centro de Defesa da Vida dos Direitos Humanos Carmem Bascarán (CDVDH/CB), com objetivo de proporcionar um espaço para o acolhimento dos indivíduos que sofreram violação de direitos humanos. O CDVDH/CB possui uma sede, onde realiza o acolhimento dos trabalhadores e desenvolve atividades socioculturais e dois polos que produzem artesanato derivado de papel reciclado e móveis planejados, utilizados para a qualificação técnica, geração de renda e reinserção dos trabalhadores na sociedade. O CDVDH/CB conta com o apoio da esfera pública e privada para a realização das suas atividades, como a ONG Manos Unidas, Brazil Foundation, Petrobras, ONG Repórter Brasil, entre outras. Este estudo tem como objetivo identificar as contribuições realizadas pelo CDVDH/CB para o desenvolvimento humano de trabalhadores escravizados, tendo como referência a Abordagem das Capacitações de Amartya Sen. A escolha desta abordagem para delimitar o estudo se deu em função da estrutura normativa proposta por Sen, para a avaliação da desigualdade e do desenvolvimento humano. O método é qualitativo, baseado na pesquisa bibliográfica, documental e de campo. Foram realizadas entrevistas com diretores do CDVDH/CB e trabalhadores assistidos, além da observação e análise de relatórios de prestação de contas do CDVDH/CB às empresas patrocinadoras. No tratamento dos dados foi utilizada a análise de conteúdo. Identificou-se que o CDVDH/CB tem como estratégia de apoio dividir suas ações em três eixos: Prevenção, Repressão e Inserção, desta forma, além de combater o trabalho escravo, objetiva-se reinserir o trabalhador na sociedade. Os trabalhadores demonstraram satisfação e se sentem seguros com o apoio promovido pelo CDVDH/CB. O estudo levou em consideração as cinco liberdades propostas por Sen: políticas, econômicas, sociais, transparência e segurança protetora. Após serem acolhidos pelo CDVDH/CB os trabalhadores tiveram suas capacidades expandidas. Como meio de expansão de liberdades os trabalhadores participam de qualificação profissional, obtiveram seus documentos pessoais e passaram a atuar em movimentos sociais e religiosos. Desta forma, tendo a liberdade como fim, a amplitude do ser e do fazer da pessoa, os colaboradores conseguiram atividade profissional remunerada, residência fixa, bens de consumo e lazer. Verificou-se que o apoio desenvolvido pela CDVDH/CB é referência no combate ao trabalho escravo no Maranhão, na reinserção desses trabalhadores no mercado e contribui para a promoção do desenvolvimento humano dos assistidos. / After 125 years of slavery abolishment, there still are slave work concentrations in Brazil. In the region of Açailândia/Maranhão that has the third Gross Domestic Product (GDP) in the state and as it’s main source of income, the benefactoring industries of minerals, still is common for the workers of farms and coal mines to be exposed to slave work conditions. Such conditions represent a violation of fundamental and human rights of workers. These individuals, even after being freed, still are vulnerable to persuasion due to the absence of public policies. Because of that, in the city of Açailândia/MA, the Carmen Bascarán Human Rights and Defense of Life Center (CDVDH/CB) was created, with the objective of providing shelter to the individuals that suffered violation of human rights. The CDVDH/CB has a headquarters where they shelter the workers and hold social cultural activities and two places that produce artesian work derived from recycled paper and furniture utilized for the technical qualification and income for the workers in the society. The CDVDH/CB depends on the support of public and private circles to go on with their activities, as the Manos Unidas NGO, Brazil foundation, Petrobras, Reporter Brasil NGO, among others. This study, had and it’s objective, identify the contributions done by the CDVDH/CB to the human development of slave workers, having as reference Capability Approach of Amartya Sen. The choice of this approach to conduct the study, was because of Amartya Sen’s concept, to evaluate inequality and the human development. This method is qualitative based on the bibliographic, documental and field research. Interviews with the directors of CDVDH/CB were done, and workers attended, beyond the observation and analysis of stock reports from CDVDH/CB to the sponsoring companies. The content’s analysis was utilized in the data. It was identified that CDVDH/CB has as support strategy, to divide it’s bonds in three axes: Prevention, Repression and Insertion, so besides fighting against slave work, the objective is to reinsert the worker in society. The workers demonstrate satisfaction and feel safe with the help provided by CDVDH/CB. The study took into consideration the five liberties proposed by Sen: political, economical, social, transparency and safe protection. After being sheltered by CDVDH/CB, the workers were able to qualify their capabilities. As a way of freedom expansion, workers participated in professional qualifying, obtained their personal documents and started to act in social and religious movements. This way, they were able to get paying jobs, permanent homes, leisure and consumer goods. It was verified that the support given by the CDVDH/CB is a reference in the fight against slave work in Maranhão, by reinserting these workers in the market and contributing to assist in the development of the assisted.

The research of doctrines and articles revealed that despite being refuted by many persons, slave labor exists and its dissemination across our territory is unchallenged - mainly in the poorest regions - and centered in rural areas. Furthermore, after the publication of the Constitutional Amendment No. 81, which altered Article 243 of the Federal Constitution to allow the confiscation of property from individuals or corporations who, as employers, are caught committing the crime of contemporary slavery as defined by Article 149 of the Criminal Code, the Brazilian Congress acknowledged the existence of workers submitted to undignified labor conditions. The latter is used to define the crime and include, among other hypotheses, excessive working hours, degrading work and forced labor. Research results have also identified the main means to combat contemporary slave labor focusing on the Public Labor Prosecutor who has relentlessly fought to completely eradicate this social injustice that taints our society, and negatively reflects on social and economic progress as well as before international agencies. The research concluded that a lot has been done to improve this situation. However, given the defiant attitude of some employers on committing the crime described by Article 149 of the Criminal Code, there is hope that the alteration provided by Article 243 of the Constitution, together with the other forms of combat, we will be able to achieve - in a very short time - a radical change in the reported numbers of workers submitted to undignified labor practices in total violation of fundamental principles, essentially human dignity, the pillar of our Constitution / O presente trabalho tem por escopo fazer uma breve contextualização acerca do trabalho que ainda é prestado em condições degradantes, configurando violação a diversos princípios constitucionais, essencialmente o da dignidade da pessoa humana, e tipificado como trabalho escravo contemporâneo. A pesquisa doutrinária e de artigos demonstrou que, muito embora existam aqueles que ainda refutam sua existência, resta inconteste sua disseminação por todo nosso território, notadamente nas regiões mais carentes, e seu maior foco se encontra nas áreas rurais. Ademais, o Congresso Nacional, após a promulgação da Emenda Constitucional n. 81, que modificou o art. 243 da Constituição Federal, passando a prever a expropriação de bens de pessoas físicas ou jurídicas, que, na qualidade de empregadoras, sejam flagradas cometendo o crime previsto no art. 149, do Código Penal, qual seja, o de escravidão contemporânea, reconhece a existência de trabalhadores laborando em condições indignas, os quais são submetidos, dentre outras hipóteses, a jornadas exaustivas, trabalho degradante e trabalho forçado, que são tipificadoras do crime penal. O resultado da pesquisa ainda identificou os principais meios de combate ao trabalho escravo contemporâneo, dando destaque à atuação do Ministério Público do Trabalho, que, de forma combativa, não mede esforços para erradicar de forma definitiva essa injustiça social, que tanto macula nossa sociedade, refletindo negativamente não só em nosso progresso social e econômico, como também perante os órgãos internacionais. O trabalho concluiu que muito se tem feito nesse sentido; no entanto, diante da recalcitrância de alguns empregadores em incorrer no crime previsto no art. 149 do Código Penal, espera-se que, com a alteração disposta no artigo 243, da Constituição Federal, aliada às demais formas de combate, possamos obter em curtíssimo tempo uma alteração radical nos números hoje identificados de trabalhadores ainda submetidos a prática laboral indigna, em frontal violação a princípios fundamentais, essencialmente o princípio da dignidade humana, pilar de nossa Lei Maior.

As an initial step, it proves to be essential to examine the effectiveness of repression, characterize the contemporary slave labor, explaining the modern forms of slavery, its occurrence modes, the legally protected interests, especially dignity. Therefore, the main international instruments dealing with the issue were examined. The main rules were also studied the internal law, beginning with the Federal Constitution, stating, besides the characterization, the most important tools for combating slave labor. Passes to the qualitative and quantitative study of decisions handed down in actions to combat the repression of slave labor, such as public civil actions, both in the first and in the second instance and it is concluded that, in the first instance, the prosecution proves effective , which does not occur in the second instance, because it uses interpretations that restrict the range of incidence of contemporary slave labor. / O presente trabalho tem por objeto a an??lise de efic??cia da repress??o judicial do trabalho escravo contempor??neo. O exame de efic??cia restringe-se ?? seara trabalhista e ocorre por meio do estudo do conte??do das decis??es da Justi??a do Trabalho da 16?? Regi??o sobre o tema. Antes, por??m, faz-se necess??rio caracterizar adequadamente o trabalho escravo contempor??neo, explicitando as formas modernas de escravid??o, suas modalidades de ocorr??ncia, os bens jur??dicos tutelados, em especial a dignidade. Para tanto, foram examinados, al??m dos instrumentos internacionais que tratam do tema, as principais normas do Direito interno, a come??ar pela Constitui????o Federal, buscando ainda apresentar os mais relevantes instrumentos de combate ao trabalho escravo. The historical context of neo-slavery and its normative repercussions are analyzed, through the recognition of the problem in the Inter-American Court of Human Rights and the regulatory framework at the international, national and state levels. Maranhão is present in the contemporary representation of slavery. It is observed that victimization for slave labor is linked to the cultural roots that for centuries tolerate this type of exploitation, together with impunity, lack of professional qualification and geographic isolation that favor this type of behavior in certain regions of the state. Analisa-se o contexto histórico da neo-escravidão e suas repercussões normativas, perpassando pelo reconhecimento do problema na Corte Interamericana de Direitos Humanos e o marco regulatório na esfera internacional, nacional e estadual. Verifica-se o Maranhão na representação contemporânea da escravatura. Observa-se que a vitimização para o trabalho escravo está ligada às raízes culturais que durante séculos toleram este tipo de exploração, somado à impunidade, à falta de qualificação profissional e ao isolamento geográfico que favorecem este tipo de conduta em determinadas regiões do estado. Aborda-se a (in)constitucionalidade da Lista Suja à luz do Supremo Tribunal Federal, que em suas decisões ora proíbe, ora autoriza sua publicação.

Partimos das diferentes nomenclaturas que são utilizadas para descrever as práticas de exploração dos trabalhadores, no Brasil, para darmos visibilidade aos diferentes campos de luta que se materializam na objetivação e subsequente subjetivação desses trabalhadores. Trabalhamos com a hipótese de que existe nesse jogo de poder-saber disputas que implicam em práticas de governamentalização e de mecanismos biopolíticos disparados por diversos segmentos que são convidados a arbitrar sobre a vida das pessoas, por meio do âmbito do trabalho. Cada nomenclatura assim, ocuparia uma posição estratégica, afim de ―defender‖, ―representar‖, o lugar de saber do qual fala. Essas disputas culminam na produção de documentos, dentre os quais alguns foram escolhidos para serem analisados nesse trabalho dissertativo. São documentos de âmbito internacional e nacional, a fim de que fosse problematizada essas práticas em dois níveis, já que percebe-se que ambos se interpolam e por vezes se completam na criação de estratégias e táticas agenciadas para o cuidado e gestão dos trabalhadores. Assim, verificou-se por meio de séries recortadas ao longo dos documentos que cresce uma demanda cada vez maior de pedido de punição aos considerados culpados em realizar as práticas de exploração, e dentre outras séries levantadas, há uma ampliação de um complexo tutelar, que começa a ser incentivado para o controle e vigilância dos trabalhadores, estimulados por organismos internacionais como a Organização Internacional do Trabalho, e outros movimentos e grupos da sociedade civil, que ajudam na produção de políticas públicas que muitas vezes acabam funcionando como uma forma de controlar os riscos a que possivelmente esses trabalhadores estejam submetidos, utilizam-se da estatística para justificar suas intervenções. Tem-se verificado, portanto, que um paradoxo de biopoder atravessa essas práticas, inserindo-as em um campo de gestão e controle da vida, onde se questiona se de fato os direitos e a dignidade humana dessas pessoas são levadas em consideração ou apenas ocupam um lugar dentro do campo dos acontecimentos possíveis que devem ser controlados por práticas de governamentalidade? Finalizamos tentando articular essas questões à produção de nomes utilizados para descrever as práticas de exploração dos trabalhadores, inserindo-os em estratégias de governo da população. / This paper presents a foucauldian genealogical analysis concerned discursive practices of power directed at workers, especially in rural areas, which constitute the object of "slave labor". We started from the different nomenclatures that are used to describe the practices of exploitation of workers in Brazil, to give visibility to the different fields struggle which materialize in objectification and subsequent subjectivity of these workers. We hypothesized that there is in this power-knowledge game disputes involving government control practices and biopolitical mechanisms operated by various segments that are called upon to arbitrate about people lives through the scope of work. Each nomenclature, thus, would occupy a strategic position in order to "defend", "represent" the field of knowledge which speaks about. These disputes culminate in the production of documents, some of whom were chosen to be analyzed in this work dissertational. These are documents of national and international level, so that these practices were problematized in two levels, as they realize they both interpolate and sometimes they are rivaled each other in creating strategies and tactics conducted for the care and management of workers. Thus, it was found, throughout cut series of documents over, that grows a demand for application of punishment of those found guilty of carrying out exploitative practices, and among others approached series, there is an extension of a tutelary complex, which begins to be encouraged to control and surveillance of workers, encouraged by international organizations like the International Labour Organization, and other movements and civil society groups, which help in producing public politics that often end up functioning as a form of control risks that possibly these workers are subordinate, using statistics to justify their interventions. Take notice, therefore, that a paradox of biopower pass over these practices, placing them in a field of management and control of life, where we ask ourselves: indeed are the human rights and dignity of these people taken into account or only occupy a place within the field of possible events to be controlled by practices of governmentality? We conclude by trying to articulate these issues to the production of names used to describe the practices of exploitation of workers by placing them in government strategies of the population.
