Challenging the Liberal Order Framework: Natural Resources and Metis Policy in Alberta and Saskatchewan (1930-1948)

The British North America Act, 1930 (the Natural Resources Transfer Agreements or NRTAs) marked the end of a lengthy battle between the provincial governments of Saskatchewan, Alberta, and Manitoba and the federal government of Canada. Prior to 1930, the provincial governments did not have administrative control over their natural resources, which were managed by the federal Department of the Interior. As a result, the three prairie provinces did not share equal constitutional status with the other Canadian provinces that did control their own resources. Under the terms of the new constitutionalized intergovernmental agreements the provincial governments agreed to fulfil all of the federal government’s continuing obligations to third parties after the transfer. One of these obligations was the redemption of Métis scrip issued by the federal government to extinguish the Métis share of Aboriginal land title. After the transfer, however, the provinces resisted granting more land to satisfy what they considered to be a federal obligation. The provinces refused to redeem Métis scrip entitlements and the federal government did not enforce the terms of the NRTAs. Both the federal and provincial governments failed to live up to the terms of the constitutional agreement and the Métis scrip issue fell through the jurisdictional cracks of Canadian federalism. This dissertation examines the historical context and consequences surrounding the Alberta and Saskatchewan government’s failure to recognize Métis scripholders’ rights-based claims to land. Each provincial government pursued different avenues with respect to natural resources and Métis policies. The purpose of this study is to examine the different phases of policy development in each province in light of the general failure of recognition. The transfer of control and administration of the public domain from one level of government to another provides interesting insights into the history of government-Aboriginal relations in Canada. Aboriginal people (including Métis) were not consulted during the negotiations leading up to the NRTAs; nevertheless (or perhaps as a result), the transfer agreements were a catalyst for political organization in several Métis communities. Métis who had been living on federal crown land were concerned that the transfer of lands to the provinces would negatively impact their right to pursue traditional livelihoods such as hunting, fishing and trapping. In Alberta, the NRTAs sparked the formation of the Métis Association of Alberta, a political lobbying group that advocated recognition of historical claims to land. During this period, parallel Métis living in Saskatchewan and Manitoba created parallel organizations. These political groups represent some of the earliest attempts by Aboriginal people in the prairie provinces to voice their concerns and influence government policy. There are three recurrent themes in this study. First, land appears as a point of convergence for Métis claims and an alternative to the distribution of government social assistance due to high levels of unemployment. Second, Métis political organizing affects government policy-making. Third, the thesis notes the marked change in policy direction by the Co-operative Commonwealth Federation (CCF) government in Saskatchewan after its election in 1944. The CCF introduced natural resources policies based on social democratic principles such as collective marketing. As We Move Ahead Together: Foregrounding Reconciliating and Renewed First Nation/ Non-Aboriginal Relations in Environmental Management and Research

The research project upon which this dissertation is based focused on enhancing understandings of the nature of current First Nations/non-Aboriginal relations in environmental management. The project was undertaken as a collaborative initiative by the author, a non-Aboriginal doctoral researcher, in partnership with Walpole Island First Nation. The research served as an opportunity for co-producing knowledge on this subject across cultures and worldviews, and as an effort to build towards our shared aspiration of learning how distinct, yet inextricably linked, First Nations/non-Aboriginal understandings, approaches and worldviews can come together within a context of mutual respect and mutual benefit. The purpose of the research was to investigate the existence and types of issues leading to First Nations/non-Aboriginal tensions in environmental management, to analyze and unpack underlying causes of challenges identified via the research, and to construct avenues for relationship improvement. The research project was grounded in a specific investigation into relations in species at risk conservation and recovery in southern Ontario, Canada. The resulting dissertation is structured around three primary focal areas: 1) investigating and exposing colonial influences at play in Canada’s Species at Risk Act, and offering a new model for co-governance in this arena and beyond; 2) investigating relations surrounding efforts towards traditional ecological knowledge (TEK) transfer in species at risk work, with a focus on exploring issues identified in relation to intellectual imperialism; and 3) introducing and characterizing an original, reconceptualized approach to First Nations/non-Aboriginal relationships in academic research; this approach focused on ways in which investigatory practice can become a means of working towards broader reconciliation goals. Research findings from this dissertation indicate that colonial factors, often unevenly visible to actors involved in environmental management and research, continue to strongly affect the potential for positive, productive First Nations/non-Aboriginal relations in these spheres - including within the species at risk conservation and recovery arena examined here. Project results provide insight into the nature of the factors influencing relationships, as well as potential avenues for addressing the vitality of colonialism in contemporary relations and overcoming the influences on First Nations and on First Nations/non-Aboriginal relationships.

Canoes and colony: the dugout canoe as a site of intercultural engagement in the colonial context of British Columbia (1849-1871)

The cedar dugout canoe is iconically associated with First Nations peoples of the Pacific Northwest coast, but the vital contribution it made to the economic and social development of British Columbia is historically unrecognized. This beautifully designed and crafted oceangoing vessel, besides being a prized necessity to the maritime First Nations peoples, was an essential transportation link for European colonists. In speed, maneuverability, and carrying capacity it vied with any other seagoing technology of the time. The dugout canoe became an important site of engagement between First Nations peoples and settlers. European produced textual and visual records of the colonial period are examined to analyze the dugout canoe as a site of intercultural interaction with a focus upon the European representation. This research asks: Was the First Nations' dugout canoe essential to colonial development in British Columbia and, if so, were the First Nations acknowledged for this vital contribution? Analysis of primary archival resources (letters and journals), images (photographs, sketches and paintings) and colonial publications, such as the colonial dispatches, memoirs and newspaper accounts, demonstrate that indeed the dugout canoe and First Nations canoeists were essential to the development of the colony of British Columbia. However, these contributions were differentially acknowledged as the colony shifted from a fur trade-oriented operation to a settler-centric development that emphasized the alienation of First Nations’ land for settler use. By focusing research on the dugout canoe and its use and depiction by Europeans, connections between European colonists and First Nations canoeists, navigators and manufacturers are foregrounded. This focus brings together these two key historical players demonstrating their “entangled” nature (Thomas 1991:139) and breaking down “silences” and “trivializations” in history (Trouillot 1995:96), working to build an inclusive and connected history of colonial British Columbia. / Graduate
