Přestupky proti veřejnému pořádku / Administrative infractions against public order

This dissertation deals with the topic of minor offences against public order. While working on this dissertation there has been a major change in the law, where the act number 200/1990 Sb. about minor offences was replaced by two new acts. Firstly it was replaced with the law number 250/2016 Sb. about responsibility for minor offences and the legal proceedings (furthermore minor offense law) and secondly with the law number 251/2016 Sb., about selected minor offences. This thesis aims at the area of minor offenses against public order regulated in the act about selected minor offences, it describes individual offenses and analyses whether there has been any change compared to previous regulations. This dissertation consists of seven chapters. In the first chapter I deal with the definition of a minor offence. I describe the individual definition of minor offences and describe its particular features. The second chapter follows the first; I deal with the responsibilities for offences caused by legal entities and business individuals. This modification was not previously included in the offense law, and I would like to describe the individual bases of responsibility for these subjects. Resume Title of this thesis: Proceedings for administrative infractions in the first instance. The thesis deals with administrative infraction proceedings in the first instance, mainly about the steps of administrative office before instituting the administrative proceedings. It is based on the new scholarly literature, incorporates new judicature and takes account of methodologies of Ministry of the Interior and practical problems. In the chapter I there are defined administrative infraction proceedings, its relation to Administrative proceedings Act and the infraction and there is also described the basic character of the proceedings for administrative infractions in the first instance. In the chapter II there is described competence of administrative office in administrative infraction proceedings, namely subject-matter jurisdiction, local jurisdiction and function competence. It deals with the changes of these competences too. Furthermore, in this context the thesis deals with professional competence of persons in authority and with contracts under public law. In the last part there are mentioned the reasons for exclusion of administrative persons, above all from bias. Evidence in administrative proceedings Abstract This diploma thesis deals with the taking of evidence in administrative proceedings, the aim of which is to refute or confirm a decisive fact. Administrative proceedings do not constitute a unified process; they are a diverse range of different types of proceedings rolled into on, in which the taking of evidence may be regulated in different ways. As a rule, general and special administrative proceedings are distinguished. The taking of evidence is considered to be an essential part of the administrative proceedings, but not obligatory one. In some types of proceedings, the taking of evidence is, in principle, excluded, while in others it may play an essential part. The diploma thesis is structured into five parts. The first part of the thesis defines the basic concepts appearing in the process of taking of evidence, as well as the historical development of anchoring the process of taking of evidence in the legal regulations of the Czech Republic since 1928. The next part deals with the principles that apply to the taking of evidence, be it the basic principles of action of administrative bodies or the principles of administrative proceedings themselves.
