A presente tese diz respeito à análise das hipóteses de atribuição da guarda dos filhos incapazes de pessoas que, por alguma razão, vivam separadamente, desmanchando eventual vínculo familiar entre elas existente. Corno esse fato não é apto a desfazer os vínculos entre cada um dos genitores e seus filhos, torna-se imperiosa a atribuição da guarda a um ou a ambos os pais (guarda simples, alternada ou compartilhada). A análise da questão toma em consideração os casos com elemento estrangeiro, ou seja, com algum fator que possa desvincular o caso fático de sua subsunção exclusiva ao ordenamento jurídico nacional, ligando-o, potencialmente, a outro ordenamento jurídico, quer pelo fato de um dos pais ser nacional de ou domiciliado em Estado estrangeiro, quer porque a criança seja estrangeira, ou, ainda, por um dos genitores manifestar a intenção de passar a residir no exterior, mesmo que todos os elementos até então existentes indicassem conexão exclusiva com o ordenamento brasileiro. Além da atribuição da guarda, outras conseqüências podem advir dessa relação fática, como a manutenção ou não do poder familiar, a regulamentação do direito de visitas, a estipulação do valor da pensão alimentícia etc. Torna-se necessário, assim, decidir qual a lei aplicável para a regulação da questão, bem como de suas conseqüências imediatas, vale dizer, a regulamentação do regime de visitas para o genitor afastado da convivência diuturna com os filhos, além da fixação da quantia necessária para a subsistência das crianças, por meio da pensão alimentícia a que façam jus. O estudo considera o direito à convivência familiar plena enquanto princípio maior e reitor da questão. O tema envolve, assim, urna série de institutos jurídicos ligados, em última análise, à proteção da criança em suas relações privadas (familiares), sejam elas de âmbito eminentemente pessoal, sejam, por outro lado, de âmbito patrimonial, englobando-se, desse modo, os direitos humanos e o direito internacional privado. Levou-se em conta o direito internacional privado convencional existente, mas ainda não ratificado pelo Estado brasileiro, indicando a eventual pertinência no que respeita a urna futura ratificação. A existência de uma série de convenções internacionais sobre o tema ainda não ratificadas pelo Brasil exigiu uma análise da questão não apenas do ponto de vista do direito interno, mas também, e principalmente, relativa à regulamentação sugerida pela sociedade internacional. O objetivo maior foi dar tratamento sistemático à matéria e indicar ao legislador nacional e ao Poder Executivo - dotado de competência para representar o país nas relações internacionais - um caminho que pode ser seguido pelo Estado brasileiro no que concerne à ratificação ou não dos tratados internacionais existentes sobre o assunto. A falta de estudos sistemáticos no Brasil a respeito do tema tem o condão de justificar a escolha empreendida, indicando a sua importância e sua originalidade, mormente quando se pretende indicar aos órgãos competentes as vantagens e/ou desvantagens que o sistema é capaz de proporcionar, seja na eleição do elemento de conexão posto em relevo para a escolha da lei aplicável à hipótese, seja nos aspectos procedimentais e de cooperação internacional envolvidos. O trabalho, em razão dos preceitos legislativos abrangidos, exigiu fossem seguidas duas metodologias distintas: uma de raiz e cunho dogmáticos a respeito dos institutos jurídicos conexos à questão e outra, de raiz e cunho comparativos a respeito da colação entre os sistemas existentes, qual seja, o sistema vigente no país e o sistema indicado pela sociedade internacional como o mais adequado para regular a questão. O método comparativo não se confunde com a mera descrição dos ordenamentos jurídicos (nacional e internacional), exigindo, isso sim, a análise de cada um dos fatores considerados relevantes em ambos os ordenamentos, procedendo-se a quadros comparativos que permitam ao intérprete atingir qual o sistema legislativo mais adequado para a hipótese. Não é recomendável, na aplicação de tal método, a análise de muitos ordenamentos jurídicos, daí por que a limitação do trabalho. Assim, não se perverte o método, conservando-se a cientificidade que o trabalho visou realizar. / The present thesis concerns the analysis of hypotheses on attributing the custody of children to people who, for some reason, live separately, undoing the possible family bond existing between them. As this fact is cannot undo the bonds between each of the parents and their children, the attribution of custody to one or to both parents (simple, alternate or shared custody) becomes imperious. The analysis of the matter takes into consideration the cases with a foreign element, that is, with a factor that may disentail the phatic case from its exclusive subsunction to the national legal system, potentially linking it to another legal system, be it for the fact of one of the parents being a foreign citizen or domiciled in a foreign country, be it for the child being a foreigner, or, still, for one of the parents manifesting the intention of living abroad, even if all the elements existing until then indicate exclusive connection with the Brazilian legal system. Besides the attribution of custody, other consequences may derive from this phatic relationship, such as the maintenance or not of the family power, the regulation of visit rights, the stipulation of the fee, etc. It turns thus necessary to decide what law is applicable to regulate the matter, as well as their immediate consequences, that is, the regulation of the visit regime for the parent removed from the daily coexistence with the children, besides the establishment of the necessary sum for the childrens subsistence, by means of the alimony they are entitled to. The study considers the full family coexistence right, while a major principle and ruler of the matter. The theme thus involves a number of legal institutions, in a final analysis, linked to children protection in their private (family) relationships, either of eminently personal ambit, or, conversely, of patrimonial ambit, thus comprehending human rights and private international law. The work took into consideration conventional existing private international law, not yet ratified by Brazil, indicating the possible pertinence concerning a future ratification. The existence of a number of international conventions on the theme, not yet ratified by Brazil, required an analysis of the matter, not only from the point of view of domestic right, but also - and mainly - related to the regulation suggested by international society. The major purpose was to provide a systematic treatment to the matter and to indicate to the national lawmaker and to the Executive Power endowed with competence to represent Brazil in international affairs a path that may be followed by Brazil concerning the ratification or not of the existing international treaties on the matter. The lack of systematic studies on the theme in Brazil have the prerogative of justifying the choice undertaken, indicating its importance and originality, specially when intending to indicate to the competent organisms the advantages and/or disadvantages the system is capable of providing, be it in the choice of the connecting factor detached for choosing the law applicable to the hypothesis, be it in the procedural and international cooperation aspects involved. The work, owing to the legislative rules encompassed, required two distinct methodologies to be followed: one of dogmatic root and character with respect to the legal institutions connected to the matter and another, of comparative root and character with respect to the collation of the existing systems, which is the system in force in Brazil and the system indicated by the international society as the most adequate to regulate the matter. The comparative method is not to be confounded with the mere description of (national and international) law systems, but one requiring the analysis of each of the factors considered relevant in both systems, referring to comparative tables that allow the interpreter to decide on the most adequate legal system for the hypothesis. In the application of the method, the analysis of different legal systems is not advisable, hence the limitation of the work. Therefore, the method is not perverted, preserving the scientificity aimed at by the work.

Considéré depuis des siècles comme un sujet dénué de réflexion et d’autonomie, l’enfant comorien reste soumis à une protection spécifique communautaire. Celle-ci est complétée par une protection étatique inspirée des instruments juridiques relatifs aux droits fondamentaux de l’enfant qui la renforcent d’une manière constante. L’enfant comorien grandit dans une société multiculturelle, marquée par la pauvreté. La protection dont il bénéficie s’appuie à la fois sur les traditions éducatives propres aux Comores, et sur la modernité, représentée par les apports juridiques liés à la colonisation et à la ratification de textes internationaux. Notre thèse se propose d’analyser les droits de l’enfant comorien dans un contexte complexe, caractérisé par la pluralité des sources juridiques. De ce fait, nous avons choisi deux angles d’approche : d’une part, nous avons essayé d’analyser les droits de l’enfant en fonction de l’organisation de la société comorienne et des balises de la protection de l’enfant sur le plan de la juristique, de l’histoire du droit, de l’anthropologie, de la sociologie et de l’ethnologie. Ceci nous a également permis de réfléchir à la protection de l’enfant tout en tenant compte des deux systèmes (formel et informel). D’autre part, nous avons tenté d’analyser l’application de la CIDE dans une société multiculturelle dominée par l’oralité. Ont également été analysés les textes internes et internationaux, les acteurs de la protection de l’enfance et leurs failles. Cette étude prétend amener l’Etat et la société civile à réfléchir à un modèle optimal de protection qui mettrait en conformité le droit positif avec les conventions dûment ratifiées, tout en tenant compte des réalités du pays . Une telle hypothèse nous a conduite à proposer un réaménagement du droit positif en matière de droit de l’enfant afin de parvenir à une réforme tant législative que judiciaire et en conformité avec le droit international. / Regarded for centuries as a subject devoid of any reflection, Comorian children are protected by a specific type of community protection. This is complemented by protection from the state which, inspired by the legal instruments relating to fundamental rights of the child, reinforces this community protection in a consistent manner. Comorian children grow up in a multicultural society, marked by poverty. The protection offered to these children is based on both the Comoros’ own educational traditions, and on modernity, represented by legal contributions related to settlement and ratification of international agreements. Our thesis analyzes the rights of Comorian children in a complex environment, characterized by a plurality of legal sources. Therefore, we chose two angles of approach. Firstly, we analyzed children’s rights based on the organization of the Comorian society and the markers of child protection in terms of legal sociology, history, law, anthropology, sociology, and ethnology. This also allowed us to reflect on the protection of children taking into account both formal and informal systems. Secondly, we analyzed the implementation of the CRC in a multicultural society dominated by the spoken word. We also analyzed domestic and international texts; actor’s involved in child protection, and their flaws. This study aims to have the state and civil society reflect on an optimal model for protecting children that would comply with ratified conventions, all while taking into account the realities of the country. This hypothesis led us to propose a reform of the law regarding children’s rights to achieve both legislative and judicial reform, all in accordance with international law.

The main theme of the work is finding an answer to the question why in the past years Czech Parliament has failed to enforce measures improving the quality of life of lone-parent families, and what could be done for these measures to be adopted. Theoretical support for answering both questions is provided by a) frame analysis (Schőn and Rein), which works with the idea of conflicting frames and bridging conflicts through reframing, and b) the theory of social construction of target groups (Schneider and Ingram). Based on an analysis of stenographic minutes from proceedings dealing with the issue of non-payment of child support (in particular with proposals for the state to pay child support first and then to receive it from the obligor) and the arrangements connected to child custody (in particular the proposal to strengthen alternating custody), conflicting frames are reconstructed (in the case of non-payment, there are three conflicting frames, in the case of child custody two). These conflicting frames, or rather the fact that they are insufficiently addressed, may be the cause of the incapacity of Czech political representation to address the above agenda. An "efficient penalizing of the debtor" is described as a possible reframing of the problem in the field of non-payment of child support....

The movement of people from county to country brought about an increase in international marriages. However, South African private international law rules with regard to the proprietary consequences of marriage are not on par with their foreign counterparts. The prejudicial rule which governs proprietary consequences of marriage has raised difficulties for our courts in past and recent cases. The advent of a new constitutional dispensation in South Africa forbids discrimination based on sex, gender and marital status. Furthermore, the question is asked whether parties to a marriage with a foreign matrimonial domicile may rely on section 7(3) of the Divorce Act 70 of 1979. The classification of redistribution orders in private international law matters has given rise to uncertainty.
The objectives of the study are to suggest workable alternatives to the current connecting factor for proprietary consequences of marriage in South African private international law and to investigate the availability of redistribution orders to spouses applying for divorce in South Africa. / Private Law / LL. Les règles de droit international privé applicables aux obligations alimentaires présentent trois caractéristiques principales. Primo, elles sont de source principalement internationale. Outre quelques règles de droit commun subsistantes, elles proviennent de six conventions de La Haye, d’un règlement européen, d’une convention adoptée sous l’égide des Nations-Unies et de conventions bilatérales et multilatérales. Secundo, elles s’insèrent au sein du mouvement contemporain de spécialisation de la discipline, ce qui implique un démantèlement des grandes catégories juridiques composant le statut personnel. Tertio, au carrefour de plusieurs intérêts, elles sont d’une particulière complexité. L’étude des obligations alimentaires à caractère international nous permet alors dedresser un bilan critique du droit international privé contemporain de la famille produit de manière désorganisée par la Conférence de La Haye et l’Union européenne. Bien évidemment, l’internationalisation des sources a permis des avancées certaines des méthodes du droit international privé. Parallèlement, elle a profondémentmétamorphosé la discipline en l’orientant vers la satisfaction d’intérêts politiques propres aux producteurs de normes au détriment de ses objectifs traditionnels. Prenant acte de ces observations, nous proposons un renouvellement du mode de production normative. L’amélioration des règles critiquables passe forcément par une réorganisation des rôles de l’État, de l’Union européenne et de la Conférence de La Haye dans l’élaboration du droit international privé. / The rules of Private International Law which could be applied to the maintenance obligations have three main characteristics. First of all, they are mainly from an International source. Some of the rules of International Law come from six Hague Conventions, an European regulation, a convention adopted under the United Nations’auspices, bilateral and multilateral conventions. Secondly, they take part in the discipline specialization through the contemporary movement which conclude the abolition of the main legal categories making up the personal status. Thirdly, they have a particular complexity being at the crossroad of several interests. The study of the maintenance obligations at an international scale allows us to critically asses the contemporary private international family law produced in the disorganized manner by the Hague Conference and the European Union. To be clarify it more, the internationalization of its sources allowed clear advance in the private international law methods. At the same time, it has changed the discipline fundamentally by focusing on the satisfaction of the norm setters’ political interests at the expense of its traditional goal. Taking note of these observations, we propose a renewal of the norms’ production method. Indeed, the questionable rules necessarily improve through the reorganization of the roles of the state, the European Union and the Hague Conference in the development of the private international law.

The legal regime governing the economic situation of married women in Iran : a dialogical view from QuebecZeynodini, Fateme 01 1900 (has links)
Family is the basic unit of society, and is grounded upon social, legal, religious and economic constructs. Depending on cultures and societies, and the often differential treatment they apply to men and women, entering into marriage may deteriorate women’s economic situation. The gender-based division of labor within family, which disproportionally burden women, notably through childcare responsibilities, causes a substantial decline in women’s income and interrupts their education and employment. This makes it difficult for women to have a career for themselves after a separation or divorce. Therefore, there is a general belief that legal principles and laws governing the marital relationship and property rights should be structured to protect women’s economic interests.
To establish an equitable economic framework between spouses, the Convention on the Elimination of All Forms of Discrimination against Women (CEDAW) opts for an egalitarian regime which asks for equal rights and responsibilities for both men and women, during and after the marriage. It rules in favor of a partial community of property between spouses according to which all economic advantages and disadvantages arising from a marriage and its dissolution should be borne equally by both parties.
However, legal regimes differ in outlining the method of contribution each spouse must commit to the household, financial maintenance, and the division of property after a separation or divorce. Some legal regimes, following the CEDAW, emphasize formal equality and grant similar rights and responsibilities to both parties, while establishing a partial community of property. Another group of legal regimes establish the separation of property as the guiding principle for marital economic relationships, wherein the expenses should be borne by men as the heads of the household, whereas women should be compensated for their unpaid contributions to the household.
As a country with a Sharia-based Civil law system and a specific cultural background, Iran has its own special matrimonial regime and does not follow the CEDAW’s approach to women and men’s rights and responsibilities. Iran’s matrimonial regime bases itself on Sharia’s approach to men and women, and is anchored in Iranian culture. This accounts for a legal matrimonial system that is different from laws existing in Western countries. Under this system, the husband and wife have different economic responsibilities.
This thesis examines Iran’s matrimonial regime and compares it to the Quebec matrimonial regime. While Quebec family law espouses a contributory approach for both spouses in marital life, all economic institutions under Iranian family law are designed to enforce a compensatory approach toward the spouses’ economic relation. The compensatory approach of Iranian law to the financial aspects of marital life causes some difficulty for the wife, which is exacerbated at the time of the termination of the marriage. Such a comparative study hopes to bring some novel suggestions aiming at correcting certain deficiencies in the current Iranian matrimonial regime.
Besides assessing the issues with Iran’s marital regime, this research seeks to propose legal solutions for enhancing the economic rights of women. A holistic approach will therefore be adopted, which will lead us to take into consideration certain cultural and religious specificities which have become mandatory rights in Iran. The reform proposals put forward in this thesis will thus seek to respond to Iran’s current social context.
This study will examine women’s economic situations in marriage, separation, divorce and upon the death of their spouse. It will argue that the cultural specificities of Iranian society and Islamic law must be examined and assessed. It will also analyze women’s economic situation in marital relationships in Iran and Quebec. The study of these two different civil law jurisdictions will focus on the principle of equality and examine related arguments and ideologies regarding women’s rights and responsibilities. / La famille est l'unité de base de la société et est fondée sur des constructions sociales, juridiques, religieuses et économiques. En fonction des cultures et des sociétés et du traitement souvent différencié qu’ils appliquent aux hommes et aux femmes, le mariage peut détériorer la situation économique des femmes. La division du travail fondée sur le sexe au sein de la famille, qui pèse de manière disproportionnée sur les femmes, notamment en raison de leurs responsabilités en matière de garde d'enfants, entraîne une baisse substantielle du revenu des femmes et interrompt leur éducation et leur emploi. Cela rend difficile pour les femmes d'avoir une carrière pour elles-mêmes après une séparation ou un divorce. Par conséquent, il est généralement admis que les principes juridiques et les lois régissant la relation conjugale et les droits de propriété devraient être structurés de manière à protéger les intérêts économiques des femmes.
Pour établir un cadre économique équitable entre les époux, la Convention sur l'élimination de toutes les formes de discrimination à l'égard des femmes (CEDAW) opte pour un régime égalitaire qui exige l'égalité des droits et des responsabilités pour les hommes et les femmes, pendant et après le mariage. Elle se prononce en faveur d'une communauté partielle de biens entre époux selon laquelle tous les avantages et inconvénients économiques résultant d'un mariage et de sa dissolution devraient être assumés également par les deux parties.
Cependant, les régimes juridiques diffèrent en définissant le mode de contribution que chaque conjoint doit engager pour le ménage, l'entretien financier et le partage des biens après une séparation ou un divorce. Certains régimes juridiques, à la suite de la CEDAW, mettent l'accent sur l'égalité formelle et accordent des droits et des responsabilités similaires aux deux parties, tout en établissant une communauté partielle de biens. Un autre groupe de régimes juridiques établit la séparation des biens comme principe directeur des relations économiques conjugales, où les dépenses devraient être supportées par les hommes en tant que chefs de famille, tandis que les femmes devraient être indemnisées pour leurs contributions impayées au ménage.
En tant que pays doté d'un système de droit civil fondé sur la charia et ayant une culture particulière, l'Iran a son propre régime matrimonial spécial et ne suit pas l'approche de la CEDAW concernant les droits et les responsabilités des femmes et des hommes. Le régime matrimonial Iranien se fonde sur l'approche de la charia à l'égard des hommes et des femmes et est ancré dans la culture Iranienne. Cela explique un système matrimonial légal différent des lois existant dans les pays occidentaux. Dans ce système, le mari et la femme ont des responsabilités économiques différentes.
Cette thèse examine le régime matrimonial de l’Iran et le compare au régime matrimonial du Québec. Alors que le droit de la famille du Québec adopte une approche contributive pour les deux conjoints dans la vie conjugale, toutes les institutions économiques en vertu du droit de la famille Iranien sont conçues pour appliquer une approche compensatoire à l'égard de la relation économique des conjoints. L'approche compensatoire de la loi Iranienne concernant les aspects financiers de la vie conjugale cause certaines difficultés à l'épouse, qui sont exacerbées au moment de la fin du mariage. Une telle étude comparative espère apporter de nouvelles suggestions visant à corriger certaines lacunes du régime matrimonial Iranien actuel.
Outre l’évaluation des problèmes liés au régime matrimonial de l’Iran, cette recherche cherche à proposer des solutions juridiques pour améliorer les droits économiques des femmes. Une approche holistique sera donc adoptée, ce qui nous amènera à prendre en considération certaines spécificités culturelles et religieuses devenues des droits obligatoires en Iran. Les propositions de réforme présentées dans cette thèse chercheront donc à répondre au contexte social actuel de l’Iran.
Cette étude examinera la situation économique des femmes dans le mariage, la séparation, le divorce et le décès de leur conjoint. Il soutiendra que les spécificités culturelles de la société Iranienne et du droit Islamique doivent être examinées et évaluées. Il analysera également la situation économique des femmes dans les relations conjugales en Iran et au Québec. L’étude de ces deux juridictions de droit civil se concentrera sur le principe de l’égalité et examinera les arguments et les idéologies connexes concernant les droits et les responsabilités des femmes.

Les évolutions sociétales - émancipation de la femme, maîtrise de la fécondité, acceptation del’homosexualité, multiplication des formes de conjugalité, nouveaux modèles familiaux, médicalisation de laprocréation - ont bouleversé le rapport entre maternité de fait et maternité juridique.La femme qui revendique le statut de mère n’est plus nécessairement celle qui a porté et mis au mondel’enfant. Les techniques d’assistance médicale à la procréation ont ouvert le champ des possibles enpermettant à la femme de réaliser son désir d’enfant, indépendamment des contraintes temporelles oubiologiques. Pourtant, la mère gestationnelle apparaît, aujourd’hui encore, comme la figure certaine de lamaternité. Elle a vu ses droits accrus par un mouvement d’harmonisation du droit de la filiation, jusqu’àdevenir l’égale de l’homme. Elle a cessé d’être identifiée par son statut conjugal, et est désormais définie parréférence au fait biologique maternel de l’accouchement. L’enfantement marque alors la singularité de lamaternité en tant que figure de rattachement, car elle est le seul vecteur d’identification spatio-temporelle del’enfant. Un ordre public fort en la matière est donc de rigueur : l’accouchement, qui détermine l’état civil del’enfant, ne devrait pas pouvoir être dissimulé. En revanche, la fonction maternelle de parenté devraitdavantage être soumise à la volonté de la femme qui se revendique mère. A strong public policy is therefore required in this area: giving birth should not be concealable,since it determines the child’s status in law. On the other hand, the maternal parenting role should dependmore on the will of the woman who claims the title of mother. The gestation mother, who should always beable to ascertain the filiation, should also be able to refuse such filiation, in favour of another mother figurenot as firmly ascertained, since her status is dependent on the will to be the mother, a will possiblycorroborated by filiation.
