Abbatial elections : the case of the Loire Valley in the eleventh centuryHowie, Catriona V. January 2015 (has links)
This thesis examines a series of documents described as electoral charters, produced in monastic institutions of the Loire Valley from the late tenth to late eleventh centuries. By considering the variations in the formulas used for each charter, the study considers what the charters were saying about power or wanted to project about the powers at play in the events they described. Through this, the thesis demonstrates that the power of lordship projected by such documents was of a very traditional nature throughout the period in which they were being produced. The count's role on each occasion showed him to be a dominant force with a power of lordship composed of possession and rights of property ownership, but also intangible elements, including a sacral interest. By considering the context of events surrounding each charter of election, the thesis demonstrates that elements of this lordship could be more or less projected at different times in order that different statements might be made about the count. Thus, the symbolic expressions of power appear to have been bigger elements or more strongly emphasised in periods when the count's political or military power was under pressure. The differences in formulas used throughout the period of the charters' production demonstrate that, despite the appearance of new elements that may appear to have been important novelties, these processes were likely to have been original to proceedings, and therefore the notions of a reform of investitures taking place in the mid-eleventh century must be nuanced. Instead of demonstrating a mutation in relationships between lord and Church, the documents demonstrate an alteration in style and content, becoming more narrative and verbose and in these ways revealing elements of the process of abbatial elevations that had previously been hidden from view.

Les réclamations pour dommages punitifs en vertu de la Charte des droits et libertés de
la personne se multiplient depuis plusieurs années devant les tribunaux. Pour être accueillie,
cette réclamation implique la démonstration d’une atteinte illicite et intentionnelle à un droit
ou une liberté protégé par cette charte. Les recours en responsabilité peuvent faire l’objet
d’une couverture d’assurance. Or, le Code civil du Québec prévoit spécifiquement que
l’assureur n’est pas tenu de couvrir la faute intentionnelle de l’assuré. Est-ce à dire que
l’assureur n’a pas d’obligation envers son assuré lorsque des dommages punitifs sont
réclamés? Il s’agit donc de déterminer si le concept de faute intentionnelle et celui d’atteinte
illicite et intentionnelle sont des concepts qui s’équivalent ou qu’il est nécessaire de distinguer.
Pour cette analyse, ces deux concepts seront abordés en profondeur. Il sera question de
l’origine de ces deux notions, de leurs fondements et de leur interprétation pour finalement
définir ces termes le plus précisément possible. Ces définitions permettront d’opposer ces
deux notions et de déterminer au final qu’il existe plusieurs éléments qui différencient ces
concepts, notamment à l’égard de l’intention requise, faisant en sorte qu’ils ne peuvent être
assimilés.
Cette conclusion aura un impact certain sur les obligations de l’assureur de défendre
l’assuré et d’indemniser la victime pour ses dommages compensatoires lorsqu’il existe une
réclamation en dommages punitifs et, par conséquent, l’assureur ne pourra faire reposer son
refus de défendre ou d’indemniser sur la seule base de la preuve d’une atteinte illicite et
intentionnelle. / Claims for punitive damages have proliferated over the years before the courts. For
such claim to be granted, it is required to demonstrate an unlawful and intentional interference
with any right or freedom protected by the Charter of Human Rights and Freedoms. Liability
claims can be covered by insurance. However, the Civil Code of Québec specifically provides
that the insurer is never bound to indemnify the insured’s intentional fault. Does this mean that
the insurer has no obligation towards its insured when punitive damages are sought? The
question is thus whether the concept of intentional fault and of unlawful and intentional
interference are concepts that are equivalent or that need to be distinguished.
For this analysis, the two concepts will be adressed in depth. The origin of these two
concepts, their founding principles and their interpretation will be discussed to ultimately
define these terms as precisely as possible. These definitions will then help to compare these
two concepts and determine in the end that there are several elements that differentiate these
concepts, particularly in regard to the required intent, with the result that they can not be
assimilated.
This conclusion will have a definite impact on the insurer’s obligations to defend the
insured and to indemnify the victim for compensatory damages if punitive damages are also
sought. Therefore, the insurer cannot justify its refusal to defend or indemnify solely on the
basis of the evidence of an unlawful and intentional interference.

The purpose of the thesis is to analyze the concept of the freedom of artistic creation and expression in the European Union law, in particular its recognition in primary law, above all in the Charter of Fundamental Rights of the European Union (Charter), and in the case law of the Court of Justice of the European Union (CJEU). Considering that interpretation of human rights and fundamental freedoms in the EU law is greatly based on constitutional traditions of EU member states and on the approach to these rights established within the Council of Europe, this thesis also deals with the conception of the freedom of artistic expression in constitutions of EU member states and in the European Convention for the Protection of Human Rights and Fundamental Freedoms (ECHR), as interpreted by the European Court of Human Rights (ECtHR). While relevant case law of the CJEU is only fragmentary, it refers systematically to the extensive case law of the ECtHR, which provides comprehensive theory of the freedom of artistic expression in Europe and provides for studying the evolution of the conception in time. Les deux dernières décennies du XIXe siècle amorcent l’essor rapide de la banlieue parisienne et le déploiement de l’Ecole d’Etat. Les lois Paul Bert, Ferry et Goblet fondent l’Ecole républicaine laïque et organisent un enseignement féminin public. Dans le sud-est parisien, urbanisation et scolarisation se développent conjointement. L’étude de l’enseignement féminin, tant à travers ses élèves que ses enseignantes, jusqu’à la mise en place de la mixité à la fin des années 1950, révèle alors l’élaboration des modèles éducatifs et des représentations du genre en banlieue. Elle souligne le rôle de l’Ecole dans la codification du rôle social des femmes et de la place qui leur est attribuée dans l’espace de la cité. Elle offre aussi une grille de lecture renouvelée des rapports entre la capitale et ses banlieues, car la différenciation de ces dernières se fonde sur un territoire ressenti aussi bien que construit et sur un imaginaire de l’espace urbain. A travers les représentations qu’il véhicule, l’enseignement féminin souligne la pluralité sociologique du sud-est parisien et ses mutations sociodémographiques. L’évolution des structures et de l’offre scolaire, les attentes des notables et des familles en font le révélateur des différents pouvoirs et acteurs qui structurent cet espace : initiatives et concurrences locales, divergences entre le local et les logiques d’unification départementale ou nationale. L’Ecole concentre les inégalités qui se développent entre Paris et sa banlieue, entre les banlieues. Cette histoire des femmes, de l’Ecole et des banlieues s’articule autour de trois périodes clefs: le tournant du XXe siècle et la politique de laïcisation, l’Entre-deux-guerres et une concurrence scolaire accrue entre les sexes, entre Paris et ses banlieues, les années 1950 lorsque la politique scolaire s’affirme comme un facteur de hiérarchisation urbaine. Entre pouvoirs et société civile, l’enseignement féminin apparaît comme un vecteur fondamental de l’organisation des banlieues sud-est, et de l’affirmation d’une identité banlieusarde. / In the last two decades of the 19th century came the fast development of Parisian suburbs and the beginnings of the state school system. Laws bearing the names of Paul Bert, Ferry and Goblet were the foundation of a republican, secular educational system, as well as they designed public education for women. In the south-west of Paris, urbanism and education followed a joint development. A study of female education through learners and teachers until the implementation of coeducation in the late 1950s reveals the evolution of educational models and gender representation in suburban areas. It highlights the part played by schools in the systematization of the social role of women and the place attributed to them within the city; it also allows for a better understanding of the relationship between the capital and its suburbs, the latter differentiated in the way they are experienced not less than in the way they are planned and built, as well as through representations of the urban space. With the representations it promotes, female education highlights the social diversity of the Parisian south-west, and its socio-demographical mutations. Through the evolution of school structures and educational offer, expectations from parents and the elite, it becomes an indicator of the powers and agents at play there – local competitions and initiatives, discrepancies between local efforts and regional or national policies. The school system focuses the inequalities between Paris and its suburbs, and from one suburb to another. This history of women, education and suburbs addresses three distinct eras : the turn of the 20th century and the beginnings of the secularization of the school system, the Interwar period and the growing competition between genders and between Paris and its suburbs, and the 1950s, when educational policies openly factors in urban hierarchical organization. Between political powers and civil society, female education appears as an essential vehicle for the organization of the south-east suburbs, and the creation of a suburban identity.

An assessment of the progress made in the broadening of access to finance to low-income earners (1994-2007)07 June 2012 (has links)
M.Comm. / The purpose of this dissertation is to assess the progress that has been made in the provision of housing finance to low-income earners. In 1994, housing affordability was constrained, as around 86% of households earned below R3 500. The focus, therefore, is on the role played by both government and the four major banks in broadening access to housing finance for these households and also those who earn less than R7 500. Frameworks that brought about certain initiatives aimed at addressing this problem are explored. On the side of government, the housing subsidy scheme and the role played by the government housing finance institutions (i.e. the National Housing Finance Corporation and the Rural Housing Loan Fund) are explored. On the banking sector side, the provisioning of housing finance prior to and after the implementation of the Financial Sector Charter (FSC) in 2004 is investigated. The dissertation concludes by looking the challenges that exist in the low-cost housing finance environment. The paper notes that, although some considerable progress has been made in the broadening of access to housing finance, there is a huge gap between the number of subsidies approved and the number of households that have benefited from the government subsidy scheme, possibly resulting from, among other things, capacity constraints at local government level. In respect of the banking sector, data analysed shows that bank involvement in the low-income market was very minimal before the implementation of the FSC. However, as much as some progress has been made, there are some serious challenges in this market that could have possibly prevented the role players from extending this access to the rest of the target group.

Cette étude porte sur la question de l’efficacité de la convention d’arbitrage à l’égard des opérateurs du transport maritime de marchandises. Dans un premier temps, la question qui se pose est celle de la détermination du droit applicable à l’efficacité de ladite clause. A cet égard, notre attention se concentre sur l’interprétation et l’application des principes propres à l’arbitrage international par la jurisprudence maritime. L’examen des clauses d’arbitrage insérées dans un contrat de transport maritime ne saurait échapper aux spécificités du droit de transport maritime ainsi qu’aux dispositions des conventions maritimes internationales. Par ailleurs, l’approche du sujet par la méthode comparative nous permettra de découvrir, à travers les solutions concrètes finalement retenues dans les trois systèmes juridiques en question, que l’effet juridique de la clause compromissoire est directement lié à l a position contractuelle de ces opérateurs. Parmi les personnes impliquées dans le transport maritime, le destinataire des marchandises nous intéresse plus particulièrement. Ce dernier n’étant pas présent, en effet, au moment de la formation du contrat, les conditions de son engagement par une clause compromissoire insérée, presque toujours « par référence » dans le titre de transport, font l’objet d’un vif débat doctrinal et jurisprudentiel. / This study is primarily focused on the enforceability of arbitration agreements incorporated in contracts of carriage of goods by sea. First, we will cover the important issue of determining the law applicable to these arbitration agreements. Special attention will be given to how courts tend to implement general international arbitration principles to maritime disputes. An arbitration agreement incorporated in acontract of carriage of goods by sea should also be analyzed in light of the specificities of maritime transport law and applicable international shipping conventions. Moreover, the comparative methodology used herein will show that the enforceability of arbitration agreements is closely related to the qualification of the operators involved in the contract. In particular, among the commercial players involved in the carriage of the goods, we sought to examine the legal position of the consignee of the goods. Indeed, since the consignee is absent at the moment of the contract formation, the binding effect there upon of the arbitration agreement, which is generally incorporated “by reference” to the bill of lading, is highly debated by scholars and judges.

C’est par un regard systémique que sont abordés dans cette étude les rapports entre les ordres juridiques européens, Union européenne et Conseil de l’Europe, et les ordres juridiques nationaux sur le terrain spécifique de la protection des droits fondamentaux. L’ensemble des interactions a atteint un degré de sophistication tel qu’il est devenu difficile d’organiser leur analyse. L’approche par l’identification d’un système européen de protection des droits fondamentaux permet de dégager des règles, qui se présentent comme des effets de ce systèmes pour les ordres juridiques précités. Ainsi, la présomption de protection équivalente entre les droits fondamentaux est envisagée comme un élément déclencheur, formalisant les interactions entre les ordres juridiques dans un système. Celui-ci fonctionne grâce aux principes de subsidiarité, de proportionnalité et de sécurité juridique. Ces trois principes sont les règles du système, révélées par le regard englobant du système. Dans l’ensemble, il apparaît que l’adhésion de l’Union européenne à la Convention européenne des droits de l’homme serait pertinente mais ne représente pas une étape indispensable. En revanche, il serait souhaitable d’avancer vers une harmonisation matérielle plus poussée, qui pourrait être réalisée par les juges européens. Il suffirait d’élaborer des notions européennes communes et des obligations positives identiques à la charge des États, afin d’assurer une protection effective des droits fondamentaux. / The relationship between the two european legal order, the European Union and the Council of Europe, and national legal orders is analysed through a systemic vision, on the specific field of protection of Fundamental rights. Their relation has become so intense that it is hard to organise a study about them. That is why the systemic approach helps consider those relations as a whole. The first step, that shifts the interaction between the legal orders mentioned into a system is the presumption of equivalent protection. Follows the discovery of the rules of the system, that are also an effect of this system. More precisly, the rules are the principle of subsidiarity, proportionality and legal certainty. It appears that there is no need for the European Union to acceed to the European Convention of Human Rights, even if it would make the legal relation easier. However, it could be useful for the effectiveness of Fundamental Rights to deepen the substantial harmonisation between the european legal orders through the identification by the judges of european autonomous concept and common positive human rights obligations.

Shaping the Climate Action trajectory within the Fashion Industry : a case study of a Small Medium Sized EnterpriseKristjónsdóttir, Marta Karen January 2019 (has links)
The apparel and footwear industry’s contribution to global greenhouse gas (GHG) emissions is one of the fifth largest per industry, equal to that of livestock, after electricity and heat, oil and gas, agriculture, and transportation (Ellen MacArthur Foundation, 2017). For industry-wide emissions reduction, investing in renewable energy and energy efficiency programs across highest impacting life cycle phases offer the most effective solution. However, identifying the highest impacting life cycles phases shows varied results depending on the particular type of business model under examination. This paper responds to the lack of existing data and empirical research on how to accurately measure, report and reduce carbon emissions across the highly complex and globally interconnected apparel value chain. This is done through a single case study investigation of an Icelandic fashion brand. A hybrid approach of a standard Life Cycle Assessment (LCA) and the Sustainable Global Value Chain (SGVC) functions to produce a Hotspot Identification Tool (HIT) to establish a holistic portrayal of business operations in relation to emission impacts and level of controllability across Scopes. The conceptual analysis and qualitative results identify the most relevant emission hotspots to lie within the company’s privately owned manufacturing facilities, as well as the procurement phase, due to its direct connection with and influence on material production, user phase, and end-of-life. The main obstacle in this pursuit is identified as restriction of resources in terms of time, capital and expertise. It is suggested that this be overcome by joining a Multi-Stakeholder Initiative where resources and expertise is pooled in a pre-competitive manner to reach common objectives. The investigation further suggests a need for global fashion brands to leverage their influential position on down- and upstream activities across the value chain, i.e. with their supply chain partners and consumers. I argue that fashion brands play an integral role in supporting local efforts to build a decarbonisation pathway towards climate neutral economies on a global scale.

La régionalisation des droits de l'homme a permis l'adoption de plusieurs instruments juridiques visant à assurer la protection des droits de l'homme. Dans cette optique, l'Afrique s'est dotée en 1981 d'une Charte africaine des droits de l'homme et des peuples. Les rédacteurs de la Charte africaine ont voulu adopter un texte qui tienne compte des spécificités et diversités culturelles du continent. Ainsi à côté des droits de première, deuxième et troisième génération, la Charte africaine consacre les droits des peuples et proclame des devoirs. Le volet institutionnel de la protection des droits de l'homme en Afrique a pris tout son sens avec la création de la Cour africaine des droits de l’homme et des peuples. Toutefois, il faut souligner le rôle important qu’a joué et continue à jouer la Commission africaine des droits de l’homme et des peuples, organe non juridictionnel, certes, mais qui œuvre pour la promotion des droits de l’homme en Afrique. La place accordée aux droits de l’homme dans les constitutions des États africains est révélatrice de l’intérêt particulier accordé à ces droits. / The decentralization of human rights has favoured the setting up of a number of legal instruments more properly equipped to insure the protection of human rights. With this in view, in 1981 Africa drafted the African Charter of Human and People’s Rights. The authors of the African Charter were anxious to provide a legislation that would take into account the specificities and cultural diversity of their continent. In this way, alongside the rights of first, second and third generations, the African Charter enshrines the rights of her peoples and proclaims their duties. The institutional side of the protection of human rights in African has taken on its full significance with the creation of the African Court of Human and People’s Rights. However, even if the organization has no legal power, we should not underestimate the importance of the role played in its defence of Human rights in Africa by the African Commission of Human and People’s rights. The pride of place given to human rights in the constitutions of African States shows how they prioritize these rights.
