Alors que la protection effective des droits et libertés est souvent conçue comme dépendante de leur garantie juridictionnelle, cette dernière implique une transformation de l'équilibre qui s'établit entre le juge, non élu, et le législateur, représentant du peuple souverain. À travers une analyse pratique des effets du travail juridictionnel sur l'activité législative, tels qu'ils se sont déployés aux États-Unis, au Canada et au Royaume-Uni sur les quinze dernières années, il est possible d'évaluer les conséquences de la consécration de certains droits dans un catalogue opposable par le juge au législateur, en matière d'équilibre entre les pouvoirs législatif et juridictionnel. Si ces trois systèmes, aux traditions constitutionnelles éloignées, disposent chacun de mécanismes spécifiques pour assurer le respect des droits consacrés, plusieurs points de convergence peuvent être mis en lumière. Leur étude sera alors l'occasion d'appréhender dans une perspective renouvelée l'équilibre qui s'établit entre les deux institutions. Elle fera progressivement apparaitre l'idée d'une véritable collaboration du législateur et du juge en matière de protection des droits et libertés dans les démocraties contemporaines / Effective human rights protection is often perceived as being dependent upon their judicial enforcement. However, such a mechanism transforms the relationship between unelected judges and electorally accountable legislators. Through an empirical analysis of the effects of judicial review on legislation and legislative decision-making, in the United States, Canada and the United Kingdom, during the last fifteen years, the actual impact of the entrenchment of human rights in a written bill of rights will be assessed and evaluated. Even though these three countries have different processes to guarantee the respect of entrenched rights, and despite their long-settled and contrasting traditions, their systems are not as conflicting as it is often thought. This study finally leads to a better understanding of the relationship between judges and legislators in contemporary democracies and underlines the idea of a genuine collaboration of powers

A Relationship Between the Florida Comprehensive Assessment Test 2.0 Mathematics Scores and Racial and Ethnic Concentrations when Considering Socio-Economic Status, ESOL Student Population

From the moment children are born, they begin a lifetime journey of learning about themselves and their surroundings. With the establishment of the No Child Left Behind Act of 2001, it mandates that all children receive a high-quality education in a positive school climate. Regardless of the school the child attends or the neighborhood in which the child lives, proper and quality education and resources must be provided and made available in order for the child to be academically successful. The purpose of this ex post facto study was to investigate the relationship between the FCAT 2.0 mathematics scores of public middle school students in Miami-Dade County, Florida and the concentrations of a school’s racial and ethnic make-up (Whites, Blacks, and Hispanics), English for Speakers of other Languages (ESOL) population, socio-economic status (SES), and school climate. The research question of this study was: Is there a significant relationship between the FCAT 2.0 Mathematics scores and racial and ethnic concentration of public middle school students in Miami-Dade County when controlling SES, ESOL student population, and school climate for the 2010-2011 school year? The instruments used to collect the data were the FCAT 2.0 and Miami-Dade County Public Schools (M-DCPS) School Climate Survey. The study found that Economically Disadvantaged (SES) students socio-economic status had the strongest correlation with the FCAT 2.0 mathematics scores (r = -.830). The next strongest correlation was with the number of students who agreed that their school climate was positive and helped them learn (r = .741) and the third strongest correlation was a school percentage of White students (r = .668). The study concluded that the FCAT 2.0 mathematics scores of M-DCPS middle school students have a significant relationship with socio-economic status, school climate, and racial concentration.

INTIMIDATION AS A FACTOR IN THE LIBERATION STRUGGLE OF SOUTH AFRICA WITH SPECIAL REFERENCE TO BELA BELA (WARMBATHS): AN ANTHROPOLOGICAL PERSPECTIVE The cultural revitalisation or adjustment model of Anthony Wallace provides a basis for interpreting religious, political and other revitalisation movements. This study focuses on political revitalisation movements. Participation in the activities of revitalisation movements does not always occur voluntarily. Leaders of such movements apply techniques and methods of intimidation enforcing change and participation. In South Africa, political revitalisation was inter alia brought about by the ANC as political liberation movement who used methods of violent and non-violent intimidation to force people, regardless of their ethnic affiliation, to support the movement and enforce political change. The ANC inter alia used charactersitic cultural phenomena and components of Bantu-speakers as resources for intimidation to ensure unanimity, participation and ultimately to achieve political liberation. In hierdie studie word daar uitsluitlik gefokus op vernuwingsbewegings van 'n politieke aard. Aangesien deelname aan die aktiwiteite van kulturele vernuwings- en aanpassingsbewegings nie noodwendig vrywillig geskied nie, het leiers van hierdie bewegings gebruik gemaak van tegnieke en metodes van intimidasie om deelname en vernuwing op die massas af te dwing. Mission statement and management of private tertiary religious institutions in Eastern and Southern Africa

The region of Eastern and Southern Africa has recently experienced an unprecedented development of private tertiary institutions. Most of these institutions are established by religious organisations which, since the inception of education, have been involved in operating educational institutions of lower levels. Although referred to as private institutions, which by definition would imply funding other than the government sources, these private institutions find themselves, at times requesting the government to fund their development as well as their operations. This study sought to investigate if these private religious institutions have unique raison d'etre expressed in the form of mission statements. The study also investigated the nature of their management and the management structures in practice. The literature reviewed indicated that private religious institutions have a unique mission based on their basic concept of education and their world view. They seek to pursue and inculcate specific values. Operating in a competitive environment, however, in which their competitors do receive funding from the government makes the private institutions vulnerable to hardships. The study was conducted using qualitative research approach in three countries, namely Kenya, Uganda and Zimbabwe; involving all degree granting recognised private religious institutions in the sample and focussing on the management. The respondents were chosen by elite purposive and snowball sampling. The main data collection method was the interview. However, document analysis, observations, and a questionnaire were also used. The findings from the data indicate that private religious institutions have unique missions although they are, at times, not expressed in the form of mission statements. As a result some of the stakeholders, including those involved in management, don't get to know what their institutions' missions are. The study concludes by emphasising the development of clear mission statements involving the stakeholders in the process and having the mission statements widely disseminated. It is also recommended that training in management is important for the managers of the institutions at the various levels. A model of management is proposed for streamlining the management of the institutions considering the requirements of the national governments as well as those of the religious proprietors. / Educational Studies / D. Protection of Personal Data, a Power Struggle between the EU and the US: What implications might be facing the transfer of personal data from the EU to the US after the CJEU’s Safe Harbour ruling?

Since the US National Security Agency’s former contractor Edward Snowden exposed the Agency’s mass surveillance, the EU has been making a series of attempts toward a more safeguarded and stricter path concerning its data privacy protection. On 8 April 2014, the Court of Justice of the European Union (the CJEU) invalidated the EU Data Retention Directive 2006/24/EC on the basis of incompatibility with the Charter of Fundamental Rights of the European Union (the Charter). After this judgment, the CJEU examined the legality of the Safe Harbour Agreement, which had been the main legal basis for transfers of personal data from the EU to the US under Decision 2000/520/EC. Subsequently, on 6 October 2015, in the case of Schrems v Data Protection Commissioner, the CJEU declared the Safe Harbour Decision invalid. The ground for the Court’s judgment was the fact that the Decision enabled interference, by US public authorities, with the fundamental rights to privacy and personal data protection under Article 7 and 8 of the Charter, when processing the personal data of EU citizens. According to the judgment, this interference has been beyond what is strictly necessary and proportionate to the protection of national security and the persons concerned were not offered any administrative or judicial means of redress enabling the data relating to them to be accessed, rectified or erased. The Court’s analysis of the Safe Harbour was borne out of the EU Commission’s own previous assessments. Consequently, since the transfers of personal data between the EU and the US can no longer be carried out through the Safe Harbour, the EU legislature is left with the task to create a safer option, which will guarantee that the fundamental rights to privacy and protection of personal data of the EU citizens will be respected. However, although the EU is the party dictating the terms for these transatlantic transfers of personal data, the current provisions of the US law are able to provide for derogations from every possible renewed agreement unless they become compatible with the EU data privacy law. Moreover, as much business is at stake and prominent US companies are involved in this battle, the pressure toward the US is not only coming from the EU, but some American companies are also taking the fight for EU citizens’ right to privacy and protection of their personal data.

Cette recherche porte sur l'évolution de l'administration locale en Roumanie et en France depuis ledébut des années 1990. L'étude de la situation de départ différente dans les deux pays a étépoursuivie par l'analyse des grandes étapes du développement du cadre juridique relatif auxcollectivités territoriales : l'avènement (en Roumanie) ou le renforcement (en France) du statutconstitutionnel des collectivités et l'évolution du cadre législatif opérant les transferts decompétences et de moyens en faveur des collectivités. Cette analyse a mis en évidence uneconception des réformes qui présente bien des similitudes, mais aussi une mise en oeuvre parfoisdifférente. Une évaluation du niveau de décentralisation atteint dans les deux pays a été entrepriseau regard des critères de la Charte européenne de l'autonomie locale. Elle a permis de relever lesavancées enregistrées par chaque pays et d'identifier les marges de progrès possibles. Au final, on apu constater qu'au-delà d'un contexte initial différent et des particularités de la carte administrative,au-delà d'une application différente des réformes, la Roumanie et la France montrent aujourd'hui undegré de décentralisation très comparable, globalement en cohérence avec les prescriptions de laCharte. / This research focuses on the evolution of the local government in Romania and France since thebeginning of the 1990s. The study of different initial conditions in both countries has been followedby the analysis of the major developmental stages of the legal framework concerning localauthorities : the relatively recent accession to (for Romania) or reinforcement of (in France) theconstitutional status of the communities and the evolution of the law corpus operating the transferof competencies and resources for local communities. This analysis revealed a conception ofreforms that has many similarities, but also some different implementation. An evaluation of thelevel of decentralization achieved in the two countries has been undertaken in the light of thecriteria of the European Charter of Local Self-Government. It identified the progress made by eachcountry, but also the opportunities for improvement. In the end, it was found that beyond an initialcontext and particularities of the administrative map, beyond the different application of reforms,Romania and France show today a very similar degree of decentralization, broadly consistent withthe requirements of the Charter.

L'identité européenne : un développement progressif par la citoyenneté et la Charte des droits fondamentaux de l'Union européenne

Ses frontières « non définies » se sont déplacées, le territoire cédant la place à un espace ouvert. Mais cette évolution n’a pas modifié la nature des interrogations sur son identité, sur l’existence d’une société européenne, sur l’identification des « peuples » européens à leur nouvelle communauté politique et sur l’émergence d’un espace public européen. La problématique de l'identité européenne est que malgré tous les moyens déployés par les institutions supranationales (processus d’harmonisation, d’homogénéisation et de convergence), celle-ci demeure un concept abstrait dont l’expression et l’enracinement dans le tissu social sont encore superficiels. L’Union européenne est une communauté de citoyens, les droits sont codifiés par les traités successifs, mais elle reste une communauté dont l’identité est encore incertaine. Bien que l’identité européenne concerne toute une série de questions qui doivent être saisies concurremment - élargissement, questions des frontières, hybridité politico-institutionnelle, nous l'analyserons notamment à travers le prisme de la citoyenneté européenne et de la Charte des droits fondamentaux de l'Union européenne. La question suivante sera ainsi posée : la citoyenneté européenne et la Charte européenne contribuent-elles à faire émerger, voire à consolider, une identité européenne? / Since the original project, the European Union has extended its borders, integrated new territories, new political traditions and has taken a new geographic form. Its borders "undefined" moved, the area giving way to an open space. But this evolution did not alter the nature of questions relating to its identity, the existence of a European society, the identification of "peoples" to their new European political Community and the emergence of a european public space. The issue of the European identity is that despite all measures deployed by supranational institutions (harmonization process, homogenization and convergence), it remains an abstract concept whose expression and rooting in the social sphere are still superficial. The European Union is indeed a community of citizens, the rights are codified by successive treaties, but it remains a community whose identity is still uncertain. Although the European identity concerns a range of questions that must be considered concurrently - enlargement, border issues, political-institutional hybridity, we will analyze it mainly through the prism of European citizenship and the Charter of Fundamental Rights. The following question will therefore be asked : European citizenship and the Charter of Fundamental Rights will they contribute to emerge or even consolidate a European identity?

The relationship between international investment agreements and EU law has attracted increased attention in past few years. The aim of this thesis is to bring a detailed analysis of various aspects of this complicated relationship. In attainment of this aim it proceeds in the following steps. After a short introduction (Chapter I.), Chapter II. briefly overviews typical content of bilateral investment treaties, following with a more detailed analysis of relevant EU law rules concerning foreign investment and subsequent comparison of both sets of rules. Chapter III. deals with investment agreements to be concluded by the EU, in particular with questions of external competence for foreign investment, responsibility for breaches of investment agreements concluded by the EU and the future shape of EU investment policy. The status of existing bilateral investment treaties concluded between EU member states and third countries is analyzed in Chapter IV. Chapter V. tackles various issues related to investment treaties concluded between member states (so called intra-EU BITs).
