Balancing parental responsibility and state obligation in fulfilling the socio-economic rights of children under the African Charter on the Rights and Welfare of the Child

"The prevailing realities of 'severely depressed' African economies make it difficult for children to enjoy the socio-economic rights guaranteed under the Children's Charter. This study takes the view that the responsibility of parents and the obligations of the state towards children's socio-economic rights must be mutually supportive. It therefore proposes the need for balancing parental responsibility and state obligations in the struggle to ensure that the socio-economic rights of children across the continent are met, albeit, under difficult economic circumstances. ... The study is divided into five chapters. Chapter 1 has highlighted the structure of the entire discourse. Chapter 2 deals with the general perspectives of the socio-economic rights of children within the broad context of international human rights law. An overview of the normative and procedural framework of the Convention on the Rights of the Child is given. The chapter also examines the normative and procedural framework available for the protection of the child at the African regional level, the starting point of which is the African Charter on Human and Peoples' Rights and eventually narrowed down to the African Charter on the Rights and Welfare of the Child. Chapter 3 addresses the concept of parental responsibility. In particular, Africa's notion of parental responsibility is critically analyzed as a factor that makes a crucial difference to the interpretations of the underlying assumptions in the Children's Charter that the socio-economic rights of children could be met through the African communal and extended family network. Chapter 4 deals with states obligations in respect of the socio-economic rights of children. The South African jurisprudence on the rights of the child is also discussed in this chapter. The chapter also highlights the interplay between parental responsibility and state obligations in fulfilling the socio-economic rights of children. A human rights-based approach to child labour in Africa : challenges and prospects in South Africa

Africa reportedly has the highest incidence of child labour in the world. To respond to this problem, some scholars recommend an outright ban on child labour through legislation. In this regard, most African countries, including South Africa (SA), have enacted legislation directed at banning child labour. However, legislation directed at banning child labour may impact negatively on certain fundamental rights of children. This is because child labour is sometimes a source of income for many children who may themselves have ‘dependants’. For instance, for children in desperate need, adherence to laws which have the effect of depriving them of basic necessities including food, housing and water is unrealistic, inadequate and totally ineffective. A notable example is with regard to orphaned children. Taking such children out of employment is counter-productive as they are left with no means of survival. On the other hand, though child labour contributes to the survival of many children and their families in Africa, it impacts negatively on fundamental rights of children. Some of these rights include the right to education, health, leisure, among others. Therefore, regardless of the circumstances that compel children to engage in child labour, it remains a problem that needs to be addressed through appropriate approaches. Perceptions, experiences and challenges of parents whose children are removed through a statutory process

Magister Artium (Child and Family Studies) - MA(CFS) / The 2009 Save the Children, United Kingdom report indicated that eight million children worldwide find themselves in alternative placement. In terms of the statutory process, alternative placement of a child is when a child is placed in foster care or in a child and youth care center. The removal of children from the care of their parents is a statutory process that is driven by issues that put the child’s safety and development at risk. Although children are removed due to a risk factor, Chapter 2 section 28 (1)(b) of the South African Constitution, known as the Bill of Rights, states that children have the right to family or parental care, or appropriate alternative care when removed from the family environment. The risks that children are exposed to often take place in the family context. This creates enormous conflict for the social workers that are responsible for their removal. Due to this conflict, parents become less involved in the process and mistrust develops on the side of the parents as well as social workers. Research indicates that the removal process is an adversarial process, which is linked to the fact that the social workers’ concern is for the safety of the child. This often leads to mistrust. This mistrust, in turn, affects the manner in which the social workers interact with the parents through the removal process of their children. This study focused on the perceptions, challenges and experiences of twelve parents residing in the Delft and Goodwood area whose children were removed from their care through a statutory process. The study found that in addition to encountering a number of challenges, the parents experienced the removal process negatively, they did not fully participate in the removal process, and the removal process did not fully meet their expectations. Based on the research findings, a number of recommendations were made to professionals in the field to improve the overall removal process and thereby address the parents’ experiences, expectations and challenges.

The study’s purpose was to investigate how Family Law appraises the Children´s Rights Conventions principle "the best interests of the child" when assessing visitation in cases with domestic violence, moreover, how the approaches can impact the children. Four family law caseworkers were interviewed through a combined interview and vignette study. The empiricism was analysed with a thematic analysis. Results indicated that the interviewees take the child's best interests into account by acknowledging their opinions. The results showed an inherent problem with a family-oriented stance in investigations. The child's relationship with parents is highly valued, which can be against the child's best interests. Ultimately, violence was seen as a serious risk factor in visitation proceedings, this contributes to negative consequences on the child. Despite that the Convention now is law, the results showed contradictions regarding what the best interest of the child is, therefore continued research is needed on the issue. / Syftet med studien var att undersöka familjerättens förhållningssätt till Barnkonventionens grundprincip om barnets bästa vid bedömningar av umgänge i ärenden där det förekommer våld i hemmet, samt vad förhållningssätten kan innebära för barnet. Fyra familjerättssekreterare intervjuades genom en kombinerad intervju- och vinjettstudie. Empirin analyserades med en tematisk analys. Studiens bärande resultat visade på att familjerättssekreterarna beaktar barnets bästa genom att låta barnet få komma till tals. Resultatet fann även ett inneboende problem med ett familjeorienterat synsätt i umgängesutredningar. Det framkom att barnets relation till båda föräldrarna värnas högt vilket kan strida mot barnets bästa. Slutligen fann studien att våld utgör en allvarlig riskfaktor i umgängesutredningar och bidrar till negativa konsekvenser för barnet. Trots att Barnkonventionen är lag påvisade resultatet motstridigheter om vad barnets bästa innebär, och därför behövs fortsatt forskning i frågan.

El presente artículo tiene como objetivo proponer la modificatoria del proceso de investigación tutelar al amparo del Decreto Legislativo 1297 con el fin de no vulnerar el Interés Superior del Niño y salvaguardar la protección a los derechos de un menor que han sido vulnerados. Para lograr tal objetivo fue necesario analizar el proceso de investigación del Decreto Legislativo 1297 sobre el proceso tutelar en relación a la condición o situación de un menor; además de examinar la problemática actual de este proceso en la realidad práctica. Asimismo, revisar la normativa en derecho comparado sobre el proceso tutelar y el análisis jurisprudencial en materia de investigación tutelar, los cuales nos han permitido identificar las debilidades que presentan las instituciones que forman parte de este proceso. La metodología aplicada es el método cualitativo a través de la recopilación documental y técnica del fichaje para demostrar que, si se cumplió con los resultados esperados en la hipótesis formulada, por lo cual, es necesario brindar una propuesta modificatoria al Decreto Legislativo 1297 de diversos artículos contenidos en el Título II al Título VI que abarca el proceso de investigación tutelar con la finalidad de garantizar la protección y el desarrollo integral de un infante o adolescente. / The purpose of this article is to propose the modification of the guardianship investigation process under Legislative Decree 1297 in order not to violate the best interest of the child and to safeguard the protection of the rights of a minor that have been violated. In order to achieve such objective, it was necessary to analyze the investigation process of Legislative Decree 1297 on the guardianship process in relation to the condition or situation of a minor; in addition to examining the current problems of this process in the practical reality. Likewise, to review the comparative law regulations on the guardianship process and the jurisprudential analysis on the subject of guardianship research, which have allowed us to identify the weaknesses presented by the institutions that are part of this process. The methodology applied is the qualitative method through the documentary compilation and the technique of the file to demonstrate that, if the results expected in the formulated hypothesis were fulfilled, it is necessary to provide a proposal to modify Legislative Decree 1297 of various articles contained in Title II to Title VI that covers the process of guardianship investigation with the purpose of guaranteeing the protection and integral development of an infant or adolescent.

The complexity of the issues inherent in relocation disputes and the relative lack of research in the area points to the need for a more comprehensive, coherent and empirically sound approach than exists at present. The major considerations involved in relocation disputes, using the best interests of the child standard as a reference point throughout, in terms of the available research and issues that require empirical attention, are presented. These include the relationship of the best interests of the child standard in considering the common motivations for relocation, significant psychological factors, cultural, gender and personal biases, the recent collaboration between the psychological and legal professions and the process of psychological assessment. A number of South African court decisions are reviewed to provide an overview of how the law tends to approach these issues. The thesis concerns two pathways for legal intervention in cases of suspected child abuse at the hands of parents. One pathway is based on social law, where society's utmost tool is child protective custody. The other pathway is criminal law, where the abuse is investigated and enforced as a criminal offence. Sometimes only one of these pathways becomes relevant, sometimes both. The purpose of the thesis is to examine and analyse the regulatory framework and its practical application, and to highlight what the two pathways of intervention can accomplish in relation to the child victim's rights and interests. In the case of child abuse, the (legal) relationship between parents and children - and between children, parents and society - is brought to a head. The study demonstrates that many complex legal issues arise when the person subjecting the child to violence and abuse is the same person who under family law answers for the child's protection, care and representation. It is inter alia noted that the concept "best interests of the child" is interpreted somewhat freely, which can risk overriding the legal rights of the child victim. It is concluded that, in order to secure the child victim's legal protection, the regulation needs many small enhancements, each tailored to the problem conditions.

It deals with the current approaches to children in Nursery and Primary schools, both in Czech schools and foreign schools located in the Czech Republic. First this thesis tries to find some historical context and understanding of the situation that Czech and foreign schools are faced with. Further attempts to map out the involvement of multicultural education into the curricula and teaching practice in the selected schools. Primarily it creates a comparison of approaches to multicultural education in selected schools in the Czech Republic. The thesis is trying to find inspiration for working with multicultural education in Czech schools, which do not pay much attention to multicultural education. Thesis should highlight the importance of multicultural education in schools and the benefits and positive impact of integrating this education into the curriculum of schools.
