Die Bewahrung des kulturellen Erbes ist eine der wichtigsten Aufgaben der Menschheit. Dennoch leidet Kulturgut an illegalem Handel, wird unrechtmäßig ins Ausland verbracht und nicht an die Ursprungsstaaten zurückgegeben. Mit dem Ziel der Stärkung des Kulturgüterschutzes wird in der Bundesrepublik Deutschland derzeit an einem neuen einheitlichen Gesetz gearbeitet, das alle bestehenden deutschen Gesetze in diesem Problemfeld umfassen soll. Das neue Gesetz soll 2016 in Kraft treten. Der momentan vorliegende Gesetzesentwurf wird in den Medien kontrovers diskutiert. Das neue Gesetz soll unter anderem der besseren Umsetzung des UNESCO-Übereinkommens über Maßnahmen zum Verbot und zur Verhütung der unzulässigen Einfuhr, Ausfuhr und Übereignung von Kulturgut dienen. Dieses Übereinkommen (weiter in der Arbeit auch als UNESCO-Konvention bezeichnet) unterzeichneten die UNESCO-Mitgliedstaaten im Jahr 1970, um das Kulturgut vor illegalem Handel zu schützen. Bis jetzt wurde die Umsetzung der Konvention in Deutschland von der internationalen Gemeinschaft stark kritisiert. Es kam nämlich trotz mehrerer Anträge zur keinen einzigen Rückgabe von Kulturgut an die Ursprungsländer, vor allem wegen des deutschen Listenprinzips (Erfordernis der Eintragung ausländischer Kulturgüter in Listen). Allerdings stößt nicht nur die Umsetzung, sondern auch das UNESCO-Übereinkommen an sich auf Kritik. Die Konvention von 1970, die zur Zeit ihrer Entstehung ein bahnbrechendes Rechtsinstrument war, zog neue Vertragsstaaten allerdings nur langsam an und wies viele Mängel auf. Dennoch bemüht sich die UNESCO mit diversen Mitteln seit mehr als 40 Jahren darum, das Übereinkommen zu reformieren. Viele Hoffnungen auf die Verbesserung dessen Implementierung sind mit der Tätigkeit der Vertragsstaatenkonferenz und des von ihr im Jahr 2012 gegründeten beratenden Ausschusses verbunden.

Les conditions de détention et la Convention européenne des droits de l'homme / Conditions of detention and European Convention on human rights

La présente étude a pour objet l’analyse de l’appréhension des conditions de détention en établissements pénitentiaires par le mécanisme européen à travers la Convention européenne des droits de l’homme. Plus précisément, il s’agit d’étudier de quelle manière la Convention internationale contribue à protéger les droits fondamentaux des personnes privées de liberté et si son action est réellement efficiente. Cette recherche doit s’ordonner autour de deux axes principaux. En effet, il conviendra tout d’abord de démontrer la réelle efficacité du mécanisme européen de prévention des conditions de détention en s’interrogeant sur le degré d’effectivité de l’engagement des Etats membres du Conseil de l’Europe. Il est dans ce sens important d’observer avec attention la qualité de la promotion des droits fondamentaux des détenus sur la scène internationale. De même, il sera nécessaire d’étudier les différentes stratégies européennes afin d’assurer une prévention opérante des conditions de détention. A cet égard, l’on constatera la parfaite prévention relative aux conditions de vie des détenus qu’a constitué le Conseil de l’Europe. Par ailleurs, il sera également nécessaire de constater la relative efficacité du mécanisme européen de sanction des conditions de détention en constatant les carences qui subsistent et les sanctions qui restent aujourd’hui insuffisantes. A cet égard, il est essentiel de s’interroger sur l’influence de la Convention européenne des droits de l’homme sur les ordres juridiques internes relatifs aux conditions de détention à travers la jurisprudence de Strasbourg. En effet, c’est précisément ce raisonnement qui va démontrer le degré d’efficacité du mécanisme juridictionnel strasbourgeois. Il est dans ce sens primordial d’étudier minutieusement la réalité des conditions de vie des personnes privées de liberté afin de comprendre les raisons de l’insuffisance du mécanisme de sanction des conditions de détention. / The present study has an aim the analysis of the apprehension of the detention conditions in penal institutions by the European mechanism throught the European Convention of the human rights. More precisely, it is a question of studying International convention how contributes to protect the basic rights from the individuals of freedom and if its action is really efficient. This research must be ordered around two main axes. Indeed, it will first of all be advisable to show the real effectiveness of the European mechanism of prevention of the detention conditions while wondering about the degree of effectiveness of the commitment of the Member States of the Council of Europe. It is in this direction important to observe with attention the quality of the promotion of the basic rights of the prisoners on the international scene. In the same way, it will be necessary to study the various European strategies in order to ensure an operative prevention of the detention conditions. In this respect, one will note the perfect prevention relating to the living conditions of the prisoners whom the Council of Europe constituted. In addition, it will be also necessary to note the relative effectiveness of the European mechanism of sanction of the detention conditions by noting the deficiencies which remain and the sanctions which remain insufficient today. In this respect, it is essential to wonder about the influence of the European Convention of the human rights on the internal legal orders relating to the detention conditions through jurisprudence of Strasbourg. Indeed, it is precisely this reasoning which will show the degree of effectiveness of the jurisdictional mechanism of Strasbourg. It is in this direction paramount to thoroughly study the reality of the living conditions of the individuals of freedom in order to understand the reasons of the insufficiency of the mechanism of sanction of the detention conditions.

The Southern Baptist foreign mission enterprise in western Nigeria: an analysis

Microfilm. s / This dissertation attempts to determine the range and the intensity of the Western missionary impact on the African scene. The Southern Baptist mission field in Western Nigeria serves as an example in case. The phenomenon of the missionary impact is of a twofold nature: religious and cultural. The cultural impact of Christian missionaries on the African scene has been of interest for some time, especially to students of the social sciences. As such, it has repeatedly been mentioned in sociological studies concerning certain aspects of social and cultural change. However, rarely has the missionary-induced culture change been studied per se, and never has such change been studied in a context which does justice to Christian missionary motivation as a primary source of action. It is, therefore, the objective of this study to describe this impact both as to its theological cause and its cultural implications. For this purpose, a methodology has had to be designed which would do justice to both the theological concern for and the sociological interest in the culture-mediating activity of the missionary work. The methodology can be broken down into the following two steps. First, the Southern Baptist mission enterprise is described in terms of the theological, philosophical, and cultural forces which contribute to the Southern Baptist mission outreach to the Western Nigerian scene. Against the background of this knowledge, the program of the Southern Baptist mission operations is observed in its interaction with Nigerian Baptist institutions. Secondly, any Nigerian Baptist reactions resulting from this interaction are submitted as data to an analytical model. For the detection of genuine Nigerian Baptist reactions, there was derived a key-factor which serves as a catalyst in determining the analytical values of those data submitted to the model. The resulting values are co-ordinated through the process of quantification and are then integrated into a graph which gives evidence of the qualitative distribution of impact factors, as they contribute to the formulation of the Nigerian Baptist outlook. The evaluation of this evidence makes possible a determination of the range and the degree of intensity of the Southern Baptist mission impact on that portion of the Western Nigerian scene which has become identified with this mission work: the Nigerian Baptist Convention. This methodology represents one portion of the results of this dissertation. The other set of results is provided by the evaluation of the information which was extracted from this analytical process. This evaluation gives some insight into the range and the intensity of the Southern Baptist cultural and theological impact on the Nigerian Baptist scene: 1. Through early autonomy and timely transfer of power to their Nigerian Baptist constituency, Southern Baptists have succeeded in keeping the traditional tensions between overlords and dependents at a minimum. 2. Because of this minimum of tensions, the Southern Baptist mission impact may have prolonged effects on the Nigerian Baptist outlook. 3. The Southern Baptist domination of the theological outlook of the Nigerian Baptist Convention may serve as an example of this prolonged effect. Exceptions are the Nigerian Baptist theological and ethical expressions which have their origin in the experience of the traditional Yoruba social structure and customs. 4. Nigerian Baptists' preoccupatian with the national future of Nigeria, together with the fact that they are a religious minority group, explains their adherence to a Nigerian rather than a Southern Baptist philosophical identity. The positive ecumenical spirit of the Nigerian Baptists is based upon the same phenomenon. 5. Nigerian Baptists--together with most other Nigerians--only now begin to respond to an indigenous cultural identity over against the previously accepted Western cultural identity. 6. Baptist principles of freedom and democracy and Nigerian Baptist political aspirations have not yet come into competition with one another.

The study looks specifically at the role of the United States and the post Cold War cases of genocide to determine how the United States encouraged or discouraged a response to genocide. By using the plausibility probe method, this study finds that the role of the hegemon is an important one that should be studied further to understand the impact of the hegemon on the international response to genocide.

An Assessment of International Regulations for the Prevention of Air Pollution from Ships

The International Maritime Organization(IMO) has adopted a draft of the International Convention for the Prevention of Pollution from Ships, 1973, as modified by the Protocol of 1978 relating thereto and by the Protocol of 1997(termed as MARPOL 73/78/97)since September 1997, amended the Convention and added a new Annex VI which regulates gas pollution emitted from ships, the latest Annex came into effect after the MARPOL convention. This study aims to discuss the effect of the Annex VI Prevention of Air Pollution from Ships after it was implemented on 19 May 2005 and the growth and decline status of pollution by document analysis and quantitative analysis methods. This study find that there were different concern positions from each PSC region, the enforcement state of Europe, Asia-Pacific and Indian Ocean regions were better than Black Sea, west and central Africa, Latin America and Caribbean regions. The statistical show that sulfur oxides decreased notably, nitrogen oxides and carbon dioxides decreased slowly by UNFCCC web; in addition, some countries did not submit their gas inventory, including developed countries: Canada, United States of America, Japan, Luxembourg and Netherlands et al. The quantitative analyses show that some countries has decreased or slow down the ship-source gas pollution with countries¡¦ economy developed, including Denmark, Ireland, Norway, Germany, Belgium, Luxembourg, Japan, Australia and United States of America et al.

Primarily focusing on his political career (1878-1894) and as an unofficial public figure after his retirement from formal politics (1895-1911), this study considers William J. Northen’s efforts in leading Georgia to the vague but resonant ideal of progress by analyzing his combination of religion and politics for social change, modern governance, and economic progress. After Reconstruction, urban middle-class southern Baptists like Northen began to realize the social problems of their civilization. Gradually, these reformers worked to expand their traditional mission of saving indivdual souls into a modern mission of saving the collective soul of society. Whereas personal, localized relationships customarily ordered southern society, under Northen, public policy and an increasingly coercive state informed by Christian princilpes of social outreach began to overtake the role of the individual.
