L'accès au juge administratif en Thaïlande / Access to Administrative Court in ThaïlandNuchprayool, Bajrawan 25 February 2011 (has links)
The Constitution of the Kingdom of Thailand 2007 defines an overhaul of the administrative courts with the separated jurisdictions in order to protect the fundamental rights and freedom of all citizens against the misused of state power, to repair any damages caused by the administration, and to control the legality of administrative acts. Moreover, the regulations on how to bring the cases to courts are simplified into uncomplicated written form and can be conducted without a lawyer. Since in the inquisitorial system lets the judge to gather evidences as to conduct the investigations with the administration. However, there are some restrictions about bringing cases to courts which included the conditions of the applicant's abilities to act and "the circle of interest to sue". This perspective of the fundamental aspects of administrative lawsuit has been influenced by western countries, including France. This research study both the theoretical and practical dimensions on how to bring cases to administrative courts which reflect current and future situation through the analysis of the Thai and French administrative lawsuit systems.

The Corporate Exploitation of Fundamental Rights: A Nation of ArbitrationCarlson, Melanie A 01 January 2017 (has links)
This thesis is an in-depth discussion and analysis of the alternative dispute resolution process of arbitration in the United States. It begins by providing a basic explanatory overview of arbitration clauses and the arbitration process. It then goes on to highlight the various benefits over traditional court litigation that arbitration has to offer. From there, the paper presents a detailed discussion of the many shortcomings of the arbitration process. It identifies the overall lack of procedural fairness that exists in arbitration today due to the fact that arbitration currently tends to favor businesses over consumers and workers during dispute settlements. The paper then identifies the various negative potential consequences that exist as a result of the unfair nature of arbitration today. This thesis concludes by presenting various ways that the arbitration process can be improved upon to make for a fairer, more neutral dispute resolution alternative.

Strings of congruent primes in short intervalsFreiberg, Tristan 11 1900 (has links)
Fixons $\epsilon > 0$.
Let $p_1 = 2, p_2 = 3, p_3 = 5,\ldots$ be the sequence of all primes, and let $q \ge 3$ and $a$ be coprime integers. Recently, and very remarkably, Daniel Shiu proved an old conjecture of Sarvadaman Chowla, which asserts that there are infinitely many pairs of consecutive primes $p_n,p_{n+1}$ for which $p_n \equiv p_{n+1} \equiv a \bmod q$. Now fix a number $\epsilon > 0$, arbitrarily small. In their recent groundbreaking work, Daniel Goldston, J\`anos Pintz and Cem Y{\i}ld{\i}r{\i}m proved that there are arbitrarily large $x$ for which the short interval $(x, x + \epsilon\log x]$ contains at least two primes congruent to $a \bmod q$. Given a pair of primes $\equiv a \bmod q$ in such an interval, there might be a prime in-between them that is not $\equiv a \bmod q$. One can deduce that \emph{either} there are arbitrarily large $x$ for which $(x, x + \epsilon\log x]$ contains a prime pair $p_n \equiv p_{n+1} \equiv a \bmod q$, \emph{or} that there are arbitrarily large $x$ for which the $(x, x + \epsilon\log x]$ contains a triple of consecutive primes $p_n,p_{n+1},p_{n+2}$. Both statements are believed to be true, but one can only deduce that one of them is true, and one does not know which one, from the result of Goldston-Pintz-Y{\i}ld{\i}r{\i}m.
In Part I of this thesis, we prove that the first of these alternatives is true, thus obtaining a new proof of Chowla's conjecture. The proof combines some of Shiu's ideas with those of Goldston-Pintz-Y{\i}ld{\i}r{\i}m, and so this result may be regarded as an application of their method. We then establish lower bounds for the number of prime pairs $p_n \equiv p_{n+1} \equiv a \bmod q$ with $p_{n+1} - p_n < \epsilon\log p_n$ and $p_{n+1} \le Y$. Assuming a certain unproven hypothesis concerning what is referred to as the `level of distribution', $\theta$, of the primes, Goldston-Pintz-Y{\i}ld{\i}r{\i}m were able to prove that $p_{n+1} - p_n \ll_{\theta} 1$ for infinitely many $n$. On the same hypothesis, we prove that there are infinitely many prime pairs $p_n \equiv p_{n+1} \equiv a \bmod q$ with $p_{n+1} - p_n \ll_{q,\theta} 1$. This conditional result is also proved in a quantitative form.
In Part II we apply the techniques of Goldston-Pintz-Y{\i}ld{\i}r{\i}m to prove another result, namely that there are infinitely many pairs of distinct primes $p,p'$ such that $(p-1)(p'-1)$ is a perfect square. This is, in a sense, an `approximation' to the old conjecture that there are infinitely many primes $p$ such that $p-1$ is a perfect square. In fact we obtain a lower bound for the number of integers $n$, up to $Y$, such that $n = \ell_1\cdots \ell_r$, the $\ell_i$ distinct primes, and $(\ell_1 - 1)\cdots (\ell_r - 1)$ is a perfect $r$th power, for any given $r \ge 2$. We likewise obtain a lower bound for the number of such $n \le Y$ for which $(\ell_1 + 1)\cdots (\ell_r + 1)$ is a perfect $r$th power. Finally, given a finite set $A$ of nonzero integers, we obtain a lower bound for the number of $n \le Y$ for which $\prod_{p \mid n}(p+a)$ is a perfect $r$th power, simultaneously for every $a \in A$.

The Matters of Troy and Thebes and Their Role in a Critique of Courtly Life in Chaucer and the Gawain-PoetJones, Oliver M. 05 1900 (has links)
Both Chaucer and the Gawain-poet use the Matters of Troy and Thebes as material for a critique of courtly life, applying these literary matters to the events and actions in and around Ricardian England. They use these classical matters to express concerns about the effectiveness of the court of Richard II.
Chaucer uses his earlier works as a testing ground to develop his views about the value of duty over courtly pursuits, ideas discussed more completely in Troilus and Criseyde. The Gawain-poet uses the Matter of Troy coupled with the court of King Arthur to engage in a critique of courtly concerns. The critiques presented by both poets show a tendency toward duty over courtly concerns.

Women, sources, and rhetoric in George Pettie’s A petite pallace of Pettie his pleasureStepanova, Olga 05 1900 (has links)
This thesis, Women, Sources, and Rhetoric in George Pettie’s A Petite Pallace of Pettie his Pleasure, studies the early modern English collection of novellas A Petite Pallace of Pettie his Pleasure (1576) and indentifies it as a collection for women and a forerunner of the euphuistic style.
The thesis consists of three chapters. In the first chapter I consider women’s position in early modern England, as A Petite Pallace is dedicated to ladies. The second chapter deals with structural elements of each story included in the collection. I also trace modifications made by the author to his source stories in order to adapt them for his readers and to attract more attention. The last chapter focuses on linguistic devices used by Pettie to dazzle his audience and to demonstrate the possibilities of the English language.

Ženy před Mimořádným lidovým soudem v Mostě a v Plzni v letech 1945-1947 / Women before the Extraordinary people's court in Most and Plzeň in 1945-1947Přibík, Adam January 2013 (has links)
This diploma thesis is about the post-war retribution on all its levels, from international military tribunals in Nuremberg and Tokyo to work of two extraordinary people's courts in Plzeň and Most, of whose activity the text applies. The text aims on women, because previous theses were mostly focused on men, which hold the more important position in the Nazi regime. On account of different roles of both sexes there is a diverse structure of committed crimes - the most frequented type of crimes for men were crimes against the state, while in a women's case it was denunciation. This fact could be partly explained by lesser possibilities of women for direct using of a repressive apparatus of the regime. The aim of the thesis is to bring in a comparison of activity of both mentioned courts against women. Main difference between those two regions is that the most of the Plzeň region was in Czech inland, but the Most area was located in the borderlands with a German majority. We could say that the result for this fact was higher rigidity of the Extraordinary People's Court in Plzeň that exceeded the second court in both percentage of sentences and rigidity of punishments. The thesis describes activity of these two courts simultaneously, with regard to all types of crimes that were committed during the...

The First Minute Book of the Supreme Court of the State of Louisiana 1813 to May, 1818: An Annotated EditionBoudreaux, Sybil Ann 01 May 1983 (has links)
The Supreme Court of the State of Louisiana, established by the first state constitution (1812) as the only appellate court in the judicial system, commenced its work on March 1, 1813. The Court's jurisdiction was limited to civil cases. It also had control over admissions to the bar and the rules for the administration of its own business. Created in the wake of the conflict between proponents of Louisiana's traditional civil law system and the promulgators of the federal government's territorial policy of common law imposition, the Supreme Court reinforced the ultimately accepted continuance of civil law within the limitations of the United States Constitution and Statutes.
The First Minute Book of the Supreme Court is a small, yet significant, part of the documentation of the Court's past. It is a segment of the extensive Louisiana Supreme Court records housed in the Department of Archives and Manuscripts of the Earl K. Long Library at the University of New Orleans. Dating from March, 1813 to May, 1818, the 340-page manuscript details the business of the Court's sessions at New Orleans, the seat of the eastern appellate district. Daily entries include the judges present, the cases before the Court, the disposition of cases, Court rules, and admissions to the bar.
The purpose of this edition is to provide a readable, accessible, and comprehensible document for use by the scholarly and research community. With the addition of missing docket numbers which serve as access points to Supreme Court case records and the annotation of persons, cases, and legal terms, the manuscript becomes an important guide for further investigation. The rendition of the text conforms to modern practices of historical editing recommended in the Harvard Guide to American History. No attempt was made to produce a facsimile of the original.

Vliv vývoje právního názoru v oblasti lhůt pro vyměření daně na výběr daní v ČR / The influence of the development of a law opinion in the section of terms for assesment of a tax on tax collection in the Czech RepublicStránská, Ester January 2009 (has links)
This thesis was focused on the influence of the development of a law opinion in the section of terms for assesment of a tax on a tax collection in the Czech republic. The purpose was to find out if the law about the tax and fees administration was a sufficient procedural tax norm in the section of terms for assessment of a tax, if existed the practice of the Supreme Administrative Court, which would edit, explain and improve interpretation provision § 47 Terms for assesment of tax which was wrote in the law about tax and fees administration. Furthermore was analyzed if the new procedural norm, the tax regulation, effective from 1. 1. 2011, was settled with interpretation the practice of the courts and what changes become against adjustment betray into the law about tax and fees administration. At the close work were make results, that the law about tax and fees administration was imperfect procedural norm in the section of terms for assesment of a tax and that the new procedural law, the tax regulation, which is more detailed specifies in the section of terms for assessment of a tax, can contribute to a better orientation in those problems.
