The thesis "Methodology of Investigation of Murders (selected issues)" deals only with the selected aspects of the methodology of this crime. Since the topic is too broad, it is not within the author's possibilities to cover the topic completely while working on this thesis. For this reason, only selected points of view on the investigation of this serious crime are discussed in details. The thesis is divided into two main chapters. The first chapter is devoted to the introduction to this topic. The initial subchapter provides a wider view of crime murder from the perspective of criminal law. It also describes the legal regulation providing the basic human right, specifically the right to life, as stated in the Czech legal order, including the documents at European or international level as well. The second subchapter deals with the physical as well as fault elements of this crime. The whole chapter is interwoven with historical aspects and background, while the author also comes with the comparison of current legislation with the previous one. The following subchapter contains the comparison of this crime with the similar crimes, particularly manslaughter, infanticide, negligent homicide and also the participation in suicide. This diploma thesis addresses the issues of the murder investigation methodology. It is divided systematically into four chapters. First three chapters may be perceived by the reader as the fundamentals of the thesis aiming at contextualizing and highlighting the final chapter which bears the core ideas and findings. Chapter One deals with crime against life from the perspective of the criminal law in the Czech Republic. An account of legal definitions of murder, manslaughter and murder of a new-born infant by its mother, as defined in the Criminal Code, is offered in the chapter. Certain features of the constituent elements of those crimes are compared and commented on in greater detail. Chapter Two presents murder in view of criminology and includes the statistical data regarding the intentional homicide rate within the Czech Republic. As for the statistical data, it is predominantly recent and up-to-date. However, there may also be included statistical data gathered over an extended period of time which better demonstrate the dynamics of crime development. Resumé This master's thesis deals with the field of forensic study of crime victims, also known as forensic victimology. The aim of this text is to draw attention to issues of this field and to discuss crucial topics based on their practicality, incidence or tendency to be incorrectly interpreted. That includes, among others, the relationship of forensic victimology to related disciplines, especially general victimology as its foundation, their development, utility of victimological knowledge and methods in criminalist practice, status of victims in the process of crime reporting, as carriers of forensic trails, the phenomenon of victim pretending from the perspective of practice and its contrast with the media image etc. It also aims to emphasize the need for sensitive, but unemotional approach to the victims, which makes it possible to perceive them with sufficient respect; this means to see them not only as a piece of evidence, but as persons in a very complicated and difficult situation when inappropriate and/or insensitive approach may lead to a number of negative consequences, in particular, but not limited to, supporting the victim mentality and increasing the victim's risk of repeated victimization in the future. 70 Criminalistic theory of a crime victim (criminalistic victimology) Abstract Presented dissertation deals with the crime victim as an object of forensic interest. It briefly introduces the science known as forensic victimology. This science is relatively new and is still looking for its place amongst related disciplines, especially general victimology and criminology. Victim has a very important part in the process of investigation. Victim can participate on the genesis of the crime. It can leave traces on the crime scene or on a offender's body. It also has an important role as a carrier of the traces - material traces on victim's body, cloths or personal belongings and mental traces in the shape of memories in the victim's mind. Getting this informations from victim can be essential for a process of investigation. The theme of the thesis is the Methodology of Investigation of Murders. According to the scope of that theme the author concentrated only on selected issues. The first chapter includes the overview of the Czech and foreign literature related to the theme of the thesis. The second chapter covers some of the legal aspects of crimes against live, as they are enumerated in the Czech Criminal Code. The purpose of this chapter is to emphasize the link between the investigation of muders as a criminalistic discipline and the criminal law. This chapter concerns crimes as murder, manslaughter, infanticide, killing of negligence and participation on suicide, including current statistical data with regard to the quantity of murders within the area of the Czech Republic. The aim of this thesis is to briefly introduce criminalistic victimology and characterise victim of a crime. Text is composed of six chapters, concerning different aspects of the topic. First two deal with the science of criminalistic victimology. Following two examine role of victim during criminal investigation according to criminalistic victimology. Last two chapters reflect position of victim in contemporary czech criminal law. The first chapter defines basic terminology used in criminalistic victimology, different to terms of criminal law. - Recognition The recognition as a separate criminalistic method serves to identification of persons, things or animals linked to a criminally relevant event. The recognition is also procedural act regulated in a separate section of Criminal Procedure Code called Some specific methods of evidence. This classification, which has come into effect in 2002, shows that the importance and significance of the recognition can't be underestimated and in addition to the theoreticians it comes to the forefront of the legislature's attention. Criminalistic study of a victim of the crime (criminalistic victimology) Abstract This presented thesis puts at the forefront a victim of the crime and its importance within criminalistic victimology, the study about a victim of the crime. The role of the victim is important both at the beginning of the criminal offence as well as during its duration. The victim is also important factor at the notification of the criminal offence, its investigation and at the court hearing of the criminal offence. In this thesis, I put at the forefront the relationship between a victim and an offender, which may exist in such a superficial range or on the contrary they may be really close to each other. There is also outlined in which extent the victim is participating on the creation of tracks, or if is their bearer. The thesis deals with a victim as a notifier of criminal activity - which reasons that lead to its (non-) notification. Furthermore, it aims to provide an insight into the subject of criminalistics victimology. The thesis is divided into introduction, five chapters and conclusion The first two chapters of the thesis focus on the definition of the basic terms of victimology, as understanding these terms is necessary for further content of the thesis. The modus operandi of a crime is currently a very neglected topic within the professional public. The aim of this diploma thesis is to describe in detail the concept of modus operandi of a crime and to outline its criminal significance. The secondary goal of the thesis is then to show in practical cases whether the assumption of perseverance of the offender is true. The thesis is divided into two parts - theoretical and practical.
