The internet and computer criminality is a part of a cybercrime which is a very wide and relatively inhomogeneous category of criminal offences. The master's thesis focuses on criminal offences against confidentiality, integrity and availability of computer data and computer systems. These cyber attacks can endanger the cyber security at the national level and inflict immeasurable damage. In the present day, a Cybersecurity Act is being prepared in the Czech Republic whose goal is to respond to these attacks. Master's thesis examines especially penal aspects of this law. Moreover, a large space in the thesis is devoted to the recently ratified Convention on Cybercrime. Besides the two above-mentioned legal norms the master's thesis arises from the Czech and foreign legal regulation and case law, for which it uses literature available in the Czech, English or German language. With regard to the chosen topic, it has been necessary to use also considerable amount of a non-legal literature. The whole work is divided into six chapters. The first chapter provides a brief introduction into the topic and also short explanations of the basic terms. Cyber-crime, terrorism and hacking is a topic discussed widely and many independent groups as for example Wikileaks and Anonymous are often taken into consideration when discussing cyber-crime. When researching cybercrime and  it is important to first research the legal background as to the purpose of the creation of the internet, and to what extend state control is an issue in the matter of both cybercrime being carried out and the establishment of cyber activist groups. How shall the law be interpreted in the case of internet hacking and under what category do these fit, terrorists, cybercriminals or hackers.

The purpose of this thesis is to introduce the issue of cyber crime, a phenomenon which is gaining importance in recent years. The first chapter outlines the basic problem: Mass use of information and communications technologies may have downsides. Consequently, the reader learns briefly about development of computers, which resulted in the emergence of the Internet. Especially, how this short evolution affected the terminology regarding crimes related to information technology. The term "cyberspace", from which we derive the term "cyber crime", becomes crucial. This virtual world is not only a place of fun but unfortunately also full of malicious behavior. Further, the work deals with the specifics of cybercrime and its differences that distinguish it from other types of crime. The fifth chapter deals with the legal regulation, both domestic and international. It lists major legislation related to the cyber crime and is especially dedicated to analysis of the Criminal Code, the law on cyber security and the Convention on Cybercrime. Next comes the main section of the thesis dedicated to crime in cyberspace. It describes the most common malicious activities which occur in cyberspace. The subject of this diploma thesis is the ransomware spread, which is currently one of the most prominent global cybernetic threats. Ransomware is malicious code that, when activated on a computer system, usually blocks access to that system or encrypts the data contained in it, which is then used to blackmail the user. This thesis deals with criminological and criminal aspects of this phenomenon. In its criminological part, this thesis deals with the issue of the etiology of the ransomware spread and its criminogenic factors, while examining, among other things, the applicability of cybercriminological theory named space transition theory to a given phenomenon. It also deals with the victimological aspect of the matter, listing the most fundamental factors influencing victimization, both in the case of widespread non-targeted ransomware attacks and in the case of specifically targeted attacks. It also examines the issue of the high latency of this phenomenon and cybercrime in general and the possibility of prevention, which it considers to be the best way to defend against a ransomware attack. Criminological aspects of cybercrime Abstract The thesis concerns the offenders and victims of cybercrime as the selected criminological aspects of cybercrime. The objective of the thesis was to particularly analyse and compare the criminological findings of the offenders and victims of cybercrime and discover and point out the specifics in comparison to the offenders and victims of the offline criminality. Both Czech and foreign literary sources were used for the purposes of this thesis. In the first part the basic terms which are used in this thesis are clarified - cybercrime, the offender and victim including the particularly vulnerable victims. The second part concerns the development of the image of the offender of cybercrime, his characteristics in comparison to the offenders of crimes committed out of cyberspace and his categorization. Particularly the attention was brought to the organized groups of criminals in the area of cybercrime and the motivation of the offender as one of the criminogenic factors. The main aim of this thesis is to find out which attacks on information systems pose a threat to the state and whether new technological trends represent a challenge for the current Czech legislation in the field of criminal law. The methodology varies across this thesis. The analytical method together with the synthesis is used to fulfil the aim. In some parts, an empirical approach is used. Criminal law aspects of data electronization in healthcare Abstract Continuous spread of information and communication technologies into all aspects of everyday life goes hand in hand with importance of data and information. This trend can be also observed in the healthcare sector which has recently experienced massive electronization. Relevancy of this issue can be clearly demonstrated on the recent cyber-attacks on healthcare providers, which seriously jeopardize valuable data in healthcare. Criminological and criminal law aspects of the ransomware spread Abstract This diploma thesis examines different aspects of criminology and criminal law with the issue of the malware spread in the form of ransomware. This text is divided into two main parts. First, the theoretical part consists of the chapters about cybercrime, malware and criminological and criminal law aspects of ransomware spread. It uses the substantive law and also procedural law perspective. All chapters are divided into subchapters dealing with the questions of offenders and victims, criminal law qualification of the ransomware phenomena and with related concepts used for the broader understanding of this kind of cybercrime. Second, the analytical part follows. This thesis combines different criminological research methods and tries to verify the main hypothesis regarding the increase in the number of ransomware attacks in the Czech Republic.
