Le principe d’égalité est un principe fondamental en droit public qui se voulait avant tout politique. Les hommes égaux politiquement sont devenus plus largement égaux en droit. Ils doivent être traités de manière équivalente. L’égalité devient de la sorte une égalité proportionnée. De nouvelles orientations du principe d’égalité semblent cependant émerger notamment au travers du paradigme des services publics locaux administratifs facultatifs. L’égalité d’accès est en effet venue supplanter l’égalité de traitement de manière à engendrer à terme une égalité réelle.Cette nouvelle conception du principe d’égalité conduit toutefois à légitimer l’existence d’inégalités de traitement. La conception croissante voire exponentiel du principe d’égalité appliqué aux services publics locaux administratifs facultatifs pourrait ainsi mener à terme au déclin de ce principe.Une redéfinition du principe d’égalité et un recours systématique au concept d’équité semblent se révéler indispensables. / The principle of equality is a fundamental principle in public law which was above all political. But, given the evolution of society and the role incumbent on state authorities, citizens rights holder objectives is also assigned rights claims. The principle of equality has to adapt to the increasing socialization of French society. The state is no longer bound to its sovereign rights but must also come to the aid of citizens. Henceforth, men become more widely politically equal with equal rights. They should be treated equally. Gender thus becomes an equal proportion. But proportionate to what? The principle is translated as "equal status to same right and same treatment." This principle of equal treatment will impose the need to define this situation also. But are there objective criteria that may determine the categories of situations.New directions of the principle of equality seem to emerge. So we're past the principle of equal treatment to a more socialistic concept. Equal access has come to supplant the equal treatment. The aim is to make people equal. They are equal by nature.
