No. of bitstreams: 0 Previous issue date: 2016-08-26 / The purpose of this dissertation is to analyze legally the application of the principle of freedom of association in the domestic work relationship, having as a case study the Brazilian legal system. Based on this premise, a historical and statistical contextualization about the profile of this worker, based on data from official agencies that used indicators of gender, race, class and age, was carried out. The principle of freedom of association has also been analyzed in the light of ILO Convention 189 and EC 72/2013, which are the starting points for understanding the impact of the guaranteed rights guaranteed to the category, especially collective bargaining. In fact, the trade union movement of domestic workers was highlighted in an international context, collating information about representative bodies and campaigns to strengthen and valorize domestic employment. At the national level, the study also looked at the constitutional view of freedom of association, how the negotiations of this class of workers take place and the scope of their collective agreements and conventions, what are the main activities of trade unions - for example, Of termination and legal assistance - finally, how the assistance to the domestic worker develops. Syndicalism. / A presente dissertação tem como objetivo analisar juridicamente a aplicação do princípio da liberdade sindical na relação de trabalho doméstico, tendo como caso de estudo o ordenamento jurídico brasileiro. Com base nesta premissa, realizou-se uma contextualização histórica e estatística acerca do perfil dessa trabalhadora, embasada em dados de órgãos oficiais que usaram indicadores de gênero, raça, classe e idade. O principio da liberdade sindical também foi analisado sob a ótica da Convenção 189 da OIT e da EC nº 72/2013 que constituem os pontos de partida para compreender a repercussão da efetividade dos direitos garantidos à categoria, em especial a negociação coletiva. Com efeito, destacou-se o movimento sindical das domésticas em âmbito internacional colacionando-se informações acerca de órgãos representativos e campanhas de fortalecimento e valorização do emprego doméstico. Em âmbito nacional, o estudo examinou, ainda, sob a ótica constitucional da liberdade sindical, como se dá a implementação das negociações dessa classe de trabalhadores e o alcance dos seus acordos e convenções coletivas, quais as principais atividades dos sindicatos ¿ por exemplo, homologação de rescisão e assistência jurídica ¿ enfim, como se desenvolve a assistência à trabalhadora doméstica.
