Com a constatação de que a ocupação irregular em área de proteção aos mananciais cresceu e se consolidou nos últimos anos, o estudo AÇÃO CIVIL PÚBLICA E AJUSTAMENTO DE CONDUTA EM ÁREA DE PROTEÇÃO AOS MANANCIAIS NA REGIÃO METROPOLITANA DE SÃO PAULO trata do conflito representado pela presença de assentamentos urbanos em áreas de proteção a mananciais e do tratamento jurídico e urbanístico que lhes vem sendo dado. Foram selecionados e analisados loteamentos em Área de Proteção aos Mananciais localizados nos Municípios de São Bernardo do Campo, Santo André, Diadema e Mauá. Tais loteamentos foram objeto de Ação Civil Pública e Termo de Ajustamento de Conduta. Essa análise foi contextualizada com a caracterização do momento pelo qual vem passando o sistema jurídico e a sociedade na modernidade e ainda, sobre pontos importantes para a compreensão dos institutos estudados: o funcionamento do Poder Judiciário, o surgimento das demandas de massa, a atuação do Ministério Público do Estado de São Paulo e do Poder Executivo, a efetividade da Ação Civil Pública e do Ajustamento de Conduta para a tutela dos interesses transindividuais. Buscou-se compreender possibilidades de interação entre o propósito jurídico e a prática espacial. Avaliou-se o impacto produzido na cidade, em sua materialidade ambiental e social, por cada um desses dois distintos que representam atitudes diversas perante a aplicação da lei. Enquanto a Ação Civil Pública se estabelece rigidamente nos termos da lei, o Termo de Ajustamento de Conduta pressupõe o acordo e a cooperação, a redução de danos e que os objetivos da lei sejam atendidos progressivamente. As conclusões e considerações poderão, assim, contribuir não só para o debate sobre a necessidade de aprimoramento da regulamentação das áreas de proteção aos mananciais, mas para uma melhor compreensão das relações entre sociedade e ambiente, entre direito à moradia e ao meio ambiente, e entre a realidade social e o Sistema Judiciário. / Due to the growth and subsequent consolidation of irregular ocupation of the protected area of mananciais, this study, named Ação Civil Pública and Ajustamento de Conduta in the protected area of mananciais of the metropolitan region of São Paulo is about the conflicts represented by the presence of urban settlements in the protected area of mananciais, and the judicial and urbanistic treatment that is being dispensed to these settlements. We chose to analyze settlements in the Protected Area of Mananciais located at the Municípios of São Bernardo do Campo, Santo André, Diadema e Mauá. These settlements were the object of Ação Civil Pública and Termo de Ajustamento de Conduta This analysis was contextualized by the characterization of the moment through which the modern society and the judicial system are passing, and also by important topics to the comprehension of the institutions studied here: the functioning of Judiciary the rise of the mass demands, the acting of the Ministério Público of the State of SãoPaulo and the Executive, the effectiveness of the Ação Civil Pública and the Ajustamento de Conduta for the tutela of the transindividual interests. We tried to comprehend the possibilities of interaction between the legal goal and the spacial uses. We analyzed the impacts in the environmental and social aspects of the cities caused by these two institutes which represent different attitudes before the application of law. While the Ação Civil Pública stablishes itself strictly in the terms of law, the Termo de Ajustamento de Conduta requires the agree and cooperation of the parties, the reduction of damages and the progressive accomplishment of the objectives of the law. The conclusions and considerations shall contribute not solely for the discussion on the necessity of development of the regulamentation of the protected area of mananciais, but also to for a better comprehension of the relations between society and environment, social reality and the Judiciary System.

Regulação ambiental, competitividade e padrões de comércio internacional no setor do agronegócio / Environmental regulation, competitiveness and patterns of international trade in the sector of Agribusiness

Este trabalho, organizado sob a forma de dois artigos, faz uma investigação a fim de esclarecer os vínculos entre comércio internacional e meio ambiente em geral, e no caso do setor do Agronegócio, em particular, focando, sobretudo, no aspecto da competitividade. No primeiro artigo, inicialmente procedeu-se uma revisão das questões teóricas atinentes às interfaces econômicas entre agricultura, meio ambiente e comércio, assim como a análise comparativa dos principais métodos empregados para estudar estes vínculos. Em seguida, especial atenção foi dedicada à identificação dos mecanismos pelos quais as políticas destinadas à promoção da sustentabilidade ambiental no setor do agronegócio podem afetar os preços, o comércio e o bem-estar social. Por fim, foram exploradas as implicações políticas que são derivadas do estudo de caso brasileiro, concluindo-se pela necessidade de construção de uma agenda de pesquisas local para o tema. O segundo artigo pode ser visto como um teste empírico para o Agronegócio das antagônicas posições defendidas por economistas seguidores da abordagem tradicional em relação aos seguidores da hipótese de Porter no que tange aos impactos do maior rigor das regulações ambientais sobre os padrões internacionais de comércio. Tal análise foi conduzida mediante a adequação do modelo H-O-V para permitir a inclusão de variáveis representativas da performance ambiental dos países analisados. Os resultados revelam que as exportações líquidas dos produtos agrícolas classificados como ambientalmente sensíveis podem ser afetadas positiva ou adversamente segundo setor e indicador ambiental em questão. / Organized in two articles, this dissertation makes an investigation to clarify the links between international trade and environment in general and in the case of the agribusiness sector, in particular, focusing mainly on the issue of competitiveness. In the first article, initially there was a review of theoretical issues pertaining to economic interfaces between agriculture, environment and trade, and comparative analysis of the main methods used to study these links. Then, special attention was devoted to identifying the mechanisms by which policies to promote environmental sustainability in the agribusiness sector can affect prices, trade and social welfare. Finally, were explored the policy implications that are derived from the study of the Brazilian case, concluding by the need to construct an agenda for research site for the theme. The second article can be seen as an empirical test for the Agribusiness of antagonistic positions advocated by economists followers of the traditional approach for followers of the possibility of Porter with regard to the impacts of the tightening of environmental regulations on international standards of commerce. This analysis was conducted by the adequacy of the H-O-V model to allow for the inclusion of variables representing the environmental performance of the countries examined. The results show that net exports of agricultural products classified as environmentally sensitive can be positively or adversely affected the second sector and environmental indicator in question.

Microstructural characterisation of type 316 austenitic stainless steels : implications for corrosion fatigue behaviour in PWR primary coolant

The environmentally-assisted fatigue crack growth behaviour of austenitic stainless steels in deoxygenated high temperature water at low strain rates has been reported to be greatly affected by the sulphur (S) content of the specimen, with high S specimens exhibiting significant reduced crack growth rates (retardation) when compared to low S specimens. To further the understanding of the mechanistic behaviour, fatigue crack growth experiments have been performed on high and low sulphur Type 316 austenitic stainless steel specimens tested in high temperature water and evaluated via microstructural characterisation techniques. At high strain rates the enhanced crack growth for both specimens appeared to be crystallographic and associated with slip localization. Furthermore, matching fracture surface analysis indicated discrepancy of the slip steps and micro-cleavage cracks between the matching surfaces, suggesting that slip steps and micro-cleavage cracking occurred after the crack-tip had advanced. It was also postulated that their formation may involve cathodically-produced hydrogen and shear deformation on the fracture surface. However, when the loading frequency was decreased, the high S specimens retarded the crack growth and the path was no longer crystallographic. Significant differences in the crack-tip opening displacements were observed in both materials, with blunt crack-tips in the high sulphur specimen and sharp tips in the low sulphur specimen when the strain rate was low. EBSD analysis at the crack-tips of both specimens showed that the strain was more localised at the crack-tip of the low sulphur specimen whist the strain ahead of the high sulphur specimen was more homogenous. It is thus postulated that retardation occurs when slip localisation is no longer the dominant factor. The localised deformation during enhancement is believed to have been caused by hydrogen enhanced localised plasticity (HELP) which causes the crack-tip to sharpen. The diffused strain distribution during crack growth retardation is believed to have been caused by hydrogen enhanced creep (HEC) which causes the crack-tip to blunt. It is also believed that both enhancement and retardation mechanisms are associated with contrasting effects deriving from hydrogen enhanced plasticity. Oxide induced crack closure was excluded as a mechanism responsible for retardation of fatigue crack growth when the stress ratio is high. Effects of hydrogen induced alpha' and ε martensite phases on oxidation behaviour of austenitic stainless steels in deoxygenated high temperature water have also been studied. Microstructural characterisation shows that hydrogen induced alpha' martensite enhances oxidation of austenitic stainless steels in deoxygenated high temperature water. The implications of this finding on environmentally assisted cracking of austenitic stainless steels in deoxygenated high temperature water is discussed.

It matters because the perception of how important the care of the e-waste and how large are the implications and consequences of improper waste management. Thus, the main aim of this research was find an application for scum generated from reactor of anaerobic treatment of domestic effluents, since this residue has no application until now. Therefore, ashes of scum generated from anaerobic treatment of domestic effluents were submitted to acid and thermal treatments, aiming pigments with more intense color. All the samples obtained are composed by Al2O3, Fe2O3 e Ca9Al(PO4)7. The samples treated thermally to 950 and 1000 °C presented excellent results for enamel ceramic pieces, for coloration of polymethylmethacrylate (PMMA) and as pigment for water-based paints. The samples obtained to 1100 °C and the synthetic samples presented good results for enamel ceramic pieces, but not for PMMA and paint, in this case milling is necessary. The residue of acid treatment is rich in Si and Ca, therefore, this sample presents potential to future researches. / Diante da busca por pigmentos inorgânicos de menor custo, visando viabilizar sua aplicação em larga escala, a utilização de resíduos contendo elementos de interesse nas sínteses se mostrou uma alternativa interessante. Assim, o objetivo principal deste trabalho foi buscar uma aplicação para a escuma gerada em reator anaeróbico de tratamento de efluentes domésticos, resíduo este sem utilização até o momento. Para tanto, cinzas da escuma gerada em reator anaeróbico de tratamento de efluentes domésticos foram submetidas a tratamento ácido e térmico, visando a purificação e obtenção de um material com coloração mais intensa e mais apropriada para a utilização como pigmentos. A partir das análises realizadas foi verificado que o tratamento adotado foi eficaz, obtendo-se amostras com coloração laranja/vermelha intensa, compostas por Al2O3, Fe2O3 e Ca9Al(PO4)7. As amostras tratadas a 950 e 1000 °C apresentaram bons resultados na esmaltação de peças cerâmicas, na coloração de poli(metacrilato de metila) (PMMA) e como pigmento para tinta à base de água. As amostras obtidas a 1100 °C e a amostra sintética (preparada com composição similar às amostras obtidas a partir da escuma), apresentaram bons resultados na esmaltação de peças cerâmicas, mas necessitam de moagem para a aplicação no PMMA e na tinta. O resíduo do tratamento ácido é rico em cálcio e silício, apresentando potencial para futuras pesquisas.

The role of important international organizations is described as well. The practical part is concerned with the characteristics of the Liberec Region. A substantial part of the thesis consists of analysis of offer - environmentally friendly forms of tourism, evaluation based on the chosen indicators of sustainable tourism and questionnaire research in four different groups: Regional authority, tourists and visitors, residents and tourism entrepreneurs in Liberec Region.

Disinfection by-products and public health concerns

Disinfection by-products (DBPs) are a major group of water contaminants and their role in causing adverse health outcomes, including adverse pregnancy outcomes, endocrine disruption, respiratory related adverse health outcomes and cancer has been subject to extensive epidemiological and toxicological research and review. Determination of safe exposure to DBPs, particularly within drinking water supplies, has been a topic of extensive debate, with a wide range of acceptable levels set across the industrialized world. The focus of the research in this thesis was on two of the main health outcomes associated with DBP exposure, namely adverse pregnancy outcomes and asthma related symptoms. To assess adverse pregnancy outcomes in Perth, an extensive classification quantification of the major DBPs in Perth drinking water was conducted. A registrybased prevalence study was carried out to assess birth defects in relation to high, medium and low DBP areas (defined by the water sampling and analysis). It was found that women living in high THM areas are 22% (odds ratio (OR) 1.22, 95% confidence interval (95% CI) 1.01-1.48) more likely of having a baby with any birth defect. High exposure was also strongly associated with an increased risk of having a baby with a cardiovascular defect (62% increased risk). Low birth weight and prematurity were also assessed; however these outcomes were not associated with an increased risk through an increase in exposure. Following on from this analysis, a population risk assessment model was developed for DBPs in high exposure environments. This involved a three step process: (i) Firstly a questionnaire-based validation and reliability study was used to assess water consumption patterns of a population of pregnant women in Perth. (ii) Secondly a prediction model for teratogenic burden of DBPs in Perth was developed, related to the exposure patterns of the population of pregnant women involved in the validation and reliability study. (iii) Finally, combining the information collected in (i) and (ii), along with the regression slope estimates for birth weight from the prevalence study (defined in Section 2.2.1), a dose-response model for THMs and birth weight was developed. Predictive simulations for birth weights at given THM levels were then conducted. It was estimated that pregnant women in Perth are exposed to between 0.3 – 4.10 µg/day ingested TTHM, and of this, the more toxic brominated forms accounted for between 0.27 – 3.69 µg/day. Based on a dose-response model used, birthweights calculated for the ‘hypothetical’ exposures ranged from 3403.2g for the highest exposure to 3503.5g in the lowest exposure, which is a difference of over 100g. Although the resulting reduction in birth weight is not extreme, there is still a significant reduction in birth weight present as exposure to TTHMs increases. This is the first doseresponse model to be developed to assess an adverse pregnancy outcome based on pregnant women exposure data, and will be a useful tool for assessing varying exposures throughout not only Australia but also throughout the industrialised world, where DBP exposure is highly prevalent.

Going Green Down Under: Environmental Communication and Green Product Marketing in the South Eastern Australian Wine Industry

The consumption of wine has served as an international communication expedient for thousands of years. From classical symposiums of ancient times to religious ceremonies practiced for centuries, wine has played a significant part in countless social gatherings across the ages and continents. Recent growth in international wine trade, however, has impacted an increasingly disrupted natural environment through amplified carbon output, overuse of synthetic chemicals, topsoil erosion, and water mismanagement. Vintners, or winemakers, have been tasked by the implementation of new legal standards, as well as the urging of ecologically aware prospective consumers, to instill a winemaking process that is green, or environmentally friendly, in order to demonstrate the employment of proactive measures for the long-term sustainability of an unstable Earth. As New World wine producers, Australia commands specific attention as many vineyards in this particular geographic area are actively advancing green wine production standards. Fueled by the emergent field of environmental communication, this dissertation investigates the sustainable practices being implemented by South Eastern Australian vintners during their winemaking process to offset environmental degradation and examines the new marketing discourse communicated via wine bottle labels to construct an environmentally friendly image. Ultimately, this research compares the green product marketing strategies between organic and non-organic wineries to determine the extent to which ecological messages are being promoted on wine bottle labels as a form of environmental communication.

A Method to Relate Product Tolerancing Decisions to Environmental Impacts and Costs in Manufacturing

Product tolerancing decisions made in product design have a significant effect on manufacturing environmental and cost performances by strongly influencing both the selection and operation of processing machinery. These decisions however are typically made without quantitative knowledge of their effects in manufacturing. With estimates of environmental and cost performances of manufacturing processes required to achieve specific part designs earlier in the product design cycle, designers may make more informed, and potentially better, design decisions with respect to manufacturing environmental and cost performance goals. In this thesis a method for quantifiably relating product tolerancing decisions to environmental and cost performances in manufacturing in order to provide decision support for cost and environmentally conscious design for manufacturing is developed. The method is instantiated as an Excel-based tool and exercised by two illustrative examples of increasing complexity, as well as a study of the manufacture of automotive transmission pinion gears with differing tolerance requirements. Uncertainty analysis is performed through the use of @RISK software; the uncertainty of parameters associated with manufacturing operations and machinery is captured through the use of probability density functions and Monte Carlo simulation is performed. Simulation results provide insight into the uncertainty of performance estimates and the risks associated with ensuing decision making. This method may be useful to product designers, as well as process planners, to support decision making efforts related to cost and environmental consciousness in the manufacturing phase of the product life cycle.
