O salário maternidade à luz do princípio da universalidade da cobertura e do atendimento

The maternity protection is the target of the analysis. It comes from the necessity of the pregnant when she gives birth to her child and from her impossibility to work during the early days of her newborn baby life. This work was realized based on bibliographic researches, law books and nonlaw ones, and articles related to the topic of this study. Superior Courts decisions were analyzed. Historic facts of the maternity protection were also emphasized, since the Convention 03 of the Work International Organization to the present documents in attention to the importance of the quality to be mother. The maternity protection and the maternity salary are ensured not only by the Brazilian Constitution but also by the present welfare laws. When 1988 Brazilian Constitution describes the equality like the main principle for the legislator and the interpreter it becomes impossible that the common legislator makes laws without observing the constitutional side. As a consequence, the subconstitutional legislator is not able to establish different treatment to the same fact: the maternity / O presente trabalho tem por escopo analisar o benefício salário-maternidade à luz do princípio da universalidade da cobertura e do atendimento bem como as conseqüências de sua aplicação no mundo fenomênico O objeto em análise é a proteção à maternidade decorrente da necessidade da segurada gestante quando do parto e da impossibilidade para o trabalho nos primeiros dias de vida de seu filho Este trabalho foi realizado com base em pesquisas bibliográficas obras jurídicas e não jurídicas além de artigos referentes ao tema objeto deste estudo Foram analisadas ainda decisões dos tribunais superiores Enfocamos também os antecedentes históricos de proteção à maternidade desde a Convenção n 3 da OIT até os documentos atuais nacionais ou não exaltando sempre a importância da qualidade de ser mãe A proteção à maternidade com a consequente concessão do salário-maternidade é assegurada pela Constituição da República e pelas leis previdenciárias vigentes A Carta Política de 1988 ao prescrever a isonomia como princípio norteador na atuação do legislador e do intérprete impossibilitou que o legislador ordinário elaborasse leis sem a observância dessa diretriz constitucional Dessa forma não está o legislador infra constitucional autorizado a estabelecer tratamento diversificado para a maternidade

This thesis looks at the emergence of women's equal rights movement in Czech society and its transformation in the curriculum. It centers on the evolution of female movement and women's emancipation from the initial efforts of informal equality, initiated by Bozena Nemcova, to the achievement of formal liberation and equal rights for women in the society in Czechoslovak republic, in 1920, by achieving an active voting rights, in other words by full and equal citizenship. The theoretical part examines sociological terminology and findings, describes secondary literature by various female writers who focus on the women's movement and gender, and describes women's action in 19th and beginning of the 20th century. The thesis discusses men who played a role in the women's civil rights movement, and also places the topic in the European context. It stresses the importance of women's work, particularly female writers, teachers and politicians. In the practical section the thesis centers on placing the topic within the curriculum reform. It highlights places of remembrance which can be valuable for low secondary school pupils, outlines Czech female emancipation in the context of Framework Educational Programme for Basic Education and summarizes information about gender in educational setting.
