O CONSUMISMO E A DIMENSÃO ESPIRITUAL DAS MARCAS: UMA ANÁLISE CRÍTICA

Consumerism is a superlative of purchases, belongings and use, a dependence of non essential goods (superfluous) to satisfy endless desires. It is impossible to satisfy endless desires: therefore the expression transcendental goal of consumption, beyond the capacity to be achieved. The transcendental dimension of consumption, through the symbolism of merchandises potencialized by the prestige brands, give enchantment and sense to the individual, and fulfills the territory that belonged to the family, Church and community. The subject tries to obtain, with the brand-fetished merchandise, a satisfaction of his mimetic desire, and/or compensate absent or fragile values, which is strengthened by advertising. The ultimate meaning of life of materialistic individuals produces immediate effects which are positive for them as well for the economy, but in the future potentially negative for the planet, for the society, as well as for the individuals. / Esta tese objetiva comprovar que, na sociedade de consumo, indivíduos consumistas transcendem sua relação funcional com as mercadorias, buscando nas marcas de prestígio uma dimensão espiritual, que substitui ou complementa as experiências religiosas tradicionais, e que se revela fetichizada. O consumismo é superlativo de compras, posses e uso, uma dependência de bens não essenciais (supérfluos) para atender aos desejos sem fim. É impossível satisfazer a desejos sem fim: daí a expressão meta transcendental do consumo, posicionada além do alcance e da capacidade de atingi-la. A dimensão transcendente do consumo, por meio do simbolismo das mercadorias potencializado pelas marcas de prestígio, propicia encantamento e sentido ao indivíduo, e se presta a preencher o espaço outrora ocupado pela família, Igreja e comunidade. O sujeito busca, na mercadoria fetichizada pela marca, satisfazer seu desejo mimético, e/ou compensar valores frágeis ou ausentes, o que é reforçado pela propaganda. O sentido último da vida dos indivíduos materialistas produz efeitos imediatos que são positivos para eles e para a economia, mas potencialmente negativos mais à frente para o planeta, para sociedade e para os indivíduos.

L'art contemporain ou le fétichisme du lucre / Contemporary art or lucre fetishism

La marchandisation de l’art se traduit par une dérive progressive de l'esprit de collection. Elle est notamment perceptible dans le désir de plus-value des collectionneurs, qui va de pair avec le fait que l'aura de la valeur artistique et esthétique d'une œuvre est fonction du prix qu'elle atteint en tant que marchandise de luxe dans les salles de vente. La valeur de l’art s’en est trouvée assujettie à un marché capitaliste dont les guerres ont paradoxalement favorisé la mondialisation. Ce marché de l’art, qui est en cours de restructuration permanente, favorise chez les artistes une course à la « starification » et à des cotations tout particulièrement ambivalentes. Faut-il en conclure que la marchandisation a pris le pas sur l'artistique, le prix sur la valeur de l’œuvre, le lucre sur l'esthétique ? Cette thèse défend l'idée que la force, et la ruse des œuvres d'art, se manifestent dans leur capacité, à se jouer du milieu religieux, idéologique ou imagologique dans lequel elles voient le jour. Cette force se révèle aujourd'hui dans l’aptitude du geste créateur, qui relève — Marcel Mauss l'a bien vu — fondamentalement du don et du contre-don, à faire voler en éclat les illusions engendrées par la marchandisation. En permettant à l’imaginaire de s’incarner à l’égal du réel, l’artiste ouvre le champ infini des possibles. C'est pourquoi la vie des œuvres d'art n'en finit pas de rendre le cosmos cosmétique, quitte à se servir du « lucre » comme d'un appât habile à stimuler le marché, dont se sert in fine, sa « main invisible ». / The commodification of art results in a gradual drift of the collection spirit. This is particularly noticeable in the desire of collectors for added value, which goes hand in hand with the fact that the aura of the artistic and aesthetic value of work depends on the price it has achieved as a luxury commodity in the sales rooms. The result was a subjugation of the value of art to a capitalist market whose wars paradoxally favored globalization. This art market, which is undergoing permanent restructuring, favors artists’ quest for « starification » and particularly ambivalent ratings. Must we conclude that commodification has overtaken the artistics, that the price is now beyond the value, the profit beyond the aesthetic ? This thesis defends the idea that force and cunning of works of art are manifested in their opportune ability to trifle with the religions, ideological or imaginary environment in which they emerge. This force is today identified in the aptitude of the creative gesture, which – Marcel Mauss saw clearly – is fundamentally a gift and a counter-gift, to smash to pieces the illusions engendered by the commodification. And strong work links the imaginary to the symbolics to become « real ». By making the imaginary equal to the real, the artist opens the infinite field of possibilities. This is why the life of works of art never ceases to make the cosmos cosmetic, even if it uses the « lucre » as a bait skilful enough to stimulate the market, which is, in fine, manipulated by its « invisible hand ».

[pt] Este trabalho utiliza o caso do desastre de Mariana (2015) como casogatilho para analisar a abordagem jurídica das corporações no contexto de produção econômica de falhas em barragens de rejeito. A personalidade jurídica de corporações carrega o mistério de ser similar a uma pessoa física, juridicamente, ao mesmo tempo em que completamente diferente de uma pessoa humana quando vista por fora da dimensão jurídica. Assim sendo, é analisado o conceito de personalidade jurídica corporativa conforme as teorias hegemônicas do direito, revelando suas insuficiências para abordar o caso do desastre de Mariana. Em seguida, são a avaliadas alternativas teóricas nos estudos de Evguieni Pachukanis e alguns autores que fazem referência aos seus conceitos. Os limites e potencialidades identificados na construção teórica pachukaniana conduzem à elaboração preliminar do conceito de personalidade jurídica corporativa e suas dinâmicas internas em dois passos. Primeiro, revisitando as teorias do fetichismo do capital e da forma-valor, que levam à uma melhor compreensão de formas mais desenvolvidas e fetichizadas como no caso do capital portador de juros, bem como o papel das transações jurídicas no circuito do capital. Segundo, revisitando a construção histórica da forma corporativa e dos seus atributos legais nos Estados Unidos da América e Reino Unido. Finalmente, são propostas algumas características e dinâmicas para interpretação da personalidade jurídica corporativa, considerando as variáveis descritas na análise prévia do desastre de Mariana. / [en] This work uses the Mariana mining disaster (2015) as a trigger case to analyze how corporations are legally perceived in the context of disasters, specifically, tailings dam failures. The legal personality of corporations carries the mystery of being similar to a natural person judicially at the same time that are completely different from a human person when analyzed outside of the legal realm. Under that puzzle, the corporate legal personality nature was analyzed before the hegemonic theories of Brazilian legal scholars, revealing their insufficiencies to approach the Mariana Mining Disaster. Subsequently, an alternative approach is assessed through the studies of Evguieni Pashukanis and some recent authors that endorse his main ideas. Pashukanis reveals potentialities and limits that led to a proper elaboration of the corporate legal personhood concept and its internal dynamics in two steps. Firstly, revisiting the capital fetishism and the value-form theories, which led to a better understanding of the most developed and fetishized forms of capital, the interest bearing capital, as well as the contradictory developments between the capital and productive circuits. Secondly, revisiting the historic construction of the corporate form and its legal features in both USA and United Kingdom, in order to perceive the ascension of the corporate legal personality concept. Finally, some the corporate legal personhood concept characteristics and dynamics are proposed. / [de] Diese Dissertation nimmt den Fall der Tragodie von Mariana (2015) als Ausgangspunkt, um zu analysieren, wie Unternehmen im Zusammenhang von Naturkatastrophen – insbesondere von Dammbrüchen – rechtlich wahrgenommen werden. Unternehmen als juristische Personen tragen ein Geheimnis in sich: Einerseits sind sie rechtlich gesehen den natürlichen Personen ahnlich, andererseits sind sie aber auberhalb des rechtlichen Raums ganz anders als menschliche Personen. Zunachst wird der von den vorherrschenden Rechtstheorien vertretene Begriff der Rechtspersonlichkeit des Unternehmens herausgearbeitet und dessen Unzugänglichkeiten bei der Analyse der Tragodie von Mariana werden aufgezeigt. Anschliebend wird der alternative Ansatz von Evguieni Pashukanis und seinen Nachfolgern analysiert. Die bei Pashukanis identifizierten Grenzen und Potenziale fuhren zu der Formulierung eines neuen Begriffs der Rechtspersonlichkeit des Unternehmens und deren internen Dynamiken, und zwar in zwei Schritten. Erstens werden die Konzeption des Kapitalfetischismus und die der Wertform wieder aufgegriffen, was zu einem besseren Verstandnis der entwickeltesten und fetischisiertesten Auspragungen des Phänomens führt, namlich des Falles des verzinslichen Kapitals sowie der Rolle juristischer Transaktionen im Kapitalkreislauf. Zweitens wird die historische Konstruktion der Unternehmensform und deren rechtlichen Eigenschaften sowohl in den USA als auch in Grobbritannien rekonstruiert. Zum Schluss werden einige Merkmale und Dynamiken zur Deutung der Rechtspersonlichkeit des Unternehmens vorgeschlagen, wobei die Variablen berücksichtigt werden, die in der vorherigen Analyse der Tragodie von Mariana beschrieben wurden.

Towards a New Currency of Economic Criticism

“The Purloined Letter,” Edgar Allan Poe's third and final tale featuring the detective Dupin, has evoked a long history of critical response. Criticism has tended to read the text for its role in the development of detective fiction and as illustrative of various theoretical positions. However, the implications of the “The Purloined Letter,” as a tale of ratiocination, has largely been left unexplored. “The Purloined Letter” explores logical processes of value and exchange, particularly economic exchange, in a manner very similar to what Charles Sanders Peirce will call pragmatism several decades later. Dupin's deductive methods and Peirce's abductive logic express the nature of objects in terms of social systems of preference and perception rather metaphysics. Peirce's classification of signs as icon, index, or symbol provides a framework of signification which can be read in conjunction with “The Purloined Letter” to flesh out the role of materiality and value in the theory of economic criticism. Reading value and exchange as part of a social system of signs, perceptions, and representations of value will serve to expose a penchant for material fetishism in economic criticism and provide a theory of currency, value, and exchange that contextualizes representational and material notions of value within the social and economic system that provides the processes and mechanisms of value determination. The way that the Prefect, the Minister D___, and Dupin each conceptualize the purloined letter as having a different representational relationship with value can be used to demonstrate Poe's abductive framework for economy.
