Interpretace mezistátní obchodní klauzule Nejvyšším soudem USA: srovnání Rehnquistova a Robertsova soudu / Interpretation of the Interstate Commerce Clause by the U.S. Supreme CourtMusilová, Nikola January 2013 (has links)
This diploma thesis aims to analyze the issue of one of the most significant congressional powers found in Article I., Section 8 of the U.S. Constitution. Congressional power to regulate interstate commerce has been instrumental to the federal government's legislative efforts in many areas of law. This constitutional provision enabled the Congress to react to the changing conditions and new problems the country has been facing, especially in the area of working conditions, civil rights, criminal justice or even environmental law and many others. The expansion of power of the federal government, however, was not always greeted with enthusiasm, especially in the first three decades of the 20th century, before the Supreme Court began to read the commerce power much more broadly, to the point that it ceased to be a factual limitation of its powers. This trend was meant to be stopped by the New Federalism movement and the five new conservative justices who issued rulings that limited the scope of the Commerce Clause. However, this group of justices proved to be very inconsistent in its own approach toward this constitutional provision and eventually fell apart, which rendered Rehnquist's attempted constitutional revolution with respect to state's rights partly a failure. As the new Court membership under...

Volební geografie postkomunistických zemí střední a východní Evropy / Electoral Geography of Post-communist CountriesSokol, Petr January 2014 (has links)
The thesis "Electoral Geography of Postcommunist Countries in Central and Eastern Europe" deals with the topic of electoral geography, which is a part of the political geography. The basic hypothesis of the paper is based on opinion that the postcommunist countries experienced the twenty years of development in the postcommunist period which made their electoral geography very similar to one in Western Europe. This hypothesis is proved by three different areas of electoral geography. The first part is composed by the analysis of the electoral geography of the founding elections in the 17 postcommunist countries (including the GDR). In the paper is proposed after the research of all 17 countries the categorization of founding elections on the basis of electoral geography. The second part examines the electoral geography of capitals. The research is focused on the size of the lectorate in the capital compare to the whole country, on the diverhgence of electoral results in the capital and in the whole state and on strength of the party families in capitals. Folowing these three areas is proposed the catehorisation of the postcommunist capitals into the five groups. The third part deals with variability of the electoral results inside the state.

How Founding Teams and External Investors Drive Success : Entrepreneurial Guidance for Swedish Technology Startups and Their Investors / Hur Grundare och Finansiärer Skapar FramgångBorgefors, Simon, Lahlou, Mehdi January 2017 (has links)
Human capital assessment is an integral part of the in-depth evaluation conducted by Venture Capitalists (VCs) before an investment decision. Furthermore, an effective collaboration between external investors and the founding team can be vital for the success of a startup venture. This thesis aims to improve this assessment and collaboration by providing an empirical account of historically successful Swedish tech startups and their founding teams (FT). We employ semi-structured interviews with 13 entrepreneurs who in total have founded over 50 ventures in order to deduce patterns to the characteristics, compositions and views of successful founding management teams. We compile and discuss their views concerning aspects such as organizational culture, team performance and their relationships with external financiers. The focus of this thesis was in part guided by our commissioner, Almi Invest. Based on our interviews and literature review, we present several findings which may be of interest to both investors and entrepreneurs. Some of our key findings are that successful Swedish tech startups are generally composed of diverse teams where the founders share some previous association and complement each other with regards to both competencies and personalities. They view culture and vision as important aspects, with values acting as the uniting factor that drives cohesion and performance. We also find that their views are largely influenced by previous experiences. Finally, we highlight some perceived inefficiencies in the collaboration between investors and entrepreneurs, mainly with regards to post-investment activities and the process of raising capital. Our findings suggest a lack of transparency between entrepreneurs and financiers regarding the investor activity levels, where entrepreneurs generally feel that VCs fall short on their promises. We suggest some areas of improvement where VCs might tune their practices to better suit the needs of their portfolio companies and improve overall performance.

TRA ARCHEIN E PRATTEIN. AGIRE LIBERO E FONDAZIONE POLITICA NEL PENSIERO DI HANNAH ARENDT / BETWEEN ARCHEIN E PRATTEIN. FREE ACTION AND POLITICAL FOUNDING IN THE THOUGHT OF HANNAH ARENDTMUSSO, LUISA GIULIA 08 March 2012 (has links)
The aim of this work is to investigate Hannah Arendt’s (Hannover 1906 – New York 1975) conceptions of free action and political founding through the twofold perspective of archein and prattein (individual initiative and plural collaboration), that consents to see them under a new light, to come to a critical evaluation of Arendt’s theory of founding a political body. We’ll do it considering some of the most important political experiences indicated from our thinker: the Greek polis, considered in its relation with homeric world, and the American Republic, considered in its twofold relation – continuity and innovation – with Roman res publica, and in its relation with colonial history before revolution. To reach an evaluation of Arendt’s concept of political founding, we’ll concentrate on the notion of “principle” of action. We used and cited many unpublished papers, that we could see at New School for Social Research (NY), and we indicate some books of Arendt Collection at Bard College (Annandale-on-Hudson, NY) also.
